(grant) a man forces the complete shutdown of an east bay freeway today... after he was seen waving what appeared to be a gun... near his broken down van. good evening i'm grant lodes. (vicki) and i'm vicki liviakis. the incident happened at around 9-45 this morning... along 8-80 near the oakland coliseum. but as kron four's philippe djegal reports... the weapon turned out to be a b-b gun. (philippe) even to the trained eye... this looks like a real handgun.officer herman baza/chp- "the average person would think it's a firearm. it's black, uh, its not orange." it's what several people reported to the california highway patrol tuesday morning was being waved and pointed towards drivers by the man whose face you see blurred here next to a white van.officer herman baza/chp- "when officers showed up on scene, uh, they held him at gunpoint. they gave him directions to follow their commands. luckily, he was compliant. he followed officer's commands." and, officer herman baza says the 24-year-old man from hayward was taken into custody without the use of force. the man's employer tells kron four he's a delivery driver who was

on his way to help a colleague whose van had broken down, when his van also broke down. officer baza says the man then got out of the van parked on the shoulder north of the 66th avenue on-ramp on interstate 8-80, stood on-top of the vehicle and started aiming what ended up being a b-b gun at passing cars in oakland.officer herman baza/chp- "he made some statements that he was fearful, uh, that he was gonna get hit by traffic, so he felt he had to pull a, pull out his bb gun, uh at people." officer baza says the man never fired the gun. no one was injured. no property damaged.officer herman baza/chp- "using our deescalation techniques, you know, something like today, we revert back to our training and experience, uh, so that we could avoid any major incident." the c-h-p says the man involved was taken to a local hospital... where he'll be held for 72-hours for a mental evaluation. in oakland, philippe djegal, kron four news. news... a three-year-old toddler who was shot in oakland last night remains in critical condition. and tonight officers are still trying to find the gunman. the boy was shot in east oakland at around 8:00 ... on robledo drive. that's in the sobrante park neighborhood bordering san leandro. officers are not sure if the shooting happened inside a home or out on the street. police are asking anyone with information to come forward. (vicki) a big story tonight... a high school in the north bay is dealing with a wave of reported suspensions... related to drugs. and as kron 4's terisa estacio reports... some students say the punishment is too harsh for the alleged crime. (vicki) lawyers for the suspected norcal rapist do not want his image broadcasted or published as his court case moves forward.. long-time uc berkeley employee roy charles waller is accused of raping several women across northern california in the 90's and early 2000's. sacramento bureau reporter ashley zavala explains what prompted waller's lawyers to make the request just minutes before what was expected to be roy waller's second court appearance here in sacramento.. waller's lawyer handed us a copy of a request he filed, asking the judge to keep members of the media from photographing,

broadcasting and distributing waller's image. the court room cage sat empty in sacramento tuesday.the suspected norcal rapist skipped his second court appearance while his attorneys introduced a motion to limit media coverage. in the request, waller's court- appointed attorneys said after reviewing evidence... "questions have been raised regarding eye witness identification of the norcal rapists' physical characteristics compared to waller's." waller's lawyers wouldn't say what specific questions...but filed a declaration with the court under seal.the judge issued a temporary ruling denying the request... saying the court cannot properly grant the motion because waller's image has already been captured by the media. waller was arrested in september after investigators said dna linked him to crimes in which he allegedly tortured, raped and robbed women in several counties scattered throughout northern california. since then, his image has been distributed and shared millions of times.deputy district attorney chris ore says the da's office is reviewing the request.. (chris ore - sacramento deputy d.a.) "obviously we also want to protect the integrity of the case, but it's a public court room, i don't see any harm in having cameras." (vicki) it's that time of year again... time for spooky costumes and candy.(grant) but while halloween is meant to be a holiday of fun, a new report tells us there are some health risks to watch out for. meredith wood has more. trick or treat -- could be less treat this halloween if you don't take some precautions.a 2012 state farm study found children are twice as likely to die on halloween than any other day.a major cause of these deaths? walking in the street.in a study of over four million deaths over a span of 20 years, state farm found nearly 70 percent of pedestrians were hit away from a crosswalk or intersection. and these deaths aren't limited to young children, either.most of the fatalities were teenagers.keep your little goblin safe by dressing them in reflective tape, trick-or-treating in groups, and carrying around a flashlight.and beware of face paint.the f-d-a does not approve color additives in face paint.they say a color that's ok for hair and nails may not be ok for skin.you can

