( james ) ( james ) breaking news we are following out of southern california... 10 people have been shot at an apartment complex in san bernardino. police say three of the victims are in "extremely critical" condition. the shooting happened in a common area of the complex. there was an exchange of gunfire all of the victims are adults. witnesses said they heard 15 to 20 gunshots. nobody has been arrested yet. we will continue to follow this story and bring you updates as we learn more. ( james ) a big story we are following this morning... get ready to pay more on your electric bills. state lawmakers approved a plan that allows utility companies to raise electricity bills... in order to help them pay off the dozens of lawsuits ...

even if they're found to have behaved negligently.pg and e is on the hook for billions of dollars if its equipment is ultimately blamed for the most expensive fire storm in state history that destroyed thousands of homes throughout northern california -- including here in coffey park -- last october.brian bushon, coffey park"i understand having them go under would be bad for everyone ... at the same time having us pay if they are found to be at fault is also hard so i don't know the answer."carol lueck, coffey park"i don't really, i don't know how i feel about it. i think that it was bound to happen that they were going to do that."pg and e released a statement that says in part that the bill is a "common sense solution that puts the needs of wildfire victims first, better equips california to prevent and respond to wildfires, protects electric customers and preserves progress toward california's clean energy goals."the measure has been sent to governor jerry brown's desk and it is likely he will sign it as he proposed the bill and has been in support of helping pg and e.in santa rosa michelle kingston kron 4 news ( james ) is another alert warning

people about the possibility of poor air quality through out the bay area. kron 4's hermela aregawi has the details. health officials have issued a spare the air alert monday.. it'll be the 11th one this year and it falls on a holiday lisa fasano/bay area air quality spokespersonarea air quality lisa fasano/bay holiday lisa fasano/bay area air quality spokesperson tomorrow is fortunately labor day so hopefully most people won't be on the roads, that would be good. but people who are going to be out and about, if they could carpool. if people can consider reducing their polluting behavior. which would be don't mow the lawn, don't use a barbeque with lighter fluid, use a chimney instead. those nds of things, that would help reduce air pollution. officials say the smog is caused by a combination of

( james ) another big story we are following this morning... one man is in the hospital after a stabbing at a homeless encampment in san francisco near highway 101. this is what the area looked yesterday afternoon. the stabbing forced the closure of an off ramp to highway 101 at duboce avenue and mission street. the homeless encampment is on the side of that off ramp. the victim's condition is unknown this morning. ( james ) bart police are searching for a suspect who attacked a bart agent at the

macarthur station. police say on friday night two women reported a man was harassing them outside of the station. when the bart agent approached the women... the attacker punched him in the face. the agent was taken to the hospital with a cut on his right cheek. officers searched the area... but were not able to find the person responsible. ( james ) 4 people are missing this morning after a boat collision on the colorado river in mohave county. this is video of the search efforts. two boats collided head-on along the california-arizona border on saturday. the collision left ten other people injured. one of them is in critical condition. ( james ) a temporary homeless shelter in berkeley is now closed... and those who lived there are now waiting for a permanent solution... that they say the city promised them. kron4 's ella sogomonian went to old berkeley city hall where several of them have now set up tents. sot: ella sogomonian// "two reasons, the first closed some people have no place to go because the shelter on 9th

street , and second to make a statement for their cause." about a dozen people have set up tents outside the old berkeley city hall overnight after a homeless shelter closed on university and 9th street in berkeley.nearly 100 people taking refuge there had to move out once use of the temporary site expired on august 31st.those who relied on the shelter say they've been forced to scramble and no permanent solution set in stone.sot: barbara brust, consider the homeless founder// "why didn't they start looking while they had them in the building?"sot: ayat jalal, first they came for the homeless// "it raises alarm they displaced a lot of people they didn't have room for. it's just a long circle they've been putting people through and unfortunately this is going to be the result." advocate barbara brust who founded the group consider the homeless says the north berkeley senior center that's opened as a temporary shelter only has room for 60...who have to wait for the center to clear out before they can bring their belongings, get some rest, and move back out in the morning.sot: barbara brust, consider the homeless founder// "i think we need to open up an appropriate place with capacity for 100. that

