92 at 4:00. and big changes are coming this weekend. wait until you see highs for next week. >> kim: will see you in ten minutes. kelly, thank you. 6:02. big questions does that suspect in the deadly starbucks shooting locally need a new attorney and if so, can his case move forward? we check in with craig who has been covering this case since the beginning. hey, cra. kim. good morning to you at home. pedro garcia is being held without bail in that terrible starbucks shooting attack. and a judge appointed a public defender for him. he is 34 years old and accused of murder an other -- with murder and other serious crimes what happened. a judge appointed a public defender. reported edward cain to rep garcia.

check things over to make sure there are no people involved in this criminal case that he had worked with before this they would be called "conflicts." he need to check that out before moving forward with representing garcia. pedro garcia will be in court and his current public defender edward cane will be there as wellle. he said earlier that today friday morning he will be able to tell the judge if he had conflicts. if he does, he will appoint a new attorney, if he doesn't he wi garcia and that a preliminary hearing in this case will be set. i will be in court at 7:30 when all of that begins to unfold. we will let you know what happens on our report on news3 live at noon. i am reporting live, news3. >> dana: craig, thank you for that. the funeral for former prime minister shimon peres taking place in jerusalem.

his funeral when palestinian president mahmoud abbas shook hands with israeli prime minister benjamin netanahu. the two have not seen each other face to face in six years and they held a warm moment at this funeral. peres died two weeks after suffering a stroke in israel. he was 96 years old. happening right now, we have federal investigators sifting through all of the wreckage in hoboken, new jersey. you saw that play out as breaking broadcast yesterday morning, and they are trying to figure out what happened before that train barrelled through the station too fast, smashing through a concrete and steel bunker. we do know a 34-year-old mother was killed by falling debris during this accident and more than 100 others were injured. investigators from the national transportation safety board are attempting to determine how fast that commuter train was going when it crashed in a very busy hoboken station and ground to a halt right there in the waiting area.

6:12 now that teenager accused of shooting three people at a south carolina school is to appear in court later on this morning. he will be in juvenile court. the judge has not yet decided whether cameras will be permitted inside that court room. two students and a teacher were wounded in the incident at townville elementary school. authorities also say that teenager killed his own father at their home. and we also understand according to authorities that the teenager called grandparents right before the shooting at the school. one boy that was hit at the school jacob hall remains in critical condition. his family says he is on life support. a vigil held for the hall family yesterday, and a go fund me page to help with medical bills. it is now 6:13. and a police officer is wounded. a suspect is dead following a shootout not far from what we are watching right now. takes us to neighboring

about eight hours in from the noon hour to almost 8:00 last night. police were chasing a man that they thought had open fired the week before at the miracle mile shops or the mobile home park. he is eluding police, had a flat tire, got of his car and ran on the freeway and was hit by a semi truck. this driver said he almost hit the suspect. >> the first reaction is to brake and after you see him run across the rest of the freeway, you know, your adrenaline -- you are frustrated because necessary that situation. and it was just a whole different -- like ten cups of coffee type of rush. the way he was running, he was definitely running from something and the next ten miles, i saw at least 12 chp and metro going to the incident. >> dana: u.s. 95 shut down

for eight hours yesterday. metro said detectives did have probable cause to arrest the suspect in connection with a shooting at a nearby mobile home park last thursday. it is now 6:33. this morning we have an update on some local families forced from their apartments because of a fire in june. they tell us they have had a rough time getting back on their feet and not just because of the fire. those victims say when they finally got back to their apartment complex to gather some of their belongings. they get there and a lot of their stuff is missing. it was gone. they had security on their premises. those who run the apartment complex say security is a top priority. the residents paid money to make sure their belongings were still there. they had some insurance. covered with $10,000 in insurance money but the property manners j tell us that their relationship with the insurance carrier is not making sense of how some of the stuff is gone and the people are not being paid out.

craig. hi, craig. >> reporter: kim, a this friday morning will give us a strong indication of how quickly this case move forward. pedro garcia, of course, is the person accused of the terrible events, the starbucks shooting, the deadly shooting that happened last sunday. his attorney, appointed attorney edward cane told a judge he needed to make sure he didn't have any connection -- unknown connections for anybody involved in this case as it is known so far. they are known as conflicts. would need to remove himself as a public defender. he said he would have an answer this morning. we will be in court at 7:30. if there are no conflicts we expect for him to continue to represent garcia. if there are conflicts another public defender would have to be appointed. if no other depender is appointed we expect a hearing today. from the justice center, back
