now at 9:00, a deadly collision on a valley road way, and tonight we are learning that this was no accident. residents continue to fight to push a halfway house out of why they say changes being made are not good enough for them. the picture was heartbreaking. a couple in their car overdosed on heroin while a little boy, just four years old, sits in the backseat. tonight an update on where that child is now. and maybe they really are reading the articles. why playboy is seeing a jump in sales since getting rid of the

good evening, everyone. thanks for joining us. new developments tonight in a deadly crash in surprise. >> this was such a horrible scene, and police say that this man, 19-year-old keith johnson, intentionally caused that crash in an attempt to take his own life, but he wound up killing someone else. danielle miller spoke to the victim's neighbors tonight, and she joins us live now from >> this is the intersection where this happened earlier this morning here at litchfield road and peoria avenue. it happened around eight k this morning, and police are telling us that four vehicles were involved. everybody was taken to hospitals around the valley area, accident caused by a 19-year-old man trying to kill himself, and

life of a 46-year-old. we did speak with a former neighbor who says margie had two sons. she just went through divorce. she was an advocate for child cancer research, and she always had a smile on her face. >> we would just chitchat, normal stuff. really shocked at what happened, just really sad. >> she was a sweet lady. my son would always over there and play, and she would be like, sure, come on in. when we were moving, we were getting rid of so many things. she was very generous, always wanting to help. it's one thing to want to take your own life, but to be just so negligent of other people's, and her life is gone, but so many

really rough year, a lot of family things, to move, and then for this to happen is just awful, at the hands of someone that didn't care. >> reporter: john and kari, such a tragedy out here. the picture, 19-year-old keith johnson. police say he intentionally caused the crash trying to take his own life. after being treated at a local hospital here, he was booked into the 4th avenue jail. he is being chargedit count of second-degree murder and two accounts of aggravated assault. thank you, danielle. we are learning new details abut what caused this deadly crash on monday night near rooems and wa dell in surprise. officers were attempting to stop the driver of this truck when he sped off and slammed into a small car. officers say a young woman inside that car died. a passenger was seriously injured. and just moments ago, surprise police confirming the identity

19-year-old named alexis rumor, and right now detectives believe the driver of the truck, a 60-year-old man, was impaired at the time of the crash. they have not released his identity yet. a car fire causing problems on the u.s. 60 during the evening commute. perhaps you were caught up in this, the consider on the westbound shoulder when it burst into flames. it took firefighters a while to knock it down. several lanes on the freeway were blocked. everything is back open tonight and no injuries are reported. new at homes and schools, a new facility in north phoenix for felons. >> but neighbors have complained, saying they fear for their own safety. so the department of corrections said it would no longer house sex offenderers at that facility. however, neighbors are saying that's not good enough because people with other types of convictions are still living there. marcy jones has the latest.

guys. lots of parents and community leaders showing up tonight. there was a sign on the door that read leave your pitch forks at the door. that's what speakers at tonight's meeting said it was all about. it's not a witch hunt, but rather a place to come together and find viable solutions for safety in their community. the number one solution they have is getting the maricopa reentry center back to be a locked facility. many in the community expressed they do believe in a program but they say this is not the appropriate area for a facility of that kind. right now the mrc can accommodate about a hundred offenders, growing to 200 as the facility expands. they will no longer accept any sex offenders but they do include violent and nonviolent offenders, including things like burglary, assault, and manslaughter.

transportation, these people need resources, they need food soup kitchens, homeless shelters, and it's not up here in north phoenix. >> why wouldn't they put the steps for the offenders in prison, trying to get them working on being put into the community, as opposed to doing it after the fact. >> reporter: there will be many more community issues held on this as promised by the speakers inside. now the doc says they have no plans to relocate but community says they are not giving up on that idea just yet. reporting live, marcy jones, fox 10 news. a 17-year-old boy is under arrest in connection with a serial flasher case, the teen accused of exposing himself to female joggers along an area called the bridal path in north central phoenix. these incidents happened over the summer months. the teen is facing several charges tonight. not guilty on all counts.

scottsdale city jury today in the trial of a yoga teacher accused of flashing teenage bars, among other things, at a bar mitzvah. lindsey radomski right here a free woman after a seven-week trial filled with graphic details, frankly too graphic for television. linda williams was in the courtroom when that verdict was read. >> the 33-year-old yoga teacher was facing a punishment that could have included up to five years in prison, and having to register as a sex offender for the rest of her life. hugged her attorneys immediately after the verdicts were read, clearing her of all ten misdemeanor charges of indecent exposure and sexual misconduct. >> ms. radomski suffered. she suffered a loss. her image was tarnished based on how this story came out.

