before we leave you this morning by 10:00am pockets maybe remaining along the coast to later this morning or even in the early afternoon. temperatures thus far we're in the mixture between 50's and 60's a lower 61, the east bay shoreline already antioch at 62 and for comparison sake most of the real estate is actually ahead of where it was this time from yesterday. the breakdown for you we can't take care of this morning, fog clouds by 11:00am we're mostly sunny at 70 79 by mid afternoon, the temperatures are going to revisit the 80's in those inland valleys of looks like for today, but the real earnest warm-up doesn't get here until the middle of the week we'll be talking all about that coming up in just a bit back to you. all right sounds good. thank you dave a developing story that we're following from overnight. >>take a look at this video another fatal officer involved shooting leads to a fiery protests this time in atlanta. you're taking a look at the that was burned down saturday where shark brooks was killed in that parking lot friday night and now we're learning that the officer who shot him

has been fired it all happened when officers found brooks asleep in his car. in the drive-thru lane and when they tried to arrest him that led to this confrontation that you're watching right here you can see the officers they were wrestling with him then they start chasing brooks and he grabs officer's taser and runs away. officers chased him brooks then appears to fire that taser at the officers that's one of the officers shoots and kills brooks as we mention that officer has been fired and the atlanta police chief has resigned. brooks cousin spoke about the video of his cousin being shot take a listen. i just think for me the most hurtful thing for me is to watch the video waco austin video. >>and what i got they see the this one hurts so much. i just i thought john was hired in beginning it. >>well coming up in about 30 minutes. we have much more on the shooting and the protests

that its part. >>new this morning police unions in san francisco and san jose of unveiled new reform measures to try and help root out racist officers kron four's ray harvey live in san francisco. she has all the details on this rain a good morning. >>good morning. marty this recent action by unions follows protest of police shootings of black men and women along with the cry to defund the police department so the union coming out stepping up and they're putting out these potential reforms that they would like to see take place we're going to show you a breakdown on your screen right now of those reforms starting with they'd like to create a database of officers that were fired for misconduct. also they like to implement a national use of force standard. they also like to create an early warning system to identify media training. also they want to make sure officers undergo crisis intervention and de escalation training and also

they want to create a use of force analysis website. that's going to allow the public to monitor win. and how use of force is used now those unions including san francisco, san jose and also issuing a joint statement acknowledging that there are races police officers and the unions are committed to finding and getting rid of these officers. now again we still would like to see a timeline of all of this and. >>this also still has to be approved, but they're playing out these initial steps. now reporting in san francisco right now harvey kron 4 news all right, thanks a lot for that live report we'll check in with rain throughout the morning robin. >>well to the east right now more than a 1000 protesters were shouting say their names in unison as they march from oakland to berkeley. >>honoring black people who've been killed by police over the years, demonstrators marched from the rock ridge bart station to sproul plaza at u c berkeley standing in solidarity with the black lives matter movement. >>i've i lives matter. and we're not saying and the other

lives don't matter we're saying that our lives are just as important it's not just enough to say things and not just enough to correct your family and that we have to take action and go out and confront our government systems and these people that are that are oppressing. >>members of our community. >>more than 1000 people took a knee and shared a moment of silence in honor of the lives lost at the hands of police. >>the demonstration remain nonviolent. >>there are now more than 7 million cases of coronavirus around the world and more than 430,000 people have died. according to johns hopkins university, the u.s. currently has more than 2 million cases and 115,000 to use me more than 556,000 people have recovered from the pandemic in the u.s. and here in the bay area were seen nearly 17,000 cases and so far 493 people have died. the virus has hit

alameda county, the hardest with more than 4200 infections. and 109,000 deaths. we have a complete list on our website at kron 4 dot com. >>well for the for first time in 3 months san francisco is allowing people to dine outside of restaurants, we checked out north beach yesterday. where we saw more traffic than we've seen in the past few weeks ilkka sorrow pizzeria that was one of the restaurants that reopen customers order from their phones and temperatures are checked before every shift. the owner was able to reopen thanks to the city shared spaces program now that allows businesses to set up tables outside on the streets. >>been great suits feels like it's a new is a new grand opening the new governor, i strongly by the come see you and we often yes, and there's bbc to there again another green i it's really great it just feels like. >>side and as you enjoy the city finally so much needed

