(vicki)just in tonight a major development in a rash of apple thefts we've been telling you about here in the bay area. tonight, a big bust. this comes on the heels of two other thefts. kron four's terisa estacio working this story for us and brings us the latest information. (take pkg) terisa estacio, reporting, emeryville. kron four news has learned at least 7 people were taken into custody in connection with busting a ring associated with stealing from dozens of apple stores. this

comes on the heels of a high stakes crime here in emeryville tuesday, and a case out of palo alot. - where police say in both cases, packs of young males raced into apple stores and took off with ipads and the latest iphone that runs close to a thousand dollars each. thefts at apple stores are at an all time high.... a north bay resident shared this video he took as the crime unfolded right in front of him... and later he shared this video exclusively with kron four news, showing the arrest of one suspect. a month ago, the apple store in corte madera was hit and images of suspects released. late wednesday, oakland police announced it assisted outside law enforcement by arresting multiple indidivus on criminal warrants. and that the arrests are are in connection with large scale crimes throughout california... they would neither confirm or deny the cases were directly involved in apple thefts. kron four news has also learned that california department of justice is involved and more information with be realeased on thursday. thefts at apple stores have plagued the bay area... on here in emeryville, residents say they are very relieved to hear there could be a major break in these cases. i am glad, they needed

(catherine) explosive indeed, from a woman who says she knew kavanaugh in his private school days... she says he was present at a

party where she was drugged and gang raped. in a sworn affadavit, julie swetnick alleged she attended well over ten parties where she saw judge brett kavanaugh, then in high school, drinking excessively and engaging in abusive and physically behavior towards girls. swetnich also says kavanaugh and others would spike the punch to cause girls to become inebriated and disoriented so they could be gang=raped in a side room or bedroom.she added that she became the victim of one of these gang or train rapes where mark judge and brett kavanaugh were present. swetnick did not allege that either man assaulted her or anyone else.kavanaugh immediately replied, "this is ridiculous and from the twilight zone. i don't know who this is and this never happened."attorneys for kavanaugh's classmate mark judge say he vehemently denies the allegation.swetnick's lawyer michael avenatti defended his client."the details in this allegation are specific, they are shocking, but above all else they are true. and my client defends them 100 percent."senate judiciary chairman chuck grassley says his committee is reviewing the latest allegation. democrats on the committee are urging president trump to withdraw kavanaugh's nomination, but the president is showing no signs of wavering ."this is one of the highest quality people that i've ever met. and everybody that knows him says the same thing. three women have now come forward with stories about kavanugh in his youth. tomorrow palo alto university professor christine blah=zee ford will testify under oath. in her prepared opening statement she describes how she was at a party when kavanaugh pushed her onto a bed and began grinind his hips. she says she believed he was going to rape her and tried to scream but he put his had over her mouth.she says she eventually got free and locked herself in a bathroom. reporting that kavanaugh was asked by the commmittee about two other unnamed accusers ... numbers four and five. n-b-c news is citing a woman who says that kavanaugh shoved her aggressively against a wall at a washington party in 1998. both women - reportedly remaining anonymous. vicki and grant? (rob live) the primary rape crisis center hotline for the south bay is run by the ywca silicon valley here on south 3rd street. the c.e.o. tells me the center has seen a sharp uptick in the number of people reaching ot for help. phone calls into the ywca silicon valley's domestic violence and sexual assault hotline are up 20 percent as a result of the "me too" movement and the supreme court nomination hearings says c.e.o. tanis crosby.tanis crosby/ywca silicon valley "....we are absolutely seeing an increase in survivors reaching out, the message is being sentand received, we

with potholes... and today, we're finding out who in the bay area, has to deal with more of them on a daily basis. this new report comes on the heels of a possible repeal of the gatax, that's supposed to help make things better for everyone. kron4's ryan o'donnell joins us with more on which areas have a smoother communte to and from work. (landvo) well, i can say, looking at the report here... it's not just one specific region that has a bumpier ride over the other. some of the "bad pothole" areas... are next to some of the good areas. each year the metropolitan transportation commission releases its annual pothole

