stephanie rothman. tonight we start in san francisco where police are investigating a shooting in the mission. this is video of the scene shared on the citizen app. there you see police received reports of shots fired shortly after 8 tonight. that's in the area of 9th and mission streets. there's no report of anyone injured, but officers have detained a person. police say this is still an open and active investigation. we will update you as more information has become available. now. switching to weather, a taking a live look now outside at the downtown san francisco. looking like a nice night out there. it was another warm day as this october heat wave continues. kron four's kathy trafton is in the weather center tracking a cool down kathy. days and days and days as brought record-breaking temperatures to places. >>such as san jose last couple of days, 106 degrees there. that's 103 a couple days ago. and you know what? the heat continues. oh, yes, it was

cooler today, but it doesn't exactly feel cool. does it? >>and the air quality isn't so good either. poor air quality in the east and the south bay, moderate air quality in the north bay. no wonder there's a spare the air alert in effect. >>temperatures right now, much cooler along the coastline. 50's and 60's in the inland spots. still, we're seeing some 70's at this late hour. these numbers are way cooler than they were last night at this time down 10 degrees santa rosa compared to last night down 3 in concord and down 7 in oakland. well, the heat advisory continues and there was a heat. excessive heat warning that will be allowed to expire for the north bay interior areas. but that'll be replaced by heat advisory and that heat advisory continues for everybody. >>all the way through 11 o'clock saturday night. yes, it's a departure from normal where you see the reds, it is hotter than normal way hotter than normal. that's for tomorrow. that's for saturday. so we have warm temperatures continuing into the weekend

and then finally come early next week, you see the lighter pinks. that's slightly above normal, but not as exceeding the hot, even some areas of gray. so we do have some hint of relief come next week. tonight, a judge's ruling says it's unlawful for the san francisco sheriff's office. do searches without a warrant that's for people arrested and awaiting trial before this decision, a judge could play someone arrested on electronic monitoring program. >>some people wearing these ankle monitors are now accused of serious felonies. part of the program is searching homes without a warrant. if necessary. sheriff. >>i've had the difficult task of running a program that strikes a balance between public safety, ensuring the constitutional rights of the accused. i'm extremely disappointed by this recent ruling. >>city officials say they will appeal this case. an animal shelter in the east bay may have to soon close down

caltrans, which owns the property, says they need to land to stage equipment for project on i-80 kron four's. sara stinson shows us how community members are coming together to help the shelter. >>right of highway 80 in san pablo lies a safe haven for cats and dogs will get your home. i permits julie bainbridge has dedicated the last 7 years, sir. her animal shelter, jellies place. right now. we have 196, i believe. >>yeah. and 60 of those are capped. the rest are large and small breed dogs like this little girl right the shelter uses donations and grant money to take in stray cats and dogs and provide free vaccines as well as spay and neuter services. they also rescue dogs from kill shelters over in fresno. one of puppy comes in injured. they would euthanize it when it comes in the door. don't know how that happened. but as you can see, he's quite healthy. in fact,

>>welcome back to kron. 4 news at 11, 30 on stephanie rothman as the death toll continues to rise from hurricane helene, president biden toured storm damage in florida and georgia thursday. kron four's washing correspondent maddie beer-temple has details on the federal response. >>so far at least 200 people have died across 6 states from hurricane helene and almost a million homes and businesses are still without power in the southeast. >>president joe biden flew over florida's coast to see the damage left by hurricane helene. he was briefed by officials before heading to georgia to view the damage there. administration has had a personnel working this from day one transportation secretary pete buttigieg says the federal government has thousands of people in place to help with recovery, but he says more funding will be needed for the days ahead. we will not be able to do all of the work that has to be done without help from congress. neither florida nor georgia's republican governors joined the president's visit.

new report malley's deadly wildfire last year was caused by broken power lines. >>atf investigators say broken utility lines cause sparks a fall from a poll surrounded by an maintain brush. the report later says crews put out the initial flames, but unfortunately the fire then reignited just minutes after the crews left, then a lead to burning of more than 2200 structures. the maui fire was one of the deadliest in u.s. history so far, killing 102 people. tonight, 3 former memphis officers have been convicted in the deadly beating of tyre nichols. the 29 year-old who was originally from sacramento was killed in january of 2023. this was during the month-long trial. jurors repeatedly watch clips of the police officers beating nichols and the traffic stop that preceded it. medical records show nichols died from multiple blows to the head. all 3 officers were convicted of witness tampering related to the coverup of the beating but were later acquitted of

the harshest of those charges. they face nichols death. 2 officers face up to 20 years in prison. the 3rd up to 10 years they had faced up to life in prison if convicted on the harshest charges. san francisco police are now sharing body cam footage of a controversial street vendor arrests from september. the arrest went viral on social media and the video shows officers handcuffing a woman has her young daughter cries. we want to warn you, it may be difficult for some to watch. the video is about 10 minutes long in this clip. you can see the vents are in a struggle for her hot dog cart with a man wearing a yellow vest. sfpd claims the woman eventually hit the city worker. but the video does not clearly show that happening at the end of this video, officers are seen talking to

