(terisa) the ghost ship case is being delayed again... but this time because the judge was on vacation. the court case is connected to an oakland warehouse fire killing 36 people two years ago. the attorney for one of the men charged... derick almena.... planned to try and get the jugde to allow them to take the original plea deal during court today.
5:06 pm
however the alameda judge who was scheduled to hear their case just returned from vacation and said he needs more time to prepare for the case. the original plea deal called for almena to spend nine months in prison but that was later rejected by the judge, saying he did not feel almena was remorseful. both almena and the other man charged... max harris... have been in jail since 2017. (ryan) a man running for fremont city council is dealing with more than just opposition from his opponents. he says he was a target of hate. kron 4's sanaz tahernia spoke to justin shaw earlier today. sanaz, tell us what happened. (sanaz) well ryan, like any other candidate running for political office, justin sha set-up political posters throughout fremont. but when his dad drove by two of sha's banners on the corner of mission boulevard and ondina drive, he noticed something was wrong. both banners had been vandalized, and on one of the banners, a pair of horns and a swastika were drawn on his forehead. now sha spoke to
5:07 pm
police who contacted people living in that area to see if perhaps they had surveillance video, but unfortunately they neither had cameras set up outside of their homes nor did they see the incident take place. sha is a chinese- american, law school graduate and although this incident does somewhat scare him and his family, he feels it's important to shed light on the issue of hate. (sanaz) now sha told me that he spoke to fremont police about the incident but he said police told him that they wouldn't file it as a hate crime, but rather as an act of vandalism. i reached out to fremont police for a statement, but they haven't gotten back to us yet.

(sanaz) coming up at 6 we'll not only will we hear more from sha, but we'll also hear what his father has to say as well. ryan and terisa, back to you. (terisa) another big story we are following today concerns san francisco's troubled millennium tower. you may recall, we told you about how an exterior window on the 36th floor was cracked. while it seems the city and the homeowners association have reached agreement on what happened. there is some confusion has to what should happen next. kron 4's dan kerman is live in downtown san francisco with more. dan? when experts for the millennium tower association determined that the cracked exterior window on the 36th floor was "due to an exterior impact.... the millennium tower association must still "maintain the protective pedestrian scaffolding along mission street and fremont street until the exterior cracked glazing panel ... is replaced as a precaution to ensure public safety."while that scaffolding remains in place on mission street it has been removed from fremont street. while some have said the hoa was defying the city, the hoa tells kron4news is was simply "a miscommunication." the hoa now says they will "ensure public safety by visually inspecting the windows of the millenium tower along fremont street next week but not replacing the scaffolding. city officials say it was not a miscommunicati

5:18 pm
facebook says they've reset the access tokens for everybody involved in this breach. here's what was stolen, 14 million users had their names, contact information, gender, relationship status, and recent place check-ins stolen. another 15 million users had just their names and contact information taken. 1 million users had only their access tokens stolen... which is how people access their user accounts without having to type in their passwords. facebook says the breach is also under investigation by the f-b-i which asked the company not to talk about who might be behind this attack. (terisa) a big story tonight... scooter company "bird" has found a way around city regulations limiting the number of rentals it can put on streets. the santa monica based startup that pioneered scooter sharing is touting its new bird delivery service. it will drop off scooters at customer's homes by 8:00 a-m, then pick them up in the evening. the service could be available in some of 70 u-s cities where bird already operates... several of those right here in the bay area. daily pricing has not been announced. most companies rent scooters by the minute and allow riders to leave them on street corners or near transit stops. but that can upset both residents and city officials, so many cities have limited the number of rentals available. however, bird thinks its personal rental service should work differently and caps on the number of scooters shouldn't apply.

demolition of the old vallco shopping mall in cupertino and already a group of neighbors are raising concerns about potential environmental hazards that could be unearthed. kron4's maureen kelly reports that the same group is also very much opposed to what developers are planning to build in it's place. construction workers continue to knock down the parking structure behind what used to be the old sears at the vallco shopping mall. those opposed to the plan say they are worried about dust and debries....as the mall is demolished...especially since there are automotive centers on site...they worry below that concrete are dangerous pesticides from when there was an orchard here.the developers of the project slated for this site ...says they are doing everything by the book. you can see water being sprayed to keep the dust down.the project, to be known as the cuprtino town center, is the first to qualify under sb-35, a new state law that allows cities to fast-track projects that include a certain amount of affordable housing. there

are two competing plans. the sb-35 plan calls for roughly 24-hundred homes, retail and office space or a second plan recently approved by city council which calls for a slightly different mix of housing and office space but would include a new city hall and performing arts center. but those complaining about environmental concerns today are with a group calling themselves better cuperino....they don't like either one of these plans..saying they are too big...and will bring too much traffic to the area. this building is four times this complex is four times the size of the eighth and empire state building in new york new york is 9 million people we have 70,000 this is just absurd they want to overturn the sb35 plan in court and are gathering signatures for a referendum that would stop the second plan from going forward. this group is not looking for a better project this group is looking for a new project and when you have a dead mall in the middle of a housing crisis that's just not acceptablethe developer says if the second plan is stopped by referedum they will continue on with the one that meets the criterea of the new state law. maureen kelly kron4 news (ken) coming up at 6:45... the coming up at (ken)
