(robin) good morning and thanks for joining us for the kron 4 morning news.im robin winston. lets start this morning with a check on weather and traffic. much like yesterday skies today will be clear from morning through afternoon for most part of the bay area. temperatures will be a bit warmer inland back into the low 80's for some areas while staying steady closer to the

person found dead in a bathroom at an east bay bart station. the body was discovered around 9:20 last night at the bay fair station in san leandro. drug paraphernalia was found in the bathroom with the body. the station was closed around 10:00 last night but has since reopened. ( robin ) a big story we are following this morning... a south bay teacher arrested for robbery and carrying a gun in his classroom. the strong armed robbery actually happened back in februaray. that's when police say - charles so- assaulted a man after a road rage incident and took his cell phone.

police went to arrest so... yesterday at chaboya middle school in san jose... that's when they found a gun in his bag inside the class room... which is a felony. ( robin ) new this morning in the east bay... a school in el cerrito is investigating a teacher for using a racial slur. that teacher has been placed on administrative leave. the executive director of the summit k-2 charter school released a statement saying in part: "k2 has a zero-tolerance policy on inappropriate, insensitive or hateful language of any kind. the school immediately launched an investigation once it became aware of claims made by students about inappropriate language used by a teacher." the school is not releasing the name of the teacher. ( robin ) a developing story we are following this morning... new details in the bizarre case of a headless torso .. found inside the home of a missing man in san francisco. kron-4 obtained court documents - detailing the arrest of lance silva... who is now in custody on a probation violation.

police found silva in possession of the missing man.. brian egg's.. stolen credit card. they say he withdrew cash from egg's account - and used egg's credit card to buy a b-m-w back in june. that car was towed - and later retrieved from a tow yard by silva and a man claiming to be paul forman - who police are now trying to find. neighbors spotted a crime scene clean up truck outside the home on august 14... that was allegedly hired by silva using egg's stolen credit card. the human remains that were found in teh house have not yet been identified. ( robin )kron 4's j.r. stone is following this part of the story. he talked talked with a number of crime scene cleanup crews in the bay area about this case. sot the fact that there was a torso in a fish tank hidden in an apartment and it took that amount of time for it to be discovered really blows my

mind.tony leonardini is the owner of bay area bio clean, a small company that specializes in cleaning up crime scenes...after police have left.sot in the case of the headless torso found in missing man brian egg's san francisco home. it was neighbors who saw the private crimescene cleanup crew at the house. they grew suspicious seeing that they hadn's seen police there. when officers arrived their dogs helped them located the torso. tony, along with several other company heads from crime scene cleanup crews, told us that questions are often asked but there is also a trust factor with the person who hires them. sot typically there is not a lot of paper work or communication with the police

department a lot of taking the person's word for it and that's why we try to do as much information gathering as possible.court documents allege that lance silva used egg's debit card to purchase the hazmat crew. investigators have not named the company that came in but tony says he is surprised they weren't the ones that found something and called police. sot typically when i go out and do a job i check the entire home sometimes the police or fire paramedics can leave things throughout the house so i typically try to check everything so i'm surprised they didnt' come across something. ( robin )that was kron 4s j-r stone reporting. tony did tell kron 4 that he has received jobs that he didn't trust... so he didn't take them. he wonders if this cleanup crew took a job like that. ( robin )happening today... the man accused of killing a 6- year-old girl during a street race back in 2009 will be in

court. we first told you about this story yesterday on the kron 4 morning news.. after nearly 10-years... police were finally able to track down and arrest shannon fox ... for the hit and run that killed 6-year-old lisa xavier in menlo park. police say foxx was racing another driver at the time of the accident. police say he then ran off to central america. guatamalan authorities caught up to him in december 20-16. he spent nearly 2 years in jail there... and is now back in the bay area. ( robin )in the east bay... three robbers broke into a man's home... and threatened to kill him and his family. it happened in broad daylight. kron 4's gayle ong has the story.

everywhere, everything all black.">chanthi duong describes the moment an intruder had broken into his hercules homeit happened in broad daylight just before noon tuesday duong says he did not know there were three suspects total until later..they demanded money and jewelry.. the robbers continued to ramsack the house..while another man stayed outside acting as the lookouthis wife and young children were also home..

