district attorney furman. with me is chief john norris and chief sam gallon. we are here to announce today charges that have just been filed against william henry cosby. these charges stem from a sexual assault that took place on an evening in early 2004 at mr. cosby's home in montgomery county. mr. cosby is charged with aggravated indecent assault. this is a felony of the first degree. mr. cosby's attorney has been notified of the charges and he is expect today be arraigned later this afternoon. when we have a specific time for that, we'll let you know. and that's going to be at the magisterial district judge's office in elkins park. the charges today are filed as a

came to light in july of 2015. statute of limitations in this type of case is 12 years. after determining that the statute of limitations regarding potential criminal offenses had not yet expired, the investigation was reopened. chief norris and the township police, montgomery county detectives and prosecutors from our office have reviewed the initial investigation. resbrer viewed some witnesses and examined information from the case and alleged victims. the evidence showed mr. cosby established a relationship with the victim after meeting her through her work associated with temple university's women's basketball program. through the course of their association, the victim came to consider mr. cosby her mentor and her friend. on two other occasions before

criminal charge in this case, mr. cosby made two sexual advances at her that were rejected. on the evening in question, mr. cosby urged her to take pills that he provided to her and to drink wine. the effect of which rendered her unable to move, respond to his advances and he committed aggravated indecent assault upon her. now, prosecutors job is to follow the evidence wherever it takes us. and sometimes that means whenever it comes to light. when u.s. federal judge edward rabrano unsealed legal filings that contained references to the civil deposition and we learned about allegations from other victims under similar circumstances, reopening this case was not a question.

enforcement officers with a sworn obligation to uphold our constitutions and to uphold the law. today after examination of all the evidence, we are able to seek justice on behalf of the victim. now, going forward and we ask that anyone that has any information regarding any similar incidents with mr. cosby come forward, we ask them to contact either the montgomery county detective bureau or the township police. at this point i will take questions. >> do you know anything about the legality of the deposition? as evidence in this case? i know there was a question about that early on. >> well, i can't at this point. you know, there's going to be motion that is will be filed in

litigated. i can't give you a determination of how that is going to result. but the depositions were released by the federal court judge and we examined them and examined other evidence that we were able to obtain in this case. other questions? later this afternoon. when we have -- >> welcome back to "gma." you heard it right there from a prosecutor in pennsylvania. it's breaking news for our viewers in the west. prosecutors announcing they are charging bill cosby with aggravated indecent assault. that's a felony. this is in connection with the andrea constat case. she was a former temple university employee. she alleged he assaulted her 12 years ago. since then dozens of woman have come out to accuse cosby of sexual abuse in the past year. the comedian has denied those claims. 78-year-old will be arraigned later this afternoon. again, a major headline out of pennsylvania. one we will continue to cover all through the day right here on abc news and abcnews.com. first in this half hour we want to start with new details about the so called affluenza teen and what he and his mother were doing on the run.

vallarta after a three week manhunt and a new video is getting a look at how they spent their time. abc news's matt gutman is there with the latest. the couches seemed to be living life on a budget staying in that shabby hotel behind me shopping at the local groceries but what's so striking about that video is how at ease they seem to be in their new lives as fugitives unaware that just two hours after that video was shot, the mexican police would swoop down on them. this morning the first images of them on the run. in this exclusive video you see ethan couch entering this butcher shop across the street from his shabby rental. the formerly blond teen's hair dyed black. hat backwards seems at ease talking to the butcher paying for chicken in pesos and leaving with a little wave. two days earlier his mother in that tank top tries to pay for food with u.s. dollars. she chats with the butcher who

the texan. about two hours after this surveillance video couch is shot monday he is arrested. you see him cuffed and escorted to a cruiser and then up close in police custody. >> after 11 days of the u.s. marshal service tracking down ethan couch we can say he's in custody. >> reporter: couch and his mother planned to disappear shortly after this video allegedly showing couch violating parole at a boozy party went viral on twitter but before they left -- >> they had a going away party. >> reporter: taking tonya's truck to the border. >> our understanding they drove the truck down there. >> reporter: investigators confirming to abc news ethan and tonya couch used burner phones to elude detection and checked into this beachside resort los tules and a worker spotted them and tipped off authorities and tracked them to this $80 a month place in old town puerto