mitzvah for their son in 2014 left the courtroom without commenting. some of the charges stem from radomski allegedly flashing her breasts to adults and boys at the bar mitzvah that night. other charges come after the party, when radomski, who testified to drinking several drinks of vodka, tequila, and wine was sleeping in one of the boy's rooms. >> we believe that the boys went in that room lindsay, fondled her breasts without her permission. this was not conscious, not awake, and it's wrong. >> i'm just incredibly happy it's over. thank god. >> radomski's attorney says she will now move on with her life and continue as a yoga instructor. a maintenance worker is recovering tonight after falling nearly two-dozen feet. the man was doing patch work on

ladder, fell on to an elevated platform. firefighters used a scissor lift to get the man down. he hurt his back badly and his shoulder but is expected to be okay. all three officers are out of the hospital tonight, and tonight we are learning more about the man accused of trying to kill them. >> i need for you to please stand up straight and give me your name and date of birth. >> marc 1972. >> reporter: 44-year-old marc payne looked dazed and seemed out of breath at his initial court appearance. potentially he is facing almost a dozen charges, including three counts of attempted murder. police say pain was under the influence when he slammed his car into three phoenix police officers outside of a qt gas station. court paperwork shows he then continued to attack the officers after the crash.

you decide 2016, if you believe the polls, things are changing. two new polls out of the key battleground states, ohio and florida, and they show that donald trump is surging in the battleground states. trump has now erased clinton's bump from the democratic national convention. in florida, trump has a three point edge among likely voters. these are the numbers right here, 47% to clinton's 44%, and take a look at this, ohio, the all important state of ohio, donald trump now holding a 5-point lead there. in both states, donald trump also holds the edge among registered independents and white voters, while hillary clinton has a large lead among minority voters. the health of both candidates has really taken center stage in the last few days in the presidential race, especially

hillary clinton expected to return to the campaign trail tomorrow. on sunday secretary clinton appeared to pass out, stumble, while leaving a 9/11 memorial event early. her doctor announced that she had been diagnosed with pneumonia just days before. you could see her really start to lose her balance, very wobbly, and almost does a header into the van. this incident has raised further questions about her health. her husband, former president bill clinton, is standing in the campaign trail right now, where he is once again defending his wife's fitness for office and her health. >> it's a crazy time where you live in where people think there is something unusual about getting the flu. last time i checked, millions of people were getting it every ye year. >> it's unclear why clinton said his wife had the flu rather than

your exclusive accuweather forecast with dave munsey on fox 10 news. hi, everybody. here we go. 90 degrees. we have got winds out of the west at 8. you can see the looking pretty good midweek. we have 84 degrees up in deer valley, 84 degrees in fountain hills, 81 degrees in apache junction, and in surprise 81 degrees as well. a little bit of moisture, just kind of along that border area here coming in, moving out very, very rapidly, not much left of it. dew point temperatures, as you can see, down into the 30s. we have got some teens showing in the mountains, but mostly 30s.

we saw the moisture in the southeastern portion of the state. the high today goes to 98 degrees in buckeye. we have 93 degrees, 95 degrees in deer valley, 97 degrees in chandler. other numbers that we have, 73 at show low, 70 at flagstaff, 91 at lake havasu and 95 at gila bend. this is your -- these are your numbers here. 98 on the high, 76 on the low, 101 the normal high. we have 78 for the normal there's your record high at 112, 58 is the record low for the day. this is what we are forecasting, about like today. it will be mid-90s, some you were 90s showing up. there's a few low 90s in that mix as well, some 70s across the north, we do have a few 80s mixed in as well, 97 forecast at gila bend. look at what we are forecast tonight and tomorrow morning,

in fact a few low 60s, mid sixties showing up out there as well. looking across the country, the frost warning is out for montana, so the cold weather returning for those guys, flooding and heavy showers. well, i'll put the heavy showers first and then the flooding, and of course a tropical storm down in the southeastern portion of the country. this is julia, 40 miles an hour winds, very, very slow moving. in fact the track that julia is going to take is right here. i'm going to give you the next three or four days here, and as you can see, this thing just comes out, comes back in, and that's about it. it does have the winds staying at 40 miles an hour early friday, might pick up a little bit late friday. they did have a 45 in there, but they are going back to 40 miles an hour. but here we go with those temperatures still hanging on into september. we are seeing 96 in memphis, 91 in atlanta, 91 in charlotte, 92

to my grandson that, hey, this guy is going to rob this place right now. >> larry says that he was at the wells fargo at 19th avenue and bethany home road yesterday. a person in a hoodie walked in acting suspicious. larry says the crook slipped the material a note, and that's when she hit an alarm, sending that suspect running, and larry followed after him. >> they let me out the door, i locked it up, said i'll go get him, the suspect around the walgreens. he took off his sweat jacket. i seen him there, tried to catch him. he threw it in a trash can. >> larry was able to give police infrmation that lead to an raet. law enforcement says they don't encourage people to step in and do something like this, but they did thank larry for his hard work. a new twist in the valley freeway shootings case, leslie merritt, jr., the man once