report. and while we're into our second year of the gas tax that's supposed to help smooth-out our roads... improvement numbers in the bay area, have just slightly gone up. let's see what cities ranked near the top... in the "very good" range. the top three spots go to dublin with 85... clayton and el cerrito with 84. palo alto, brentwood and colma all come in with an 83. and the areas with the lowest scores... in the "poor" range. at the very bottom once again, is larkspur, with a score of 42. petaluma scored a 46. and unincorporated sonoma county, came in at 49. the end goal of course... is to get all the bay area roads up to an 85 rating... so the work is then to just maintain roadways... rather than repair them... which would cost a lot less. (vicki) the debate over the california gas tax will be settled on the november ballot.

both opponents and supporters of proposition six -- which would repeal the tax - - are going the extra mile to drive home their points before election day. (grant) capitol bureau reporter ashley zavala explains what the ballot measure would do... and how both sides are trying to sway voters. ((ashley)) there is a sizable amount of support for and against the repeal effort. gubernatorial candidate john cox is supporting prop six. but a coalition of public safety and government groups say repeal will be a rough road to travel. ((pkg))nats--the price you pay at the pump could change immediately if proposition 6 passes.(carl demaio - yes on 6) "the gas tax is unfair, it's costly, it's regressive, it hurts working families."the measure would repeal california's recent 12 cent per gallon gas tax increase.it would also require voter approval for any future gas tax increases.((nats-ad)) opponents of prop six released this state-wide tv ad claiming cheaper gas in the end, could be costly.the legislatve anaylyst office says repealing the tax will slash 5.1 billion dollars in funding...opponents say that would halt 6,500 road repair and infastructure projects.(michael quigley)) "the conditions of our roads will continue to deterioriate.. roads will become less safe and utlimately what we'll have is

a situation where voters will have to pay more in the future and millions of dollars of tax payer money will be wasted shutting down projects that are underway."(demaio) "ohhh the politicians and special interests just want more of your money ...they're going to threaten you, we're going to take hostages, we're going to cancel projects..."supporters of prop six rallied on the capitol steps this week..the group claims funds from the gas tax is not all going to the roadways.(demaio) "look, the reality is, you already pay one of the highest gas taxes in the country.. those projects should've already been funded." from the ministry being allowed to conduct mass at a church in an east bay city (grant)the priest was previously accused of child abuse in another california church. and as kron4's haaziq madyun reports...an investigation into how this happened is underway. (take pkg) (pkg)father j. patrick foley was removed from the ministry by the catholic diocese in san diego. according to this letter from bishop michael barber of the oakland diocese foley was removed from the priestly ministry due to inappropriate behavior with children. however somehow st.

isidore church in danville didn't get the message. according to this same letter to st. isidore perishners father gerald moran, who you see here, did not seek a letter of suitability before allowing foley to celebrate mass and sacraments at the danville church. as a result of this violation of national catholic church protocals father moran has been placed administrative leave from the parish while an internal investigation into this matter takes place.bishop barber's letter goes on to say the church is not aware of any children or vulnerable adults at st. isidore being harmed in any way by father foley. parents here at st. isidore catholic school did not want to talk on camera but off camera at least parents told me there is a considerable amount of outrage that the church allowed this to happen. although father foley has been officially removed from the ministry for inappropriate behavior with children, according to his website he is still making himself available to the public, offering a variety of church related services. i reached out to father foley for his response to to this. i received no reply. in danville haaziq madyun kron4news

another look at traffic tonight... as the transbay transit center remains closed this evening... and likely through next week... another crack was discovered in a steel beam in the brand new building. addressed the media today... and said the belief right now... is that this is a localized issue. (2shot) this recent crack found at the transbay transit center is just the latest of building concerns making headlines recently. (cross shot) kron4's ryan o'donnell joins us now with more on some of the other issues, people have been talking about. there are three big ones... and they're all within a few blocks from each other. let's take a closer look at the area we've been talking about. this is from google maps... and taken during construction of the