(ken) tonight at 6.... fully autonomous "ghost" cars will soon be here. the d-m-v has authorized "waymo" to begin testing cars right here in the bay area... without any drivers at all. waymo... of parent company alphabet -- will begin testing on public roads and highways -- for the first time in california --- near its silicon valley headquarters. (pam) and i'm pam moore. this is the latest step forward in driverless technology for waymo -- which started working on self- driving technology at google, back in 2009. grant lodes is here in the studio with more on what comes next.. grant (grant)that means fully autonomous vehicles -- without a test driver in the car. however -- an operator must continuously monitor the vehicle remotely.while this is brand new to california... accordg to waymo -- theyve already driven 10 million

autonomous miles on public roads.they also boast that they've driven nearly 7 billion ásimulatedá miles. waymo's permit includes day and night testing on city streets as well as highways --- up to 65 miles per hour. and although this tech has been tested largely in arizona... waymo says the vehicles are safe to use in fog and light rain.the cars will hit the roads in the shaded area shown here --- including parts of mountain view, sunnyvale, los altos, los altos hills, and palo alto. if and when the testing expands, waymo says they will submit another request to the d-m-v.eventually -- members of the public may be allowed to ride in the autonomous vehicles -- as part of an early rider program similar to what has already happening in arizona. of course --- there are always risks to new technology... and driving in general. one of the test minivans got into a serious crash in arizona in may....

four's philippe djegal reports... the weapon turned out to be a b-b gun. (philippe) a passerby recorded this video of the man whose face is blurred -- just moments after witnessing that man wielding what appeared to be a handgun towards other passing cars, while standing ontop of the van.. the california highway patrol eventually determined the gun doesn't fire bullets. it shoots b-b's. but that wasn't entirely clear when officers approached him. officer herman baza/chp- "the officers used their patience and their training to deescalate the tense situation. if you could imagine, you're getting called to a someone pointing a firearm, uh, at people -- that's a tense situation." before 10 o'clock in the morning... the 24-year-old man's van had broken down on the shoulder, north of the 66th avenue on-ramp on interstate 8-80 in oakland his employer tells kron four that he was on his way to help another delivery driver whose van had also broken down when all of this happened. the man, from hayward, is described as usually peaceful and quiet. his family says he may be struggling mentally. officer herman baza/chp- "luckily, he was compliant, the bb gun was tucked in his waistband. there was no use of force. uh, you know, they took him into custody with no issues. he explained to officers he started wielding the b-b gun because he felt unsafe in the area.officer herman baza/chp- "he was fearful, uh, that he was gonna get hit by traffic. so, he felt like he had to pull out his bb gun, uh, at people." the man was taken to a local hospital where he'll remain for three days during a mental health evaluation. in oakland, philippe djegal, kron four news. couple - just before falling from a popular overlook. this is the photo.... you can see the woman with the pink hair in the background.. shortly after it was taken -- she and her husband accidentally fell from taft point. their bodies were recovered last week -- about 800 feet below the cliff. the husband worked for cisco in san jose. the man who took the photo says he felt nervous seeing the woman so close to the edge when he took the photo. something the president can even do.. well pam, as ken mentioned, birthright citizenship is guaranteed under section one of the 14th amendment of the united states constitution. it says in part that "all persons born or naturalized in the united states, and subject to the jurisdiction thereof, are citizens of the united states and the state wherein they reside." that basically means that if you're born in the united states you automatically are a citizen of the country, and what the president said he wants to do is sign an executive order ending the right to citizenship for children of non-citizens and undocumented immigrants born on u-s soil. now if the president is specifically trying to amend the constitution by way of an executive order, he's going to run into some problems. according to the national archives, the president doesn't have a constitutional role in the amendment process... however, the issue can be brought before the united states supreme court for an official interpretation - at which

man is on a mission trying to right .... what he belives is a 100-year- old wrong.(ken) a florida man claims his father was wounded in war and never received the purple heart he deserved. reporter steve andrews has the story. (reporter pkg) it was 100 years ago the war to end all wars 23 year old ralph carle, a member of the u.s. army's 119th regiment fought the germans in europe in 1918 and 1919.. ralph died in 1943, when his youngest son edwin was just 4 years oldi never really got to know him but i had a real father edwin heard stories that his father was wounded in the war. but he was not awarded a purple heart. i think i have enough evidence he found docuents dated in 1932 and 34 that show his father ralph suffered eye trouble due to gas and a shrapnel wound over the right eye.all i keep getting is well you gotta do this or call that or write to them and so on and so forth and fill out this
