looking to start a revolution and killing activists. he was arrested and today he was brought here in a wheelchair to court where he was charged with four counts of attempted murder. investigators say 45-year-old byron williams has told them he was on his way to kill people from the tides foundation in san francisco. >> it's politically motivated on his part, we're just lucky he wasn't able to carry out his mission. >> reporter: the tide's organization criticizes conservative news outlets and promotes a progressive agenda. yesterday, police told the ceo that the company had been the target, no one here had heard of byron williams. >> i would not even try to explain this person's behavior. >> reporter: williams was in

court today for the shooting against law enforcement officers. >> our investigation is not over yet, we are still following a couple of leads. but we do believe he was acting alone. we are not looking for any accomplices. >> reporter: now today's charging in court just cover the shoot out with highway patrol officers, williams is facing a life sentence after a three time sentence. an fbi spokesman says at this point the federal government is not filing any charges, but that could change. we're live in oakland, christien kafton, ktvu channel two news. that freeway shooting came days after oakland police layed off 40 officers. that has people in oakland wondering if police will be able to handle calls.

>> reporter: it's been a week since oakland released police officers. >> you don't know how many hours or maybe the whole day to wait for police response. >> reporter: he's not the only one with those concerns. >> what if i get robbed and i dial 911 on my cell phone, how fast are the police they have going to respond to me. >> reporter: oakland officers have improved their response time from an average of 15 minutes a call down to nine minutes but still short of the department goal of five minutes. but with the lay offs will response times go up?

>> that is a concern. and what we're part of the resources we had out on the field were extra resources to prevent these crimes from happening. >> reporter: joan says there are just as many officers on patrol today than before the lay off. and he wants to take away the perception that police are not responding to calls. >> it's not that we are not responding to service calls, we calls -- police say they are trying to stop an arsonist before the firebug strikes again. there's been more than a dozen

arsons since saturday. the most recent incident was on telegraph avenue near bancroft early this morning. clemons is on the scene right now with the latest on the investigation. >> reporter: julie, we are outside sam's market. let me show you this is where the recycling bin was. if you can look over here you can see the bin that was set on fire. berkeley police and firefighters were on scene within moments to put out the flames keeping damage to a minimum. on this surveillance tape you see two people who appear to look in the store front then do something to the recycling bin that flames up soon after they leave. store owner fred ayad and his son hope their surveillance cameras will help police capture the arsonist. >> cost me money and more

expenses to the businesses. >> i hope something happens to the men on the video. >> reporter: 14 of the same incidents are from the same suspects. >> often times they're by the shadows, they're by trees. they want to see the response, they want to see the flames. it's the thrill that the suspect is seeking. >> reporter: and police say because arsonists like to linger, the public can be extremely helpful in this investigation by reporting any suspicious characters you may see by a fire. and richmond police say two cars that were set on fire overnight were both stolen.

the first was found on san joaquin street around 2:45 this morning. meminutes later a second car was found burning. no arrests have been made, investigators also say they don't believe the fires are connected to a series of two dozen car fires in west contra costa county that began last year. for a second straight day, ac transit drivers had to deal with late buses and a slow commute as unionized drivers failed to show up to work. the drivers are staging a sick out, upset of a contract that  increases their health care cost. today an alameda superior court judge refused to grant a restrain order. more than 200 bus drivers or 20% of ac transit's work force failed to show up to work yesterday and again today. >> same people were still waiting for buses, getting more increasingly frustrated and

finally i said, look, we just need to give up. >> ac transit drivers have been working without a contract since june 20th. the proposed budget would help ac transit from closing a gap. and for those looking to ride ac transit tomorrow, sick outs are still expected tomorrow. congress could pass the $34 million extension by tomorrow. helping americans and californias who's benefits have run out. >> we'll be able to go back and automatically file the extension for them. checks as early as next week for some people and following thereafter for others. >> reporter: unemploys californians will still have to

fill out claim forms for the time their claims had lapsed. and revenue up 78% for the most recent quarter, apple has said reknew was up 78% for the most recent quarter. the earnings were spurred by sales of apple's new i pad and iphone 4 despite recent complaints of antenna problems from that new phone. maureen naylor has more of what that means for officers. what's been dubbed antenna gate has not appeared to affect sales of the iphone four. >> reporter: at the same time

apple was announcing the quarters earnings, brophy was going into this apple store to buy a new mac computer, this after getting an i pad for her birthday. >> the i pad definitely turned me on to apple products. >> reporter: the numbers follow a volatile few weeks for apple after highly publicized problems with the antenna for some iphone users. that issue seems to have had no effect on sales. >> they basically said, even since then they show no slow down in demand and in fact, they are selling every i four that they can make and they are still backlogged in stores from two to three weeks at at&t

stores. >> reporter: but the antenna issue did keep this man from buying the phones for his company. >> we decided to stick with the blackberry until they fix those issues. >> reporter: one analysts believes numbers will only rise when the device is released to all 88 countries an during the more busy holiday shopping quarter. reporting live, maureen naylor, ktvu channel 2 news. and just a quick correction here, i misspoke a moment ago apple made $3.25 billion in net profits. not 325 billion, my mistake, sorry about that. and yahoo rebounded from a 6% drop earlier in the trading day. the company reported a 51% increase in quarterly net income from last year. but revenue came in below wall street expectations. the dow jones recovered from a triple digit loss earlier in the day to close up 75 points,