where is this teenager and the mother right now? huh -- how soon will they be hauled back to the u.s.? >> they are still in mexico in the custody of the mexican authorities. we expect within the next 24 to 48 hours to have them back here in texas. >> you have reported that the teenager and his mother had a sort of going away party before they even left. so i'm curious about the punishment now. this teenager had only ever faced probation for drunk driving killing four. what kind of punishment does he face now? >> what we're hoping is that he will be placed into an adult court system and placed on an adult probation system which will be very, very strict and very intensive. much different than what he was under the juvenile system. probably the way it looks under the law as messed up as it is he'll probably only be able to sentence him to 120 days actually in jail under the old case but then he would be able to put him under very, very intense supervision on probation, much different than he was before. >> the potential for 120 days

meantime, the mom could face more jail time than the son. >> that's true. the case we're filing against her for assisting him and hindering an apprehension in texas is a felony punishable by two to ten years in the penitentiary so she could conceivably do actual prison time and we certainly will push to have her prosecuted to the fullest extent of the law. >> you found them in puerto vallarta. what kind of message does this send to that community where four families are remembering their loved ones killed in that drunk driving incident. >> yeah, i mean it's just terrible for those families. they've all been victimized all over again. they just had to all spend christmas without a loved one because of his irresponsible activities and so i know from talking to some of the family members they were very hopeful that we would catch him and bring him back to texas and let him face justice and such that it is and i know they're very relieved he's in custody and hopefully on the way back to texas soil. >> all right, sheriff anderson with us from texas this morning,

reaction. to this stunning development. >> it is stunning. because this is a case they investigated and decided not to file charges in in the past. now he's charged with a crime where he could face up to 10 years behind bars. what changed? the first of all, you have got his own statements in connection with this civil case, not criminal coming out. so for the first time the authorities see what bill cosby said. they're going to try and use that against him. second you have got all these other alleged victims and the prosecutors believe they will be able to call some of them to the witness stand. so you have got two big new developments that led to this charge.

going to be allowed to bring these other accusers to the witness stand in this case? >> well, that's right. there's going to be a fight over that because the legal standard that they're going to have to overcome is does this show this was a pattern. you can't just introduce other alleged victims just to show he's a bad guy who does bad things. you have to be able to show that this was a pattern of conduct. that's going to be a huge legal fight. there's also going to be a huge legal fight about whether to allow in his statement in the civil case which was supposed to be sealed and confidential. >> dan, just to clarify, this was a case -- the allegations stem from an incident in 2004. local prosecutors investigated in twefnt 04 and '05 and declined to bring charges. it is 12 years later after we have seen all these other women step forward that they're moving on this case? >> that's right. if you look at the specific

encouraging others to lean in. well, now she's sharing how she was able to do just that in the face of a terrible tragedy revealing her most important support system and for the first time opening up about some of her hopes for the new year. this morning, facebook executive sheryl sandberg giving her social media friends a lot to like sharing a very personal message on her page opening up about the difficulties of 2015 in an emotional post writing, "this year new year's has more meaning for me than ever before." eight months ago the facebook coo and disney board member lost her husband of 11 years and father of their two children, dave goldberg passing away during a family vacation at the age of just 47. sandberg called goldberg her best friend, the love of her life and a key part of her professional success as she shared in her 2011 barnard college commencement address. >> if you pick someone who is willing to share the burdens and

the cheapest room we found on the strip was 2-hundred and 15 dollars at the flamingo. rates caesar's properties are higher...the least expensive room there for 6-29 a night. downtown is less expensive..the d has rooms as low as 2-19 a night. and if you're looking to score last minute concert tickets...you can still get tickets to see brittney spears...bruno mars and maroon five. if you're headed to the strip for new years...leave your drones at home! it's against the law to fly unmanned aerial vehicles with-in five miles of an airport without permission.. and the strip is with-in 5- miles of mc-carran airport... so don't bring your drone with you. metro will be on the look out for anyone.... breaking the law.. if you're riding your motorcycle around for new year's...you can get a free ride home! starting at 6 p-m thursday night to six a-m friday morning "hog hauling motorcycle towing" will pick up riders and their bikes! and take you home. the number to call is on your screen.. we'll also have it....
