fox 10 news at noon starts now. thank you being here at noon. sheriff joe arpaio back in court today for a special prosecutors now say they are filing criminal charges against the sheriff. >> well, the hearing just ended and fox 10's nicole garcia was just in court and joins us live with what that means for the sheriff. nicole? >> reporter: the sheriff's attorneys weren't anticipating anything major to come out of today's hearing. in fact the sheriff was not even here at today's hearing. he wasn't required to be here, but federal prosecutors saying today they will formally file criminal contempt of court

and the criminal case against the sheriff has officially begun today. but unlike in many criminal cases there will be no formal arrest. the sheriff will not arrested, there will be no mugshot and there will be no arraignment. the judge agreed to waive the arraignment and the sheriff's attorneys are saying that he will plead not guilty to the charges. arpaio could face up to six months in jail if he is convicted. now, federal prosecutors want to get this trial going. they are asking the judge for a bench a trial without a jury, but the sheriff's attorneys want a jury trial. mel mcdonald, the lead attorney in this case, is saying the sheriff is an electe official and he should be judged by a jury of his own peers. again, arpaio is saying that he is innocent of these charges, that there was no malicious or willful intent to disobey the judge's orders, but as this case proceeds, the sheriff may also

as prosecutors will be investigating whether or not the sheriff committed obstruction of justice as well. a trial date has been set for december 6th, but attorneyses are saying they are going to ask for more time. again, sheriff arpaio officially will be charged with criminal contempt of court charges. reporting live, i'm nicole garcia, fox 10 news. the camp verde marshals office is now looking for a man who they say shot and killed someone at a convenience store. this is levi jones. county deputies believe he is responsible for the crime. witnesses say the 27-year-old left the scene of a camp verde circle k in a hyundai, arizona license plate brj 4045. if you know where he is, you are asked to contact the yavapai county sheriffs department. this man they say is responsible for a violent

phone and grabbed her purse and even drug the woman across the parking lot. police eventually recognized him on surveillance video and he has been booked on three different accounts. batman usual the one stopping the criminals, but at a mesa convenience store here batman was in fact the criminal. mesa police are now looking for the man who robbed a mesa am/pm at gunpoint while wearing a batman mask. police afraid to open the register so the suspect only got away with som food. if you know anything about this crime please call mesa police. new developments in a case where a burglar not only stole things from a family but shot and killed their dog in the process. police now believe there is a second suspect out there. brian tibbits arrested after surveillance video showed any more a walmart using credit cards that were stolen in that robbery. investigators say tibbits admitted to his role in robbing

about taking a computer and some jewelry. but he says he is not the one who killed the family's 7-year-old dog. he says a man named bobby who he was with shot the dog. if you have any information, you are asked to call phoenix police or silent witness at 480-witness. new details about a southern arizona sheriff official accused of using money that was in crime investigations. the pima county sheriff chief deputy has been accused of misusing funds seized in racketeering charges. the pima county sheriff's department is not commenting on the investigation. a valley couple arrested, accused of leaving their young son inside a car all by himself while they went gambling and

23-year-old brad porter, jr. and 25-year-old jessica lopez were arrested on sunday outside a casino. they found the child all by himself inside the car, also found alcohol and drugs in that car. police say the parents had alcohol on their breath when therapy arrested. it's unclear if the boy is now with a family member or in protective custody. coming up, wine country being threatened by a wildfire. we are valley where that fire is quickly spreading. there has been more and more talk about an nfl team moving to vegas, and now we are getting a look at how expensive a stadium

i learned as a police officer and a businessman you should never abuse people's trust. unfortunately, today too many politicians either serve their party or themselves, and arizona families suffer. the arizona republic called paul babeu a disgrace. babeu spent $28,000 of taxpayer money at a five-star resort and was questioned by the fbi for using public money to promote himself. because you deserve leaders you can trust. sheriff paul babeu was headmaster at desisto school in massachusetts. a boarding school rife with abuse. a lot of things went down that probably shouldn't have. this isn't about abuse or neglect, because none of this was found. except these records show the state found it, students and parents testified about it, and a judge ordered it to stop. the cornering, the sheeting, i didn't know how to

dccc is responsible for the content of this advertising. officials say a four-year-old girl will be reunited with her family in florida after she was kidnapped and driven all the way to tennessee. police found rebecca lewis just outside of memphis. a hospital employee recognized the girl suspect because of an amber alert all the way out of florida. they were later spotted in georgia but she again was found safe. she'll be able to find her family and see them today. the federal government wants to make changes to native american health plans, but the navajo nation is fighting back. the va wants to adopt a new

they want to consolidate multiple community care programs into one program with standard rates. the navajo nation vice president says the plan is, quote, "outrageous," and that it violates the government's responsibility to provide health care to native american tribes as well as veterans. parts of the wine country are burning this afternoon. a wildfire sparking near napa, the fast moving fire has forced evacuations from two different communities. so far nobody has been hurt. at least five structures though have been damaged. this is extremely many grapes grow in this region but this time of year it is extremely dry. about 50 acres have burned. crews have said that they have about 50% containment on the fire. sin city could get an nfl stadium but it would come with a price tag of $1.9 billion. >> the one in l.a. is probably more. i think it's a couple billion, but still this is a lot.

carolina, hurricane matthew leaving an emergency flood disaster in its wake. thousands of homes are damaged. others are still in danger, and so far more than 20 deaths in the u.s. are being linked to hurricane matthew with nearly half in north carolina. now officials warn of potentially life threatening flooding from swollen rivers that will continue for days. >> when you have got moving water, regardless of how deep it looks like it may be, it's very, very dangerous. >> hundreds of tho the southeast remain without power from florida all the way up to virginia. >> and we are having some weather issues here in arizona as well, in safford, schools are going to stay closed for a couple of weeks. look at the size of that hail. that's a big chunk of hail. two inches of rain fell there, also that big hail that you saw, causing major flooding to several of safford's unified schools there, and they will not

utah and it will not drift far enough south to give us any shot at it. we'll continue to see the blue sky for the most part across most of the state. off we go then, 90 in yuma, 93 in kingman, 79 in sedona, 65 degrees now in flagstaff, and as you look across the valley, well, upper 80s in many spots to around 90 or so as we get over toward mesa. around the rest of the u.s., cold shot spilling across the northern plains, 32 in snow showers across montana. a generally pretty nice day for much of the u.s. on we go to the way your day will shape up, all of this under blue sky, 90s for the deserts, 70s for the mountains, about 67 up in flagstaff, and tonight we drop to 40 at window rock, 50 in douglas, and about 58 degrees for yuma. here's the rest of your ten-day stretch. each day looks pretty fantastic, and boy, we love to see these kinds of numbers.