becomes twice the occupancy of pathways and is year round as a drop in center as well. i know that is a hard pill to swallow but i think it's what we need."the homeless chose to set up on this lawn to get more eyes on their cause that they are in need of a permanent shelter promised by the city...that mayor jesse arreguin tweeted in still in the works. in the meantime he's directing the displaced over to the senior center that's now open and the frances albrier community center at san pablo park set to open a shelter later this month.sot: ella sogomonian// "that second shelter in san pablo park will be ready on the 16th and will remain open until the end of the month...where these people can go afterward has yet to be determined .in berkeley ella sogomonian kron 4 news." ( james ) happening today. buses will be replacing bart trains at oakland stations while crews work on the tracks. regular service will resume tomorrow. you can see on this map... a bus will take riders from bus will take riders from the 19th street station ... to the west oakland station. ( james ) bart is now rolling back some of the increased security that was put in place after a number of violent attacks over the past few months. officers had been working 10-hour days... 6- days a week. but that is now changing. bart says emergency staffing was only for three weeks... and whether officers work overtime now... is their decision. that means you will likely be seeing less officers both at the stations and on the trains.

but most riders we spoke with say they didn't even notice the security increase to begin with.

report that recoends the city allow two retail licenses. they will also discuss possible locations for the businesses. right now... the city is under a temporary moratorium on all commerical pot activities. that moratorium is set to expire november first. ( james ) the murder of iowa college student mollie tibbets... who is from the bay area... has sparked a backlash against latinos. the man accused of killng her is an undocumented immigrant. now there is a robocall in iowa urging people to kill all latinos in the u-s. laura terrell has the story. call:"she was stabbed to death by an invader from mexico."the one-and-a-half minute robocall is disturbing to hear.it starts by talking about the death of 20-year-old mollie tibbetts.and goes on to call for the death of all 58 million latinos in the united states.call:"re-found america as whites only and get rid of them now. every last one."pat

rynard/iowa starting line: "this is literal white supremacy type of talk."pat rynard runs iowa starting line, the website that exposed the robocall going out to several des moines residents tuesday.the out-of-state group road to power is claiming responsibility.pat rynard:"it can take only one or two people to put a couple of bucks behind a robocall to spread all kinds of fear and angst in a community."joe henry:"community members are very afraid."joe henry, a leader in the local latino community, says people are already on edge after an arrest last week in tibbetts' murder.joe henry:"we had young people last week who were confronted even walking in parks."but this robocall is taking it to a dangerous level. joe henry:"this takes us back 50 to 60 years. this takes us back to lynchings, blaming a whole community."he wants everyone in the community, all races, to stand up against hate.joe henry:"these hateful messages are just going to continue when good people don't speak up. this is a very important time."

"neil, if this flight is successful, you'll go down in history. what kind of thoughts do you have about that?""we're planning on the flight being successful.""first man" had a very successful premiere at the venice film festival, but some conservatives got upset when it leaked out that the iconic scene of neil armstrong planting the u-s flag on the moon isn't in the movie. the u-k's telegraph quoted star ryan gosling at the festival as saying armstrong's moon walk "transcended countries and borders," and that armstrong was humble, shifting "the focus from himself to the 400-thousand people who made the mission possible."(nat) "whoa! i like mom's new job!" one and a half million times on social media. it shows two men trying to push another off the train...who's been identified as san francisco local , 21 year old dexter lotz. the deli employee says he was enjoying his day off and was on his way home when he claims the man in blue lunged at him for having the volume up high while listening to music.sot: dexter lotz, attacked on muni// "we could have worked something out this has happened plenty of times on muni and people have asked me but have been polite about it. but he didnt even give me a chance to even turn it down. as soon as any verbal confrontation happened he immediately leaped at me."lotz says he nearly lost consciousness when the man put him in a chokehold...and a second man in grey grabbed his legs and joined in on the attack.people can be heard in the video begging the men to stop.(nats)lotz believes he was met with the aggressive behaviour because of his ethnicty...half guyanese...and has been on edge ever since. sot: dexter lotz, attacked on muni// "i just want people of color in this city to feel

( james ) another big story we are following this morning... police arrested three men after three separate investigations into internet crimes against children. stanley barbarich was arrested in sausalito on child pornography charges. police say he was found with more than 600 files of child porn. maurice alvarez was arrested in san francisco after homeland security investigators say they found him in posession of more than than 600 images of child pornography. police also arrested cristobal avendano in san francisco. investigators say he was trying to use social media to meet a 14 year old girl for sex. ... residents are demanding answers after a beloved community mural was painted gray overnight. kron 4's ali reid has the story. it's almost like a funeral here it's very upsettingespecially with the limitations we have with our families. our parents and our siblings not being able to vote or get a license. there's an endless amount of things they're not allowed to do.before it was painted over ... this mural was a beacon of hope.... it's been a cultural monument for people, by way of teaching history, by way of the historical figures that were on the mural33 years ago, artist jose vesa velasquez, along with children from the east side youth center ... created "mural de la raza" ... depicting mexican-american and indigenous history.this is who i am. this is my family's history. this is all of our stories being toldfor more

