threats are investigated. reporting live, danielle miller, "fox 10 news." police shooting in northeastern arizona leaves an officer wounded and the suspect dead. this happened in kingman while officers are serving a search warrant. the suspect, jeffrey cave, fired at police hitting the officer. police returned fire and cave was pronounced dead at the scene. the officer who was wounded was rushed into surgery and is now in stable condition. and the man accused of trying to run down police officers with his car pleads not guilty in court today. marc payne is facing a long list of charges including three counts of attempted first-degree murder. he stood silently while the judge entered the plea for him. paip purposely drove into a group of police officers. the video captures it all outside of the qt gas station. near the i-17 and camelback it was one of the officer's first night on the job.

this just, in mesa police are asking for your help finding an 11-year-old girl who is missing. brianna delou was last seen this morning about 8:00 a.m. she was wearing her school uniform. blue pants and a red polo shirt. she was last seen with this man. donovan who is known to the family. brianna is mentally disabled and her family is concerned about her well being. if you have any information call mesa police. scary moment for a hotel gunmen robbed a worker at gun point this happened earlier this week at 3:00 in the morning at the day's hotel near 89th avenue and grand. the suspects walked into the lobby. one goes up to the desk pointing the gun at the victim while the second suspect who was a woman went behind the desk to steal cash, because of the masks we don't see their faces. the pair did flee the scene in a black four door dodge ram driven

anyone with information about this crime should call peoria police. and chandler police searching for a man they say fired a weapon inside of a goodwill store near alma school and ray road. police say employees got to work this morning and they found the man inside the building. and that's when he fired a shot and then took off that store was evacuated. nobody was hurt. police say there were signs of forced entry in the back of the store. that suspect is described as an hispanic man, 6'0" wearing a gray shirt and pants and hat. skyfox over the scene of a construction accident this much is near tatum and doubletree ranch road. four workers were injured after scaffolding collapse. they fell between five and ten feet. and three of those workers had minor injuries and were treated at the scene. fourth worker had to be taken to the hospital. we are told he should be okay. >> police in avondale have released the name of the young boy who died after accidentally

police have not said how the little boy got his hands on that gun. no arrests have been made at this point. a teenager accused of opening fire at an elementary school in south carolina will be in court tomorrow. the teen's name and age have not been released. the police believe he shot and killed his father at their home and then went to the school and opened fire and students and teachers were headed to recess when this happened. one teach and two students were wounded. the teacher and one of the students have been released from victim, a six-year-old boy is still in the hospital in icu. what a scene in new jersey this morning during the commute. one person dead. more than 100 others hurt when a commuter train crashed into one of country's busiest train stations. tens of thousands of people use the hoboken train terminal every day to get into and out of new york city and today at the height of rush-hour, a train plowed into the waiting area.

didn't stop and people are falling over who were standing. and then the roof came down. >> witnesses say the new jersey transit train smashed passed th& end of the line barrier. crashing through a wall and pillars ultimately collapsing a section of the terminal's roof. >> the woman in front of me -- and the gentleman hit his face right here and it's bleeding but he was helping people because he didn't realize he was injured. >> falling debrie killing a woman standing on the platform in the staichtion crash injured more than 100 people. >> extraordinary reaction from local law enforcement and ems. along with civilian passengers who assisted in evacuating the trains as quickly as possible. and helping with the triage of the passengers who were injured. >> new jersey governor chris christie says the train's engineer has been cooperating with investigators but is injured in critical condition. >> what we know is that this

speed into the station and crashed through all of the barriers bringing it right to the interior wall of the hoboken terminal. new tonight at 5:00, thousands of beauty schools students showing up to class today only to learn their school has been closed. regency school has 7. schools across the united states including two here in arizona. stefania. what have you learned about this? what happened and these people have to be horribly disappointed. >> yeah, that's right. really a slap in the face for most of the students here at regency beauty institute. they came to school and found this note on the door letting them know the school was going to be permanently closed. i reached out to the department of education and learned one of the 79 campuses they was placed on probation for not meeting financial standards. rather than fixing the issue

and close all 79 of their schools. >> we were all giving up a lot of things for this and it just happened out of nowhere. we didn't get warnings, nothing. >> dozens of students of regency beauty institutes in the valley woke up this morning with a big question mark on their future. >> my heart sank because what i love to do is just got taken away. >> students from the cosmetology school tell me they got word yesterday evening from the school that they would be shutting their doors nationwide due to financial issues. blame, quote, a negative characterization of for profit education by regulators and politicians that continues to worsen. today we learn from the department of education that one of the schools was on probation for not meeting financing standards and were giving 75 days to fix the financing but instead we are told regency decided to pull the plug and shut down all 79 locations. leaving these students grambling. several of them rushed to the

locally owned beauty school has opened up their doors to work with students on transferring but many of them still have questions. >> i just think they should have given us a notice like headquarters was down here last week about talking about all of the opportunities we had. >> perhaps the biggest concern for most of these valley students the thousands of dollars they took out in federal loans to attend the school. >> a lot of money. >> almost 20 grand. that's a lot. >> i don't know what to do right now. >> the national accrediting commission for arts and career says they will work with regency to place the students who would like to transfer at new institutions and as for those federal loans, the department of education says they will work on close out. students will have to contact the department to figure out what's happening with their loans. you can find that information on our website, fox10phoenix.com. we want to welcome you to fox 10. you are our newest reporter and

