( robin ) a man who was seen on bart holding two chainsaws is now facing charges.. kron 4's gabe slate spoke to a passenger who caught it all on video. like something out of a horror movie this man 47 year old patrick bingman of san francisco, pulled out 2 chainsaws while riding in a bart train on monday around 430pm. sound from jalina bluford - bart passenger he was sweating bad jalina bluford recorded video of the incident on her phone while riding bart from fremont to oakland she said partrick bingman appeared to be high on drugs at times he got close to people with the chainsaws and verbally threatened them. sound from jalina bluford - bart passenger he was bart massacre.. and i'll hurt you. jalina tweeted video of the chainsaw man while it was happening, bart responded to her tweet with a tweet of their own saying they had

never seen anything like that. bart police said they received several calls about the incident, they were at the lake merrit bart station ready to board and arrest patrick bingman when he got off the train.. bingman was arrested for making criminal threats and he had other outstanding arrest warrants he has been booked into the alameda county jail bart has tweeted that no one was injured and the chainsaws were never turned on. jalina appreciates that bart police did take action but thinks it could have been quicker. sound from jalina bluford - bart passenger we need to be safer..

( robin ) in the east bay, authorties arrested man they say was wielding a b-b gun near his broken down van on interstate 8-80. the incident forced a complete shutdown of the interstate around 9-45 monday morning near the oakland coliseum. the 24-year-old man from hayward was arrested without incident. the man's employer tells kron four, he is a delivery driver who was on his way to help a colleague whose van had broken down, when his van also broke down. ( robin )

police say the man never fired the b-b gun. no one was injured. the man is now at a local hospital ... where he is being held for a mental evaluation. ( robin ) new details on the shooting of a 3-year-old boy in oakland. police have arrested the boys father. the boy was shot monday night in east oakland on robledo drive. that's in the sobrante park neighborhood bordering san leandro. according to police, the district attorney is currently reviewing the case. the child remains in critical condition this morning. ( robin ) in national news... people in pittsburgh continue to mourn the loss of 11 people killed in a synagogue shooting over the weekend. john lawrence has the details. pittsburgh.....still in shock after saturday's fatal shooting rampage.on tuesday three of the victims were laid to rest.doctor jerry rabinowitz was remembered fondly......martin davis/friend of shooting victim "there aren't words that can

victims are expected over the next few days.i'm john lorinc reporting. ( robin ) the suspected shooter faces 29 federal counts. some of the charges are eligible for the death penalty. ( robin ) we're learning more about a couple that died in a yosemite cliff fall. they both lived in the bay area ... and a new photo has surfaced showing one of the victims just before the deadly fall. this is the photo ... it's a selfie taken by a man hiking the same area.you can see the woman with the pink hair in the background. shortly after it was taken -- she and her husband fell from taft point. their bodies were recovered last week -- about 800 feet below the cliff. the husband worked for cisco in san jose. family members of the couple believe they fell while taking a selfie. ( robin ) a high school in the north bay is dealing with a wave of reported suspensions ... related to drugs. but as kron 4's terisa estacio explains... some of the students believe the

punishment is too harsh for the alleged crime. student. i think it is wrong, the kids should not have been suspended. there is no one to watch them at home. this reaction after - kron four news came to this high school after being contacted by a concerned person... who said, 64 students were recently suspended, and one expelled for alledgely using an social media account to sell and buy marijuana. (take vo) calls to the superintendents office in the windsor unified school district were referred to the principal here at windsor high. who late tuesday issued this statement... saying quote "rumors around an event can stretch the truth: there were not 65 students involved in any incident last week. the need for student confidentiality prevents me from sharing any details involving any ongoing investigation."the principle continues in her email,

suspected nor-cal rapist do not want his image broadcast or published ... as his court case moves forward.. long-time u-c berkeley employee roy charles waller is accused of raping several women across northern california in the 90's and early 2000's. ashley zavala explains what prompted waller's lawyers to make the request.. just minutes before what was expected to be roy waller's second court appearance here in sacramento.. waller's lawyer handed us a copy of a request he filed, asking the judge to keep members of the media from photographing, broadcasting and distributing waller's image. the court room cage sat empty in sacramento tuesday.norcal rapist skipped his second court appearance while his attorneys introduced a motion to limit media coverage. after

"questions have been raised regarding eye witness identification of the norcal rapists' physical characteristics compared to waller's." waller's lawyers wouldn't say what specific questions...but filed a declaration with the court under seal.the judge issued a temporary ruling denying the request... saying the court cannot properly grant the motion because waller's image has already been captured by the media. waller was arrested in september after investigators said dna linked him to crimes in which he allegedly tortured, raped and robbed women in several counties scattered throughout northern california. since then, his image has been distributed and shared millions of times.deputy district attorney chris ore says the da's office is reviewing the request.. (chris ore - sacramento deputy d.a.) "obviously we also want to protect the integrity of the case, but it's a public court room, i don't see any harm in having cameras." ( robin ) it's been almost a year since the recreational use of marijuana became legal in california. but the legalization process has not been entirely smooth. kron 4's maureen kelly looks into this budding industry that is still struggling with growing pains. this video was shot last month when the cannabis harvest was in full swing....farmworkers

watering their crops which have grown to big bushes in the sonoma county soil under sunny fall skies. other snip the ready green buds....or flowers as they are commonly refered to in this growing industry....getting them ready to be dried before they are shipped to a dispensary. shivawn brady is this farm's dire now....so little about how they are growing has changed in this first harvest since weed was made legal for adults.....expect the increase in red tape.37:31 i think it's upwards of 22 different agencies that are regulating this crop i spend almost 40 hours a week just focused on compliance and trying to fiture out all of this1120 , from the california fish and ti most heavily regulated lks at the justice grown farm only cultivate a little less than one acre on their 56 acre propery because that's all they are allowed under county

ordinance. they'd like to grow a second acre on this patch as well....but that's unlikely to happen unless sonoma county decides to change their cannabis rules...yet again. this is the second harvest they've gathered here at this location. they used to be in another spot....but were forced to move after officials decided their old farm was in an area not suitable for commerical pot farming. they are applying for a variance so they don't have to move a third time.that and many other aspects of becoming a legitimate cannabis business remains up in the air. compliance is a moving target so it's challeging to build your operations, make smart capitol investments when you don't know exactly what that finish line should look like. while they have authorization to operate justice grown still does not have an official permit from the county ...and it could be six months to a year until that's a reality. brady says there are over 200 cannabis farmers in sonoma county trying to get a process began and as yet, none of them have been granted one. 5:52.so that leaves a lot of

highway patrol believe a man was driving drunk when he hit and killed someone in sonoma county. it happened just north of windsor on old redwood highway. authorities say 26-year-old josmar ortiz was arrested following field sobriety tests. they say his blood alcohol level was above point 0-8 percent. the collision happened after authorities say ortiz's car crossed the double yellow lines and hit another car going in the opposite direction. the driver who died has not been identified, another person was also hurt in the crash. union city near the scene of the crash with more. sara? at least two people have died following a multiple-vehicle collision that is still blocking all lanes of northbound interstate highway 880 near whipple avenue in union city early this morning, according to the california highway patrol. the chp said the collision was first reported around 10:40 p.m.
