hadley, gm and jiang was arrested this morning. there's his mug shot. this after a mcdonald's customer recognized him. he was taken into custody this evening in new york. prosecutors are now charging him with murder. this after investigators say they found a 3 d printed pistol and a 3 d printed silencer in his backpack. croft foreshock momo reports on what kron 4 has learned about his time here in the bay area. >>luigi man joni's time here in the bay area was pretty limited. he really just spent one summer here in the bay area back in 2019 as a high school instructor at stanford university. we know he have taught he has ties to san francisco, california. new york police announcing monday the arrest of 26 year-old luigi man joni who they are now calling a suspect in the shooting death of united healthcare's ceo brian tom said new york police announcing monday 5 charges including carrying a gun without a license forgery and falsely identifying himself to authorities. he is currently being held without bail.

many here in the bay area reported feeling the shaking as well. the epicenteof t earthquake is just northeast of yearning 10, which is directly east of lake tahoe. there have been no reports damage and tracking it all is calm for sheet meteorologist lawrence karnow. he joins us with a closer look. larks. >>it's your attention that's considered a moderate quake, right? and that happening right in the desert there in the middle of nevada. but nonetheless, even some people here in the bay area said they felt but really got things going this afternoon. numerous quakes popping up there as well. what appears to be an unknown fault in that area. there are many faults throughout the nevada and they do have some large earthquakes. this one, a very shallow and only about 2 miles deep. and that means yeah. gets to the surface really fast, making it feel that much more powerful. they're not the only ones feeling the earthquakes that have been numerous throughout. you can see the latest on the earthquake saw numerous aftershocks that we had large earthquake a little bit earlier in the day. now we

continue to see more some fairly substantial. you've got some of those over for even some fives that popped up after that as well. the most recent one, the smaller quake. but it's hard to know whether this is the small quaker. there might be a larger quake on the horizon. still too early to tell. but just to give you an idea, some folks in the bay area said they felt this quake. that's 200 miles away. but we're all part of that whole fault zone. we've got the north american plate and the pacific plate, robin against each other. and we just live in the world of faults here in the bay area. that's true. lauren, thank you. >>monta vista high school cupertino is set resume classes tomorrow. that's after false reports of an active shooter today. no word on where the threat came from. the school went on lockdown this morning and cancel classes for the rest of the day. while deputies investigating the initial report. but officials say school will be in session tomorrow. and the man who stole a plane from paulo also before landing on a beach in half moon bay. it's now been sentence. louise eras is being

released from jail on time served but will be under mandatory supervision for 125 days and must pay $50,000 in restitution to the plane's owner. back in february, he walked onto the tarmac at paulo alto airport, broke into a private plane and flew it over the coastal mountains. that's all before crash landing on the beach. there. according to investigators said he did this to, quote, show the government that airports lack proper security. and san francisco hotel workers on strike are trying to discourage people from attending a major healthcare conference in january. jp morgan healthcare conference is scheduled to be held at the westin saint francis hotel and hotel workers. unions as executives and investors who attend this conference are responsible for the inflated health care costs, which have contributed to this labor dispute about 2500 marriott hilton and hyatt workers have been on strike since labor day. they're now demanding affordable health care, better staffing and higher pay every

day. a 45 year-old family-run mediterranean restaurant is here to stay. we first told you about lot, mediterranean august when they were told they could ever do their lease. well, now the legacy businesses on san francisco's fillmore street have been offered a lease extension. kron 4 sarah stinson has the update. >>there's been a lot of change the last couple months here on fillmore street with for lease signs popping up. but customers and the owners of law mediterranean say they're relieved to hear it won't be vacant anytime soon to 45 a new lease on life david rowe. jen is excited as family restaurant la mediterranean has been given an extended lease until it's a great day. we are very, very happy today. we just got to celebrate the fact that we're going to be here for years to come. david rosen runs cafe la med. his father lavonne opened it 45 years ago for him. his life's

>>welcome back. i'm stephanie rothman tonight. the chp in the east bay is investigating following a freeway shooting. chp says 2 people were shot while driving along highway 24 near renda happened over the weekend. kron four's lindsey ford has reaction of people who live and work in the area. we are in community is shocked after learning about the deadly shooting on highway. 24 near orinda. >>sunday night country custis eph taking pictures and examining the vehicle that was shot at leaving the driver and passenger with minor injuries. the crime, anomaly says alvin gonzales because the city of orinda is typically safe. he lives in walnut creek and works not too far from fish ranch. really? pretty calm from what i've experienced pretty safe. to be honest. he was stopping at a chevron gas station monday night.

