has filed a wrongful death lawsuit against the driver involved and a crash that killed her back in april. kron 4 sarah stinson has an update speaking with the attorney representing the family. she reports from cupertino. >>a walk home from a park turned tragic for a cupertino family. 11 year-old monte qatari was among 4 children walking in the bike lane when investigators say a truck plowed into them on april. 27. >>not he was walking back from a park near her home with her sister and her 2 cousins that were visiting from india and her father and her grandfather were walking with them. just several steps behind. they legally walking in the bike lane because there wasn't a continuous sidewalk. qatari died at the hospital a couple days later. >>her family has now filed a lawsuit against the driver of the truck. sima bought is the family's attorney. i don't know if i can. >>overstate the hole that's

been. left in the heart. nike's parents. >>but says mall, he's younger sister and cousins, ages 8, 7, and 4 suffered serious injuries. she also fears of the emotional damage done to te children. her sister watched. >>older sister die right in front of her eyes, >>all these all the children have suffered the santa clara county sheriff's office identified the driver as 38 year-old adam. she in lieu of cupertino, was arrested on suspicion of driving under the influence of drugs. but so far has not been charged with the crime. the family is also suing grandparents who owned the truck involved but says they should not have loaned it to him when he was unfit to drive. according to our investigation. >>he had had at least one dui in the past and he did not have a valid driver's license at the time of this incident, but says they're in the process of filing another lawsuit against the city of

cupertino in hopes that it will make this stretch of road safer for pedestrians and hoping that by this lawsuit we can help effect some change because this should not happen again. and if it if there are changes made in this can absolutely happen to anybody. i reached out to the city manager of cupertino as well as the santa clara county district attorney to see if there's any criminal charges being filed. but i did not hear back in time for this report. meanwhile, this civil lawsuit will have to work its way through the courts. >>i'm sara stinson reporting in cupertino. kron. 4 news. >>well, that's just one of the many side shows that people are concerned about it. in san francisco today, mayor breeze legislation to combat those sideshows and the reckless driving along with it was approved by city leaders. the new laws will increase criminal penalties for those

who plan and participate in sideshows making it illegal to prevent law enforcement from disrupting sideshows and more law enforcement will also expand strategies to work with regional partners on preventing the scheidt shows including cars and dirt bikes. the legislation will go in front of the board of supervisors for a second and final vote next week. and tonight, outrage from the oakland police officers association out mayor sheng thao and her executive order to remove homeless camps. it requires the removal of tents from anywhere they deem is hurting critical infrastructures, such as sidewalks and parks. the police officers association is calling the order a, quote, last-minute political son before voters decide whether to recall her this november. the says they have not been notified of this plan, especially since the police department is a big element and actually removing the homeless encampments. in a statement in response to the vice president of a sergeant,

officer, michaela accusing him of retaliation, abuse of power, discrimination and bullying. it all comes just weeks after her office was put under investigation for allegedly being a toxic environment. hours after sunday's press conference, a board of supervisors responded to the sheriff saying they would take an appropriate action and that executive calatayud rejected those claims made by the sheriff. happy to do an open investigation. they also added that he's been with the county 41 years ending their statement saying, quote, unless proven otherwise the board will remain united in its full faith and trust in his leadership. this obviously upset the sheriff leading her to put out a statement saying, quote, it sends a clear message when you raise a complaint in san mateo county as a woman, you will be dismissed. we spoke with residents in the county regarding the situation. take a listen to what their thoughts were. >>i can't be sure on either side. i have to say the dismissal of for 3rd in command was a little suspicious. but i have to wait to see what happened. i don't necessarily disagree with the

mean, it really is offering businesses that com sign leases some pretty big incentives. how much are we talking about here? >>that's right. so for new businesses moving into our downtown, we will be basically 0 business tax for 2 years and free parking. now that's meter. we're doing 2 free parking spaces for every 1000 square feet least. but these are pretty meaningful incentives. and we hope it attracts more companies to lease space in our downtown. >>so we want do that because of why. what is it that you are hoping will be a payoff for the businesses that are in downtown santa say? >>well, first and foremost, you know, those getting those office workers back to downtown's are just critical for supporting the small business ecosystem. it's estimated that your average office worker spends about $195 in the vicinity of their workplace each week. that's