sunday afternoon; laid to rest next to his naval academy classmate and life-long friend, admiral chuck larson. ...cindy mccain...saying goodbye to her husband of the last 38 years.the final ceremony for john mccain was held inside a chapel at the u-s naval academy in annapolis, maryland -- with hundreds of midshipmen attending the service, along with close friends and members of john mccain's family, including his 106-year-old mother, roberta.after the ceremony, pallbearers carried the casket to a caisson waiting outside, and the body was taken to a burial site on the grounds of the academy's seven-acre cemetery -- with around five-hundred midshipmen lining the route.in honor of the former pilot, navy jets executed a "missing man" formation above the cemetery. broke the rules.but he told them that, over the years, he came to appreciate the lessons he learned there about courage, humility, and sacrifice.i'm andrew spencer, reporting ( james ) in the east bay....oakland police are stepping up patrols in one neighborhood ... after a "peeping tom" was caught on video lurking through someone's yard. one woman had a repeat visitor to her oakland home on walnut street in the maxwell park neighborhood.she says her surveillance cameras recorded video of a man hopping her fence and peering through her blinds. < was really susprised at first i mean who expects to look into their backyard and see that theres somebody looking through their windows so i immediately started yelling intruder and he jumped back over the fence and ran away.">( james ) the cameras recorded the same man on two other nights as well. ( james ) the warriors are just about a year away from moving into their new arena.

here you can see our quadcopter four video.. it shows the progress being made at the chase center.... going up in san francisco's mission bay. kron4's maureen kelly takes us on a tour for the latest look inside the construction project. over there at center court it's where the first jumpshot will be for the warriors first game at chase center. construction on the new home of the dub nation is now more than halfway complete. the erection of the steele that will support the arena's roof is nearly finished and they are two weeks away from the topping off ceremony for the 135 foot tall structure. outside you can start to see the white facade that will cover most of the chase center. we're at really we're at the stage now where you really were you can see everything coming together which i think is exciting for all the people that been working on this for

six years to try to imagine what it would look like when we got to the stage..roughly a thousand construction workers a day have been at work on this privately funded project....the cost of which is to projected to be over a billion dollars. in addition to warriors games, the 18- thousand seat arena also expected to host 200 or so events like concerts and conventions. uber is planning to move into the two office buildings also under construction on the campus ...there's also 100-thosand feet of retail space which is expected to be taken up mostly by restaurants . here's a rendering of an aerial view of what it will look like once finished.....which also depicts the 5 and a half acre waterfront park that's part of the project. the third street plaza will be the venue's main entrance. the facade right there right there a large video boards san francisco's only outdoor video board here's what that will look when finished. they are talking about using it for public gatherings like movie nights....or possibly project things like world cup games.+ teams president says the construction project is on schedule and the arena is expected to hit target it's target date of opening in september 2019...so if all

( darya ) one man is in the hospital after a stabbing at a homeless encampment in san francisco near highway 101.

this is what the area looked yesterday afternoon. the stabbing forced the closure of an off ramp to highway 101 at duboce avenue and mission street. the homeless encampment is on the side of that off ramp. the victim's condition is unknown this morning. ( darya ) a temporary homeless shelter in berkeley is now closed.. and those who took refuge there are now displaced... as they now wait for a permanent solution promised by the city. overnight... a dozen tents were set up outside the old berkeley city hall. nearly 100 people were living at the temporary site that expired on august 31st. those who relied on the shelter say they've been forced to scramble and no permanent solution set in stone.

missing this morning after a boat collision on the colorado river in mohave county. this is video of the search efforts posted by the san bernardino county sheriff. two boats collided head-on along the california-arizona border on saturday. the collision left ten other people injured. one of them is in critical condition. ( darya ) firefighters are battling a brush fire in nevada... that was sparked by a plane crash. the plane went down yesterday afternoon. at last check... the fire has burned 40 acres. there's no containment yet. it's unclear if anybody survived the plane crash. ( james ) new this morning in the north bay... the c-h-p had to rescue a woam who fell from a train and into a creek in marin county. this is video released by the c-h-p showing that rescue. this happened near cataract falls. police say the woman had fallen about 40 feet. the woman was taken to

