fatality accident which happened overnight hours. southbound on the decatur past sunset before the 215 beltway apparently witnesses say the driver was out of control popping willy's set of hot dogging and went into a single vehicle accident and then later died. right now there's still police on the scene investigating we have seen cars being able to get through on either side but they do need to swing wide to get around that one. elsewhere checking travel the green right now no delays right now on any of your major freeways. one other accident after the far northwest overview by the 215 and the 95 in oakland was being cleared out of the way but we still had some flashing lights from roadwork and the area. >> kim: new this morning we take you inside the deadly starbucks shooting here in town. we have new details to share with you let's check and live with craig. this time yesterday morning talk about a report by the

that the shooter and the victim knew each other. sounds like that is not the case this morning as we get ready to see the shooter in person for the first time in court. >> reporter: it does but there's more to the mystery that surrounds all of this that began to unfold around 11:30 a.m. sunday morning. the charges against pedro garcia include murder robbery with a deadly weapon and berkeley while possessing a gun all very serious charges. especially when you consider th been in prison before and somebody they went to prison for violating probation. talk about the police report obtained by news 3 yesterday which had some fascinating and puzzling new information. in the police report in the drive-through garcia apparently ordered a bottled water he tried to pay for it with a credit card the card had his name on it but the security chip had been removed so the starbucks employee could not process the payment but let them have the water anyway.

the water. it was a short time later that garcia left the store left the drive-through tractor went into the store and there was a shooting it was 41-year-old alexander who was killed in that shooting. he was identified yesterday. we'll see the suspect garcia and court 7:30 a.m. this morning. >> dana: we heard they had a conversation before the shots rang out.look like there was some sort of a face off and they say that garcia said are you ready to pull on me are you ready to draw on me dog. on him and did not pull a gun out and garcia the only one who shot that afternoon at that starbucks at least according to police. metro corrections officer recovering after being beaten by a convicted killer. inside the county jail the inmate 54-year-old david frost dick sentence two weeks ago to life in prison with the possibility of parole for killing his fiancie. robin jenkins. now he's facing new charges. police say on wednesday the attack in officer behind bars. >> during that fight that

he was struck with a flashlight that became dislodged from his belt and the base area. and was being choked out by the suspect legs. >> thankfully the corrections officer only had minor injuries. the entire incident by the way caught on camera. district attorney still wilson says avidia will be used against frost dick when he appears on this new case next month. >> that burglary suspect here in town is confirmed to be related to british royalty. we know that he's agreed to other day. that is 53-year-old alexander montague manchester. facing charges for three different crimes including burglary and also filing a fake police report.he happens to be australian but it turns out there's some investigative reporting that he is indeed related to british royalty. the duke of manchester is going to be in court again to
