police say lopez drove his pickup through a red light in late october.. t- boning a car driven by khalil ali tiner. lopez is facing multiple charges including dui. breaking news out of baltimore.. where protesters are still marching right now.. and prosecutors are making plans to re- try a police officer.. in the wake of a hung jury that led to a mistrial. jurors said they couldn't reach a unanimous verdict for one of six officers charged in the death of freddie gray. palo sandoval has the latest from baltimore. --reporter pkg-as follows-- (nats) police officers stood side by side in long lines -- as protesters approached. crowds gathered in the street. but the family of freddie gray and the city of baltimore urge calm. we are prepared to respond". gray died after being transported in a police van. william porter was the first officer out of six tried. prosecutors argued porter ignored gray's pleas for help. they also said porter did not buckle gray properly into a seat belt and did not follow police policy. porter's defense said the opposite. arguing standard protocol was to not use seat belts. the jury considered the charges against porter -- involuntary manslaughter, second-degree assault, misconduct in office and reckless endangerment. but could not reach a decision. now gray's family will wait for a new trial as protesters in the city of baltimore demand justice. to claim the cell phone. no charges were filed. : we're following some new developments right now in the fight against terror. the department of homeland security has issued a new system to keep americans aware of the current terror threat level. it includes a 'bulletin'.. to warn of self-radicalized individuals who could strike public events and places with little or no warning. the current system would only alert americans if there was intelligence on a "credible and specific" threat to the homeland.. which hasn't happened in years. the public should expect an increased presence of law enforcement across communities in the weeks ahead. more stringent security should also be anticipated at public places and events. the color coded system for threat levels.. implimented after 9-11.. was abandoned in 2010. the white house says president obama will visit san bernardino, california on friday to talk with the families affected by the terror attack earlier this month that left 14 dead. the meetings will be private. following that visit..

that's not far from arlington.. in the dallas fort worth metroplex. no word yet on when that policy go that's the latest from the breaking news center. for a parent.. finding out your child has appendicitis can be alarming.. but is surgery always the answer? abc's dr. timothy johnson has the answer. fevers... they may be the symptoms of appendicitis... a condition that strikes 70,000 children a year in this country and if you're a parent... the very mention of it may worry you. most parents think appendicitis always requires surgery, but this may not be the case. researchers at the children's hospital in columbus, ohio looked at more than 100 children who had uncomplicated acute appendicitis. some got surgery, others were treated with just antibiotics. and the researcher found that the were treated with just antibiotics. and the researcher found that the children who received only antibiotics did just as well as the children who underwent surgery.
