rothman. new details tonight in connection to the police shooting last night in san jose. police say the gunman started shooting into the ceiling of a restaurant on center road. officers also had word he man shot someone outside the restaurant, but instead they were unable to confirm that information. and when officers arrived on scene, the gunman was still armed. >>officers attempted to de-escalate the situation, giving the suspect commands to drop his weapon. but the suspect did not comply. the suspect then pointed his gun at the officers causing 4 officers discharged their weapons at the suspect striking him more than one time. >>both the chief and the mayor credited officers for putting their lives at risk and preventing a greater tragedy. and starting off the season with a win. the forty-niners beat the new york. just 32 to 19 tonight. a big boost to the red and gold. but some of the faithful were not so happy about some new tailgating rules. kron shaq moments shots

dairy farms in the central valley. california is now the 14 state in the country with confirmed avian flu cases affecting dairy cows. this includes farms in colorado, texas. and just today, more cases spiking in michigan. for more on this, i spoke with doctor terry lee and bauer of veterinary medicine at uc davis. as of right now, it's not exactly sure how it when from birds to cows, especially here in california. but with your background and your knowledge, what do you believe may have been the case? >>yeah, it does seem based on the genetic analysis that's been done, the information that has been shared by those scientist and a case that it was probably a single unique at that or the first. transfer from birds. dairy cow. and then all of the subsequent infections that we've and other dairy cow herds across the country in the affected states. there's been from from

originating from cows are from people working with those cows. and we don't have any evidence that there's been a different. virus that's been introduced in the cattle from a different bird exposure. so all the evidence currently points to the fact that this was a single unique event. and then there's been secondary spread from dairy cattle after that initial event occurred. >>i mean, and what are the symptoms? it's not as deadly as it is for birds. correct? >>right. so. it's called highly pathogenic. wasn't because of students and at a am domestic poultry oprah did not back to. diseases your front carol. it reduces very low death rates, but the cow become sick. become lethargic depressed. you stop eating

exhibits for the public so they can see that. but as you mentioned, they have to take into consideration the risks that might create for closure of cattle and for people. so i i think, you know, that decision that they made is similar to what other regions of made to reduce or eliminate that particular situation so that we can manage that risk more effectively >>and for it to go state to state like this, it's possible that differing cattle shows or i'm just bringing cows from state to state and may have made a jump from the cows and made it spread. so believe that quarantine for these california dairy farms? are there a case just like when we had the pandemic for us, humans, we had to quarantine to make sure didn't spread. this is similar, correct. >>so that's correct. so affected herds that identify are quarantined by the state department of agriculture and

firing shots into the air and at the suspect had shot one individual outside the restaurant. authorities say it's unknown why the gunman identified as 50 year-old robert rivera sent us a shot. another man in the parking lot. that man is now being treated for critical injuries at a local hospital. the chief says when officers arrived on scene, rivera was still armed. officers attempted to de-escalate the situation, giving the suspect commands to drop his weapon. but the suspect did not comply. the suspect then pointed his gun at the officers causing for officers, the discharge their weapons at the suspect striking him more than one time. rivera was treated at the scene and pronounced dead a short time later at a nearby hospital. now officers are learning more about we're learning that the suspect had a strange himself from his family was drinking heavily and it may comments regarding suicidal ideations. employees at the restaurant stated he'd been drinking heavily at that establishment. by all accounts, we believe the