lindsey ford kron. 4 news. >>on the peninsula, woman is dead tonight after being stabbed in a redwood city home. it happened last night on 7th avenue near bay road. police say a man called them and said he had just at the victim officers arrest them and it's unclear what his relationship was with the victim. jewish community leaders are cleaning up after san francisco center for jewish students is vandalized with anti-semitic graffiti. this is one of the 2 areas of the san francisco hillel that were attacked. cabe are references a centuries-old battle between jews and muslims. as usually there's say it's a blatant attempt to stir up hate and they're not taking that bait. staff francisco hillel say a student discovered these words spray painted on the building this morning and they also found signs of attempted break-in. >>as to a muslim jewish, only war for 14 centuries ago. so it's a it's a deep reference.

fight near lamar hernandez-thorpe thanking residents and praising city staff members in antioch for their support during his 8 years in public office. he served as a council member. the first 4 years. and may are the final last 3 years as it relates to the fbi investigation. that was probably the hardest thing that i personally have to deal with. hernandez thorpe says the fbi investigation uncovered racist text messages involving more than 40 police officers. a scandal that included substantiated allegations of corruption and abuse of force, which has severely crippled police staffing levels. and i'm sorry. when i walked out of those doors, it's not over. we're still under 2 investigations by the federal government. one investigation by the state's attorney general's office and then won one investigation by the state dog. it is bad. >>but i don't want anyone ever think that that's normal. and that we should just accept that as normal because it is

miami where he lives. he did appear before a judge over zoom but did not appear in person like he has for the last 6 weeks of this trial. many is accused of murdering bob lee under the bay bridge early on april 4th, 2023, the defense has argued self-defense. while the prosecution says many murdered lee because he blamed him for the drugging and assault of his sister professor at uc law. san francisco are of the room says it won't be an easy decision for the jury. everybody's jittery at this nobody could have knows what to think. and

during the season of audi sales event. talking about ending what's called birthright citizenship. >>that's the constitutional amendment saying that all persons born in the u.s. are citizens kron four's. catherine heenan spoke with ucsf law professor rory little for more on what may lie ahead. >>maybe clarify for people worry what he is trying to do. i mean, can he get around the 14th amendment? >>you let's say that trump has been able to get around all sorts of things. we didn't think he could, there's a constitutional amendment enacted in 18. 68 that says that i'm going to quote. >>all persons born or naturalized in the united states and subject to the jurisdiction thereof are

citizens the united states and the state where they reside. that is what we called birthright citizenship all persons born in he united states are citizens. it takes two-thirds of the states or two-thirds of congress to propose any changes to the constitution and it would take 3 quarters of the states to ratify in order to change amendment. so i don't think president trump can do it by executive order or congress cannot even do it by statute in this part of the constitution. >>so it what he would do, i guess of food that came to pass. it would federal agencies would require rory that at least one parent or guardian be a u.s. citizen in order for children to automatically be citizens. is that how it would be played well, that may be what he would try, but that would not be constitutional. the constitution says, and it's pretty simple. >>all persons, all persons, in the united states, our citizens. now the only

exceptions to that historically have been children of diplomats who were sent here. they're still subject to the jurisdiction of their home country. their diplomats working here and sort of terribly and the racist origins of the constitution. indigenous people. we're not recognize the citizens, even if they were born here until the 1940's. but still, that's almost a century. so supreme court held in 18, 98. >>that it didn't matter where your parents were born. if you were born in the united states, you are a citizen and that was the intention of congress in 18 68 when they wrote the 14th amendment because the supreme court had previously said that african-americans could not be citzens even if they were born here. after the civil war, the constitution was amended to say yes, they can. if you're born here, you're a citizen. >>so are you're suggesting maybe this might not get very far or is this the kind of

thing that could end up before the supreme court? >>you can imagine sort of horrific executive orders like nothing's been done yet. you can imagine executive order that says something like i'm going to say that anyone who was born in the united states if they were illegally here, if they were not here as legal ella events that they were not documented, i'm going to say they don't count under the 14th amendment. now i think that would be under a lot of presidents the plain language of the 14th amendment. but, you know, you can try anything you want and then somebody will have to sue and say, well, that's not what it means. so that's the way litigation gets done in this country and it'll it can rise to the supreme court. i'd be very surprised if any of the justices? certainly not a majority, even if they've been appointed by trump. would agree with that idea. i suppose he could try it and see what happens.

