>>welcome to kron. 4 news at 11:30am, stephanie rothman. more fallout tonight over alleged public intoxication involving an alameda city council member. some fellow council members are now taking sides. and this all started with a trip to long beach for work conference. that's where body cam footage from long beach police shows alameda city council member trish cara spencer on the ground. some city leaders argue herrera spencer needs to be reprimanded while others say she was a victim. kron. 4 shock moment has more from both sides. >>long beach police body camera footage shows the moment when officers found alameda city council member. trish, however, spencer outside a bar, you can see she's on the ground and after police say she was denied entry to a bar for being too drunk, her name tag still around her neck from a convention earlier that >>you know, i was in long beach for the league of

california for new city's annual conference. the mayor of alameda was also at that same convention in october and says she found out about the incident next day. you know, first, i just felt a lot of sadness for my council colleagues in then disappointments, mayor marilyn ezzy ashcraft says she has not heard from councilmember spencer's since the incident but has now written a letter to be read at the next city council meeting to publicly reprimand spencer over her conduct in long beach after going to a conference paid for by taxpayers really be the first step in a in a process >>acknowledging or no calling to the attention of a council member that their behavior. >>was not in accordance with city council code of conduct. councilmember herrera, spencer argues that she was not drunk, but rather was attacked and even potentially could cost a statement provided to kron 4 news by the council members,

fred reads, quote, the videos showing trash at the scene of the incident and that the er do not provide any consistent evidence with intoxication. >>they are just as consistent with a concussion and other injuries that would produce shock. the council member also claims her jewelry was stolen vote. you can see her wearing some of it in the video. she also struggled to answer basic questions and through some slurred speech repeatedly says she's fine with dementia. frankly, my first thoughts are, you know, maybe with an order is compassion. vice mayor tony day sot says there isn't enough evidence to say she's drunk and even says she may have suffered a stroke despite none of the officers on scene running any stroke assessments, this raise any suspicion on your mind. my focus is simply on on the issue of whether or not intoxication. >>was involved. and i just don't see there is no information produced by the city of long beach itself. now, we also reached out to councilmember spencer to find out if she filed a police report based off her claim that she had jewelry stolen.

we were told by her representative got no report has been filed as of yet. we are also 2, which is not expected to be at this upcoming city council meeting. were her fellow council members may vote to reprimand reporting here in alameda jacmel. but kron 4 news. >>switching gears to weather, a taking a live look now at the golden gate bridge. you can see the roads are wet there. it's a wet start to the weekend because the first significant rainfall of the season sitting the bay area tonight, we're going to switch over to kron 4 sheet meteorologist lawrence karnow who's tracking it all, lawrence. >>that rain coming down outside around the bay area finally clouding up throughout the afternoon. the rain moving in the north a first this evening and now it's just spreading across the bay area. so things are getting slick out there all around the bay area. now and a lot more rain to come. in fact, some spots already over half an inch. some of the mountains like mount tam, almost 3 quarters of an inch already. and so this is the storm system coming out. the gulf of alaska. really the second in a series of storms rolling into the bay area. you can see

coming in in the afternoon. more scattered around the bay area now, but a pretty good band of moisture moving through, especially in the north bay. but now it's more scattered about the bay area. now you see some of the cells coming in along the coastline. the pencil, you're seeing some showers in the south, san francisco more that on the way inside the bay redwood city. some scattered showers in your neighborhood. the not a whole lot just yet. but i think got a little more coming as we head throughout the night apart the east bay picking up the rain in san leandro and hayward also in the san ramon and further north, you get more rain. so it is going to be on and off throughout the night tonight, but not going to ruin your weekend. thanks, lawrence. >>well, tonight calls continue to grow for a san jose city council member omar torres to step down. he faces allegations of child crimes. santa clara county democratic party, joint city council members, residents and the mayor and calling for him to step down. mayor matt mahan explains how the city council will move forward. >>assuming it qualifies, that would be a yes or no vote.

>>almost a 3rd of children in california's foster care system end up out on the streets. and mayor matt mahan hopes this and another former hotel serving as temporary housing in downtown earlier this week can help strength a statistic. the oakland city leaders gathering today to highlight a drop in crime in their city. mayor sheng thao, along with the assistant police chief announcing a 33% reduction in homicides so far this year. they say oakland is on pace to record one of the biggest reductions in homicides in the city's history. mayor thao added opd is working with limited resources during all this. >>with the repeated property crimes and the burglaries in the right to break, stores. and what have you were seeing that this is a trend across the state and this is why the governor has implemented inside the state legislation around stronger penalties with retail theft. we have very minimal resources for our police department. for our department prevention.

>>but again, we wake up every day and we don't say we don't complain about how limited resources we have. we work with what we have right now. we know we're on the right track and we're working every day. getting more resources. >>the event happened today outside of saint columbia catholic church where crosses our place each year to mark the number of homicides in oakland. this is the first time since 2019 that the church says they're on track to make a less than 100 of them. city leaders say they remain committed to invest 8, okay, investing in public safety. a towing company in oakland and its owners have been convicted of illegal vehicle towing and tax evasion, private property in pounds and its owners will now pay nearly $500,000 in restitution to the victims whose cars were towed a legally. the defendants who pled no contest. more than $300,000 in back taxes, district attorney pamela price promise to deliver real financial relief to those affected. a claims process