suing. >> his lawsuit against state and county officials claims false arrest and false imprisonment. merritt spent seven months behind bars before the case was dismissed. steve krafft has reaction from the maricopa county attorney. >> he was accused and then freed in connection with the valley freeway shootings, but now leslie merritt has filed a lawsuit against county attorney bill montgomery. the heart of the 22-year-old leslie merritt's claim that he was arrested in connection with the valley freeway shootings, causing him to be locked up in jail for a crime that he didn't commit. >> there is no evidence today that he was the i-10 shooter. phoenix is absolutely no safer than it was at the time of

>> reporter: merritt's attorneys argue that there was no evidence of a link between merritt's gun and the freeway shootings. county attorney bill montgomery says the investigation remains open after that string of cars and trucks were shot up on valley freeways, and charges could be re-filed if the facts call for prosecution. but he was tight lipped about the lawsuit. >> i'm aware of it, and we'll handle it as we go forward. there's made yet, whether or not this office will handle the defense of the case within the office or if we will, after review of any potential conflict or appearance of a conflict, if we might assign it to outside counsel. >> reporter: the lawsuit does not contain a demand for a specific amount of money. mr. merritt's attorneys would not discuss how much money they might make if a jury finds in

specific response to the claims made in this lawsuit. steve krafft, fox 10 news. a big heroin bust at our southern border, a 31-year-old woman arrested at the port of nogales. border agents say the woman tried to smuggle $50,000 worth of heroin into the u.s. the drugs were hidden inside a baby formula container, you are looking at it right there. the woman had her 2-year-old with her when she was taken into custody. th with a family member. remember these heartbreaking images out of ohio. tonight, we are learning more about what happened to the people in these photos. the boy we now know has been sent to live with relatives in south carolina. the couple who is the boy's grandmother and her boyfriend, were both arrested. the grandmother had apparently just gained custody of the little boy a few weeks ago. police released these photos to illustrate the severity of the heroin problem in that community.

from 11 different agencies from around the state testing their skills today. the highly trained dogs underwent a federal test created to ensure that the dogs are able to identify explosives. the response varies from dog to dog. some sit when they smell it. others will just lay down. instructors tell us if these dogs can determine the explosives in training, they will be able to do so in the real world. >> our atf laboratory, our chemist the different criminal cases across the country, all of the different types of i.e.d.s, the explosive material that's used to make those, and then they make a determination as to basically the ten most common odors used. >> the explosives change from year to year based on current criminal cases which ensure that each canine can fully detect any danger. more than a hundred first

dozen federal and local state agencies took part in a training drill at the grand canyon today. this is quite a sight. the emergency training exercise simulated a tour helicopter down on the west rim. it gave first responders a chance to test communications through a safety broadband network set up in the aftermath of 9/11. today's drill was the first ever test conducted on tribal land in the united states. edward snowden is hoping for that may be his best hope to avoid big, big trouble. snowden is the nsa whistle blower who revealed the nsa's massive surveillance programs by leaking documents. he's now living in russia. several groups are joining together to try to secure his freedom, calling on the

from russia. >> whistle blowing is the last resort upon which we all rely when all other checks and balances fail and the public has no idea what's going on behind closed door. >> the obama administration says the way snowden disclosed that information damaged the u.s., and they believe that snowden should return home and face charges. another major sporting event is leaving north carolina because of the state's house bill two, also known as bathroom bill. the atlantic coast conference announcing that all neutral site college championship games will be taken out of that state. the league says that the bill that bars transgender people from using the restroom that they identify with does not coexist with the ideals of the a.c.c. this move follows the nba pulling the 2017 all-star game out of north carolina over that bill. several players in the nfl

if you have a galaxy note 7 smartphone, samsung wants you to do a software update. the company says that update will prevent the phones from recharging beyond the 60% mark and overheating. the goal is to keep the batteries from overheating and starting a fire. the galaxy note 7 has been linked to several fires.

we are finding out this actually was no accident. the act of a young man who was trying to take his own life instead takes that of an innocent driver. fox 10's danielle miller is live tonight with more details on what we are learning. danielle? >> yeah, marc. police say that man who caused this accident is now here at the fourth avenue jail being charged with several things out here. he is 19-year-old keith johnson, and this accident happened in the intersection of road and peoria avenue around 8:00 this morning. police telling us that eight cars total were involved, and all four drivers of those vehicles were transported to valley hospitals for various injuries this morning. they are telling us that 19-year-old keith johnson was the man who caused this accident. he was actually trying to kill himself, and that's the reason why he rammed into several of these vehicles. he himself did survive, but
