suggested today that president trump is trying to avoid the partial government shutdown later this week. the biggest issue lawmakers are not agreeing on is funding to build a border wall.... one of trump's campaign promises. press secretary sarah sanders didn't commit to any specific plan to get that funding... but she said agency leaders are being consulted. "the president has asked every one of his cabinet secretaries to look for funding that can be used to protect our borders and give the president the ability to fulfill his constitutional obligation to protect the american people by having a secure border. so we're looking at the other options."(vicki)(vicki) earlier today sanders indicated the white house could support a bipartisan senate bill that funds homeland security... and could avoid a shutdown. hit t-v show 'laverne and shirley'. she also went on to direct some cult classics like 'big' and 'a league of their own'. marshall came from a well-known hollywood family which includes her brother, director garry marshall. the comedienne was also an avid sports fan. tom hanks, who grew up in the east bay and starred in a couple of marshall's hit movies, tweeted: "goodbye, penny. man, did we laugh a lot! wish we still could. love you." funeral arrangements for penny marshall have not been announced. the city of san jose is trying to reign in theproliferation and operation of e-scooters. (vicki) kron four's rob fladeboe has the details for us now live from san josecity hall. rob? there are at least two thousand e-scooters deployed across san jose, most of them here in the downtown area. while serving as a convenient and economical form of transit, some scooter riders are causing problems. they are putting others at risk says mayor sam liccardo.sam liccardo/san jose mayor "...we are hearing from hospitals from san francisco to austin to san jose of the many injuries resulting from scooters, particularly those that are operating at high speed and on sidewalks..."the mayor says the new policy considered by the city council tuesday is not about stifling innovation but to rather impose some regulations that would keep thescooters out of bike lanes and off busy sidewalks. one idea is a technology called "geo fencing," similar to what helps grocery stores keep track of shopping carts.sam

parents, teachers and health professionals from the u-s surgeon general-- doctor jerome adams is warning about the spike in e-cigarette use in teenagers. adams issued an advisory about the negative health consequences of e-cigarettes today. he says one out of five high school students is currently using the product. the problem spreads to those even younger. one survey reported a 50-percent increase in vaping among middle school- age children. adams says no amount of nicotine is safe. the chemical can do particular damage to young brains... because they are still developing. adams warns that the epidemic of vaping could contribute to-- quote-- "a whole generation addicted to nicotine." opioids offer little chronic pain benefit and wane over time. the results come from a review of nearly 100 randomized trials published in the journal of the american medical association. the analysis found for adults with chronic pain, opioids offer narrow improvements over a placebo for pain and physical functioning, on average. and those benefits also tend to decrease over time. the analysis comes as federal agencies and other officials in recent years have been cracking down on opioids prescription. (vicki) a rarity in walnut creek. late last week, a condo offered at below market rate closed escrow... it sold for less than half what similar market rate condos are going for. kron four's philippe djegal spoke with the realtor who finished the deal... he explains how few of these units are available and how you should prepare if you plan to apply for one. walnut creek was listed for sale in late october, and realtor brian pastor with keller williams realty says it closed esgrow is less than six weeks.... after, only two open houses.brian pastor/realtor- "i had just shy of 100 folks that came through on those two days. now, we did receive 17 offers on the property." but eventually a young couple -- who are both educators -- got the place... the large response to the unit was the result of it being offered through the city of walnut creek's below-market rate affordable housing program. brian pastor/realtor- "it could have very well been double. you know, now we have other units here that are also one bedroom, one bath. and, one recently sold for $435,000." the city of walnut creek has a stock of only 40 to 50 below market rate units. but none are available. once people get one, they typically don't leave. eligibility is based on income -- in this case, the two people who applied had to make less than 72-thousand dollars combined to qualify. and, in general, in order to apply for a b-m-r unit, you must be a first time homebuyer.brian pastor/realtor- "the three steps in order to get into a bmr -- you want to make sure that you're pre-approved with your bank. uh, you want to look at your finances. uh, you want to make sure that you understand your credit. and, also, very important with a good realtor that you trust."

common chemicals found in toothpaste, shampoo and other personal care products may be linked to early puberty... and that exposure can come even before the children are born.... that is according to a new study by a team of uc berkeley researchers. kron four's terisa estacio spoke with the lead researcher about the findings and what it means for young girls. (take pkg) a special team here at the uc berkeley extension branch pioneered the study... the group with the center for environmental research and childrens health focused on whether in utero exposure to certain chemicals such as

parabens or phtalates could lead to early puberty in girls... dr. kim harley, cerch. we found that it did, that women who used products had higher levels and those higher levels lead to girls going into puberty earlier then boys. dr. kim harley says the concern is that early puberty can lead to certain medical issues for girls. dr. harley. it can lead to cancers, reproductive problems. dr. harley says - the team looked at 600 women and tested their daughters between teh ages of 9 and 13. the study is still ongoing... dr. harley. we need to do more, but it is invaluable, it can be information that we can make better choices for us and girls for better health. in berkeley, terisa estacio kron four news. ## (grant) next at 5:30... scary moments for ##news. kron four terisa estacio kron four news. ##

one was sunday afternoon -- when the roommate of a 19-year-old man contacted police saying he was unresponsive. when officers arrived-- the man was found dead in his room. the second death happened yesterday morning when officer responded to reports of a possible drug overdose. police say they administered narcan-- but they were unable to save the 67-year-old man. (vicki) developing news tonight... we are learning new details about last months ferry crash at san francicsco's ferry building. the crash caused an estimated 325-thousand dollars in damage to the ferry and the dock. drugs and alcohol test results from the crew members have come back negative... so impairment has been ruled out as a factor. the coast guard says the investigation is months away from being complete. the goldlen gate ferry.. the company that operates the ferry service is also conducting its own investigation. minor repair work to the terminal is ongoing. lawrence karnow: it was partly