investors concerns about slowing revenues were reversed by positive earnings reports, the nasdaq was up 24 points. in pacifica, police say a driver asleep at the wheel is responsible for extensive damage to a condominium complex. here are some photos sent to ktvu but a resident of the ocean point townhomes. investigators say a 25-year-old man from san mateo drove his chevy blazer crashing into a detached garage then hitting and totalling a parked car inside that garage. the blazer then crashed through the opposite wall of the garage and slammed into the porch of a home. no one was hurt. former raiders quarterback jamarcus russell appears in court tomorrow on a drug charge. fog is back big time into the forecast, take a look outside, we've got a bunch of it, it's going to be in your neighborhood in the morning, i'll tell you how it will

a new push is unway in san francisco -- is under way in san francisco to make nail salons safer. today the san francisco board of supervisors president said he wants to do something about that. david stevenson is live in the city with the report. >> reporter: there are about 200 nail salons in san francisco and this proposed new ordnance is aimed at making it safer for those who work inside. >> i just love your nails.

>> reporter: it's considered a luxury by some, but now manicures are being called dangerous. these chemicals are in nail polishes and nail polish remover. >> after a few years, i was diagnosed with breast cancer and then you know i had asthma too. >> reporter: san francisco supervisor david chu introduced an ordnance suggesting that salons swap nail polish and removers with similar items that don't have those chemicals. environmental scientists say

it's a good first step but with the nail polish companies, it's still a secret what's inside these chemicals. environment groups this afternoon gave out free manicures at a cosmetology school. a sixth california child has now died this year from whopping cough prompting health officials to increase their campaign. the county has 62 cases so far this year. but marin county where some parents are reluctant to vaccinate their children leads

the state. >> the risk of getting whopping cough are -- the risks of whopping cough are much greater than the vaccine. activists with the aids health care foundation held a die inoutside of nancy pelosi's officers this morning. program helps low income people pay for the hiv medication that keep them healthy. 1,800 people are on waiting list for the program in 12 states. activists want congress to allocate $128 million in stimulus money to shore up that program. dozens of farm laborers prayed in front seat of governor arnold schwarzenegger offices asking him to sign a bill that will allow them to

get an increase in pay. most california workers get over time after eight hours. the california farm bureau says changing the law could put some farmers out of business. the governor has not said whether he will sign the bill. a group of mostly teenagers is calling for a moratorium on pg & e smart meters. the group called teens turning green staged a -- staged a rally today against the installation of meters. they say installations should stop until studies show that there's no health concerns to homeowners. >> it becomes a home mesh grid of ems radiation that we're going to live in 24/7. >> pg & e says the meeters are just as safe as high tech devices commonly used today. on to the weather now. we've been talking about how so far this summer there have not

really been a lot of hot days. >> we mentioned that, in the earlier newscast. the 5:00 newscast that we haven't had a lot of spare the air days. usually we've had a few going into the late july, early august period. but not the case. outside we go, we have a lot of fog and low clouds at the coast. we come in a little closer here. we show you the fog, it's making its way across the city. it's still not south of market or by the ballpark, but it's shooting across the baby berkeley, alba, richmond. of course this is a topigrapic feature. the fog, not now but in the next few hours will get over those hills and push into the inland bay valleys and provide further cooler. just a show of where the fog is currently. the fog will be back tonight in your neighborhood. it'll be another day tomorrow like today. let's head through the microclimates at the coast tomorrow.

we're looking at temperatures in the 50s. it's foggy all day. south of market you'll get to the mid-50s. out toward richmond and we're going to pop through the hill. change microclimates completely. and now you're out to the 70s. we go further out toward mount diablo, you're back into the mid-80s. if you keep going, you will find 90s. high pressure is the story but it's kind of weak. tomorrow will be the last day of cooling. and then that red line is going to start to go up but not very quickly. so you see where we were over the weekend. we had upper 90s. fog is everywhere in the morning, it burns back, you knew that was coming just like today. temperatures a degree or two cooler tomorrow. that's your wednesday than they were today. then thursday you will see on the five day forecast they start to come up a little bit. as a matter of fact there's your five day forecast. temperatures trend up.

but you notice that bottom tier of numbers representing the hottest and warmest area in the bay area all this week into the weekend. still below 90 degrees. so that is unusual. usually this time of year we're looking at the mid-90s in the inland valleys. >> and stronger stretches of heat too. >> we haven't had it. what the nfl is testing to help keep athletes safe. and russell was in court today, details on his arrangement, next.

former oakland's quarterback jemarcus russell pled not guilty to drug charges. russell was arrested earlier this month and charged with possession of codeine syrup without a prescription. the nfl is pushing for their players to wear more padding to reduce injury. some players will be asked to test a new type of knee, thigh and hip pad during this year's preseason. the equipment is lighter. if the tests go well, officials

hope to make the new gear mandatory for the 2010 season. camp is just a few weeks away. the dodgers try to make it 2-0 against l. a. and the a's lost last night to the red sox. one of the unsung heros this season. that still have the a's contender for the western division. gonzalez as he's one of the few guys that's managed to stay healthy. he already has more rbis than he did all of last year. making a great contribution, playing regularly and he thinks he's figured out the reason why he's been so successful so far.