the weather forecast as we take a live look outside from walnut creek of this time around days for us here with the forecast. hi dave hey, good morning morning, good morning, everybody and first light we're also getting from the golden gate bridge show lots of fog going on this morning, the fog trap is really well in place and a little bit of drizzle to pass over the bridge to just a touch. >>again this all mixing out in the next couple of hours and will be shifting back to mostly sunny, here's the fog cover by 1030 you can see it's going to linger along the coast. so that may be a little problematic even into the afternoon hours we may not completely get rid of that we have a little bit overcast marine layer kind of hanging around a little bit. temperatures now are pretty much in the upper 50's lower spiffy 9 going on livermore 62 antioch 61 conquered and hayward 62 for oakland and 58 san francisco, but on the satellite the radar picture you can see that the heavier weather is still far up towards the north we get this this marine layer. we'll get some scattered clouds tomorrow which will show you just a bit. but on balance this is kind of just our marine layer

that snapping up here giving us that fog and some of the drizzle also going on this morning, future cast for there's the clear-up job i think we're going to have fog problems along the coast so look for kind of a mostly cloudy appearance going on today and even some parts of the city might even experience that as well may be hard to look these clouds. now you can see by this evening looks like the clearing happens nicely. it doesn't really seem to redevelop tonight except some upper level, scattered clouds just a touch into tomorrow afternoon to make note of this is just the lane the warm-up are going to wait for until the middle of the week that's when numbers ale is not here yet and really the footprints of it getting in place you can't see as well as the winds that really tells you the tale here. now later on today we see the uptick of winds but late overnight look at this 02:30am heavier winds going up here in the north bay in the east bay and we did the same process in the monday night look at the real estate covered by monday evening just about everybody, this is when the high starts to take over. as we go into the middle of

the not enough for a wind advisory, but certain will kind of breezy there as you can see well into the overnight monday into tuesday morning a little bit. so we've got going on here is clearing and mild to warm 80's are back in land breeze is going on tonight we sure showed you are in the week a few clouds and still breezy upper 70's for the bay 80's going on in london for the weekend, middle 90's far inland valleys, it looks like that's wednesday thursday all of the high reaching its peak and then minor cooling as we head back into the weekend for today 69 as skies improve windy, 75 for oakland, 79 meanwhile for san jose. however, the will be some token 80's to be had in the far east asia will notice and up to the north bay as well, but still mixing it out was still some 70's. we don't really get that surge happening until mid-week well look at that extended forecast in your 4 zone in just a bit back to you all right, thank you dave. well police have detained a man in connection with 6 suspicious grass fires in the north bay. >>the fires were set overnight

friday in adair and larkspur check out the photos here 61 year-old eric larsen was detained after witnesses saw him in the area of a fire at larkspur plaza. the first 3 grass fires were in the quarter moderate marsh area saturday morning a fire was sparked on larkspur his blue rock neighborhood, 20 homeowners nearby had to be evacuated. then a short time later 2 more cross fires broke out nearby. firefighters quickly detain them and no one was injured. well in fresno county take a look at this crews are battling 3 brush fires near pine flat one of them is the hog fire. so far it has burned 600 acres, it's only 10% contained as of this morning. authorities are asking residents nearby to evacuate fire broke out friday afternoon in the area of a lakeview marina, several structures are believed to be threatened, but so far no injuries reported. and no word on what caused that fire. and here in northern california

firefighters are working to put out the grants fire. it's burning in sacramento county while battling a blaze of firefighter rescue the calf and a fine you see right there in the photo this is captain mark below holding the fun and cal fire says that the animal is under observation for smoke inhalation they believe it's going to be ok. the cat has been reunited with its herd and so far. the grand fire has burned over 5,000 acres and is only 65% contained. >>precautions were in full fuel view as a president trump spoke to graduates in the u.s. military academy at west point saturday afternoon. >>his speech comes as the cdc gives new guidance and coronavirus cases climb in more than a dozen states karin caifa reports from washington. >>rivera president trump at west point speaking as part of a socially distant commencement. >>thank you for answering your nation's call. >>more than 1100 new graduate of the u.s. military academy listen to the president while wearing masks pace at least 6