$195 per office worker going directly into the small businesses. the restaurants bars retail, the different entrepreneurs and small business owners who are providing amenities in downtown core. so it's a driver. i also just note that as we get those businesses established, they will grow here after that 2 year holiday from the business tax, they'll businesses that sign a 4 year or longer lease. so we're basically giving them a discount up front, but hopefully locking in their activity and and that tax base in the long run. >>so i was like a good coupon you know, and send those of this nature and so for us. so what do you think? have you reached out to city council members about getting this approved tonight? >>wearing support, it's actually coming to the council october first. so we're old. we're about the staff memo. we've got all the details of the plan. it will come to council one week and i'm i'm

fairly optimistic. we'll get there. what we've seen in downtown san jose is an incredible rebound nights and weekends. we're actually at 120% of pre-pandemic foot traffic nights and weekends in downtown san jose. but like all downtowns across the country, we're still struggling with high commercial vacancy rates downtown. so this is one more tool at our disposal to get those businesses to take another look at leasing space in the downtown core. >>what about mayor? as far as the sun is a moment now, we know that that was unveiled with a lot of fanfare. has that been successful? has it brought more people downtown? >>those are doing really well. so that program is essentially our small business pop-up effort where we have negotiated lower leases with landlords who have had long-term vacancies for storefronts downtown. and then move what first-time entrepreneurs and to start new business to test the concept.

and with a little bit of support from the city to see if they can become viable. so that's been sort of a small business pop-up for those to be viable in the long run, though many of them will need more office workers. so it's really about building ecosystem. it all started a year and a half ago when i first came into office saying we're going to focus first on being safe and clean. we have the safest, big city and safest downtown of a big city in the bay area. we're going to going to be clean. we've invested our ground works team to address graffiti and illegal dumping or enforcing our pedestrian facilitation zone and have pd walking patrols and bike patrols. now we're starting to bring in and refill those storefronts with small businesses. i think the last piece is getting those office workers there to sustain those small businesses, a case over talking about businesses, 50 employees that would save the company $40,000 of the next 2 years. >>600 employees estimated savings of $500,000. now, if you take that out of the

general budget for santa's word, is that money? then therefore be offset? how are you going to pay for that? yeah, great question. so that the benefit of focusing this incentive on attracting new business is that we are losing any revenue. >>when we have vacancies, as we do today, that's revenue. we're not getting. and as those businesses come back, we will immediately see a boost to city revenue because they'll be spending money and we collect sales tax revenue. so while we will forgo the business tax for 2 years. it's it's not tax that we're collecting today. and there's there's really no general fund impact there. in fact, we'll see increased sales tax revenue because we'll have more workers downtown. >>very good. thank you very much. we look forward to following up on the i believe you said october first, right? that's a city council meeting. okay. that's right. in

capitol hill are looking into the failures that lets the botched rollout of the free application for federal student aid program. house committee is hearing from the government accountability office about the mistakes that led to more than 400,000 fewer applications this year. washington correspondent maddie beer-temple reports.

>>under 4 million missed calls and education botched that in 432,000, fewer fafsa submissions later representing an overall decrease of 3%. the government accountability office says the department of education's new fafsa launch hurt lower-income students the most. these are the families that need education to help achieve an economic future. the g a o shared findings from its new report on the fafsa rollout. it described delays and website problems that weren't fix for months. example, if you're born in the year 2000, you simply couldn't proceed. the report also found the department knew there could be delays as early as august 2022. but didn't announce that for 7 months. regrettably. >>implementation of the law has been derailed. >>both republicans and democrats expressed concern about next school year's fafsa period. it's already been pushed back to december.

now let's turn to credit card giant visa. the department of justice filed suit against visa over allegedly unfair practices in the debit-card market. according to the doj visa for more than a decade entered into exclusive agreements with merchants and banks that restricted them to visa zone processing network as opposed to say the mastercard or discover networks visa allegedly threatened to impose higher fees on merchants if they went with other payment networks. visa process. nearly 4 trillion dollars in debit card transactions in the year through june and generated over 7 billion dollars in processing fees. these are the climb to comment on the doj is lawsuit. its shares were down 5% today. back to you.

