starbucks, according to local police he went inside and shot a man as a result. he will face a judge for the very first time this morning. covering this case from the beginning. he joins us live with what to expect. >> hi, craig. >> good morning, kim, and good morning at home. we are going to see pedro in court. he walked into the starbucks location where i report live this morning at rainbow and warm springs. police say he's the shooting suspect, they say pedro jose garcia is seen in news 3 video walking out with his hands up, walking from the coffee shop not long after the shooting that killed a man and then left a dozens others fearing for his lives. open murder with a deadly

weapon, burglary while possessing a gun. these are all serious crimes. he also has a rap sheet, which we began to learn about yesterday in 2003, guilty on a felony assault charge. he did get probation in that case, but then was accused of violating probation in 2004. he went to prison for two years for violating probation. we'll see him in court this morning. i'll report live on news 3 live at noon. studio. >> we're hearing from people that were inside that store on sunday. including one man who tried to save the life of the victim. >> he's breathing. he was actually fighting us and telling us to let go, don't touch me. we were like, sir, if you don't let us help you, you're going to die. we laid him out, i cut his shirt off. and then we began to cpr, after we saw he was unconscious.

the financial markets seem to think that hillary clinton won that first debate in the presidential race last night. future are higher, not even close to where they were overnight. the mexican peso gained. that's a reversal in trends that we have been seeing as donald trump has been climbing in the polls. investors >> coming up in 43 days, we're going to vote on recreational marijuana use for people, at least one new study out here says that would be good for our economy. >> in colorado, they have actually seen some economic boost from legalizing marijuana. so in the state of nevada, it would create thousands of jobs, reduce black market sales and generate millions of tax dollars for education.

when he stopped into that starbucks and turned into a hero among us. the next day he actually went back to work saying it is important for him to get back on the job to look for some sort of normalcy in what was such a bizarre related incident. 5:37. he calls himself the duke of manchester and the duke is going to be in the court room this morning michelle velez is live in downtown las vegas with more >> reporter: his nameal lex ander montague manchester and he has been in las vegas in jail since august stemming from a couple of different charges, felony and misdemeanor charges against him including robbery. his arrest stems from an an allegedly false police report claim he was attacked by his wife. now his attorneys say they are concerned about his medical condition and today in court, they are expected to ask for his release in what is a medical necessity.

two months of hurricane season in this country but this is not along the coast of florida. this large storm is ready to make landfall in taiwan this afternoon. they are saying they will have sustained winds of 96 miles per hour with gusts up to 118. in that part of the world, they call these typhoons but the same type of storm as a hurricane here. earlier this month typhoon killed at least 28 people in china and taiwan and cut power so not a good situation right now in taiwan. at 5:46, the little blue bird and the mouse will get together. that is the talk. everyone is atwitter whether walt disney will buy twitter. bloomberg is all over this one. bloomberg says disney is working with a financial advisor to make a possible bid. twitter is looking at a acquisition deal worth some 30 billion. the teal would give disney the
