three phoenix police officers outside a convenience store. >> i thank god that we are not planning three funerals right now. it's been two years in the battle over flight path changes at sky harbor appears to be at a standstill. what progress has been made. a college player caught on camera punching a ref and knocking him out, the night the player says the video has it all wrong. thank you for joining us. first tonight on fox, marc laquon payne behind bars tonight, police say the 44-year-old tried to run over officers at a qt on purpose. two of the officers hit, one jumped out of the way. thankfully those officers will recover. nicole garcia live at the 4th avenue jail.

amazing that the officers that were hit in that horrific crash are going to be all right. they survived that crash. the suspected driver, 44-year-old marc payne behind bars here tonight facing three counts of attempted murder, and it turns out marc payne has a history of attacking phoenix police officers. this is the man accused of intentionally running over three phoenix police officers, unprovoked. 44-year-old marc laquon payne did not respond to reporters' questions as to why. >> and i'm outraged by this incident. this is a violent, cowardly act on our police officers, and it's simply unacceptable. our phoenix police officers were targeted. >> the surveillance video is difficult to stomach. it shows the three officers standing outside of their patrol car. without warning, payne's vehicle rams into them at high-speed. one officer is able to dodge the car. two officers are directly hit. the impact sends a rookie officer flying into the air. a sergeant is trapped under the

partner tackle pain and take him into custody. >> unbelievable. our officer that hits the front of the glass and smashes the glass gets back up, engages in the fight to take the suspect into custody. phe runs over us, and then he still fights with us as we are trying to take him into custody. while we don't know why payne plowed into the officers, we know he has a history of attacking police. payne was arrested in 1997 for assaulting three phoenix police officers. payne cut a plea nearly 20 years later, he's in jail for attacking three officers again, only this time he's facing attempted murder charges. >> reporter: and the two officers that were seriously hurt, a sergeant suffered a broken leg, and that rookie officer, it was his first day on the job and he suffered head injuries. investigators say payne was

garcia, fox 10 news. >> nicole, thank you for this. a car plows right into a phoenix building, the driver losing control near 22nd avenue and indian school road. witnesses say he crossed all lanes of traffic, hit a tree before slamming into the building right there. people in the building say they thought a bomb went off. >> that's my office right thank god i wasn't at my desk. i would have been killed. that's my desk right there. >> police say luckily nobody was hurt. the driver is not expected to be facing any charges. arizona is facing a lawsuit over denying immigrants driver's license. the suit claims arizona is unconstitutionally holding licenses from immigrants who are considered to be legally in the u.s. governor doug ducey's office says it is reviewing that

people who visit city hall right now can basically just walk right in. but soon they will have to be going through metal detectors and have their bags screened with an x-ray machine. some 25,000 people visit the city hall and buildings every week. city of phoenix getting bragging rights, receiving $9 million in a federal grant, allowing them to hire 50 new firefighters. in the past five has received $35 million in federal funds for its fire and police departments. here's what's left of a home near 61st avenue and mcdowell. paul harris and his wife, they were sitting on their patio at around 1:30 in the morning before going to sleep. they didn't sleep very long before they heard loud noises. >> small explosions, like poof, poof. and then i got up, and as soon

down my hallway and the whole front room is gone. >> harris, his wife and their two kids, luckily they all got out safely. there was a lot of damage done. unfortunately there was no time to get any belongings out of their house. the fire was started by a hot water heater, and firefighters believe it was accidental. >> tonight at steele indian school park for what they are calling a day of solidarity. the pipeline would carry oil through north dakota through south dakota and into iowa to an existing pipeline in illinois. according to the standing sioux tribe, the area contains artifacts and they are worried the water could be contaminated in the area.

officials were inundated with hundreds of noise complaints, and since then citizens and officials have been fighting in court to get quiet in the neighborhood, but as ty brennan reports, that still heart disease not happened. >> every few minutes, planes are taking off at phoenix sky harbor airport neighborhoods, residents still upset about flight paths being changed two years ago. before the flight paths were changed, p head over the salt river before changing paths, but right now they are headed right out over populated neighborhoods. for two years now, steve says he's had to live with the constant sound of planes taking off from phoenix sky harbor and flying right over his historic phoenix home. >> we can't enjoy barbecues and family time, and there's a plane flying over right now.

