thank you for joining us fox 10 news at noon starts now. thank you for being here at we begin with a weather alert. skyfox catching a dust storm moving in. we have blowing dust and rain moving through the valley this afternoon. >> well, earlier we saw some storms working their way to the valley from the south. >> yeah, let's get to cory who is following this whole thing. and cory, what is this, is there any bluster behind this, or is this going to be one of those thin little dust storms, and that's going to be about it? >> you know how things go here, and we love to see the rain

sure enough we have got some going now, through the last half hour or so, continuing to i have the its way up north. if it does, if you're up that way, you want to keep your eyes on the southern skies. there wasn't a whole lot of rainfall when it came through, but it did push that dust in the direction of the valley. right now most of the heavy rain is here along the beeline highway if you're headed up out of mesa. towards payson you're going to encounter some brief periods of heavy rainfall if you're in between those two towns, but all of this is headed to the north and west, so camp verde and everybody west of the 17. from the valley, showers from 101 north ward toward cave creek, desert highlands, and up towards desert mountain and so forth, north scottsdale, along the mountains, seeing pretty good rainfall too. that's kind of the way the day is going to go. we have all of this drifting toward the west, a low cut itself off, everything circulating around, you can see

direction out here around lake havasu city. we'll be under this area of clouds and showers for the rest of the afternoon. we'll keep an eye on it all, full forecast coming your any in a couple of minutes. a border patrol agent is dead after police say he was involved in a standoff with officers. fox 10's nicole garcia live in maricopa this afternoon has the latest on this story. nicole, what can you share with us? >> yeah, celeste, more than 12 hou investigators remain here at the home. they are investigators with maricopa police and the border patrol, the medical examiner just arrived. and you can see there is still a lot of evidence of that shootout here that happened last night. you can see those shattered windows up there on the second story of the house. that's where police say jeremy russo, who is a border patrol agent, opened fire on a maricopa officer who was arriving here responding to a domestic violence call. police believe he was shooting

rounds from russo's rifle hit at least three other homes directly across the street. police say one maricopa officer fired five rounds at russo after that officer was shot at. that officer was not hurt. neighbors told us they heard about a total of a dozen gunshots go off last night. >> there was all kinds of noise before we went to bed. we heard gunshots. i thought they were probably firecrackers, but my husband knew it was gunshots, and then we went to bed and there was some more shooting, and then the flash and bang, and the helicopters. >> reporter: now the d.p.s. swat team was also out here. they responded to the shooting, had to blow in the front door, and they sent their robot into the house. it was that robot who discovered

an upstairs closet. investigators are still waiting on that medical examiner to tell them exactly how russo died, if he killed himself or if he was hit by a bullet fired by one of the maricopa officers. again, the cause of death is still under investigation, the medical examiner just arrived on scene. russo's three children and wife were able to get out safely, and russo's wife did tell have been drunk at the time of the shooting. thank you, nicole. a tragic accident leaves a man dead after he was hit while trying to change a tire on the side of i-17. the person who hit him has been arrested. the car pulled over last night, on the white line there. there were three people with him when he was hit who suffered

disabled vehicle, was hardly even damaged by this collision. it's just a tragedy that the people riding in this vehicle were seriously injured and there is a fatality as a result. >> and it also brings up the dangers of trying to pull over and change a tire on the side of the freeway. trying to get off the road if you can. the driver of the truck that hit this young man, 61 years old, police he may have been under the influence at the time of the crash. on to another developing story, this one in the west valley.ppolice say overnight. this is the easy pawn near 94 avenue and bell road in sun city. turning to political news, donald trump and hillary clinton took part in the first presidential debate. >> and at several points it was the heated fierce contest that many were expecting it to be. the republican and democratic involuntary manslaughter taking the stage at hostra university.

that were demon stra bli untrue. >> i hit her harder in certain ways. i eased up because i didn't want to hurt anyone's feelings. i may hit her harder. i don't know if it's the same forum or a similar forum. >> the vice presidential debate a week away, and hillary clinton and donald trump will take part in two more, the october 9th. a tribal group holding a prayer run today, the group one of the groups against the construction of the south mountain freeway, saying it will destroy a mountain considered sacred to them. the run will be held at 4:00 p.m. at the freeway resistance camp at the gila river indian community. construction on the freeway began last week. the ten-mile run will end in ahwatukee, where a.d.o.t. is hosting a public meeting on the freeway tonight. >> that meeting will be held

desert vista high school on frye road. there will also be meetings held tomorrow at betty fairfax high school and on october 6th there will be another meeting, that one will be at fowler elementary school. coming up here at noon, we will have the latest on that shooting in a mall in texas. what police are still trying to figure out here. police, the big announcement planneded from spacex with the ambitious company may be planning to do in the next

a new page of controversy for sheriff paul babeu. sources tell us the fbi has subpoenaed records related to how babeu's office used seized criminal money also known as rico funds. said pcso's use of the foundation is like money laundering. and they've also accused babeu of using the funds to fuel his campaign. it may already be illegal campaigning with government resources. or if they're just being used to make the sheriff look good, as he runs for congress.

