trying to spark a revolution. officers say when he was pulled over by the california highway patrol early sunday morning he had no intention of being arrested and he said that's why he opened fire. 45-year-old byron williams is the man police say fired on chp officers early sunday morning. investigators say they interviewed williams and was headed to shoot people. investigators say he didn't have a specific hit list but his plan was to wait till monday morning to start his killing spree. >> this was his plan. we are just lucky the chp stopped him when he did or people could have been killed. >> reporter: the tide foundation describes itself as a nonprofit. no one here had ever heard of

byron williams. >> all we know is what we've heard from the press. so, we are trying to figure out as much as we can. and we are obviously paying close attention to security matters going forward. >> reporter: williams was charged in court today for the shoot out with highway patrol officers. he's been charged with four accounts of attempted murder of officers. a host of arm charges and charges for being a felony in possession of body armour. he's facing 25 years to life in prison as a three strikes offender. today's charges just cover the shoot out with california highway patrol officers on sunday morning. the fbi is also investigating williams after finding a binder in his vehicle entitled simply california. now earlier today i spoke with an fbi spokesperson, he says at this point the federal government is not filing any charges, but he says that could change. we're live in oakland, christien kafton, ktvu channel 2 news.

our coverage of that shoot out on interstate 580 continues online. just go to ktvu.com and go to the 580 shooting tab. police in concord are investigating an unthinkable crime. a mother accused of stabbing her own child then stabbing herself to death. officers were called to a home on park glen court. they say they found the 10-year- old girl with a knife wound and a 39-year-old woman, her mother dead. according to police, the girl said her mother woke her up and then attacked her but she was able to get away. police say it looks like then the woman cut herself. the child is in serious condition. investigators are working to find a motive. the objections of two county sheriffs have forced state correction officials to parol a convicted killer to san joaquin county. hersaw is scheduled to be released from prison on monday. an appeals court overturned his

convection. he later pleaded guilty to one count of voluntary manslaughter. correction officials wanted to parol him to another county but sheriffs there objected. two bank of america branches were robbed at gunpoint. in the last one police say the woman got away with a lot of money. the woman is described as white, hispanic or of mixed race. she's in her 30s, 5'3" tall. she has brown hair, tinted red or orange. she is about 130 pounds. another bank was robbed yesterday morning but police do not think it's the same suspect. a teenager who died near a

cliff, andrew leonard hicks jr., earlier reports said he may have been distracted by a cell phone. but his family says that is not correct. they say hicks was trying to get a better view when he fell to his death. today, ac transit drivers staged a sick out a judge ruled on the matter and riders did an awful lot of bidding. sal castaneda has the story. >> reporter: this is day two of what transit riders say has been a very unreliable compute. some buses have been late, and others have not come at all. for howard height and others waiting, it became aparticipant apparent the bus was not

coming. >> finally i said, look, we just need to give up. >> reporter: the latest labor dispute has disrupted service and today an alameda superior court judge refused to impose the contract put forward by the members sunday. drivers say the imposed contract is unfair. now transit officials say many bus operators have not shown up for work. the shortage has forced delays and cancellations. 20% of the drivers are staging a sit out. and we think that's a terrible thing to do because it penalizing the drivers of this district who are working class, the poor, the young and the elderly. >> reporter: union leaders say they are not too blame for delays and missed buses. >> ac transit did an entire restructuring of the service that is provided to the public. they haven't put the public on notice, so therefor they are making it look like we are not coming to work.

>> reporter: drivers have been working without a contract since june 30th. the district says it needs to close a $56 million deficit. drivers and management have been arguing over concessions including increases in health care copayments, a two tiered mention plan and different overtime work rules. negotiations have been ongoing since april 1st. many riders say they hope service becomes reliable again soon. >> the worse thing was there was misus information. no buses, no one letting us know that there may be a sick out. >> reporter: the two sides are scheduled to be back in court july 30th. at that time the judge could leave the contract in place or could force both sides back to the bargaining table. live in oakland, sal castaneda, ktvu channel 2 news. kagan's nomination is now on the way to a full vote in

the senate. all of the democrats voted for her, but every republican expect for one voted against her. lyndsey graham of south carolina was the lone republican voting in favor of kagan. the senate will likely vote on kagan's nomination sometime next month. republican meg whitman wants the public record detailing how her opponent jerry brown is using public money as attorney general while he's running against her for governor. whitman's camp has asked for a list of communications personnel, the department's budget and an accounting of expenditures. the request comes after a news story looked at the balancing act between brown's job and his candidacy for governor. another child has died from whopping cough, bringing to six the number of deadly cases in california this year and putting the state toward the worse outbreak in 15 years. infants are the ones most at

risk. all of this year's deaths have been under 6 years old. john fowler is live in concord tonight with more on how bay area health officials are responding to this, john. >> contra costa county health officials are planning a free immunization clinic here. people we talked to say they plan to attend. >> i take it very serious, i'm a mom of three. keep these little ones healthy is very important to me. >> reporter: at thursday's regular farmer's market and concert now free vaccinations for anyone over the age of 7. >> we're really encouraging grandparents, siblings, care givers, health care workers to all get vaccinated to protect the babies in our country. >> reporter: while many have already had the vaccine, protection dies off.