totally robin marty good morning. good we do have a little bit the way of a breeze that's going on today, we'll see more winds going on later on this afternoon, however, so. >>we'll see that today tomorrow because this high that's going bring us some real warming weather come the middle of the week has to kind of position itself right now we have this really thick marine layer, no kidding a look at the fog look at the cloud cover we're dealing with this is all this low level moisture spewed on in across the bay area that has to mix out now so give a little time to do so model say it will do so most of the weather traffic remains up towards our north. we have some scattered clouds tomorrow little little bit more aloft but on balance is that marine layer we have clear out upper 50's lower 60's over most the real estate for right now the bottle with 6162 for oakland, 61 for hayward in again kind of a hodgepodge of 60's and upper 50's as we look inland. so for today, 70 looks like by 11:00am by 2 at 79 we're going to be dabbling in to some of those 80's we'll show you what areas or get there on our 4 zone forecast coming up in a

bit and checking into that extended forecast which has some big time warming by the middle of the week back to you all right dave, thanks a lot in case you're just joining us. we want to a refresher is top story this morning. the death of a black man at the hands of police reignited protests in atlanta saturday night, hundreds of people attended that protest they blocked a major interstate a fast food restaurant was set on fire. >>and authorities responded with tear gas the community asking for justice in the death of her sharp brooks dianne gallagher has more from atlanta. >>protests grew in atlanta last night over a deadly police shooting a new name being chanted rashard brooks fatally shot by police at a fast food drive-thru in atlanta. protesters shut down an entire interstate and set fires at and near the wendy's restaurant were brooks was killed friday night. >>earlier police used tear gas and flash-bang try to clear

the area. >>the georgia bureau of investigation says police were called around 10:30pm friday night about a man sleeping in a car in a wendy's drive-thru. police say that man brooks failed a field sobriety test and then resisted arrest in video taken by a bystander you can see a struggle. according to the gbi the yellow object in the officer's hand is a taser eventually brooks appears to swing at an officer before taking off with the taser wendy surveillance video released by the gbi kick-off for that video ends what you see is brooks running from the police at one point he appears to turn back towards the officer and discharged the taser before turning back around and continuing to run. brooks was shot, taken to the hospital where he died the gbi said choose attorneys representing family spoke out last night's why not talk to him as a human being and say hey buddy made you have too much to drink.

>>leave your car here take over. i've seen it happen before. but they didn't have instead they got physical. he ran. he did have the taser but according to law tasers not lead the wet. so he didn't have legal weapons and he was running with the taser and then they shot, it's just it didn't need to happen. garrett. rolf the police officer who shot and killed brooks has been terminated. >>atlanta police spokesman carlos campos tell cnn the second police officer devin brosnan has been placed on administrative duty and the police chief is stepping down. >>we need to change the culture of policing we need to evaluate how we train we need make sure police not only of support to communities that they are they have a duty to protect and serve. but in any case they need to be in the community that they have to do is protect to serve a cousin of brooks yesterday. i think about his right human. i thought this little bit in it.

400 block of brown's lane in a rural on current unincorporated area petaluma and we'll have any updates for you as we get them in the newsroom. santa cruz police are looking for whoever vandalized the mission santa cruz during a recent protest and march that march wednesday night was in the area of mission plaza park and holy cross church. police say that someone vandalized the mission with graffiti using red spray paint profanities were written on the mission walls and also on its memorial plaque. santa cruz police are asking anyone with any information to give them a call. >>and one person was hurt in a senior housing complex fire near japan town in san francisco check out the location on the map here it happened on the 6th floor of a building near pine and octavia last night, everyone was forced to evacuate, it's unclear how seriously the person was injured. but officials say that their condition is stabilized the cause is under investigation. well to the east by now fremont police have arrested

this man dennis aquino on suspicion of ransacking of fremont home friday afternoon. a resident says that she heard noises in herfhome and she went downstairs to see the home ransacked in a man running away officers tracked down a key know who was booked into the santa rita jail. he's on probation for a vandalism and he and stay away orders from several locations in the city of fremont including the area where he was arrested. >>coming up this morning protests over the death of a black man who was apparently lynch does body was found hanging near city hall in palmdale and that's sparking some action. and we'll take a live look outside very light traffic the bay area toll plaza at the bay bridge and cloudy skies.

