bay vandalism suspect has been arrested... accused of writing hateful images including the n- word... and swasticas. as kron4's haaziq madyun reports... the community played a role in identifying the suspect the two toned hooded sweat shirt you see being worn in the photo on the left, matches the hoodie you see on the right. it is also the same clothing worn by the person allegedly responsible for a major vandalism spree in downtown antioch over the thanksgiving weekend. tuesday morning antioch police announced the arrest of a suspect. he is 24-year-old lawrence phipps of antiochsot the graffiti which included swaztikas and racial slurs was very disturbing for some folks here at shearz- on-3rd beauty salonsotthis artistic mural,

an antioch visual landmark was also defaced during the vandalism spreesot antioch police are not saying what they have for a motive in this case. however investigators are crediting the swiftness of the arrest as a result of multiple tips from the communitysotthese still images from survellance videos prompted the tips from the community. if there are any videos of phipps actually spraying graffiti downtown, police are holding on to that evidence as part of their investigation...in antioch haaziq madyun kron4news (vicki) developing news tonight... prosecutors have delayed their death penalty decision in a deadly stabbing at bart. john

lee cowell was charged with murder and attempted murder for the stabbing death of nia wilson and the stabbing of her sister letifah at the macarthur bart station in july. he is now facing the death penalty... but the decision is being postponed for three weeks. cowell is expected to enter a plea on december 20th. (vicki) some tense moments at a north bay school this morning... this after a bomb threat came in at a middle school. as kron four's terisa estacio reports, the school immediately deployed it's emergency response plan - moving nearly 1200 students out and getting back to their parents safely - which was no small feat. (take pkg) sound: "it was terrifying." concerned parents and others stood in this long line around the mill valley community center as they waited to be reunited with their children after a bomb threat shut down mill valley middle school. linn walsh, asst. to city manager, mill valley. we got the call in the morning and acted quickly contacting parents, and nearby residents. as the the 1200 6, 7th and 8th

graders remained inside - anxious parents waited outside. yeah, just trying to get to my kid. at the school - dogs trained to sniff out explosives teamed up with local law enforcement as they went floor by floor and room by room looking for any device. it was scary at first. as the morning unfolded... more children were connected with their parents. parent. relieved. although no explosive were detected... parents say this gave them insight for any future emergency. parent. i think they could have given more information. as for the threat... the police department has launched an investigation. in mill valley, terisa estacio (grant)(grant) terisa estacio in mill valley, terisa estacio

(philippe) in the east bay... when rain falls -- so do trees.steve padilla/public works- "trees are gonna fall." recent storms caused this oak tree to topple over on the iron horse trail in walnut creek... partially collapsing a fence, narrowly missing the

house or any people.steve padilla/public works- "we're sharpening our blades, you know, we're getting ready for this. we're having some storms that are coming up, uh, and so we want to be prepared, uh, not just for trees, uh, but for standing water, uh, and floods as well." steve padilla with contra costa county's public works department says his crews are clearing storm drains... and, identifying any other potential hazards that could become problematic during rain events.steve padilla/public works- "make sure that you're prepared as well, you know, make sure that you have flashlights available in case the power goes out. make sure, you know, that your yard is clear. you know, clear up your yard. if you have a lot of leaves, it is fall, uh, and so, get the leaves out. it could be very slippery. those leaves could then cause clogs in drains and so we want to make sure everybody is safe, you could help us help you." and, for those concerned about flooding at your home... the county has provided five free sandbag stations. steve padilla/public works- "bay point, byron, oakley, martinez and richmond." padilla says the sand will be available for as long as the storms last. in walnut creek, philippe djegal, kron four news. the family of a teen who drowned in the pool at an east bay high school is filing a lawsuit against the school district. benjamin curry was a freshman at san ramon valley high school in danville. he was found in the deep end of the school's pool back on may 8th. today-- his family filed a wrongful death lawsuit-- claiming the teacher, aaron becker, was on his cell phone while students were treading water. they say surveillance video showed the teacher standing on the diving board and looking at his phone. danville police ruled curry's death as an accident and did not file charges. (grant) we're learning more about the deadly shooting at a country bar three weeks ago down in thousand oaks. the ventura county sheriff's office is now giving more details about what happened inside the borderline bar and grill when a dozen people were killed.(vicki) kron4's ryan o'donnell joins us with more on what's being released today.