do anything.">the robbers got away..but duong and his wife did not see where..police say a neighbor saw a black chrysler with dark tinted windows parked near the victim's home with the engine running ( robin ) four pilots... who are u-s veterans... are charged with lying to the f-a-a about their medical conditions. two of the men are from the bay area. 57-year-old gregory chrisman of burlingame, 32-year-old nicholas beyer of discovery bay, and 36-year-old walter grant of humboldt county are charged, along with a fourth man from georgia. chrisman allegedly told the v-a he had p-t-s-d. beyer claimed he had serious depression.... and

investigators say grant told the v-a he suffered from tension headaches. all suspects had been getting disability payments from the government for those disorders... and are accused of deceiving the f-a-a...by not revealing that information. right now...all four men are out on bail. prefer sller animals like cats and dogs-- so always make sure your pets are on a leash. ( robin )people in san francisco were able to see what a safe injection site might look like. the model treatment program dubbed "safer inside," includes seven booths, where people can use drugs without judgment and get easy access to treatment. it would to be the first in the country. however -- not everyone believes the site could be a solution to the drug epidemic. the san francisco police officers association thinks it may actually attract more users to the city. ( robin ) the bill to allow the city to open the site is now headed to governor jerry brown's desk, where he could sign it into law. the safe injection site model is at

( robin )when you head to the farmers market in san jose ... you will find something else next to all the fresh fruits and vegetables... kits to treat overdoses. a farmers market outside valley medical center is giving out free narcan. the narcan nasal spray kits are designed to reverse the effects of an opioid overdose. ( robin ) there have been 27 opioid deaths in santa clara county so far this year and there were 70 in 20-17. narcan can buy time for an addict to

( robin )california lawmakers are advancing a companion bill to the new law eliminating bail. it would keep anyone arrested for crimes that require them to register as sex offenders... to stay in jail until they see a judge. senators were in support of the update before sending it to the governor. the bill expands the list of people ineligible for quick release. california's bail overhaul will take effect in october of next year. ( robin )the california assembly has voted to require all public universities.... to offer medication abortions at their campus health centers. none of the 34 university of california, or california state university campuses currently offer abortion services. private donors have agreed to pay millions of dollars in startup costs... including ultrasound machines and staff training. universities would be required to offer the

services by 20- ( robin )california's u.s. senator kamala harris is reacting to the issue. on twitter she wrote ... " i cant believe this still needs to be said in 20-18, but every woman deserves access to safe, affordable, and comprehensive health care... and that includes abortion." ( robin )in national news... a judge threw out a total of 55 counts of felony child abuse... after five adults were linked to a new mexico compound with a dead child. 11 other children were found there starving. reporter andrew spencer explains the judge's ruling. one of the judge overseeing the cases called it...judge jeff mcelroy, taos county district court: "a complete failure to follow the proper procedures in prosecuting a case." ...highlighting the shocking details the public has already seen: a remote compound in northern new mexico, 11 children found emaciated and starving, a small child missing and later found dead... the original charges -- 11

bay family is outraged... after their kindergarten student... walked more than two and a half miles home... all by himself. that child was supposed to go to an after school program on campus... but no one ever showed up to take him. kron four's terisa estacio has the story. how? duanna kirby is furious... she says on monday, jackson was supposed to go to a youth enrichment program here at fairview elementary school in hayward. it was jackson's first day of kindergarten. the program is on campus, about 50 feet away

from his classroom. but that is not what happened. instead, duana says, she got a call from her son, from home. duana kirby, hayward mom. so, i am at work and get a phone call from my son on his cell phone and i say what are you doing calling me, i said to leave your cell phone at home. and he said, he did. that he was at home to call and safe that he was safe. duana says she rushed home from her job.. and indeed jackson was there. she then quizzed him about how he walked nearly 2.6 miles home... and why he wasn't in the afterschool program. duana. he said he was in the bathroom and when he got out, no one was there and so he grabbed his backpack and walked home. duana says she and her husband are angry and want answers to how this all happened. . duana. someone could have grabbed him, he could have been mauled by a dog, hit by a car. as for the district... they sent kron