witnesses. what one is claims. someone told the little girl to cry in hopes it would make the officers leave. the woman was medically cleared and later released. the parent company of supermarket chain safeway is ordered to pay millions for overcharging customers. a complaint filed in marin county and joined by alameda and sonoma counties accused the grocery chain of false advertising and unfair competition charging items for more than their lowest advertised price. the complaint also has that safeway scanners at checkout charged more than what was advertised as well and item sold by way, such as me produce and baked goods also had less than the package than what was labeled safeway will now have to pay 4 million dollars to settle this lawsuit. >>happening now, eastbound lanes of 5.80, on the richmond, sandra fell bridge are closed again tonight. the repaving project that started last night. it will continue through tomorrow morning at 07:00am, but it's not completely done just yet

the governor's office is now responding. >>this group of black leaders from across california making their voices loud and clear outside the governor's office in los angeles. they argue he has not done enough to advance reparations for descendants of enslaved black americans. i am disappointed that key reparation bills have been stalled or blocked. they say they're specifically frustrated after members of the california legislative black caucus last month opted not to advance to reparations bills by senator steven bradford, including one that would have created the california american friedman affairs agency in charge of overseeing the reparations process in the state and another that would have funded future reparation related policies approved by the legislature. and governor. this was the scene inside the state capitol last month when members of the community found out the black caucus would not advance senator bradford's 2 bills. caucus leaders announced they made that decision after the newsom

administration wanted to make changes to the legislation to turn it into a two-year study looking into how reparations could work in california. >>but camilla, more who chaired the california replaces task force for the last 2 years since the task force already did that submitting this 1100 page report of reparations recommendations to the governor and legislature. >>the time for studies is over for its part. governor newsom's office points out just last week he signed several of the black caucus is priority reparations bills into law including one requiring grocery stores to notify communities before they closed down in another, creating a formal apology letter from the state of california to descendants enslaved black americans. but those here say for now they're skeptical and apology without material reparations. not only fails. >>but exactly exasperate harm. we demand a public apology after reparations. real reparations are enacted. critics have pointed out the state cannot afford direct

someone arrested on electronic monitoring program. for more on this and other bay area, legal matters. kron four's vicki liviakis and graham lotus, boca legal analyst michael cardoza. >>as city officials that the sheriff in san francisco thinks that the public is less safe without the option to have these ankle monitors on some suspects as they await trial. he also thinks that the jails are going to become more overcrowded because you're not going to the option to let these folks out in the public with the ankle monitors while they await trial. okay. what say you? well, there's a federal judge that said if you let them out on the ankle monitors. >>you cannot search them. and sheriff's write homes and them the their persons and their whole that person's on their home. you can search him. well, the sheriff said, wait a minute, they're in custody. technically right. when you're in jail, they can search you when you're on the monitor, aren't you? technically in jail? so why can't they search

you? i don't think this judge, federal judge. thought it out because i can pretty much tell you what's going to happen. still up in number one, they're going to stay in jail or you're going to have a judge that said, well, wait a minute, i would normally let you add in the bracelet, but we can't search you. so i'm just gonna all are you and let you out with no condition or we're cognizant. so let them out on their own with no conditions at all. and that's what happened. commit a crime. absolutely. and that's why i'm saying this makes no sense to me because again, they're technically in custody. they're given a break. if you were at if you are doubts, the people in jail. all right. you have a choice. we'll put you out on the ankle monitor, but we're going to search you or you stay in jail. what your choice you say? search away, guys? let me out of here. so i would imagine the people in jail aren't real happy with this federal judge and he's going to back up the jail or

like i say, there's going to be some judge that's going to go wait a minute. the new bail laws say i've got to let you out there. more liberal. so i'm just going to let you out without any condition that also like waiting to ala is that's why i say this federal judge, in my opinion did not think this out very well where they're going appeal it now. imagine. but these guys are jail or out an or which puts us. we the public and about situations. so i don't see where that yeah. it's gonna that. another interesting story. san jose player, brooke slusser joined a lawsuit. >>that several female athletes filed in georgia. and this has to do with transgender player on that she says that her teammate, blaire fleming, told her that she's transgender >>not laughing about. i'm laughing at the fact this school didn't tell the players. we're letting a

you're going to let them play with women. that's tough for me. i know a lot of parents that half girls in college is saying a plan with my daughter. you could hurt her. even though we want to be fair, we want to be inclusive. the ncaa has to use a little more common sense here. maybe another leg. i don't know if there are enough transgenders to do that or rural sports? i don't know. but it just doesn't make any sense to me or a lot of people that you let a person transgender with male attributes with that strength going against the woman that doesn't have that. now, look at the other side. you have woman that wants to be can think she's a man and she wants to transition into that. i mean, that causes all sorts of problems. are you going to let them, for example, played college football at division. one level that's not going to happen. they could get hurt horribly. and from what i understand, i was talking to