you're watching fox 10 news at noon police in houston still trying to figure out why a local attorney went on a shooting rampage yesterday, injuring nine people before being shot and killed by officers. investigators say the suspect

on it. he started randomly firing at drivers in a houston neighborhood. he had two weapons, more than 2,500 rounds of ammunition. detectives later found more weapons and ammo inside his home. police are now looking into whether money problems could have triggered this whole thing. preparations for the trial of dylann roof, who is accused of the deadly south carolina church shooting, continued today. more jurors courthouse. he faces 33 counts following shootings of nine black church goers. jurors will continue to report this week. the those jurors will be summoned back to court in november for individual questioning before the trial begins. another day of protest in south carolina following the fatal shooting of a black man b

emotional audience made voices heard calling on the mayor and city for reforms. also a sad day in new york this morning, a firefighter is dead and several other people hurt after a fiery explosion in the bronx. it's an unbelievable sight, as you can see. crews have been called to the home to investigate a gas leak, being reported that it was actually a drug lab two-story home. hit by flying debris when this explosion took place. the lab reportedly used to grow marijuana, still unclear what sparked the explosion. coming up later in the show, elon musk, the ceo of spacex, could have something to do with space travel in the future. we showed the showers to you at the top of the show. find out if you might be in line to get wet, all coming your way in the next few minutes.

it along, but some people love the run, so i don't want to disappoint those folks. by the time the weekend rolls in, everything is going to be fantastic. if you love the sunshine, you are in the right spot because the weekend is going to be great as well. but for now we are under these low hanging clouds. they look so terrific. we are looking northward here from the top of south mountain, and this is the kind of day we are in for, gray skies, drizzly at times. we have seen even some blowing dust. i think we'll still have a chance at some some of that as we move into the later hours of the day. your story at the moment, 96 the typical high, 106 the record, we won't be near even the normal today. we'll cruise through the afternoon in very cool style. here's the way everything looks out there, a low circulating its way here across arizona. it's not moving anywhere fast, and i think it's going to stick with us for the rest of today, probably into tonight.

tomorrow as well, as it kind of drifts itself slowly off to the east. so if this is the kind of weather you enjoy, good for you, because you still have a shot at some more of it. let's bring things in close, show you who is getting wet. again the rain continues to circulate around in a counterclockwise motion around that low, working up the beeline hee up towards camp verde, all points west of the 17 as prescott another shot. here in the valley, a couple of sprinkles having just popped up here in glendale, west parts of the valley, and kind of up along the grand avenue, if you're going to be traveling that way. but from the 17 northward from the junction of the 101 all the way up here to the northeast through cave creek into desert mountain and north and east of there, you're going to find a rain, and some of that rain is starting to pick up, getting a little bit heavier there. that will continue its drift off

city and so forthment also out here along the colorado river, still kind of busy there from lake havasu city up towards kingman. the futurecast, as we put it all in motion for you, we will expect to see the same formation of showers stretching in kind of an arc from southeast off to the north and west. but they can't last forever. in fact, by the time we get on into thursday, as everything kind of drifts itself off to the north and east, we'll still see some cloudy skies and maybe some mountains but things will start to clear out pretty well across western arizona by thursday afternoon, and then as we get into friday, man, off we go. we are going to be in for a terrific stretch of weather from friday right on into next week as the first full week of october will really look and feel like the first full week of october. but here's the way we stand now. we won't get a whole lot warmer than what you see at the moment. so we are going to finish off the day in pretty good shape. here's that forecast, 89 about

a big fox 10 news is back. big announcements expected from spacex ceo elon musk today. we have some video from a previous launch from spacex. it's reported the company will reveal its plans to take humans to mars in the next decade.

there on the red planet, so he's giving a speech discussing the challenges that need to be solved in support of a, quote, "self-sustaining human presence on mars." he said several times that he founded spacex in part to colonize mars. the lawsuits are already piling up for yahoo over the 2014 hack that exposed the account informing of 500 million people. three lawsuits have been filed so far, and two of the filed in san francisco seeking class action status. the company has not commented on the suits. days after snapchat announced developing its first advice, the photo sharing app hit a big style, more than 60 million active users in the u.s. and canada, 40% of the 100 million active worldwide.
