but first we begin with breaking news -- residents in missouri are being told to leave their homes immediately! this-- as a levee near west alton fails on the mississippi river. west alton is just north of saint louis. rain continues to pound the state...overwhelming already swollen rivers. a state of emergency is in effect there. and we've just learned the death toll has gone up to 13-people. hello and welcome to action news live at midday, i'm dayna roselli. jessica janner is off today. and breaking here at home -- a homicide suspect is in police custody...for shooting and killing his father. here's our first look at the suspect. he's 21-year-old eugene mbayi tshiyombo. police say he killed his 68-year- old father last night at a home near pecos and the 215. we're told the two argued the night before... the suspect is now facing murder charges. let's get straight to our top story --

couch was wanted in texas...after authorities say he violated his probation. you'll remember two years ago, he killed four-people in a driving drunk crash. but he was sentenced to only probation using the affluenza defense. meantime, authorities just this morning have issued a warrant for his mom's arrest. a metro corrections officer is now on administrative leave... after being arrested for a misdemeanor prostitution charge. robert moore was taken into custody last wednesday, but he's since been released. metro released the details about his arrest last night, but they didn't say specifically what moore is accused of doinhe's been with metro since 2005. a valley mosque vandalized... not by graffiti or toilet paper, but bacon! the f-b-i is now investigating this as a possible hate crime. and, one of the mosque's founding members is speaking out. action news reporter marissa kynaston has more.

the search for a missing elderly man-- wallace inkenbrandt was found dead. the 72 year old's family says he left to buy food for relatives on christmas eve, and never came back home. he had dementia and cancer. the tragic loss has been very hard on the family. they did not want to talk about the details of his death. and we just learned the name of the woman killed in a deadly crash. the clark county coroner identifies her as 32-year-old susan lee. she died last monday, when nevada highway patrol says she rolled her s-u-v so bad... that she was thrown from the driver's seat. she was not wearing a seat belt. no one else was hurt in the crash. a motorcyclist killed at a memorial ride for another biker. last night, dozens of riders from various motorcycle clubs came together to remember shamon hudson. he went by the nickname "big boi." they say hudson organized the ride on sunday for a fellow rider who recently passed away from natural causes. they don't know what caused hudson and two other riders to go down. the 38 year old had 3

now to chicago... and and that deadly police shooting that ended the lives of two people. the father of one of the victims is now suing the windy city. you'll remember saturday, police shot and killed a 19-year-old shot and killed a 19-year-old quintonio legrier and his 55-year-old neighbor, bettie jones. the father of that teen is now suing. police responded to the scene for a reported domestic disturbance... the teen was said to be threatening his father with a bat. when officers arrived, the teen fled. and that's when police say officers were forced to open fire. the neighbor somehow got killed in the crossfire. also in chicago - the police officer charged with shooting a teen 16-times to death...has pleaded not guilty to murder charges. former officer jason van dyke appeared in court this morning. he's facing 6-counts of murder for shooting and killed 17-year-old laquan mcdonald last year. you'll remember the surveillance video from that