election stories. and of course, the results on election night. tonight, a federal jury has convicted a former kentucky police detective involved in the death of breonna taylor. that's a 26 year-old died back in 2020 when louisville police forced entry into her home and opened fire assault member jury found brett hankinson guilty of violating taylor's civil rights. hankinson was also accused of opening fire during the 2020 raid. but he was not charged with the shooting and killing of taylor. this is the first conviction of a louisville police officer who was involved in the deadly raid. hankinson faces a maximum sentence of life in prison. switching gears now, it's almost time to turn back your clocks. daylight savings is this sunday and experts are reminding drivers to please be careful on the roads. aaa says there's a 6■% increase in %-pde

trends. >>with election day right around the corner, statewide, millions of californians have already cast their ballots. capitol correspondent eytan wallace has a breakdown of the early returns so far. >>yes, stay wide. we're talking more than 6 million ballots cast so far. it's been

about 4 weeks since county elections offices sent ballots to every registered voter in california. of the 22.0, 5 million registered voters in the state about 6.3 million have cast their ballot coming up to a turnout rate thus far of about 28%. those figures coming directly from political data, or pdi, a non-partisan voter information service tracking ballots and voter trends. things are looking as we expect paul mitchell is vice president of pdi. he notes of the ballots cast so far about haf are from registered democrats just under a 3rd are from registered republicans and roughly 20% are from no party preference voters. but now that in-person early voting centers have opened across the state. mitchell says gop voters are increasing their turn out. the voters voting in person are much more republican than the overall voting population so far. and so that is potentially a signal that a lot of republicans like they have

since 2020 are wanting to vote in person rather than using the vote by mail regardless of party. one of the striking trends he's seeing so far. >>older californians are out of voting. younger california more young people and seniors and the registered voter population. but when you look at who's turned in a ballot, 44% of the bounce and comment of come from seniors and only 13% of the ballots that have come in have come from younger voters. those 18 to 35 mitchell says he's also seeing similar trends among latino voters while they make up about one-third of all registered voters in the state, fewer than 20% of the ballots cast so far from that demographic. looking ahead, mitchell says the best plan for any california who has not yet voted simply to have a plan. there's actually been a lot of research on this. if you want to make sure that yourself and your friends and your family vote is, tell yourself what your plan is and get your friends and family to tell you what their plan is. one, somebody expresses a planned about their chances of turning out skyrocket.

headed southward, even the possibility of an isolated thunderstorm with little instability atmosphere out there tomorrow. there's a slight chance early on. then after that, partly cloudy skies and by sunday we've got sunny skies returning and some gusty winds. some of those offshore winds begin to settle scattered showers around the bay area. right now, some downpours being reported all around just widely scattered to santa rosa. they've had over half an inch already. still a couple raindrops to be had there continuing further south. we've got some more rain in toward bolinas mill valley. get a little bit of a break right now. mount tam u.s. had already about 3 quarters of inch of rain and county napa. some scattered showers there right now. and further south. we've got more rain in the oakland, san leandro, lafayette. you're seeing some showers in your neighborhoods and with hayward further south, the sunday mail against raindrops now milpitas just beginning to get some rain in the san jose. but it is very light there. and the santa cruz mountains picking up lots of rain. now a more to come throughout the night tonight. all right. the frontal system to get a pass on by now. overnight, still more scattered showers around

the bay area. the possibility of an isolated thunderstorm as we head toward around 2 o'clock or so. another wave moisture moving on through. and then as we head toward about 5 or so that will be right at the back end of the system and things begin to tail off. so if you sleep well, you probably wake up to some sunshine, some passing clouds tomorrow some cool temperatures around the bay area. rain totals. yeah, we're going to see some nice amounts. half an inch. plus in some spots more than that over some of the coastal range. do a really nice soaker. that is great news because on the way, guess what? we've got those winds as we head toward tomorrow evening starting to get more of a northerly component, getting a little bit gusty out there. then as we get into sunday. yeah, we got that offshore wind and more gusty winds kicking in. that's in the urban areas over the mountain tops, maybe even stronger than that. and then maybe another wind event as we head toward about wednesday of next week. so the hour. glad we got and here's what worry about. fire danger overnight. lows 40's and 50's highs tomorrow. generally in the 60's around much of the bay area. but it's going to be cool out there. you have that wind blowing in that make

francisco. police say a multi-agency investigation focus on a man who actively sells fentanyl in the area of 6 and market streets around 12:00am on tuesday. officers saw that man in the area and took him into custody. investigators served a sort a search warrant his home on oakland and found multiple opioids tools used for drug trafficking guns. that man was booked into jail on multiple related chart, gun and drug related charges. and police say they are continuing an investigation. the martinez refining company has agreed to settle for 4.4 million dollars for a legit clean water act violations. the company allegedly discharge millions of gallons of wastewater that harms human health and water quality. half of the money will go towards cleanup projects across the state and the other half will go to environmental projects that benefits bay area communities. and bart says is started working on putting in new fare

gates at the palace street station in san francisco. the agency says the installation will happen in phases so that riders can still use the current gates while the new ones are being put each new array will take around 2 weeks to complete. >>barr says the project should wrap up around december. >>agency says it's finished installing the new fare gates and 9 other stations. and the goal is to put new gates in all 50 bar stations by the end of next year. buster posey has made his first major hire since becoming the president of baseball operations for the giants today, naming zach missy in as the team's new general manager. he's been with the team for the last 6 years, most recently serving as vice president of professional scouting. and before that, he spent 14 years in the brewers front office. both minassian spoke to the media via zoom earlier on friday and talked about their plans for the future. >>and then here for the last 6 years, i think was important