the race for maricopa county the race for maricopa county sheriff takes a bitter turn as sheriff joe arpaio is now being sued by his opponent paul the sheriff calls the lawsuit a political stunt. this all stems from a tv ad that you may have seen. the sheriff is running it right now claiming that paul penzone was once accused of abusing his ex-wife. andrew hasbun is looking into it and joins us live with reaction from both campaign. >> that ad is running all day and no indication it will be taken down. the allegation stem from a divorce many years ago. he says they aren't true. he and his ex-wife have worked

dropped. but arpaio's campaign says what is in the police reports are fair game. >> the ad cites a police report from 2003 while penzone was going through a separation from his then wife. the ad claims penzone was abusive toward her and today penzone fired back. >> there has never been a time in my life bring ever hurt, harmed any woman or child including my former wife. >> penzone says the issues between his and his wife were resolved and she signed an aft clai and the case was tossed. >> the actions that mr. arpaio has engaged in constitute defamation and false light of an innocent family. >> the arpaio campaign responded by showcasing the police reports from the 2003 incident where glendale pd responded to an alleged assault. >> the fact of the matter is the arpaio campaign has every right to look at police reports and court records to tell the public what they find in those records about paul penzone.

lawyers for penzone have no way to get them taken off. arpaio's lawyers say they plan to countersue. >> this lawsuit is a political stunt. >> paul penzone will disagree. i will fight to protect my family. where he cares about keeping his office. >> both candidates will not take any questions today. arpaio's campaign plans to spend millions on tv ads leading up to the november election. i'm andrew hasbun, "fox 10 news." orange is the new diane guerrero in the valley to encourage latinos to get out and vote. guerrero has been politically active this year pushing for immigration policies that will allow families to stay together. her parents and older brother were deported back to colombia when she was 14 years old. guerrero pushing to keep immigration issues front and center during this year's election. >> we can no longer just whisper immigration. undocumented. no, you have to say immigration, undocumented we have to fix the

because you deserve leaders you can trust. hi, folks, we started out with rain. it was a light rain, 92 degrees right now. winds out of the north, hour. we have 93 degrees right now in glendale. 90 degrees in fountain hills. at gateway 91 degrees and ahwatukee 94 degrees. there is your moisture. we have seen it through the day today. you see the early stuff kind of coming through here working its way through the valley. but right now we aren't seeing much as far as the valley is concerned. that's the early stuff that came through, the afternoon stuff. down here in the southeast here,

sierra vista. some big storms by safford on the day today. and then we did see some good storms up north as well. get you to look at flagstaff area and encroachment of another storm -- there you go already gone through there. that's moving pretty fast at this time. and then you can see on the west side a little bit of active weather as well. and this is an area that we are looking at as far as flood area through the night tonight and there is a couple of them out there where they will see a the night. and then take a look at this see how this rosalynn and still some of the moisture, remnants of the moisture of rosalynn making it up into the state. look at some of these numbers that we picked up. .75 of an inch in show low. .48 an inch and then 67 in the winslow area and then scattered amounts among that. dew point temperatures, yeah, they are up and will be staying up. you can see some of those numbers getting back up into the

again as well. 93 degrees. that's the high. we go to today. you see that 91 at goodyear. 92 in scottsdale. 73 up in page. 87 at kingman. 72 in sedona. and 93 down in tucson. this is your day. 93 on the high. 75 on the low. 95 and 72 normal high and low. record high 107. record low at 52. this is what we are forecasting for tomorrow. 93 degrees. we will be very much like were today as we look across the country, there is a few things going on. look at that moisture finding its way in that flooding in iowa, now it's in illinois and it's in indiana. a little bit of kind of fighting its way and still in iowa as well. and then also heavy thunderstorms up to six inches of rain. in some of these outer islands here and that thunder continuing out there and then one thing we did want to remind you about and that is matthew, matthew, this

animal control animal control officers have a mystery on their hands. how did this chihuahua get himself stuck on the roof. that little dog was rescued after spending several days on the roof of a south phoenix home. nicole garcia is live now with how the story played out. >> well, he didn't have a name so nicknamed this little guy rufus, unfortunately we never know how he got up on the roof but what we do know tonight is that he is safe and sound.

no place for a dog. but somehow that's where this chihuahua ended up. >> he was -- seemed very calm being up on the roof. he was walking around. didn't seem to be afraid of anything. kept walking back and forth, side to side. he obviously wasn't afraid of falling off. >> after being stuck up there for a week, help arrived. officers with the arizona humane society and maricopa animal care and control got a ladder and some dog food and were able to lure them to safely take him down. >> when i picked him up here to look at him, he just kind of hugged me. he acted like he was thankful to be down off of the roof. >> animal control officers say rufus here is a stray. he didn't live at the home he was stuck on so now they are hoping his rightful owners will come forward. >> the doug who we will call rufus is in decent help. he looks underweight but is otherwise fine who he belongs to

related to how babeu's office used seized criminal money also known as rico funds. critics have said pcso's use of the foundation is like money laundering. and they've also accused babeu of using the funds to fuel his campaign. it may already be illegal campaigning with government resources. or if they're just being used to make the sheriff look good, as he runs for congress.

hit-and-run victim and the woman who saved her life share their story. monica is just a freshmen at gcu. hit by a car, left in the middle of the road. >> luckily for her, jesse her guardian angel saw what happened and then rescued her and tonight only on fox 10, marcy jones spoke to the pair about that life changing day. >> this is really an incredible story. as you both know, recently we have been covering a couple of stories where something bad has happened when a tries to step in. when i talked to jesse, she said nothing was more important and on her mind than stepping in and helping to save this life. >> monica and jesse may look like old froans but they -- friends but they met three weeks ago. the day monica almost lost her life. >> with a blink of an eye i see a human, a petite little human up in the air and fall into the next lane. another blink i just blinked