relocated to washington. i was involved a few years earlier as running the expos as an executive and with the marlins before getting the stadium built there, i'd threatened relocation and became instantly unpopular with the fans in miami. and i think the first thing you have to do is you have to make yourself available. and john just hasn't done that and it can be hard for owners to do what they don't like being criticized. they're very thin skin. shockingly. but when you say in the letter that you wish that i could speak to all of you individually, well, you could you could have spent way more time meeting with fans and walking around your ballpark. and he just hasn't done that. i get it. but then there's no reason to say in the letter and also to say that we tried. i used to say we tried also and the answer is i did try. but i also know that i don't want to say it in those words because you could succeed anywhere by putting more money into a stadium deal. and that's something he didn't want to do. and i don't blame him for a business standpoint, but then don't rub the salt in the wound. so

gives public schools until july first 2026 to come up with their own set of rules. the main reason for the law to help students focus on their studies, improve their mental health and encourage more face-to-face social interaction. the law does allow for students to use their phones during emergencies or if teachers or doctors say it's ok, cell phone use among teens has been linked to depression, anxiety and cyber bullying in july. la usd approved its own cell phone ban during the day which starts in january. users of the russian-based anti virus software, casper ski found a surprise on their computer. a new anti virus application called ultra a v according to the website bleeping computer. there didn't seem to be much warning for the switch and in many cases the program installed itself overnight, causing some users to believe it was malware. v says its customers were notified by email in early september. the

>>yeah, we've got that fog that has moved in along the coastline. so yesterday we're talking about some 70's right along the coastline. well, that all changed today. the low clouds and fog surging onshore really kind of deepening as we head toward the afternoon. that's we've been inside the bay and that's going to set the stage for tomorrow. we've got some much cooler weather on the way. so i know they were looking at the fog along the coastline, but it's still a blistering hot in some spots inland. in fact, in little more than 102 degrees, well above the average 97 and hot in concord. 95 and hot in santa rosa. 93 in hot in san jose. 83 in oakland and 75 degrees in san francisco. but things are changing now. we've got low clouds and fog that are surging onshore. likely to see

some drizzle along the coastline early tomorrow morning for everyone. i think a cloudy start to the day. then some sunshine in the afternoon, but only partial clearing and then cooler temperatures all around. some of these numbers are good 10, maybe 15, maybe even 20 degrees cooler. what we had today. so, yeah, we're going to see the cooler weather kind of settling in midweek, then warming back up a little bit into the weekend. 58 degrees now pacifica. 59 in san francisco still warm 72 degrees and conquer. not that cool. marine air has not settled in there yet even 80. and brent, what 65 degrees in fairfield. but that's going to ramp up as we head through the night tonight. more that fog is all the way. so we're going to see plenty of the great stuff. the good news is the air quality improving old with onshore wind. and we're going to see that as we head through the next 24 we trough of low pressure, going to be diving along the coastline. that's going to kind of ramp up that marine. they're bringing more fog and some cooler temperatures to go with. in fact, models picking up some of the drizzle overnight tonight along the coastal sections as we get toward tomorrow morning. watch out. maybe a little slick on the road coast side as we head

through the day started breaking up and then the fog really come surging back on shore as we head toward the afternoon numbers break down like this. we've got 60's in the san francisco. 59 degrees in daly city. some drizzle out toward the beaches inside the bay about 60 in burlingame about 65 degrees in san carlos boer, me up to the south bay should be very pleasant afternoon. generally in the 70's, couple low 80's where you have some triple digits in the tri valley today. so much cooler there by tomorrow afternoon. but still on the warm side, 86 degrees and brown about 77 in fairfield back along the coastline, keeping the 50's. and here you go, your tenant and the temperatures kind of bottom out tomorrow, then start warming up a little bit on thursday and friday, high pressure likely to move those temperatures back in the 90's on friday and saturday, but not real hot and then cooling back down as we head in towards sunday and monday. and as we get an october, the temperatures look right about average for this time of year. >>and as the mlb regular season winds down with both the giants and a's out of the playoffs. both teams are just hoping to finish the season strong. we'll start oakland tonight with the a's are
