are mowed down by a car outside of a quiktrip convenience store by a man behind the wheel. thankfully those officers are still alive. they survived this. it's hard to believe when you see the surveillance video. it shows the crash. it is very difficult to watch this. take a look. amazing that any one of them is alive tonight, and you can see the officers standing outside the store, doing their job, when the car comes speeding toward them. two officers hit, a third officer is able to jump out of the through the store windows. >> and this is the man that police say was behind the wheel. we were there as 44-year-old marc laquon payne was brought into jail tonight, payne keeping quiet as reporters tried to ask him questions. but tonight we are learning more about his past. nicole garcia joins us now live from the fourth avenue jail in downtown phoenix with the latest. >> reporter: yeah, this is almost like d?j? vu for

he's at the fourth avenue county jail tonight facing three counts of attempted murder, the phoenix police chief calling his acts cowardly and unacceptable, and it turns out payne has history of attacking phoenix police officers. this is the man accused of intentionally running over three phoenix police officers, unprovoked. 44-year-old marc laquon payne did not respond to reporters asks as to why. >> and i'm outraged by this incident. this is a violent, cowardly act on our police officers, and it's simply unacceptable. our phoenix police officers were targeted. >> the surveillance video is difficult to stomach. it shows the three officers standing outside of their patrol car. without warning, payne's vehicle rams into them at high-speed. one officer is able to dodge the car. two officers are directly hit. the impact sends a rookie officer flying into the air. a sergeant is trapped under the vehicle. >> these officers could have

god that we are not planning three funerals right now. >> the injured rookie helps his partner tackle payne and came into in custody. >> unbelievable. our officer that hits the front of the glass and smashes the glass gets back up and engages in a fight to take the suspect into custody. he runs over us, and then he still fights with us while we are trying to take him into custody. >> reporter: while we don't know why payne plowed into the officers, we know he has a history of attacking police, arested in 1997 for assaulting three police officers. officers pulled him over for a traffic stop. he had had a warrant out for his arrest. but when officers tried to take him into custody, he fought, elbowing and kicking them. payne cut a plea deal in that case and was put on probation. nearly 20 years later, he's in jail for attacking three officers again. only this time, he's facing attempted murder charges. and again, thankfully the

troopers seized truck they say belongs to smith. the victim was identified as 19-year-old javier gonzalez. yesterday gonzalez was stranded on the side of the freeway because his truck had broken down, when he was hit and killed. hundreds of people showed up at steele indian school park tonight in phoenix in support of the standing rock sioux tribe and their fight a dakota pipeline. they claim it would poison their water supply. last week, the feds asked crews to voluntarily stop their work, but protesters say that is not enough, and tonight a member of the sioux problem, who happens to also be an a.s.u. law student, had a message for the government and president obama. >> you promised up, and we believe in promises and uphold

don't believe this should be another broken promise. please listen to us and let us have clean water. >> the company says construction is almost 60% complete and concerns about the water are unfounded. it's been a nightmare for parents and now a change of plans for one of the two glendale schools that were forced to close over safety concerns this week, students from challenger middle school will soon take over the formerly used by cordova primary school. that school was shut down because of low enrollment. the building near 39th avenue and glendale has more than two-dozen empty classes, and that should be enough for challenger's 650 students in grades four through eight. class is expected to start up again on friday. students at landmark middle school will hold their classes at desert spirit elementary beginning on thursday. new at 9:00, it's been two years now since the f.a.a.

planes taking off from sky harbor airport. that move made residents living along the new route angry. and city officials say they were never told that this was going to happen, so they have been fighting with the feds ever since, and now here we are, two years later, and still no resolution. ty brennan joins us now live with the latest in this case. ty? >> yeah, every few minutes here at phoenix sky harbor airport, a plane is taking off, and those residents are still very mad about those flight path changes. now, let me show you exactly what's going on here. this is phoen here on this map, and before those flight paths were changed, those planes would take off, gain altitude, before heading west. but now as you can see in this dark blue, they are cutting a path right over neighborhoods, and that has neighbors very upset. >> two years ago we woke up to much more noise over our neighborhood than we had experienced. >> reporter: for two years now, steve says he has had to live

your exclusive accuweather forecast with dave munsey on fox 10 news. take a look here. 89 degrees. the winds dying down, west southwest now at about eight miles an hour. and as we look at some of these numbers, 86 degrees at deer valley, 86 in surprise, 88 in mesa, 84 at apache junction. still some moisture out there. you can kind of see that stuff working the east side more than anything. as we go down to the city here and get you a look at phoenix, little something out here off to

take a look at the tuscon area, and that was really, well, you can see really full of moisture earlier. but that stuff is drying up, leaving the state. we continue to move up that east side, because that's where everything is, and that's where it's headed out of here from. in fact, we'll show you here. up north, this stuff was really heavy earlier. not much going on now. but as we back off and take a look at the entire state, not much happening on the west. a little something everything has found its way over into the eastern portion of the state. still pretty windy in a few different places, but the wind has died down considerably compared to what it was. 98 degrees on the high today. 97 in goodyear, 96 at deer valley, 97 out at gateway. other numbers would be 81 degrees at winslow, 77 at prescott, 86 at kingman, 88 degrees up at page and 100 degrees at gila bend.

high, 78 on the low, 101 and 78 would be your normal high and low. this is what we are forecasting for tomorrow. lots of mid-90s, a few low 90s thrown into that mix as well. some temperatures coming down nicely here over the next 24 hours. we are looking at 83 at winslow, 67 at flagstaff, 80 in sedona, 96 at gila bend, and 93 down at tuscon. look at the once again we see these temperatures, some 60s starting to show up in the mix now, mid-70s, low 70s, nice looking overnight lows to get things cooling off just a little bit. once again, we did see some freezing temperatures up in the northwestern portion of the country. big storms across iowa cause a little bit of flooding, at least flood warnings for those areas. and then heavy showers down in florida, there's a reason for that.

a low pressure system that is working to be -- well, it is a tropical storm right now that has just made that level because we checked that before the news, and it was still about 35 miles an hour, but now they have given it tropical storm status, and it's right next to jacksonville, so pumping a lot of moisture into that area, and as you can see, keeping the temperatures down a little bit as well. but you can see there's still some warm temperatures out there, a little bit of cooling from the north. 73 for tomorrow, and we are seeing some nice looking 90s all through that ten-day forecast. some of them get a little close to 100 and may step over the line. watch your kids around water. coming up in the next half hour of fox 10 news, the world of halloween and high fashion colliding on the runway. we get a behind the scenes look at a valley company's sexy costume show at new york fashion