transit center. you can see the foundation going in right here. but just next to it... is the millenium tower right here... now, nick-named the "leaning tower of san francisco..." raising a lot of concern, because so far, it's sunk, around 18 inches and leans to one side. and then just west of that building... you have '25 jessie street...' where it too has sank... but much less... settling only less than an inch in almost 40 years. (ryan)kron4's maureen kelly talked to a structural engineer who says there's no evidence these instances are linked. the leaning millenium tower looms over the new tranbay transit center....but despite the close proximenty of the two massive buildings.....a structual engineer says it's highly unlikely that the cracked beams found in the transit center are related to the sinking being experienced at condo building. it doesn't appear that there's any plausible theory that this would be related to the

foundation issues at the millennium tower. this crack is probably due to some very local issues in that structure. he says if it were true...we'd see a lot more evidence of settlement beyond the cracks.this would not be the first thing that would be noticed you'd see in the ground, you see distortions evidence in the floor slabs, in the wall systemshe says the cracks in the transbay center's steel girder could have a number of causes .....including a defect in the material itself....defects in workmanship.....or a defect in the design of this very unusual building....supporting the very heavy weight of a 5 acre park. every cause that i can think of is unusual because of the very rigorous quality controls and quality assurance and processes that we put on modern structures especially steel structures nevertheless we can't rule them outhe says no matter what the cause the solution will likely involve adding more steel to strenghten the weaken spots....it could be a quick fix if the problem is specific to one area.....but if it's prevelant....than the investigation and the solution will need to be more extensive. maureen kelly kron4 news.the leaning millenium tower looms over the new transit center....but despite the close proximenty of the two massive buildings.....a structual engineer who specializes in steel structures says it's highly unlikely that the the cracked beams found in the transbay transit center are related to the sinking being experienced at residential condo building. it doesn't appear that there's any plausible theory that this would be related to the

(vicki) in the east bay.. a school employee in walnut creek has been arrested and charged with seven counts of child molestation. contra costa police arrested 71-year-old enrique pina. pina worked at palmer school in walnut creek... but authorities say the charges are ánot linked to the school. authorities are looking for more victims. (vicki)also in the east bay... alameda county sheriffs deputies continued their search today for a 71-year old fisherman who has been missing since monday.it is believed he slipped and fell into the 18- feet deep delta-mendota canal near livermore.his family says he fishes there every day -- and that they were concerned when he didn't return home at his usual time.deputies are employing the use of a drone, helicopter, motorcycles, and

dogs to search for the man. (grant) in the south bay... the city of san jose has agreed to lease land to the group of transients known as "hope village"...for only one dollar a month for the next six months. hope village first opened without permission... and the homeless people camping there were forced to leave. the new site is across from the old one. the new site is being cleaned and should be ready by tomorrow. (grant) and a c-h-p pursuit ended in a crash...leaving three people injured in san jose this morning. the chase ended in the area of south capitol avenue and excalibur drive. the driver suffered minor injuries. two ápassengers were taken to the hospital for treatment -- one had major injuries and the other had moderate injuries. (vicki) in the north bay... police have arrested 2 teen girls for a fight at a high school football game.. that led to a stabbing. it happened during the montgomery high school football game friday night in santa rosa. police say a 16-year-old girl confronted a 15-year-old girl at the game. during the

fight... the 15-year-old stabbed the 16-year-old. the 16-year-old was not seriously hurt. both teens were arrested... one for the stabbing and the other for starting the fight. surveillance camera shows what happened when a homeowner surprised two burglars who were leaving her house with stolen items.she screams.they bolt and, during the escape, one of the hooded strangers subdues the woman with pepper spray.this happened mid september in panorama city near the intersection of ventura canyon avenue and cantara street.neighbor millie gan was aware of the crime but had not seen footage of the attack.millie gan/neighbor: "i heard there peppers there was pepper spraying and they were in the house when she got home, so that was that's horrible. that must have been terrifying for her. i feel really bad."many neighbors we spoke with did not want to go on camera but say thieves have hit the area heavily and that home breakins happen all too common.some are frustrated and field police aren't doing enough to combat the problem. several neighbors are fortifying their property with cameras and lights and fences and watch dogs.we do know detectives have been going door to door asking for any surveillance footage and millie gan tells us people have reported a suspicious vehicle in the neighborhood the week before this burglary. witnesses believe the culprits we're looking for potential targets.millie gan/neighbor: "i heard there was a black jeep that driving through here the whole week before that happened."chris wolfe/reporting: "really? what's the mood in the neighborhood with this going on?"millie gan/neighbor: "scared. everyone's terrified. yeah."

