>> thanks for joining us here at 10 o'clock. i'm noelle bellow. the rain is back tonight in the bay area. sticking around through the weekend. a high surf advisory also in effect through sunday morning. let's get you a live look tonight across downtown san francisco. it was a little murky earlier, but now the rain starting to move in a little bit across the bay crime. first chief meteorologist lawrence karnow has been tracking this latest wet. whether he's got the latest for us right now. hi, lauren. really been an active weather week, noel. and you know what? it's going to continue now as we're going to see. >> a couple more shots of rain. another one coming in tonight. i think a stronger system coming in as we head in toward late saturday night and sunday clouds out there. no getting around that some patchy fog down below. even a couple raindrops begin to pop in the rain line and move a little further to the north today. but now beginning to drop south and it will bring

with it a few scattered showers overnight tonight, not as heavy, but you see some rain moving in right now. most the heavier rain in far northern california, but a couple scattered showers begin to pop locally to. and you see some of that moisture moving in right now in parts of the north bay, even saying a little further south making its way across the bay area. so we're going to see more of that as we head throughout the night tonight and tomorrow morning to go along with that, of course, we've seen some very large waves along the coastline. we're going to be watching out for that. maybe some 20, maybe some 30 footers out toward the immediate coast. more on that coming up in a few minutes. but more rain coming our way over the weekend. there's that next storm system rolling through on sunday. you expect some heavier rainfall early on sunday morning. if you plan to head to the high country, a lot of snow coming their way to so yeah, it's going to be awhile before we clear things up. but i do have some sunshine in the forecast, too. hopefully for the new year. we'll talk more about that coming up a few minutes. thanks, lawrence. >> according to a new report, homelessness across the country has increased by more

than 100,000 people just in the last year here in the bay area, specifically in santa clara county, nearly 10,000 people are unhoused. those new numbers come as hundreds of people are set to have their encampment swept starting next week. crown. first jack moment reports from one of the south bay's largest homeless encampments. >> i know one week from friday. this notice posted along a several mile long stretch of coyote creek. this one-off story votes as sweeps will start in the new year. these people are criminals. these people are down on their luck. >> these people have lost houses, lost jobs, lost loved ones. john cartwright has been spending her holidays, telling the hundreds of people along coyote creek that they need to get moving. >> the silicon valley water board recently approved a ban on all camping along their waterways, citing safety and hygiene concerts. the band starts on january second, but it's unclear how quickly law enforcement will force people out of their tents. if you're sweeping people out of the creeks where they supposed to

go and if you don't have any answer, you should be sweeping people out of anywhere. shelter space is routinely fall in the south bay and the number of people living on the streets is increasing. according to the latest housing and urban development data. >> nearly three-quarters of a million people were found living on the streets across the u.s. california has by far the largest number of people living on the streets. a total of 160,000 more recorded this year. cartwright's not surprised. not at all. and i'm sure that's an under count. everyone who anyone who's ever counted knows that's undercount into the bike path. she hands out supplies and some belated christmas cheer. but you know what? i'm not going to tell you a flavor there. it's horrible man. >> it's harwell mercy. watson has never been on house before, but he ended up here just 6 weeks ago. he was evicted after his roommate who paid rent was hospitalized. many some more substantial. i mean, i could go to a shot of it. >> if this, if this pope at there. it's like you got to do a raffle ticket. you got to

stand up if you don't get well, people live pretty deep into these waterways here. we are standing at one of the park's by happy hollow park and zoo. >> to give you a little idea of how deep these people live. take a quick look to my right. you can see this bridge that people made. and if you follow that bridge up the hill, there are dozens of tense, all lining this waterway of people who will be forced out over the next couple months. i mean, i lost a career job. i was working for caltrans. and everything just crumble and well, murphy is in limbo, just figuring out how to live on the street. >> he will likely be forced out of his newfound home. you enact rules against a group of people. it will never be successful. robert gear, it helps with the y time. count for the unhoused. he disagrees, however, with the county steps towards removing people from the creeks and rivers, he says more people like murphy should be included in the conversation and not labeled a criminal. you must involve them in those decisions so they can agree to it. so it