( darya ) the father of murdered iowa college student mollie tibbetts says his daughter's death should not be used to promote political agendas. a mexican farmworker -- who was in the country illegally -- has been charged in tibbetts' death. rob tibbetts spoke out against using mollie's death to promote what she believed were "profoundly racist" beliefs. he says she's not a pawn to be used for debate and referenced donald trump junior. the president's son said not enough attention has been paid to the suspect's immigration status. mollie tibbetts grew up in the bay area. her body was found august 21st. ( darya ) police have arrested three men after three separate investigations into internet crimes against children. stanley barbarich was arrested in sausalito on child pornography charges. police say he was found with more than 600 files of child porn. maurice alvarez was arrested in san francisco after homeland security investigators say they found more than than 600 images of child pornography. police also arrested cristobal avendano in san francisco. investigators say he was trying to use social media to meet a 14 year old girl for sex. ( james ) in the east bay.... oakland police are stepping up patrols in one neighborhood ... after a "peeping tom" was caught on video lurking through someone's yard. one woman had a repeat visitor to her oakland home on walnut street in the maxwell park neighborhood. she says her surveillance cameras recorded video of a man hopping her fence and peering through her blinds.

( james ) community and religious groups protested for the final time outside of the west contra costa county jail in richmond on saturday. they were calling for the release of undocumented immigrants. but now that local authorities have cancelled their contract with ice.... undocumented detainees have been transferred out of the jail. eight undocumented immigrants were released from the richmond facility in the last week. that includes hugo aguilar who says he is greatful to be back with his family. and now that he is out he says he wants to do more to help other undocumented immigrants.

( darya ) one man is in the hospital after a stabbing at a homeless encampment in san francisco near highway 101. this is what the area looked yesterday afternoon. the stabbing forced the closure of an off ramp to highway 101 at duboce avenue and mission street. the homeless encampment is on the side of that off ramp. the victim's condition is unknown this morning. ( darya ) 4 people are missing this morning after a boat collision on the colorado river in mohave county. this is video of the search efforts posted by the san bernardino county sheriff. two boats collided head-on along the california-arizona border on saturday. the collision left ten other people injured. one of them is in critical condition. ( darya ) firefighters are battling a brush fire in nevada... that was sparked by a plane crash. the plane went down yesterday afternoon. at last check... the fire has burned 40 acres.

( james ) new this morning in the north bay... the c-h-p had to rescue a woam who fell from a train and into a creek in marin county. this is video released by the c-h-p showing that rescue. this happened near cataract falls. police say the woman had fallen about 40 feet. the woman was taken to the hospital and is expected to be okay. ( james ) the c-h-p is making good on its promise to crack down on drunk and distracted this labor day weekend. since friday night... officers across the state have made 685 d-u-i arrests. the also say 10 drivers and 2 pedestrians have lost their lives on the roadways. ( darya ) happening today. buses will be replacing bart trains at oakland stations while crews work on the tracks. regular service will resume tomorrow.

jose ... neighbors are demanding answers after a popular community mural was painted gray overnight. 33 years ago, artist jose vesa velasquez, along with children from the east side youth center ... created "mural de la raza".it depicted mexican- american and indigenous history. but last week the building was sold ... the new owner decided to paint over it. and since then ... the building is being defamed. ( darya ) because the new because the new building owners did not notice the artist, the city believes there's been a violation of california state law .... and are sending a notice about the

video lurking through someone's yard. one woman had a repeat visitor to her oakland home on walnut street in the maxwell park neighborhood. she says her surveillance cameras recorded video of a man hopping her fence and peering through her blinds. family has a warning this holiday weekend ... after an out of control jet ski slammed into the back of their boat.. the terrifying crash was caught on video on folsom lake. a wife says a jet ski came uncomfortably close - before striking the side of the boat - leaving a hole. luckily no one on the boat was hurt. but leah prior says they did find the jet skier who hit the boat -- he did not have insurance. construction on the new home of the dub nation is now more than halfway complete. the erection of the steele that will support the arena's roof is nearly finished and they are two weeks away from the topping off ceremony for the 135 foot tall structure. outside you can start to see the white facade that will cover most of the chase center. we're at really we're at the stage now where you really were you can see everything coming together which i think is exciting for all the people that been working on this for six years to try to imagine what it would look like when we got to the stage..roughly a thousand construction workers a day have been at work on this privately funded project....the cost of which is to projected to be over a billion dollars. in addition to warriors games, the 18- thousand seat arena also expected to host 200 or so events like concerts and conventions. uber is planning to move into the two office buildings also under construction on the campus ...there's also 100-thosand feet of retail space which is