the sheriff's office says the shooter opened fire and tossed several smoke grenades into the bar to create confusion. he then sat and waited to ambush law enforcment officers who responded to the shooting. the gunman used only a single handgun... but had military training from his time in the service. the sheriff's office also ruling out a possible girlfriend or bar owner as possible targets. sheriff bill ayub/ventura county: "as you can imagine, this was a terrifying experience for everyone who was there. confusion and chaos can only begin to adequately describe the situation. for example, when sgt. helus and the chp officer approached the borderline, more than 100 people were fleeing from the scene -- some of them jumping through windows to escape." the gunman killed 12 people, including a law enforcement officer, before turning the gun on himself.one victim was also stabbed. why he did this... is still unclear. (grant) the creator of the animated nickelodeon show

"spongebob squarepants" has died. stephen hillenburg was 57 years old. hillenburg revealed last year he had been diagnosed with a-l-s, or lou gehrig's disease. spongebob earned numerous awards during its run, including four emmy awards, and has been adapted into a broadway musical. it has aired on nickeloden since 1999. (grant) today marks the 40th anniversity of one of san francisco's darkest days. the assignation of then mayor george moscone and supervisor harvey milk. kron4's

maureen kelly attended a special ceremony at city hall where both slain leader's legacies were celebrated. it was a really tough tough time in 1978mayor london breed standing in city hall not far from where the assasinations took place...a day that sent shockwaves thru san francisco. both mayor moscone and supervisor milk have been shot and killed.their assailant... disgruntled former supervisor dan white who was later sentenced to manslaugther and ended up killing himself after his release from prison. moscone had served as a state senator before being elected mayor of his home town....he's is remembered for changing the fa of city governement by appointing women, people of color and members of the lgbt community to committees and boards making it more diverse. supervisor harvey milk is

remembered as a civil rights pioneer...one of the first openly gay people to be elected to office.activist and author cleve jones says the day of the double killing he thought movement to make the city more inclusive died with themthen that sun went down and people began to gather on castro street like you're going to like we're going to gather tonight gay and straight young and old, black and white and brown, immigrant and native born and we let our candles and we march down here and we feel this entire plaza with the light of our candles, and i knew then i was wrong, it was not over it was just beginning, and harvey's legacy and george is legacy continues. we see it in the faces of the people who represents represents city government today, we see at the victories that we are winning we see in the resistance to donald trump and everything that he represents. it's not over those to man taught us how to fight, love each other, defend each other and hold onto that dream that makes the city so speciala candlelight vigil in their honor will gather in the castro tonight at 7 oclock.....a somber tradition now in it's 40th year.maureen kelly kron4 news. (grant) starting in the east bay... a police chase ended in a deadly crash in san pablo. the crash happened just after midnight today near san pablo avenue and road 20. officers say a contra costa sheriff's deputy attempted to stop a gold lexus in el sobrante-- but the driver did not stop.

the driver then led the deputy on a high speed chase-- at speeds that reached 100- miles-per-hour on city streets. the deputy stopped the chase because of safety concerns. officials say 12-seconds later-- the deputy found the car and it had rolled over several times-- landing on the roof and trapping the driver. the driver died at the scene and his name is not yet being released. investigators are still trying to figure out why he fled from the initial traffic stop. (vicki) on the peninsula... police in palo alto have released a sketch of a man who they say attacked and robbed a man last weekend. officers say he was one of three men who approached the victim while he was on his phone. it happened as he was walking on a bike path just south of downtown. the man in this sketch is said to be the one who pushed the victim on the ground and punched him. the three men took the victims phone and other belongings before running off near downtown. (vicki) residents are on edge after a spike in home

burglaries in various neighborhoods throughout hillsborough. police say may of the burglaries happened while people were out of town for the thanksgiving holiday. they say the thieves are breaking windows and doors to get into the home. in most cases- the homes didn't have security alarms installed. police say there is evidence that links some of the burglaries to the same thieves... and that the men all wore hooded sweatshirts. (grant) in the north bay... santa rosa police arrested a man for assault and vandalism --- using a sword. you're looking at pictures of the damage. it happened just before midnight last night on west 9th street. police say a man with a sword went up to the victim's parked car and tried smashing the windows. when another person tried to intervene, officer say the suspect hit him in the leg with the sword, causing minor injuries. the suspect has been identified as 32-year-old brian rivas-lagunes. he was booked into the sonoma county jail. (gra) today, mississippi voters are choosing their next u-s senator -- in a race that's been mired in controversy. kron4's ryan o'donnell joins us with more on today's big day in the south. republicans are rooting for incumbant cindy hyde- smith... while democrats hope mike espy takes over this highly contested sete seat. originally, it was thought senator hyde-smith was shoe in... until her character came in question. pictures of her posing with confederate memorabilia a the emergence of this video of her telling supporters she'd attend a public hanging,sen. cindy hyde-smith / -r- mississippi: "anyone that was offended by my comments i certainly apologize." if he wins, espy would be the state's first black senator since reconstruction.mike espy / -d- mississippi senate candidate: "if i'm lucky and