he? >> a fair contract in san jose jacmel but kron 4 news. >> tonight police in oakland are investigating a deadly shooting. they found the victim yesterday afternoon on foothill boulevard near the franklin recreation center. that person was shot several times. >> no arrests have been made. if you have any information you're asked to give oakland police a call. this comes as the chp is presence in the east bay is being extended. governor gavin newsom making the announcement today but also called out oakland over its police pursuit policy. capitol correspondent eytan wallace reports. >> statewide, california highway patrol organized retail crime task force in 2024 alone. it recovered over 13 million dollars in stolen goods, arrested more than 1400 suspects and conducted 777 investigations. he says his decision to add the additional chp patrols and resources to areas he describes as regional hotspots, including

bakersfield, bernardino, san francisco and oakland helped get those results. but specifically in the city of oakland, he says he will discontinue his decision to an additional chp patrols. if the city does not take quick action to change its policy that says an officer can engage in a police pursuit only if the suspect is believed to have committed a violent crime or if there is a probable cause. the suspect is in possession of a gun. otherwise no pursuit. newsom says that policy hampers officers ability to do their job. this extreme. >> pursuit policy. you can run a red light. you can come close to sideswiping a school bus during the morning hours right in front of a police officer and the pursuit policy in oakland says we can't. we cannot foresee that suspect. we cannot engage that suspect. we need to see that policy changed. oakland council

members and attendants say they are working on changing the policy. it is my hope that in the new council that we can get this time in the next 30 days or >> looking ahead, statewide newsom believes doesn't bipartisan retail theft new laws he signed earlier this fall will make a difference, including one that will increase penalties for those who steal more than $50,000 in items. >> in another allowing prosecutors to combine the value of multiple stolen items to meet the larger penalty for a felony. still, newsom defended his stance against prop 36. the 2024 ballot measure that voters overwhelmingly passed to increase truck treatment and increase penalties for some theft and drug offenses. newsom expressed concerns over lack of state money to fund prop 36 and he believes it could lead to mass incarceration. but republicans hope he helps implement prop 36. now that past and now that it's law, he continues to look at prop 36 with skepticism. >> and for my colleagues in couple weeks ago.

>> sent a letter to the governor requesting that he fully support and fund prop. 36 is important. >> and we should have a better idea about how newsom plans to fund prop 36 when he unveils his preliminary spending plan in january reporting a tonn wallace kron. 4 news. >> a serial san francisco shoplifter is facing more severe charges tonight marking the city's first case filed under prop 36 on christmas eve. the man allegedly stole medications worth more than $400 from a walgreens inouye valley. thanks to prop 36. instead of citing and releasing the suspect, he's now facing felony charges that law went into effect 10 days ago. plenty of other new laws are set to go into effect at the start of the year, including the daylighting law which gives out tickets to people who parked too close to a crosswalk. reporter chip yost gives us a look at some of the new laws. >> secretary, please call the

roll. >> one of the new laws passed this year aims to address the challenge of prosecuting people for breaking into cars primarily the bill closes the locked door. new poll. >> which is a nonsensical barrier holding all part of burglaries accountable no longer. the bill's author says will prosecutors have to prove a car's doors were locked to prosecute someone for auto burglary? another law that goes into full effect january 1st after being passed in 2023. >> could make parking in your neighborhood a little more challenging by limiting how close you can park to a crosswalk. >> before 13 would make intersections safer by widening sight lines, getting drivers better vision. one looking out for pedestrians. >> the new law prohibits people from parking within 20 feet of either side of any marked or unmarked crosswalk or within 15 feet. if a curb extension is present.

legislators also attempted to make cannabis shops more marketable by allowing them to prepare and serve none. cannabis food and beverages on site. here's what the bill's author said about the idea in an interview last we know from places like answer them. >> that there's a huge demand for this. and california can become a destination for cannabis just like we are for winds bringing hundreds of thousands of people to our state. >> that was chip yost reporting for us. still ahead here on kron 4 tonight, a teenager in the south bay arrested for selling guns where investigators say the 19 year-old was getting those firearms. plus crews in santa cruz rushing to get the wharf back open after its collapse. the safety concerns tonight. and a woman set on fire while riding the subway. what we're leared g about her acc killer.

