hold and then slammed him to the ground. later morris touched the agent who demonstrated what happened. morris was led away by security, but says he will not press charges. coming up later on on "cbs this morning," we'll discuss the implications with cbs political analyst john dickerson and our political team will bring you election results at 10:00, 9:00 central. well, apple won a legal battle against government efforts to force it to break into a loft iphone. this involves a drug case in new york city. the judge ruled apple is not to have to. this is not related to the case regarding the san bernardino shooter. and the dispute between apple and the fbi travels to capitol hill today. fbi director james comey and apple's chief lawyer are scheduled to testify before the house judiciary committee.

if it complies with the fbi request it would set a dangerous precedent. a 14-year-old ohio student is under arrest charged with murder after allegedly opening fire in his school cafeteria. the trouble started at madison high school about 30 miles north of cincinnati yesterday morning. two students were wounded, and two others were injured while trying to escape. >> i looked to the left like what's going on, all of a sudden, bang, bang, bang, bang. i thought, okay, that's a gun. i ran back into the library. >> one of the kids who got shot, i grabbed his leg and then fall down, and then the kid that's shooting like run out. >> the student gunman ran out of the school, dropped his handgun, and was captured. police say they have a motive but aren't saying what it is. in california a woman and her two young children are safe

ex-husband. her husband lead a chase yesterday afternoon. at one point he stopped but refused to surrender. the chase continued into the night. he stopped again, got out of the car and made a run for it. his children and their mother are in good shape and the suspect remains on the run. well, a watershed moment at the supreme court. justice clarence thomas asked a question. this is the first time thomas has asked a question in ten years. he has said he relies on written briefs. the case involves the federal law that bans people convicted of domestic violence from owning guns. president obama is schedule yumed to meet with senate leaders today to discuss the vacancy left with the death of justice antonin scalia. senate republican leaders say they will not consider a obama nominee and want the next president to fill the vacancy. funeral services will be held today for the virginia officer who was shot and killed on her first day on the job.