( robin )( robin )( robin ) concord police are investigating reports of a man approaching two young girls... at the sun valley mall. an employee caught the man, allegedly showing the girls pornographic photographs, or videos on his cell phone. the employee reported the man

to the police back on july 14th. ( robin ) the man has not been arrested because the two victims have not come forward... that's why police are reaching out now. police say, the girls in question are approximately 10- years old. ( robin )santa clara county officals wants to warn people about a housing scam. residents are reporting getting letters from people wanting to buy their homes... even if it isn't on the market. the district attorney's office is warning these offers are much lower than the home is worth... and say these scammers then flip the houses for a profit. they are targeting people who are unknowlageable about the housing market and the elderly. ( robin )in the north bay... rhonert park police are asking for help... as they try to find the people responsible

for beating a developmentally disabled man. it happened on august 16th in the area of camino colegio. police say two men attacked the victim as he was taking his nightly walk. they say one of the suspects accused the victim of throwing a beer bottle at his house. officers say the suspects then started hitting the disabled man in the head with a silver bat. police are asking anyone who might have witnessed this atack to come forward. ( robin )bart... could have soon have the authority to set zoning standards and approve development on agency-owned propery throughout the bay area. this...after the state assembly passed a new bill tuesday afternoon. the bill now goes to governor jerry brown for his signature. under the measure... bart would govern residential and mixed-used projects on property the agency owns within a half-mile of station entrances. the bill would affect an estimated 250 acres in all. it would give the bart board untill july 20-20 to formally adopt its

since wildfires ripped through the north bay.. destroying thousands of homes in santa rosa. as kron 4's charles clifford explains... reconstruction may not be going as quickly as some would like. here in the coffey park , the area is just bustling with construction work.across the neighborhood. hundreds ohomes destroyed last year by fire are in various states of being rebuilt. but according to the city of santa rosa's permit office, only 9 out of nearly 2700 homes destoryed by the fire have been fully completed. there are several reason for the slow progress. the first is insurance. many home owners didn't have enough insurance and they are struggling to pay for the reconstruction. sotit's been stressfull.rick merian is rebuilding his house in coffey

park. he says that he's actually happy with his insurance company but nearly 11 months after the fire he is still wrangling with them over money.sotwe are in negotiations now for the rest of my policy. another reason more homes haven't been completed is that there's a lack of contractors. many houses under construction are sitting quiet while crews are on other jobs. nats in addition to rebuilding his own house, rick is also a drywall contractor. he says he has a backlog of 40 homes that need work.soti'm going from one to another. i can't guarantee anyone a start of finish time because when i finish one job i go to another.he also says it's not uncommon for workers to leave one job for another that pays better.soti lost a guy this week.despite the challenges, the neighborhood is coming back together. rick hopes to have his home finished soon.sotm hoping we are moved in by october. now, rick also tells me that even the people who manage to rebuild their homes many of them will face higher insurance costs in the future

because insurance companies have taken such a huge hit on rebuilding these homes.in santa rosa charles clifford kron 4 news. ( robin )4 your money this morning... a new report from u-c berkeley says almost five million californians... are working in low paying jobs ... earning less than 14- dollars an hour. that's about one- third of the state's labor force. places like stores, restaurants, child care centers, and farms are where most of california's low paid workers are employed. those people are earning less than they were four decades ago. workers in the middle haven't seen their income increase, or decrease in years. as for the top 95 percent of earners... they enjoyed a jump of 25 dollars an hour. right now the average age for a low wage earner in california... is 36-years-old. ( robin )also for your money... san francisco's fisherman's wharf is looking attract a new type of customer to the tourist hot spot.

kron4's maureen kelly explains how businesses... are working to lure locals to the area. fisherman's wharf is a good place to come to find san francisco sweatshirts....a lcatraz themed pajamas....and sourdough bread....but it's not easy to find are people from herewhere are you from italyi'm from south americai'm from lathe fisherman's wharf community business district found that of the 16 million visitors they have here evry year....only 14% live in the city.so they are looking to change that.....they have a new retail strategy looking at making the storefronts more inviting.....they getting closer to launching phase two of project to make jefferson street more pedestrian friendly....you see the wider sidewalks here completed in phase one on western end of the street. and while there are plenty of souvenir shops near the heart of fisherman's wharf....the other end of the district on bay street has bigger more general interest shops....like ross and trader joe's, and orchard supply. what they would like to see if the middle of the neighborhood to be filled in

overnight... a massive tree in the east bay comes crashing down and smashes at least a half dozen cars. take a look at the video... you can see just how much damage was done. this happened in pleasant hill. kron 4's sara stinson is live at the scene this morning with the details. ( sara )take a look at the damage...this is just one of seven trucks and cars destroyed by a huge branch of a heritage tree. take a look at the video from earlier ...people who live here came out from their homes around 12:30pm to this wreckage here on hardy circle in pleasant hill. i spoke to the owner of the home where this tree stood for over 350 years...she says this is a city tree named

in the east bay... a school in el cerrito is investigating a teacher for using a racial slur. that teacher has been placed on administrative leave. the executive director of the summit k-2 charter school released a statement saying in part: "k2 has a zero-tolerance