>> cleanup continues in santa cruz after the wharf collapsed during dangerous swells. they slammed into the structure and sent to some of the people working on the wharf into the water is kron four's. gayle ong reports. the hope is to reopen the wharf in a couple of weeks. >> incident on monday really the largest swell that we've seen 30 years. and as a result, santa cruz city leaders say about 150 feet at the end of the war was destroyed after dangerous swells slammed into the structure just before 01:00pm monday while the coast was under a high surf warning,

according to the national weather service wave heights were about 30 to 40 feet with the highest breakers around 60 feet at the time. so that combined with the end of the war being. under construction. >> really damaged weakened from previous year storms. that was really vulnerable. why the impact causing 3 construction workers to fall into the water along with the dolphin restaurant and a restroom. >> that part of the pier was already close since january of this year. right now, our immediate concern is the balance of the world open and our businesses operating again as soon as possible. the santa cruz city manager at some 400 employees will be receiving funds to offset the amount lost during the closure. that may include help with rent in the meantime, crews are working to reopen. the wharf is too critical path items. the first removal of the heavy equipment. >> that fell into the ocean as a result of the incident were working with power. engineering. the contractor on the project as well as other salvage experts as to how best

we've got rain going on. people are driving a little fall. there's a lot of stuff going parts of country are getting hammered. really cold weather. some very stormy weather tornadoes in the deep south. so, yeah, there's a lot going on out there. so even though you may not begin delays as much sfo are oakland. >> or maybe a san jose, you may see some of the connecting flights having some issues causing some delays. so right now looking toward sfo so far, so good, not much in the way of rain there right now, but likely going to see a few showers. mostly cloudy winds are light right now. so far, no reported delays cell phone after traveling across the country, things have cleaned up quite a bit. in fact, we have some delays this afternoon. chicago o'hare, things looking good there. now we've got some rain coming down. newark also looking at some rain. so as we go toward tomorrow, again, the possibility of some more delays headed across the country that you got your get away forecast into the monterey bay tomorrow, you'll see a lot of clouds and again,

watch out for that large surf along the coastline. high surf advisories continue along the monterey bay as well. temperatures could be the 50's and a couple of 60 southern california. also look at the large waves to but temperatures will be warmer there about 65 degrees in pasadena. 64 in san diego and 61 degrees in los angeles. lot of folks want to head the high country. enjoy that snow. i think tomorrow you're going to catch a break. you're gonna see temperatures generally in the 40's. lot of clouds out there, but beware, as you get into sunday, we've got a storm system moving in, likely going to see some more gusty winds and some heavy snow as we head toward friday night or excuse me saturday night and into sunday. so headed up there. yeah. going to be kind of rough there. you've got some showers early tomorrow morning and then it looks like it's changing to a much larger storm system on sunday with that storm, bringing the heavy rain and the gusty winds. then as we get into monday, those clouds start to part of it. and boy, as we head toward the end of the year and the beginning of the new year, we're going to be skiing on some fresh powder. if you can get up there looks like things are going to be opening up about say they said they've

got over a foot of snow in the past. 24 hours, 69 inches at their summit. there. orel a 55 inches on the ground. 34 trails are now open there. they're really wide open there. want to get up there and enjoy boreal. how much trouble look at the 75 inches on the ground. they had almost a foot of snow on. yeah. there enjoying all that powder out there around the state. yeah, it's going to be a little bit cool out there in spots. be prepared for that. the further you go north, watch out we'll have more in your tent coming up in a few minutes. thank you, lawrence. in the south bay and 19 year-old is behind bars in san jose accused of making ghost guns. >> and selling them. police say lucien cabrera posted these photos and videos online. they show him shooting the illegal guns at open fields and east palo alto and san jose. >> officers say one video actually shows him shooting one of the guns on a school campus cabrera is suspected of importing those weapons from out of state. a disturbing story out of new york tonight. a man accused of setting a