>>welcome back the city of palmdale in los angeles county is supporting an independent investigation and autopsy in the death of robert fuller, a black man who apparently was lynched in found hanging in a tree near city hall. greg mills reports. >>100 here in the park where his body was found. what they really want. our answers. >>it's like her brother robert fuller found hanging from a tree in this park across from city hall early wednesday morning authorities originally said it was an apparent hundreds here at the park in

honor of fuller. the sheriff's department homicide detectives are investigating his death. i don't want to make about race, but i don't feel no black man is going to go hang yourself, especially when times has going on right now. >>i really believe it was actually a city of palmdale heard the demand for an independent autopsy. and an independent investigation. and told fuller's family they support that he says depp in the right direction or i feel like it is tommy anderson joined in this call for answers, this is really this friend but for somebody 3. >>for a black man to be hung in a tree near city hall that's the message brandi where and her husband brought their kids here to hear the message we wanted to show them that people can gather together peacefully to show that they want justice for somebody who was done unfairly the rally started in the park where fuller died. >>they marched about mile to the palmdale sheriff's department a couple deputies

heating, but it's with us during the night and particularly late afternoon tomorrow. and tomorrow night into tuesday, this is all partially with this high pressure that's kind of positioning itself in the right spot because we're increasing pressure like this this change is driving some winds. after that's all said and done we'll lose the winds by mid-week temperatures start to climb which you see that extended forecast and we're going to go back to the 90's for those inland valleys today though it's 80's 86 for fresno 83 bakersfield, 65 big bear. so cal's and make sure some 70's with the central coast. and the mixture of 60's 83 by the way for sacramento, little bit this disturbance is we're dealing with just this marine layer wrinkle right now on balance though the next couple of days as we're in the middle the week obviously high pressure is in place it does weekend into the weekend. as we can of the first day of summer by the way on next saturday. however, no major system trapeze is through to give us a really good earn a shot of rain course is getting

>>happening tomorrow shoppers will now be able to indulge in some good ol retail therapy, but with some adjustments of course westfield mall in san francisco is reopening tomorrow. it's been closed since the shelter-in-place order back in march, so it's been a while since we've been able to shop there right. the mall is requiring all customers and employees to wear a face covering, so don't forget. the mall has also installed sanitizer stations in the common areas and social distancing reminders throughout the center. well also opening tomorrow is westfield valley fair in santa clara, this isn't a shopping center. one of my favorites. they will be opening with new modified hours mass will also be required at the times the mall are open and they will be increasing cleaning on all high traffic areas they will also be monitoring and controlling the number of guests entering the mall so keep that in mind you may have to wait in line a little bit to view their new operating hours you can go over to our website. we have a list of for you on kron 4 dot com.

>>well business owners in san joaquin county are excited to be reopening but county officials say they might have to close again if covid-19 cases continue to search one winery in lodi opened its doors to customers this weekend kristi gross was there and talk with visitors. >>eat drink and be merry michael david winery opened its doors to customers again this weekend. it's our first time here in a long time because they've been mostly closed. winery had been serving customers through online orders and drive-thru pickup spun out there serving them by the bottle with outdoor dining the next best thing right now spacey to. >>serve the food with lines of people already know conor michael phillips says he thought he would be able to reopen its tasting room friday as parts of the state move into phase 3 of reopening that he and longtime customers were disappointed to learn don't have to wait a little bit longer take what we can get right now. >>and we just have to be patient for. >>the county to open up for the actual tasting and get back to semi normal we're happy that there be careful

coast. this will be problematic. i think i don't think point raise going to obviously much the way of sun and all today up there. temperatures thus far in the lower 60's some lower 50's working in here bit 65, antioch up to the north bay upper 50's lower 60's 59 for san francisco 62. san jose and most of the real estate we're actually ahead of this time where we were yesterday. temperatures will warm though a little bit more so in those inland valleys expected. we're going about 79 say about 3 o'clock another feature throw in here particularly late in the day is some winds building. that's going to be today tomorrow or talk some about that in the 48 hour forecast as well back to you. all right, thank you dave. >>a developing story that we're following for you from overnight, another fatal officer involved shooting leads to a fiery protests. this time in atlanta, you're looking at a wendy's that was burned down saturday rush art brooks was killed in that parking lot friday night and now we're learning the officer who shot him has been fired. >>it all happened when officers found brooks asleep

in his car in the drive-thru lane. then they tried arresting him and that led to the confrontation. you see now officers wrestling with brooks he then grabs the officer's taser and runs away the officers chased him. brooks appears then to turn and fire the taser at the officers. that's when one of the officers shoots and kills brooks as we mentioned that officer has since been fired the atlanta police chief has resigned and now we're getting a look at police body body cam video of the incident and the moments that led to the confrontation. >>go back to sleep okay all right. and he stepped out with from a kitty any weapons on your anything like that i don't have anything or is okay, but that's down to make sure.