( james ) ( james ) ( james ) it has been nearly 11 months since the deadly north bay wildfires destroyed thousands of homes in santa rosa. this morning we are learning more about why the rebuilding process is taking so long. so far only 9 out of nearly 2700 homes destroyed by the fire have been completely rebuilt. one of the reasons for the slow rebuild is a lack of contractors.

one man we spoke with says he is a drywall contractor... and not only is he trying to rebuild his own house but he says he has a backlog of 40 homes that need work. ( darya ) in national news... almost all of the criminal charges have been dismissed after 11 children were found starving at a compound in new mexico. judges threw out a total of 55 counts of felony child abuse because the five adult supects were not given a preliminary hearing within the 10-day time frame required by law. one of the judges overeeing the case called it a complete failure to follow proper procedures. ( james ) there is a major push to get state lawmakers to pass a water tax. two senate bills would implement a voluntary water tax on customer water bills and a mandatory tax on dairies and fertilizer manufactorers. the state has reported more than one million residents are exposed to unsafe drinking water. the two bills wojuld create a safe drinking water fund which will secure needed funding for safe water drinking projects. the association of california water agencies opposes the legistlation saying the program is costly. ( james ) the state assembly has approved a bill to extend bar hours to 4-a-m. the so called "local act" is limited to nine california cities... including san

damage...this is just one of seven trucks and cars destroyed by a huge branch of a heritage tree. take a look at the video from earlier ...people who live here came out from their homes around 12:30pm to this wreckage here on hardy circle in pleasant hill. i spoke to the owner of the home where this tree stood for over 350 years...she says this is a city tree named emma. she believes the tree was rotting and thats why its branch fell. she says it sounded like a loud bat cracking and then a huge boom. her husbands work truck is nearly cut in half. it was parked in front of their home. you can see several other cars with significant damage too. city crews have been working to cut pieces of this branch. some cars are going to be towed soon. coming up we will hear from the homeowner about how this could have been life threatening. live in pleasant hill sara stinson kron 4 news. ### happen when it did, 3 minutes later my daughter would have been coming home from work and she parks behind the truck with the biggest damage... so she would have gotten her car squished... maybe her in it. so i have to thank everything she's not hurt.>

grant of humboldt county are charged, along with a fourth man from georgia. chrismanallegedly told the v-a he had p-t-s-d. beyer claimed he had serious depression.... and investigators say grant told the v-a he suffered from tension headaches. all suspects had been getting disability payments from the government for those disorders... and are accused of deceiving the f-a-a...by not revealing that information. right now... all four men are out on bail. ( james ) the state assembly has approved a bill to extend bar hours to 4-a-m. the so called "local act" is limited to nine california cities... including san francisco and oakland. it would allow but not require cities to extend sales of alcohol at bars... nightclubs and restaurants to as late as 4-a-m. the bill now goes back to the senate for a vote. if passed it will head to the governor for his signature. ( james ) it has been nearly 11 months since the deadly north bay wildfires destroyed thousands of homes in santa rosa. this morning we are learning more about why the rebuilding process is taking so long. so far only 9 out of nearly 2700 homes destroyed by the fire have been completely rebuilt. one of the reasons for the slow rebuild is a lack of contractors. one man we spoke with says he is a drywall contractor... and not only is he trying to rebuild his own house but he says he has a backlog of 40 homes that need work. ( james ) people in santa rosa also tell us that the rebuilding process is being slowed because many people were under insured.

( james ) there is a major push to get state lawmakers to pass a water tax. two senate bills would implement a voluntary water tax on customer water bills and a mandatory tax on dairies and fertilizer manufactorers. the state has reported more than one million residents are exposed to unsafe drinking water. the two bills wojuld create a safe drinking water fund which will secure needed funding for safe water drinking projects. the association of california water agencies opposethe legistlation saying the program is costly. short drive to an elementary school ... turned out to be a scary car ride for one stowaway puppy in fresno county.( james ) the owner only found out when she heard the desperate cries for help.