a string of suspicious fires in berkeley grew today to 13. officials are investigating an arson this morning outside a store on telegraph but today's fire, well it might just be the last thanks to surveillance video. debra clemons is live in berkeley with the developments. >> reporter: we're outside of sam's right now and it's business as usual. but boy have those owners had a busy day today. someone set a fire outside of their business, threatening their business. switch to another view and you

can see in the upper left hand corner they've stopped and appear to be doing something with the recycling bin. they leave and a short time later it's engulfed in flames. police show up to put it up with extinguishers, but flairs go back up and they beat it down again. the owners consider the damage to their store front, they gave surveillance video to police this morning. video police are now analyzing. >> i hope the two are on that video, and they get caught. and something happens to them like a night in jail and they go in for arson. because that is arson, it's not a prank. >> reporter: there was no damage to the store, so the

almost all bay area counties. then it's back to the coast. tomorrow afternoon, that's wednesday afternoon. kinds of like it was today in terms of burn off. but we have a lot of coverage in the morning. that sets your tone for the day. that means temperatures will be a little cool. lots of fog and low clouds, we can expect temperatures to be a few degrees cooler in many bay area locations then it warms up a little bit. but the basic trend this week will be mild to warm inland. fog along the coast and temperatures slightly below the average in some locations. it's going to warm up a little bit as we head through time. i'll have the details on that. five day forecast and forecast more specific to an area where you live. a new study finds many freshmen are unqualified to take college courses. standized test scores show almost half of last year's cisu freshmen were unqualified to

new numbers released today show a drop in unemployment in most states including here in california. the labor department says 39 states saw their jobless rate decline last month. now that's a slight improvement from may. in california our unemployment rate dropped 1/10 of one percentage point to 12.3%. it is still one of the highest in the country. tonight millions of the

those unemployed americans are one step closer to receiving another lifeline. the extension to benefits cleared a critical line. >> reporter: with exactly the minimum votes needed, the senate today voted to advance legislation restoring unemployment benefits to an estimated 2.5 million jobless americans. >> the motion is agreed to. >> reporter: the democratic victory came after the bill picked up another supporter. >> thank you. >> reporter: clark goodwin was sworn in today replacing the late robert byrd. he helped override republican objections over the cost. >> what republicans are about unemployment benefits, yes. deficits, no. >> reporter: instead of adding to the federal debt, republicans argued the jobless benefits should be financed through cuts to other

government programs. democrats though say the unemployment checks will have a positive and immediate effect on the struggling economy. >> there's hardly anything you can name that is more stimlative to the economy than put money into the hands of those who need it desperately, who will spepd spend it immediately, who will inject the money into the economy and create jobs. >> reporter: a job is what americans desperately want. >> anything to put food on the table. >> reporter: from a 50-year-old handyman, to a 50-year-old heavy equipment operator unemployed for one year. >> i'm almost like homeless. if you can't pay your bills, they want you out. >> reporter: well a final vote to end the senate is expected tonight. the legislation would next return to the house for lawmakers approval and then to president obama's desk. the president says he will quickly sign that bill into law.

we are learning more tonight about a bizarre incident at a concert in the south bay. a man disguised as a woman tried to attack a singer who was performing on stage. the suspect is a former fighter pilot from overseas and a familiar name in the bay area.

today robert handa spoke to the suspect from his jail cell. and robert is live tonight with more of what he's saying. >> reporter: we're live here in little saigon. an area that got its name because of lee tong and his efforts have only gotten more direct. >> reporter: 63-year-old lee tong is in custody and he wouldn't have it any other way. tong a former vietnam fighter pilot calls himself a freedom fighter. a touring vietnamese pop singer seen by many vietnamese as part of their country because of the singers involvement in government youth programs. >> they come here to lulaby the vietnamese americans here and he leaves our community.

there were some nervous moments at a community college in sacramento today. a bomb squad and hazmat team

was called in to investigate a suspicious van. although they did not find any explosives they did find a surprising discovery. >> reporter: for a while this morning a large perimeter and the bomb squad combed the college. that after propane cans were seen inside this van. the driver, 31-year-old curtis matthews was arrested. >> the behavior exhibited by this person is some what suspicious. public safety is our number one concern. we want to explore this a little more, we want to look into his past and what he's been doing. >> reporter: this morning, college police took a list of con contents in the van. in a window, copies of associate arts degree. but this was od a tomb like box lined with plastic was venting through the roof. matthews told officers it was a

coolest day of the week. and tomorrow will be cooler with more fog. when the fog blankets all the area, it is slow to warm. we go outside and i want to show you the bay area microclimate. you can see the heat out in the valley. but here's what we lie, where the sea breeze impacts us. you can see the cooler colors representing 78 in livermore, 64 in oakland. temperatures today in concord just 81 degrees. i would expect concord on a day like this, climatetology about 78. that continues again tomorrow as more fog really pushes inland tonight and tomorrow morning. i'll show you that in the fog model in just a moment. this is the low pressure center that's bringing the fog in. this is what i talked about last night. this system is not supposed to be there. when it is there, like this. it just ushers the fog inland. if this was winter, it would be bringing rain. but since it's not winter, what it's getting is just enough

lift to send it into the bay area neighborhoods. as far north or far east in the delta. forecast then for tomorrow morning, wednesday morning. look where it is, this is the computer model says, here is where the fog is going and you can see it folding right through the line of the golden gate bridge. and temperatures tomorrow morning just in the 50s. temperatures tomorrow afternoon mostly 70s with a few low 80s, the fog does burn back but it's a slow burn back as it was today. then as we head into thursday, the high pressure will start to reaccomplish itself and temperatures will come up a little -- reestablish themselves and temperatures will come up a little bit. reds are your 80s and 90s. cooler colors represent that sea breeze. and we have cool sea breezes. 73 in napa tomorrow, that's

actress lyndsey lohan is now officially a prisoner in the los angeles county system. lohan showed up today the begin serving her sentence. unlike her previous court appearance, lyndsey lohan remained composed. the star is serving her time at the lynnewood detention facility outside los angeles. she is being held in an isolation cell for her security. illegal immigrants who came to the united states as children were on capitol hill today lobbying congress for passage of the dream act.