an attorney and my office scott, who is and we have a very good discussion about that. and she brought up some good points. she was telling me that there are men or women rather that want to become transgender and they take the steroids and they take. all of that. but they don't still gain the strength of a man, even though they want to be a so how are they going play with men? it's just. ncaa has to do some. i don't know what the answer but i do know you're putting people at risk and you're putting women and horrible college position. women. that have to change in a locker room with a transgender. that's still a man. lot of people get up in the air about that. when you know you get started, they call people well, your purse access to a gun. no, no, no. we kind of use common sense here. so ncaa has to bring

years or 20 years or life. so the judge looks like the crime's severity of the crime right age and they put it in the particular site that next whole lot more sense to may. and the judges real news were misdemeanors. keep in mind reduced from felonies and santa clara counties, very conservative and i trust them to take cases and go. all right. this really isn't that the felony level, even though cases are pushed. but an emotional cases where when people are you molested a girl, you know it everybody goes off the deep end. the judge looked at the facts, the da down there and that's very conservative office reduced from a felony to a misdemeanor and they put those conditions on. i leave it up to the judge and the da down there to make those decisions. you know, there's a super visor their right. and if he doesn't, he gets dragged back into court and the judge will toss them in jail. do you didn't listen,

pretty intense fire that started outside and spread to an attic in livermore this week, video shows crews putting out the flames at a home in the spring town neighborhood. they say the fire started wednesday afternoon and then spread to 2 other homes. but crews were able to thankfully prevent significant damage to the second home. fire officials say no one was hurt. and officials in alameda county announcing a conviction against a former county sheriff's deputy. devon williams is accused of killing a married dublin couple back in september 2022. police say williams was having a romantic relationship with the wife and now he faces 50 years to life in prison. sentencing is set for next month. an animal shelter in the east bay may have to close down caltrans, which owns the property. it's on says they need the land. the stage equipment for a project. they're going to have on i-80 kron four's there since then shows us how community members are now rallying together to help the animals.

hurricane helene is driving up demand for blood donations. the american red cross is issuing a now and appeal for donations, but also volunteers kron four's vicki liviakis spoke with a lick, the regional communications director for the northern california coastal chapter of the american red cross about their relief efforts. >>so what is your organization doing right now to help people who are impacted by the hurricane? >>you know, first our hearts go out to all those that are they've been affected working around the clock to make sure folks basic needs are being met. we have multiple shelters open across the states that are affected over 1300 responders there, including 30

from northern california that are helping with feeding helping with mental health health services of refill prescriptions for people who had to evacuate their homes. >>you know, we're we're hearing this thing could such a wide swath of what, 500 miles and, you know, million people or more are affected. this really taxes. yeah, everyone's ability to to deal with the situation. what's the toughest part of the job right now? one week after after the storm. >>so working around the clock to make sure those basic needs are being there's definitely needs all across the board and just kind of the work that we're doing 2 to do that. they're only able to do that with volunteers that are able to deploy for for those 2 because of the generosity of donors that make it happen. and our partners partners are truly magic and everything. so americans have really big hearts. you know, know that people have been saying, hey, you know, what can i do to help? >>you know even going there to

help. but that's put the brakes on what's the most effective thing that people can do? folks are able to deploy for 2 weeks. there is some training that we have to do. we understand that's not for everybody. it's possible for going to drop everything and deploy for 2 weeks making a financial donation allows us to make sure that the sport is getting there as well as blood donations as a result of this. the storms, they cancel hundreds of blood drives. >>and need for what is constant. so communication has been a real we hear that people, you know, they're cell service is down. >>what are you hearing on the ground from your people? >>yeah, we were feeling was that resilience from people? you see the best in people during during these times. it's obviously difficult times in our shelters are seeing folks who are all going through the same thing together. we have those mental health volunteers that are there to talk to those very difficult times and support people through the recovery. >>so for you on the coast here, you know, the biggest

>>the time from ulta wine is just around the corner. but right now farmers are not happy about how hot their grades are getting. as reporter dennis shanahan shows us the weather is just one of the challenges. local grape growers are now facing. >>makes it a challenge to. make sure you have quality fruit. tom irwin of merwin vineyards in clarksburg is a 7th generation farmer is also the owner of silt wine company. he showed us some of the damage of the heat is causing the south that have been exposed. the sun right here. it's i mean, they're they're basically they're basically raisins. now as soon as the forecast for this week became clear, growers started doing what they could to protect the crops. we immediately started to irrigate again, but it's been a really hot summer already. there's been it's been record record heat over 100 degrees in july and august

>>you know, there's only so much we can do is from a farming side to cool the vineyard downer, keep the plant healthy. it eventually all those all those days of over 100 degrees really take a toll on the planned. in some cases, growers have to choose whether to pick the grapes before they've had a chance to fully ripen. >>or leave them on the vine to struggle up and become worthless right now to salvage what they can. growers are harvesting in the coolest hours of the early morning before the sun comes up, grapes picked on a hot afternoon by contrast might start fermenting on the way to the winery. the weather is just one headwind in the industry right now. wine makers are also facing dwindling demand. there are a lot of >>wineries that are struggling to sell wine. we've consumption grow, you know, the past 25 years. and, you know, this is one of the first years that we've seen on a massive decline consumption overall nationally where one says younger adults in particular are not drinking as much wind as an industry. we have to find a way let them know about products. so it's