woman on fire in a subway car. it's now facing multiple counts of murder. laura ingle has the latest on the investigation. sebastian's was not in court, waiving his appearance on friday. >> and was charged with 4 counts of murder. and one count of arson to break that down. further 3 charges of second-degree murder. one charge of first-degree arson and one charge of first-degree murder, which could bring him a sentence of life in prison without parole. if convicted. the brooklyn district attorney calling the sunday morning murder of a sleeping woman on a subway who was burned alive and evil deed district attorney eric gonzalez says his team of investigators are confident they have enough evidence to support the state charges calling this an intentional act. if we watch the video short, many of you have seen the video. >> it it's clear that a lighter was used to set her on fire and you know, that's why working very on the case right

now. the da said investigators are continuing to work on identifying the victim, but >> because she was so badly burned and appeared to be homeless. this has become more challenging. investigators are working on advanced fingerprinting and advanced dna to help identify her and say they have made progress but cannot go into specifics. police are also going through multiple camera systems both at the subway station and on the subway to see if they can spot this woman getting into the car that will hopefully help identify her to pay to will be back in court on january 7th for his arraignment. >> that was laura ingle reporting for us tonight. still ahead on kron for news at 10, a mcdonald's worker shoots and kills a man inside the fast food restaurant. what led up to those shots being fired? plus, bird flu leads to the death of 3 house cats. but pet owners need to know tonight to keep your animals safe. and why lyft is now suing san francisco. also

entered the mcdonald's last night. then there was some sort of confrontation with an employee eventually pulled out a gun and shot the delivery driver employee ran away but was later found and arrested this afternoon. not too far from the mcdonald's. we'll take a look at this video of the recently crashed aircraft in central asia shows holes in the tail section of the plane. >> 38 people were killed in this crash. an aviation experts now believe russian air defense fire was likely responsible. u.s. officials agree. tom dempsey has the very latest on the investigation. >> a recent interview with reuters, one of the passengers aboard the plane described hearing a loud bang shortly before the plane attempted to land at its original destination. right now, investigators are likely analyzing 2 black boxes recovered from the wreckage of azerbaijan airlines flight. 84 32, which could provide vital clues as to what exactly

happened with 2 sources telling newsnation directly that early signs point to a russian anti-aircraft system being responsible for this tragedy. the flight left azerbaijan's capital on wednesday to head to grozny in chechnya southwestern russia, which has been a target of ukrainian attack drones during the ongoing war. russia's aviation watchdog group says due to heavy fog and local alerts over ukrainian drones. the flight diverted hundreds of miles to kazakhstan, but the plane never made it to its destination. of course, the last moments of the plane in the air all got captured on video and footage shows pieces of the plane scattered on the destroyed in total. 38 people died in this crash. will 29 others on board survived reuters sites for sources who say russian air defenses downed the plane and some reports describe a russia diverted the plane from its airspace and j and its gps system. investigators say it

>> by this time next month, san francisco will have a new mayor marking the end of london breed's historic tenure. breida became the first black woman mayor in the city's history. i sat down with her earlier this month to talk about her legacy. >> i'm london breed. i am president of the san francisco of supervisors and soon to be mayor of the city and county u.s.. >> in london breed says it's been an honor to serve as mayor of her hometown. >> but it's been crisis after crisis after crisis. it is with profound sadness that i confirm. >> mayor edwin m lee passed away early this morning thrust into the spotlight following the sudden death of mayor ed lee. >> breed was tested early and often as mayor, most notably having to leave the city through a pandemic. please. >> for all of us.

>> make smart decisions when it mattered. when we needed to save lives. i really feel proud that i was able to step up and and helped lead the city's. you feel like you're turning over the city too? >> the mayor elect in a better state than where you found it? i think overdose deaths are declining. we're getting people off the street. crime is lower than it's been in over a decade breeds statistics paint a picture of positive change during her tenure. >> but she admits numbers don't tell the whole story. people think that. >> you know, well, you know, numbers are one thing. and if you don't feel safe or something happens to you, they don't matter in major cities, things are going to happen. but here's the difference. we now have a different kind of response. we now when those crimes are committed, people getting arrested. they are getting prosecuted. you know, they're getting provided with second chances if they're struggling with addiction. but there's accountability. and i think that has been the game changer for us and why we're