fitness trackers are being voluntarily recalled... due to the risk of burns. the bluetooth trackers by digital wellness company provata health... are black, blue, and green. they were given away during a promotion

between august 2017 and july of this year. according to the u-s consumer product safety commission, there have been 13 reports of the devices overheating while charging or being used -- and three of the users suffered burns on their wrists. if you have one you should immediately stop wearing and charging it. provata health has offered to replace them for free. (vicki) uber has reached a $148 million dollar settlement over a 2016 data breach that affected 57 million users. according to the new york attorney general this is the largest multi-state data breach settlement in u-s history. the settlement stems from accusations regarding a 2016 data breach that exposed about 57 million users' data and uber's subsequent paying of hackers to cover up the breach instead of reporting it to authorities. to tell you about in the those apple store thefts that have been happening here in the bay area. law enforcement plan to make an announcement tomorrow... (pam) as kron four's terisa estacio reports, we have learned officials have made several sweeping arrests. (take pkg) terisa estacio, reporting, emeryville. kron four news has learned at least 7 people were taken into custody in connection with busting a ring associated with stealing from dozens of apple stores. this comes on the heels of a high stakes crime here in emeryville tuesday, and a case out of palo alot. - where police say in both cases, packs of young males raced into apple stores and took off with ipads and the latest iphone that runs close to a thousand dollars each. thefts at apple stores are at an all time high.... a north bay resident shared this video he took as the crime unfolded right in front of him... and later he shared this video exclusively with kron four news, showing the arrest of one suspect. a month ago, the apple store in corte madera was hit and images of suspects released. late wednesday, oakland police announced it assisted outside law enforcement by arresting multiple indidivuals on criminal warrants. and that the arrests are are in connection with large scale crimes throughout california... they would neither confirm or deny the cases were directly involved in apple thefts. kron four

east bay - there's a scandal involving a priest who's been removed from the ministry - yet allowed to conduct mass at a local church.(pam) earlier, this priest was accused of child abuse in another california church. and as kron4's haaziq madyun reports ... an investigation into how this happened is underway. (take pkg) (pkg)father j. patrick foley was removed from the ministry by the catholic diocese in san diego. according to this letter from bishop michael barber of the oakland diocese foley was removed from the priestly ministry due to inappropriate behavior with children. however somehow st. isidore church in danville didn't get the message. according to this same letter to st. isidore perishners father gerald moran, who you see here, did not seek a letter of suitability before allowing foley to celebrate mass and sacraments at the danville church. as a result of this violation of national catholic church protocals

another big high rise that has made headlines ..... the millenium tower.(catherine) the transbay authority says the crack in the new transit center is not related to the problems across the street. kron4's maureen kelly checked in with an independent structural engineer for a second opinion. while the developers of the millenium tower has blamed the practices used in the construction of the new transbay terminal for it's lean......the transbay authority has denied that.....and says there's no connection between the cracked steel beams.....and the sinking going on across the street.a structural engineer agrees that theory is not plausible.he says if it were true...we'd see a lot more evidence of settlement beyond the cracks.this would not be the first thing that would be noticed you'd see in the ground, you see distortions evidence in the floor slabs, in the wall systemshe says the cracks in the transbay center's steel girder could have a number of causes .....including a defect in the material itself....defects in workmanship.....or a defect in the design of this very unusual building....supporting the very heavy weight of a 5 acre park. every cause that i can think of is unusual because of the very rigorous quality controls and quality assurance and processes that we put on modern structures especially steel structures nevertheless we can't rule them outhe says no matter what the cause the solution will likely involve adding more steel to strenghten the weaken spots....it could be a quick fix if the problem is specific