>>now this again is body cam footage you can see the officers approached the car brooks is sleeping and waiting at the drive-thru. they conduct a field sobriety test and when the officers figure out that he's had too much to drink and shouldn't be driving. then they tried to arrest him and that's when you saw that confrontation escalate we will have much more on this shooting incident and the protests that followed in atlanta coming up in about 30 minutes. bringing it back to the bay area and new this morning police unions in san francisco and san jose, veiled new reform measures to help root out racist police officers kron four's rana harvey live in san francisco with more on this rain. >>marty morning this recent move by unions follows protests of police killings of black men and women along with a cry for defunding of police departments across the bay area so again. the union told

by presenting these this will help root out racism throughout the department so take a look at your screen. here's a breakdown of what they're proposing. they want to create a database of officers fired for misconduct. they also want to implement a national use of force standard. >>along with creating an early warning system to identify needed training. they want to make sure officers undergo crisis intervention and de-escalation training along with creating a use of force analysis website that then allow the public to monitor when and how forces use now those unions, including san fhancisco and san jose also is issuing a joint statement acknowledging that there are races police officers and that the unions committed to find and get rid of these officers now again these are all proposals and they still have to be approved. we're going to be looking into a timeline when all of this will be potentially implemented the for now reporting here in san francisco. reyna harvey kron 4 news all right ray thanks for

we're taking a look at the sfo this time around a bit of a fog there, but no delays this find out more about today's forecast from days far. hi, dave hey, good morning marty good morning, everybody and i got more fog here this the golden gate. yeah, this is the fog trap. so we always like to watch it for clearing out, but at least i can make out the southern tower here going on so at least did see some sun to come through they're starting to tap. yes, sir, but right here we see some sun trying to come through just a little bit so we're moving to a mostly sunny mode, here's the clearing of the fog we see going on later on this morning except at the coast and that's going to be a problem area. i think we're probably got the call that kind of a mostly cloudy day for the beaches. temperatures thus far we're in the upper 50 some lower 60's 65 antioch 62 coming in for conquered 59 for livermore there aren't any major systems dropping south we do have a high that's building later this week. but it's us marine layer, the comes wishing on in it's the lower level moisture so the sun comes up on top of us here. it heats the ground that starts with the drier air aloft. if we had clouds a lot to be a little harder now we

in san francisco. it happened on the 6th floor of a building near pine and octavia last night everyone was forced to evacuate. it's unclear how seriously the person was injured. but officials say that their condition is stabilized the cause is under investigation. well to the east bay now fremont police have arrested this man dennis, aquino on suspension of ransacking a fremont home, a suspicion of ransacking of fremont home friday afternoon. a resident says that she heard noises in her home and she went downstairs to see the home ransacked and a man running away officers tracked down a key know who was booked into the santa rita jail. he's on probation for a vandalism and has to stale has stay away orders from several locations in fremont including the area where he was arrested. >>in the south bay this morning santa clara county now calling for everyone to more coast closely follow social distancing and safety measures after a new string of coronavirus cases at construction sites 10 confirmed cases and more than

this time in atlanta, you're looking at the windies that was burned down saturday re shark brooks was killed in that parking lot friday night. and now we're learning the officer who shot him has been fired. >>it all happened when officers found brooks asleep in his car in the drive-thru lane of that wendy's they tried arresting him and that led to the confrontation. you see there. you can see the officers wrestling with brooks he then grabs the taser from the officer and runs away. the officers give chase brooks that appears to fire the taser at officers. that's when one of the officers shoots and kills brooks as we mentioned that officer has since been fired the atlanta police chief has resigned and now we're getting a look at police body cam video of the incident and the moments that led to the confrontation. >>go back to sleep okay all right. and he stepped out with