seeing such a difference. i never thought. >> the opportunity to be mayor of the city and county of san francisco was possible. >> agreed is the 45th mayor of san francisco and the first black woman elected to that office. but perhaps more informing her legacy. she became the city's first mayor in 5 decades who attended public school in san francisco. i think it was not just about being black, but they someone who grew up in poverty in this city. >> and had, you know, the kinds of experiences i had. i mean, i grew up in the midst of the crack epidemic. there was gun violence. there was last. there was hopelessness. there was poverty. i mean, it just every decision that i made had everything to do with understanding when people have had to live like that, like i've lived like in fear that, you know, the city and government can be transformative in helping to

change, you know, and save lives. we have one of our lowest numbers of encampments that we had even since before the pandemic. people wanted to see things right away. and i understand and respect that because i felt the same way. but i'm so glad that people are starting to see the difference. while the most recent federal count shows fewer people are sleeping outside. that same count shows an increase in the number of homeless people without permanent housing. >> while the city continues to fall well, short of state mandated housing goals breed says recent changes will help her accomplish her goal of creating more places to live in san francisco. the stuff we've done here on the local level >> will have impacts after leave office for housing production in san francisco in theirs. nothing that could be done to stop these units from being built within the past. the obstruction was always at the local level. obviously there's a new mayor. there are several new members of the board of supervisors as well that are going to be coming.

and what is your advice for those and coming there's a lot of lot of new people that are very, you know, >> and i think what's more important is i think it's probably don't act like, you know, everything, mayors and supervisors, they come and go. but whenever you're in a leadership position and you're fortunate enough to be able to serve in this capacity. >> make it about the city and not necessarily about yourself. >> the mayor says she is not exactly sure what she'll do after leaving office, but she is looking forward to remaining part of the city as it is. of course, her hometown. other news tonight, lyft suing the city of san francisco. the company claims it was over charged 100 million dollars in taxes over the last 5 years. >> the suit filed last week says the fees paid by riders to drivers are not part of the company's revenue and should not be taxed. left says it makes most of its money from

the fees. it charges its drivers. the company wants refunds for overpaid taxes as well as interest and penalties. san francisco says it will review this complaint. time now to get you a check of the forecast as we take a live look at the bay bridge. it does look like perhaps the road is a little wet out there tonight. some rain coming back for us here in the bay area, lawrence, it doesn't seem that it's as heavy as it was last night. last night was a lot of rain. yeah, you're absolutely right. this coming is a much more scattered shower type of storm system. >> as compared to last night. so we are seeing some of those showers popping up around the bay area. so, yeah, the roadways are getting slick again. we're not done with the rain for the year, but it looks like i can see them do. it looks like we're finally going to see some sunshine make return to the bay area, but not quite yet. clouds out there right now. showers pushing through a san francisco and across the bay area overnight tonight but will be more scattered as we head throughout the night. and

of course, we've had those huge ways. those swells moving along the coastline. surfers have been loving it out of mavericks. they've had so up. huge swells moving in there, but 20 to 30 footers along the coastline that some dangerous stuff. you got to watch out for that out toward the beaches. if you plan to head there, just stay off the rocks and stay away from the water's edge and enjoy those magnificent wave. just a really pounding the coastline. here's a look at some of the wave heights that are moving in along the coast right now. in fact, seeing some of these waves right now and a half moon all that big, although it's going likely pick up now to 12 feet was a 9 early on today. just off the coastline. you can see some larger waves to 16 and little further north to 20. but further out in the middle, the pacific, you can see that big bull's eye out there that orange dot. and yeah, we are going to see some much heavier swells moving in along the coastline. and that's what we're watching out for those ones out there 29 feet right now have seen some over 30. so that is going to be moving in over the weekend. and that's why the advisory for those large waves continues until sunday. a

eating northwest naturals raw and frozen pet food, which is sold nationwide. the portland based company has voluntarily recalled the frozen turkey line linked to the death earlier this month. health officials in la county reported 2 house cat deaths both had consumed raw milk linked to a statewide recall due to infected dairy herds. the virus has been detected on farms in at least 16 states and hundreds of herds are quarantined in washington state. the deaths of 20 big cats, including a tiger in just the past month, according to the facility's director, all had become infected with bird flu. now dozens of human bird flu cases have also been reported in california, oregon, washington and other states. but so far, no deaths or known spread from human to human contact. >> i strongly advise people not to drink raw milk. this is