>>meantime, governor newsom has been talking, as you know, about to trump proof in california. i guess things like this sanctuary cities. what kind of legal ammo exists worry for that kind of attempt. >>well, mean, let's put this good light. it's better to fight things out in the courts that it is to fight it out in the streets. so we use litigation as a substitute fr, you know, street warfare. and let's hope we never get to that point where we are, riots in the streets. either way we solve our problems. so california pulling, you know, they will spend a lot of money on litigation and down. california will resist detention camps for all undocumented people. if such things were ever done reminiscent, you know, the 1930's in germany and leading to world war. california will resist that in the courts and

that litigation will take some time you know, and we'll see whether trump is willing to invest that kind of money. federal money in an effort. it seems ill-fated under the law and then let's hope that he spends his time doing things as he said in his interview yesterday, which will unify the country and which well lead to some success for his administration. he wants to be a successful president at this point. this is his last term. i think he knows it's his last room despite what you might say and he wants to be historically viewed as a good president. there's lots of places he can put his energy. that would be good for the country, including the economy. let's hope puts his energies there. but if he doesn't, california and other states, well, i on in the courts. >>all right, professor rory little always gracious of you to chime in here and help we appreciate it. thanks, corey. thank you so much.

>>for your health and other bay area child has possibly contracted bird flu this time in marin county last month, alameda county confirms a bird flu case. there. kron four's. lindsey ford has the story. on friday, marin county public health announced that a child possibly contracted bird flu. >>the source unknown as well as the recent confirmed bird flu case in alameda county. this year alone, bird flu has infected over 50 people in the

u.s. and 31 in california, according to the cdc, the chances of contracting bird flu is low, says infectious disease specialist dr peter chin. hong with ucsf health. because as of now, bird flu doesn't transfer from human to human. >>that person is unlikely to spread it to another prison when they go home. for example, because it's very hard to unlock that that door. as you get one more of these things happening. we're worried that it will figure we find key that unlocks the door to get inside because things like pneumonia. and that will be worrisome. unlocking that door, meaning the bird flu virus does have potential to mutate like covid. >>making it more susceptible to human to human transporter. dr chan hong says the child in marin county is most likely being treated with tamiflu. antiviral medication commonly used to treat the more familiar flu here in the u.s.

that kind making wild birds. >>so i guess the other thing is that people denver is dropping you know, they should contact health department. >>historically, the bird flu originated in birds. but as of march of this year, the virus was found in dairy cows this year, a california dairy company, raw farm llc, issued a voluntary recall to a batch of their raw milk that detected bird flu for best safety practices to protect you. from viruses like the bird flu chin, hong says stay away from raw milk in dead animals. and if you are having flu-like symptoms like muscle aches and headaches, stay home for all to get the flu shot. and the reason why is that, you know, it's not the breed. flu shot. >>you don't want to be a situation. we got regular flew at a bird flu together because what happens is those 2 viruses could exchange jeans. and then briefly can figure out a way to get body. >>in marin county, lindsey

ford kron, 4 news. >>in sacramento county organizers running a christmas tree lot are letting a thief ruin their holiday spirit. this after someone broke in over the weekend and made off with some trees. now they're turning to the community for help. lot stuff on ian reports. we heard it straight from organizers. they tell us there were signs in plain sight indicating that this was a tree lot run by local scouts. and we're hearing that these thieves didn't hit once but twice. they first started with this part of the gate and the nonprofits they were in the clear they secured part of this. >>only for them. 24 hours later, 2 then hit this part of the gate where they would make straight cuts, allowing them to enter and steal even more trees. and they're saying thanks to some sharp scouts, they were able to get the slot back in business. it's also around pressure to the kids. friday night. thieves hit this christmas tree lot in galt. >>organizers tell us that these took power tools and made straight cuts to the gate