morning. >>good morning. marty we know this recent action by unions follows protest of police killings of black men and women along with that cry to be fun, local police departments now the union feels like this is a way to root out racism in the department, but we want to give you a breakdown. what they're proposing so take a look at your screen right now. they want to create a database of officers fired for misconduct, they also want to implement a national use of force standard and want to create an early warning system to identify the media training. we also want to make sure officers undergo crisis intervention and de escalation training. they also want to create a use of force analysis website. that's going to allow the public to monitor when and how forces use now these unions including san francisco and san jose are also issuing a joint statement acknowledging that there are races police officers and the union's commitment to fine and get rid of those officers. now

city's name on the november ballot. well police have detained a man in connection with 6 suspicious grass fires in the north bay. the fires were set overnight friday in corte madera and larkspur check out the photo 61 year-old eric larson was detained after witnesses saw him in the area of a fire locks for plaza. the first 3 grass fires were in the quarter mudder marsh area and then on saturday morning, a fire sparked in larkspur is a blue rock neighborhood, at least 20 homeowners nearby had to evacuate and then just a short time later 2 more grass fires broke out nearby firefighters quickly contained them and no one was injured. >>in fresno county crews are battling 3 brush fires near pine flat one of them is the hog fire. it's burned 533 acres so far it's just 25% contained. authorities are asking residents near the fire to evacuate. those fires broke out on friday afternoon in the area of lakeview marina,

here, here's us live shot coming in from u c berkeley and although it's lifting a little bit we can see the east bay shoreline. it's still quite a bit of that fog cloudiness that's kind of lingering around little bit that's just localized really aloft not much is happening. it's pretty much the traffic is going way above us as you can see from west to the east. however we'll have this high pressure starts to build by the middle of the week and that's going to start to see those temperatures do some moving by the time we get to wednesday or so for right now the progress stands as the u.s. mid 60's line of the east bay shoreline 64 up to santa rosa 66 for nevado 61 meanwhile for san francisco. we have 68 for any aac 64 for san jose and we're pretty close to where we were from the temperatures yesterday don't want to kind of stands out little bit as fairfield at 7 degrees ahead 3 degrees ahead for san jose. but with this fog keeping temperatures kind of corrected her overcast is what it looks like for now slowing our progress 77 is expected by 1 o'clock by 4 at

atlanta last night over a deadly police shooting. >>a new name being chanted rashard brooks fatally shot by police at a fast food drive-thru in atlanta. protesters shut down an entire interstate and set fires at and near the wendy's restaurant were brooks was killed friday night. >>earlier police used tear gas and flash-bang try to clear the area. >>the georgia bureau of investigation says police were called around 10:30pm friday night about a man sleeping in a car in a wendy's drive-thru. police say that man brooks failed a field sobriety test and then resisted arrest in video taken by a bystander you can see a struggle. according to the gbi the yellow object in the officer's hand is a taser eventually brooks appears to swing at an officer before taking off with the taser wendy surveillance video released by the gbi kick-off for that video ends. what you

the video in this case. this was the scene saturday afternoon as hundreds of people flooded the streets on foot in their cars from the valais host city hall to the vallejo police department where they were greeted by officers in right here. they hit the streets demanding justice for sean lowe to justice for sean monterrosa and other victims of police brutality and those killed at the hands of police back on june second the 22 year-old monterroso was shot and killed, but the legal officer jarrett on as monterroso was kneeling in had his hands raised as officers were checking out reports of looting at the walgreens according to police time thought that i hammer that monterrosa had on him was in fact a gun turns out that it was not a gun. family members and lawyers continued to call for time to be prosecuted saying there was no threat. for officers and that no shots needed to be

no delays being reported for this morning's at least that's good news there. temperatures thus far we have 60's on the board for most of the real estate 59 meanwhile for half moon bay that's the chilly spot in a may be tough to really shake this fog off this morning or even throughout the day today along the coastal areas, here's the uptick in terms of the winds that we see going on by this afternoon and lingering overnight. both tonight. tomorrow night as we get into monday as you can see. tuesday morning and still having some winds. this is the repositioning of high pressure now we don't see any wind advisories that are with all of this, but at least it will be kind of breezy in spots throughout the next about 48 hours to 36 hours. highs today, 82 going on for a bigger still 86 for fresno sacramento, 84 central coast in the 60's and we have the mid 70's down to southern california. happy to pass this little wrinkle here. it's pretty much smooth sailing with obviously the high in place but even as it breaks
