mind you, and they were both on the second round of pulling them off the mountain. it's very easy to get off the trail and not know where you are going. the lesson to learn is that they actually called 911 prior to them really, really needing some significant help. we were out there last week for someone that it was just too late for and i think that was the good thing to learn. they alerted 911 so we could rescue them without any injury. and fire crews want to remind people e weather, the temperatures will be dipping a lot of people will be out hiking since our weather isn't so hot. they say you still need to be just as prepared as if it were triple digit temperature. still have plenty of water and they want to remind hikers that they have been receiving several calls of people lost at night here on camelback. they tell us it is never a good idea to go hiking at night. obviously today with this example here, if these women can get lost in the day, you definitely can get lost at

american airlines plane forced to make an emergency landing at sky harbor this morning. the plane was on its way to phoenix from portland, oregon. the faa says the pilot radioed the tower that they flew a tire on takeoff. the trucks followed the plane as it rolled to a stop and was really a landing without any problems. no problem at all. you decide. we have an election alert. arizona state senate president andy biggs has won the recount in district 5. >> it was close. biggs winning by 27 votes. giving him a victory over challenger christine jones. >> jones conceding the race minutes ago and marcy jones is live with reaction. it's still so close but it was even closer before so he gained some votes. >> absolutely. and after so much back and forth it appears it may be finally over until november. christine jones just came out to talk to us. she said it took so long to get down here because she wanted to

offer her congratulations. here is what happened. judge joshua rogers read the recount. the result is bigdz at 25,244 and christine jones coming in at 25,217. this time a difference of 27 votes. judge rogers had yet to rule on jones' request to review 577 overvote ballots. now those were considered originally excluded by county election officials because the machine picked up marks for more than one candidate. the argument camp was they should be examined to determine if the voters intent was obvious. now jones says her camp is laying down their swords and accepting a loss. >> hardest part about today was knowing that in the end there were more than 300 voters in congressional district 5 who tried to vote whose votes didn't count either because their signature didn't match registration card or because they voted in the wrong precinct

right precinct. that is a meaningful number when you are separated by nine votes and i hope the county recorder's office and i have every confidence that they will, learn from this experience and improve it the next time. >> jones came down smiling but yet with the hint of sadness in her eyes. she is not ruling out ever running for any position again, but she can't really wrap her head about being on another ballot just yet. come november. she is voting all republican all the way reporting live, marcy jones, "fox 10 news." massive fire on the u.s. 60 closes down the freeway and as you see here it backs up traffic for miles. this all during the morning commute. the fire sparked by a crash involved almost a dozen vehicles and in all when it began, the dump truck was going west. it crashed into an eastbound lane of the freeway near alma school road. the cars collided with they caught fire.

backed up it it was a cleat mess. traffic nare -- complete mess. traffic narrowed down to one lane making that commute extra slow. the road re-opened after the wreckage was cleaned up. some four and a half hours later after the crash. one set was out -- look at this. this was amazing. take a look at what things look like afterwards a charred wreckage here from the fire. the burned out vehicles from the damage is kind of hard to believe that anyone that no one was killed in this. this way. it was sparks and everything and fire. then i saw maybe this inches away from hitting the debrises a couple of seconds later the car hit me from behind. the flames are going up so we had to back up our vehicles. seriously, i was amazed that no one seriously got hurt. >> as foi the -- as for the driver of the tow truck, dps is still investigate wag caused him

tense homes -- tense moments along a valley freeway this morning a wrong way driver speeds down the 202 narrowly missing other drivers and many of whom called 911 to figure out what the heck was going on. here is the route he traveled. picked it up at dobson and the 202. eight miles. eight miles. almost really all the way over there passed sky harbor airport. he traveled in the eastbound lanes on the 202 calls started pouring in. and with the guy and then he traveled eight miles way over the speed limit and tonight we are hearing from the passenger who was in that car. anita roman has the story tonight. according to dps, this man was a passenger in a car that drove the wrong way at 90 miles per hour for nearly eight miles. >> all i know i was sleeping the whole time. yeah. >> original call was westbound in the eastbound lanes around the 202 and the 101 area.

said dobson and it continued westbound in the eastbound lane. >> multiple officers responded as the blue hyundai continued from dobson toward 32 street. that's where it trooper traveling westbound in the west bound lanes spotted him. the driver has been identified as 26-year-old fernando lopez martinez. >> the -- i thought was a vehicle looked like making a u-turn on the freeway with its headlights off turn the eastbound. >> the driver when on to 40th street where dps says he exited the freeway. took the underpass and got back on to the 202 in the westbound lanes. eventually exiting again at 4th street. >> the driver pulled into the street and parked in front of the business over here. and helicopter followed it and then our officers arrived and prior to the arrival is when we found the helicopter pilot said that passenger and driver had switched seats.

but i can't say because i don't know. >> according to dps, the passenger passed a feel sobriety test and was not charged at the scene. the driver was taken into custody on suspicion of dui and will face additional charges of endangerment. anita roman, "fox 10 news." and about those additional charges of endangerment. dps saying that stems from the drivers who called 911 who had way to avoid a head-on collision. construction workers have to beginon mountain loop 202 expansion. the first phase of construction will include improvements at the interstate 10 loop 202 interchange near pecos road. adot plans to widen the shoulders and extend the existing high occupancy vehicle lanes from pecos road near 48th streets new interchange. there will be only -- there will only be one eastbound lane of traffic on pecos road. westbound traffic will not be affected immediately. the initial phase of

a new page of controversy for sheriff paul babeu. sources tell us the fbi has subpoenaed records related to how babeu's office used seized criminal money also known as rico funds. critics have said pcso's use of the foundation is like money laundering. and they've also accused babeu of using the funds to fuel his campaign. it may already be illegal campaigning with government resources.

>> well, some argue it could be. this stems from the arizona supreme court recently upholding a sexual molestation conviction. but it is what the judges wrote in their majority and dissenting opinions. could this land you in court? it's unlikely but possible. according to the two dissenting justices in this 20 page state supreme court ruling. the justice examined the language in arizona sexual abuse laws which do not reqre intent in order to be charged. >> the statute says intentionally or knowingly having sexual contact. right? sexual contact is just the direct or indirect touching of the gentiles of somebody else or of the child. that is where the whole changing of the diaper could come into play. >> in the ruling, the majority writes prosecutors are unlikely to charge parents, physicians and the like when the evidence demonstrates the presence of an affirmative defense. however, the dissenting justices
