including governor gavin newsom who says it takes us back to the 80's with mass incarceration. among the proponents of the law, san francisco mayor london breed in san jose mayor matt mahan. that's one of many tools alongside problem care courts and building more shelter and more housing. but it's a really meaningful tools. and frank, that we've lot the kind of accountability to prop 36 will provide. mahan says californians can't afford not to pass prop 36. we faced 8 billion dollar. >>theft. >>tax, if you will. last year. that's about $200 for every person in the state. that's the amount of goods that were stolen and the state business owners say they hope thieves will now reconsider. if a crime is worth committing. people will think twice about committing the crime because the price too hot. offenders convicted under prop 36 will be required to serve their full sentence in state prison regardless of prior criminal history. prop 36 is set to go into effect by the end of this year.

>>i'm sara stinson reporting in the newsroom. back to you. will some disturbing new allegations tonight against san jose city council member omar torres. >>the embattled councilmember was arrested yesterday after another alleged victim of assault came forward against him. rob or shock moment brings us the very latest. >>the court documents we obtained are shocking of a detail that san jose city council member omar torres raped his own cousin when his cousin was just a young boy to when he was a teenager. that cousin told police he only came forward to talk about omar torres when he saw the recent media reports about an ongoing investigation into torres himself. torres was in court wednesday to be a rate. we are told he's being charged with 3 felony counts of child molestation. according to the court documents we obtained the victim recorded a conversation between him and torres talking about the crimes torres allegedly committed against him. we learned torres repeatedly raped his cousin at their

texas and san jose homes. while other family members were in the other room. this all happened throughout the 1990's. in their record, a conversation torres admitted to raping his cousin, calling himself a sick person and also profusely apologizing. mayor matt mahan addressed his colleagues arrest and highlighting the next steps will know the charter provides. 2 options which can be combined. one is an appointment, temporary employment to complete his term. the other is a special election with the option of doing a temporary appointment for a special election. >>chief paul joseph says since this case regarding torres cousin is so new and the department's ongoing investigation is still underway. there may be more news surfacing about torres with victims still out there. >>we also know that additional survivors are always a possibility. we have a responsibility to pursue those possibilities and reassure those who come forward that they will be supported. santa clara county district attorney's office also thanking assault survivors for

somebody up there likes what i larson says by good fortune. he returned home safely to start a family that still supports him to this day. they're the ones that have kept may gone. grand children, my great grandchildren. got a grandson who is a grandfather already. larson's wife passed away more than 30 years ago. since then he endured a stroke and heart attack. but he calls these medical miracles because he's never felt better as he nears his 100 and second birthday. i'm i'm sitting here telling things like this year. without an acre of pain. papa jake says he is eternally grateful for all his new friends on social media project. just love you guys. it's been one heck of a ride and you guys all make it so much more interesting. and as the world changes around him, one thing remains constant for papa jake. his belief in luck and resilience. talk about a lucky lucky man.

he's up to 3 years behind bars if they've committed theft, at least twice before. 36 would require those who commit certain felonies like selling drugs to serve time in prison and it's 3 or more people commit certain felonies, their sentences could be lengthened by up to 3 years. the sacramento county sheriff's office believes the measure would make our streets safer. we hope people will see this that there are actual consequences to these actions. >>effectively what it will do, you are going to see harsher sentences. you are going to see the arrest again climb. but >>you're going to see a drop-off because again, hopefully the folks were arresting are actually staying in jail. now, sacramento county da 10. hello has long been a proponent for the measure and says he's already in talks with community leaders to implement change if this officially passes. but i can tell you right now talking discussing our law enforcement partners with the county. >>with behavioral health to set up a plan to implement this. so when it becomes effective on december 18, no later than then.

>>this year's presidential election was an unprecedented, want to say the least to break it down further. a kron four's vicki liviakis and grant lotus spoke with sonoma state political science professor david mcewan. >>tribute very convincing victory, too. >>under performance all around. if you look at the total vote, let's just start there. you compare the total vote of 2020 this morning. that total vote was less than 90% of what we saw in 2020. we have more eligible voters. the

voting eligible population has gone up since twenty-twenty into 2024, the number should be higher. it's not. then you look at turnout across the board. and when you look at turnout across the board, you see things like 51% of suburban white women voted for donald trump, african-american males. that number was 8% for donald trump in 2020. it's 27% yesterday. that's a threefold increase. that's pretty big. and then you look at what has happened with younger voters and younger voters. joe biden carried younger voters 18 to 29 by 25 points. kamala harris carried them as well. but you carry them only by 13 points. and so we see a lot of differences there going on. and you see that underperformance, particularly in areas beyond the blue wall in all the swing states and that lack of performance also affected up and down the ballot. and what we don't know who's won the house yet. democrats did not perform well again because of that lower turnout number that we see overall, particularly in the battleground democrats in

>>yeah. i mean, right away. they prioritize taxes and fiscal kind of components. here's why the governor, there's a lame duck session that happens in december and they're going to put forward a couple different things that you might see a bill that's floated relative to a national abortion ban. that's all for kind of pomp and circumstance to kind of drive democrats whilst. but there will be issues related to funding the government because the government runs out of money on december. 21st, there will be issues related to the debt ceiling, the debt ceiling that happens. we reach that limit in the month of january. and then there's the issue of extending are revising the trump tax cuts. this is the famous bill of 2017 that gave were wealthy. a lot of money and that bill has to be changed and it has to be reauthorized are coming. some guys, it's going to blow up the deficit. so this is where having, if you will, the senate on your side and the house could be hugely influential or how extreme are strong or how big that tax cut

miles per hour at mount saint h red flag warnings. you'll notice san francisco. it's expired there. it's expired down across the santa cruz mountains so that's good news. we still have some winds up in the north bay. they decrease overnight and by 07:00am tomorrow morning. the red flag warning. will it be expired for the entire bay area? so the wind gusts, i really diminishing now. our thoughts turn to rain. are we going to get some? we need some drought monitor showing abnormal moisture at this point. but here's a ray of hope. first of all, you'll notice this area of low pressure. that was one of the big players in our really gusty winds last couple of days. it's going to finally leave. we're going to see rich start to really build in the offshore winds. all of a sudden turn onshore. so by the weekend, by saturday into sunday onshore winds, then all eyes turned to this big area counter clockwise circulation. we have area of low pressure heading toward us. and guess

what, by monday, there is our front. there's our chance for rain across the san francisco bay area. so it's going to be lovely precipitation outlook for the next 6 to 10 days slightly above normal. so we could see a few extra raindrops forecast highs for tomorrow numbers mainly in the 70's and then a look ahead shows the extended forecast. sunny, sunny temperatures the next couple days in the 70's and the warmest inland spots. then a little cooler for the weekend. a little cloudier for the weekend. that chance of rain and much cooler on monday, partly cloudy the next couple of days. and you know what temperature outlook is slightly below normal across the west coast. so and we're going to be a little bit cooler, a little bit less wind. >>and that does the here for us at kron. 4 news will be stephanie rothman. thanks for watching.