(grant) another big story another big story tonight... following the state's deadliest and most destructive wildfire... lawmakers are taking a closer look at the state's emergency alert systems. lawmakers met with state and local emergency management officials in southern california today. kron 4's capitol bureau reporter ashley zavala explains what they're hoping to accomplish.. ((pkg)) trt:1:36((kim zagaris- caloes)) "we need a communications system, not just alert and warning, that is resilient and reliable for not only the public but for us in public service."reexamining the state's emergency alert system is now a focus for state lawmakers.tuesdays hearing comes on the heels of the camp fire... the effectiveness and use of the state's emergency alert system is under scrutiny after frantic fire victims were

it's a symbol of the christmas season... but this year a noble fir may be hard to come by. the pacific northwest christmas tree association says there is a tree shortage across the country. the organization blames the great recession in 2008. they say there was oversupply about 10 years ago and growers planted fewer trees to save money. the effects of that are now being felt around the country. the association warns shoppers can now expect fewer trees to pick from ... and higher prices for the trees they do find. they say you could pay ten percent more for a tree this year. following the debate over climate change, you have heard the warnings of the dire consequences of global warming, today a united nations commission reported that the u=s and several other countries are actually moving backwards.(grant) that's right: carbon emissions going up when they should be going down.and that's putting us on track for a global temperature rise of mre than three degrees by the year 21-hundred..(vicki) kron four's ryan odonell is here to break down the latest numbers. (ryan)this is how the world looks in terms of greenhouse emissions.the biggest... is china, the u-s, india, russia and japan.and out of the top five... four are in green, top five... four are in green,

meaning they're on track to meet their commitments to reduce emissions.and right now, the u-s and the european union aren't keeping up. (nat salmon in river)get ready to see less of this ... more of this(flooding nat)and even more of this ...(fire nat)and this.the u=n's annual report on emissions says even if the world's industrialized countries keep to their current goals ... global temperatures will rise by nearly six degress farenheit by the end of the century.that means california's wildfire and drought cycles will get even worse.salmon may disappear from the northwest. farmers in the heartland will see crop yields drop as the temperature rises.east coast fisherman will find cod and lobster are scarce ... oceanfront communities will suffer from floods and beach erosion.in th south, hotter weather will make it easier for mosquitos to spread the potentially deadly west nile virus.to avoid that the temperature would have to rise no more than two degress celsius--three point six degrees farehneheit.and to do

professor. in a post last week... ford thanked supporters for their donations. organizers said the funds were to help cover the costs of travel, security and other financial hardships ford encountered ... when she accused justice brett kavanaugh of sexual assault during their high school years. despite the allegations against him, kavanaugh went on to be confirmed to the nation's highest court. (catherine) we've been honoring outstanding teachers in the bay area... today it's a math teacher in marin... chris french teaches at san andreas high in larkspur.. it's a 'continuation' high school...where he helps students catch up on the credits they need for graduation. chris is described as 'exemplary' -- and a fantastic mentor not only to the kids he works with -- but to his teacher colleagues. he's plays a key role in planning student and staff activities and was a big contributor to helping san andreas earn california model school status this past year..

"i immediately checked my fridge to see if i had any romaine because i like it, but i didn't have any." "all the sudden its bad and it's like ah what am i going to do?"the c-d-c first issued the food safety alert two days before thanksgiving."my wife threw out some of the lettuce we had that was in our refrigerator and most of the stores have taken it off the shelves so that's what we did and we didn't have it for thanksgiving."and ever since stores have been clearing their shelves.it's called a clean break where all producers and distributors get rid of contaminated lettuce and provide clear labeling to show people the lettuce's date and origin. the f-d-a says you
