penn national gaming has taken their issue to the supreme court twice now. the first time they were denied, but the second is ongoing. "they're challenging two decisions entered by the distrcit court in polk county affirming the decisions of the racing gaming commission to solicite new bids and d award that license to the hardrdock folks as well asas denying renewal of belle's license to operate the former argosy casino," said assistant iowa attorney general, john lundquist. and tuesday, that decision was sent to the court of appeals. lundquist says he has no insight into why the case was transferred, but he says it's not unusual. and, that doesn't mean it won't be sent to the supreme court again because... "if one side or the other disagrees with the ruling that's entered by the court of appeals they can seek further review from the supreme court and then the supreme court would decide

grant that discretionary review and review the ruling that was entered by the court of appeals," said assistant iowa attorney general, john lundquist. lundquist says the next step will be the official transfer to the court of appeals. being held in the woodbury county jail on 76-thousand dollars bond. police say cummings was one of two men who entered the home of jodi blackwell in the 26- hundred block of south alice street about three a-m monday. the men asked for drugs and money. police say the victims believe they had the wrong house. blackwell's younger son ran to get help from a next door neighbor. the other son, age 19, was tied up and beaten with a crowbar while blackwell was held at gunpoint. thththieves took multiple video game systems, a tv and cell phone. police say the investigation continues, but anyone with more information is urged to call crimestopper s at 258-tips. charges have been filed against a stanton public school board member related to a case of animal cruelty. kirk van pelt was arrested thursday on n o charges of aiding in animal cruelty and four counts of contributing to the delinquency of a child, all misdemeanors. the case involves cell phone video that allegedly shows the graphic torture of a cat.

the gift of giving. that's the mission of a number of siouxland mcdonald's restaurants. for the past few weeks, 20 restaurants had a "giving tree" set up at their store. both customers, and employees, could grab a tag off the tree that included items the ronald mcdonald house charities of siouxland needs. dish soap, clorox, granola bars and more were donated to families, who stay at the house. "it goes along ways for these families because they don't have a lot.

a new christmas cd is out just in time for the holidays, and this one features all siouxland artists. on the "christmas in the sioux too" album, you'll hear traditional carols mixed with some rock, country and jazz. this is the second year the musicians have worked together on a christmas album. the cd is ten dollars for a hard copy or a digitial download. proceeds from the cd sales will go to toys for tots and casa in sioux city. there is a cd release party tonight at the marina inn. it's free and open to the public. it starts and 7 and there will be live performances

can't make it to the party tonight, we have the link inside this story at ktiv dot com. this weekend siouxland is welcoming some of the best young gymnasts from across the state of iowa. the iowa gymnastics junior olympic championships kicked off at the long lines center in sioux city. over 400 athletes from 27 different teams will be competing over the course of the weekend. since sioux city hasn't hosted the event in years, it was a special honor when the city was chosen. "we're very proud that the siouxland gymnastics academy, their families and their coaches have put on a wonderful, wonderful meet for us here," said iowa state chairman for u.s.a. gymnastics, todd beyer. "we're very proud of the fact that it's out in sioux city. it hasn't been on this side of the state in many, many years." the iowa gymnastics junior olympic championships will be going on through sunday evening. brad's here -- with another full night of high school basketball ahead. the norfolk boys were nearly unbeatable last season. ktiv's mark freund is live with more

had one of the top teams in nebraska last season -- but came up short of winning a state title. the panthers were hit hard by graduation -- but as they say "tradition never graduates" and they're expecting big things again. sports fource is "on the road" in norfolk, nebraska ktiv's mark freund is live with more. last season ended in disappointment for norfolk - after finishing the regular season an unblemished 25-0, the panthers were upset in the first round of the state tournament. this is a new season for the panthers - despite losing star forward tyler hagedorn - norfolk is hoping to make a return trip to lincoln. tonight's opponent comes from lincoln - 2- and-1 southeast is in town. these two teams played just once last year - with norfolk coming away with a 39-16 win. this year, the panthers are 1-and-1 - with a loss to papillion-lavista and a victory over lincoln north star. sportsfource is on the road in norfolk, nebraska with norfolk head boys basketball coach ben ries. southeast was just 7-and-18 last year - but this is a new season

"we were just playing too fast offensively and we were all trying to get it back at once," said isu coach steve prohm. "the biggest thing was to just kind of remind these guys