events a surprising a surprising turn of events in a d-c federal courtroom today. president trump''s former national security adviser michael flynn will now have to wait until march to learn his legal fate. karin caifa has the details on the high- profile sentencing hearing, and what happens next. after drama in a d-c federal courtroom tuesday -- michael flynn -- exiting the court with his sentencing unexpectedly postponed until at least march -- his attorneys taking up an offer from the judge.judge emmet sullivan, had harsh words for flynn, telling him -- "i am not hiding my disgust, my disdain for your criminal offense" -- and seeming to suggest he would end up behind bars.michael zeldin / attorney, cnn legal analyst: "i think flynn's lawyers felt and they took this time out -- that flynn was going to get jail. the judge felt it was so

(vicki) a terrifying moment for a texas family. the parents of a four-month old boy say a man hacked into their nest wi-fi camera network, pretending he was going to kidnap their baby. the family filed a police report and authorities are investigating. jacob rascon reports. topper rigney gets all the love and care you would expect

recall -- adam brothers farm - - is voluntarily recalling red and green leaf lettuce... as well as cauliflower, "out of an abundance of caution." none of the recalled products has tested positive for e-coli-- and no one has gotten sick from those products. the recalled cauliflower and red and green leaf lettuce were harvested between november 27th and 30th... and distributed to several states. the c-d-c recently linked romaine lettuce grown in northern and central california to an e-coli outbreak that sickened about sixty people. kron 4's dan kerman has more on why there will be no civil trial to determine if the sheriff's deputy who shot lopez... crossed the line. at a news conference tuesday sonoma county sheriff rob giordano announced the county had reached a 3 million dollar settlement with the family of andy lopez.sot rob giordano/sonoma county sheriff :08the reason for a settlement is a 13 year old is dead and the right thing to do for the community to move forward is to settle the case. lopez's family filed a federal civil right lawsuit against the county after lopez was shot and killed by sonoma county sheriffs deputy eric gelhaus back in october of 2013... at the time lopez was walking down moreland avenue south of santa rosa carrying what looked to be an assault rifle .. in fact, it was an airsoft bb gun. the settlement means there will be no trail. i hope its a beginning for the family to move forward.since the shooting the sheriff says the department has improved its outreach to the community.in

(ken)the national weather service confirms a tornado touched down near port orchard, washington today. that's across puget sound from seattle.take a look at the damage caused by the twister. the kitsap county sheriff's office calls some of the damage "catastrophic".there are no reports of deaths or injuries from the tornado.but authorities say there are active power lines down and gas companies are checking for leaks.the national weather service will send a team to the area tomorrow to determine the strength of that tornado. it's believed to be just the second tornado ever to touch down in kitsap county. announced a lawsuit today ... against a litany of prescription drug makers and distributors -- for their role in the opiod epidemic. the suit was filed on behalf of the city and the state of california. it accuses the makers of drugs such as oxycontn and fentanyl .... of misleading doctors and patients. and wholesalers such as the san francisco- based mckesson corporation ... of failing to monitor and report suspicious drug sales. the state department of public health says, opioid addiction caused the deaths of more than 21- hundred californians last year. the suit asks for damages for the costs associated with treating the opioid epidemic .... and asks for an injunction to stop alleged misleading marketing tactics. a new study examines the effect of closing one of the east bay's major emergency rooms. the report was commissioned by the institute of regional development at u-c berkeley kron4's haaziq

found in toothpaste, shampoo and other personal care products may be linked to early puberty... and that exposure can come even before the child is born.... that is according to a new study by a team of u-c berekely researchers.. kron four's terisa estacio spoke with the lead researcher about what it means for young girls and what can be done about it. a special team here at the uc berkeley extension branch pioneered the study... the group with the center for environmental research and childrens health focused on whether in utero exposure to certain chemicals such as parabens or phtalates could lead to early puberty in girls... dr. kim harley, cerch. we found that it did, that women who used products had higher levels and those higher levels lead to girls going into puberty earlier then boys. dr. kim harley says the concern is that early puberty can lead to certain medical issues for girls. dr. harley. it can lead to cancers, reproductive problems. dr. harley says - the team looked at 600 women and tested their daughters between teh ages of 9 and 13. the study is still ongoing...

president trump's charitable foundation is shutting down amid an ongoing lawsuit. that's according to a document filed toda.. y by the new york state attorney general's office. the dissolution of the charity resolves one element of the lawsuit -- which claims, the president and his children..... violated campaign finance laws and abused the foundations' tax- exempt status. and the shutdown does not signal the end of the lawsuit against the foundation.. the new york a-g still wants nearly three- million dollars in restitution, plus penalties ... and a ban on trump and his three eldest children... serving on the board of any new york non-profit. unified school district has put a hold on plans to remove a controversial mural in koreatown. the school district had said it would paint over the mural -- but after artist shepard fairey threatened to paint over his own mural of r-f-k in protest -- the district is now saying it will instead continue the conversation over winter break. at issue -- the distinctive rays eminating from the center of the mural. korean activists say the motif is too similar to the japanese imperial flag.chan yong jeong, wilshire community coalition:"it's in the middle of koreatown on public school, not private property, and the sun ray thing, from koreans' view it looks so similar, enough to remind us of the rising sun flag."//butted to// beau stanton, artist who painted the mural:"i think that the district made a decision based on a perceived route of least resistance. they just wanted the problem to go away. and now, it's kind of backfiring."
