thank you for joining us for fox10 news at 5. we begin with a news alert. reports of a body found in a burned aprtment. it happened at a complex near 43rd avenue and thunderbird. that's where marcy jones joins us live. she just talked to some neighbors. marcy?

in phoenix -- police invesitgating a shooting near 35th avenue and baseline. officers say a man was shot in the chest right outside his home. the man was leaving his house at about 4-30 a-m -- when he got into an argument with two people. one of the suspects opened fire hitting the man once. he was rushed to the hospital.. but his condition is unknown. officers haven't said if any suspects were arrested. another developing story -- a man stabbed while sleeping in his pickup truck. police say the victims truck was parked near a convenience store on 16th street and roosevelt. after the stabbing the suspect took off on foot. the victim was able to drive a few blocks before collapsing. he is expect to be okay -- no word on if police have made

police need your help finding two people in connection with an armed robbery. this happened back in june at the circle k near the i-17 and glendale avenue in phoenix. the two men enter the store and one of them holds the clerk up at gunpoint. the other man starts demanding money, cigarettes and beer from the clerk. the man with the gun hits the clerk in the head with running with the bag of cigarettes and beer. "we certainly don't want them fighting over property and that's what's scary about this video. this clerk wasn't fighting over property. he job when suddenly they just come in and not just put him at gunpoint, but they hit him with the gun too." police describe the men as two black men in their twenties. if you have any information... call police. the family of a man shot and killed two years ago is asking the public to help police put the suspect behind bars. kevin ore was shot and killed on his way walking

that he was last seen working at the rum runner bar near seventh street and northern avenue. his family says that they want the suspect behind bars so they can't hurt anybody else. o "and until we know or until there's an arrest, whoever did this is out there walking around and can do that to your family." if you have any information on the case... call silent witness at 4-8-0 witness. it's labor day weekend and while many people headed out of the valley for cooler took left yesterday others are celebrating here. police are cracking down on drunk and impaired drivers across the valley. departments statewide will have additional officers on the roads and several checkpoints starting tonight at 6.

need a designated driver triple a is offering "tipsy tow." the service will start at 6 p.m. monday night and runs through 6 a.m. tuesday morning. the service will take a driver, passenger and vehicle up to 10 miles for free. on monday - drivers or passengers can call 1-800-aaa-help. unofficial local election results posted today for two very close races. those results showing maricopa county recorder pulling ahead of aaron flannery by about 200 votes, but the race for congressional district 5 much closer. andy biggs and christine jones almost in a tie. that race now needing a recount. fox 10's danielle miller is live and has more with what this all means. well both camps have declared victory, jones on election night, and biggs today. we spoke to a political consultant today and

can officialy call the race will be election officials. he says the recount process could take up to a week to get official results.

secretary of state will hold their canvass on monday the 12th. reporting live danielle miller fox 10 phoenix. the arizona democratic party is joining in on the taco trucks on trend. they put the phrase on their marquee and said they will have a taco truck on hand today. this is in correlation with their voter registration and voter outreach event that happened earlier today. the arizona democratic party were hoping to get more people registered for the general election in november. "we are helping the taco truck ow to come buy some tacos. but at the same time those who aren't registered, to register to vote." so many people went to the event that the taco truck ran out of food. some dogs at maricopa animal care and control are getting a free haircuts in hopes of being adopted. woof wagon is a mobile pet grooming business and they

you can see the changes that the grooming has done to their appearance. animal care and control hopes that the grooming will help the dogs find their new forever homes. good shape even though he spent days buried in the rubble. we're seeing new video of the five point six earthquake that jolted awake thousands of people in oklahoma. surveillance video from a public school show the force of the tremors... the u-s geological survey says the quake hit around 7 -- am. it's epicenter just ten miles away from northwest pawnee, oklahoma. officials there are reporting no injuries or casualties but several buildings were damaged. reports indicate the could be felt from as far away as nebraska... all the way to texas. on to a weather alert-- people along the east coast still picking up the pieces after hurrican hermine touched down in the past few days. and even though the storm has been downgraded-- heavy rains and high tides are expected to cause more major problems... fox news correspondent joel waldman has more details from north carolina.