interrupted, so it's been a big change. >> the flight paths changed two years ago this sunday. the assistant aviation director at sky harbor says the flight paths were changed when the f.a.a. unveiled new technology which was supposed to be new efficient and safe for public airlines, called next gen, but there was never any public comment before the changes happened. lawsuits the flight paths back, but a year after that lawsuit, nothing has changed. but she is hopeful that the residents and the f.a.a. can come to a resolution. >> we can reach their goals, but they need to understand that there's more at stake than just the airlines and them. >> so what happens next? we are told that the legal briefs are now in the hands of the courts and it's up to them to decide what to do next. ty brennan, fox 10 news. yesterday we told you about

to try to figure out what to do with students who were suddenly displaced after anywhere schools were changed for structural reasons. today it's announced this students from challenger school, attending class at the alhambra family resource center. what this will allow students to do is attend a full day of school. before they were talking about splitting the students up. the change will not happen until friday. challenger was one of two schools that was closed due to structural problems there. if you have had trouble getting great seats to a great concert, bruce springsteen or other shows, congress is now doing something about that. we'll explain. and congress is also investigating hillary clinton's e-mails, and now members of congress say they want to see donald trump face a criminal investigation as well. if you would like to contact me on social media, it would be great to hear from you.

we keep asking that question. pnasa sending some new images back from the mars rover curiosity, and it almost looks like some hiking trails here in arizona. according to nasa, the rover came across dozens of dark streaks which could be water seeping up from the plan et's hillsides. international rules prohibit curiosity from touching any part of mars that might contain water in order to prevent contamination. nasa will reroute the r ensure that the site is not disturbed. your exclusive accuweather forecast with dave munsey. >> there's sign, no not touch it. >> all right. makes so innocence to me. -- makes no sense to me. let's talk about something that does make sense, the weather. >> that doesn't make much sense either, but there is nice weather out there. the weather is staying kind of stable here, temperatures

88 degrees right now, winds out of the south southwest at 13. 84 at deer valley, 83 at apache junction, 84 in mesa, 84 in surprise, temperatures coming down nicely. a little bit of moisture around the state. all of that moisture is staying to the east of us here. we have seen a little bit of clutter by apache junction, which means it's probably just something coming off the radar. it might be a little moisture in the air in that area, and you can see that stuff is there's safford in right there, east fork, and as we get up in show low, you'll see right up in this area here, with that moisture kind of pushing through, we run up flagstaff and then look north of there, and as we back off, and you can get a look at it here from a distance, you see everything off to the east and everything moving on. it's still pretty windy out there. look at that, 26-mile-an-hour gusts in winslow, 12-mile-an-hour gusts in payson,

flagstaff. and here's your high on the day, 98 degrees surrounded by some low 90s, some mid-90s, and some upper 90s as well. we had 68 degrees in flagstaff, 77 degrees in prescott, 79 in payson, and 100 degrees at gila bend. 98 for our high today, 78 for the low. 101 and 78 would be the normal high and low. there's your record high at 109, your record low 55. forecasting for tomorrow once again, mid to low 90s throughout the entire valley here. as far as the rest of the state goes, we are forecasting a few 60s and 70s across the mountains. it will be 80 degrees in sedona. this is your forecast for overnight lows, and boy, don't they like nice again. have a few 60s thrown into that mix as well. as we look across the country, we see some freezing temperatures up in the northwest, so that chilly weather hanging on. a little bit of flooding after

hard time getting live from fox studios, fox 10 news is back. if you are having a hard time getting tickets to, say, the latest bruce springsteen concert or maybe a college footba working on making that easier for you to score some seats. ticket sellers and resellers testified at a senate hearing today. congress is cracking down on the use of computerized software by ticket brokers that snap up tickets. these so-called bots buy as many tickets as possible as resale for significant markups. members of the senate commerce committee are expected to vote on similar legislation very soon.
