channel 2 news at noon. good afternoon. topping our news this noontime, the alleged gunman involved in a shootout with chp officers on 580 in oakland will have his second court appearance delayed until this afternoon. 45-year-old byron williams is meeting with the public defender to discuss medical issues. it's not clear at this point what those issues might be. according to police, williams said he was traveling to san francisco sunday to start a revolution by targeting people at two nonprofits with progressive leaning. williams is scheduled to enter a plea today. he faces forecourts of attempted murder of a police officer -- he faces four counts of attempted murder of a police officer, among other charges. we just got in information about a homicide in oakland

regarding a virginia visitor. claudine wong has more on this developing story. >> reporter: we just walked out of the oakland police department where we took a look at surveillance tape of two suspects wanted in connection with a deadly robbery over the weekend. the father of three from virginia was in town for a job interview. he had gone down the street for a teeth cleaning and was on his way out to his car at 11:30 on sunday night when he was robbed, shot and killed. police have just shown us this surveillance tape that they say will be critical to solving the case. >> this is five minutes before the murder in the same block where the murder occurred. walking away with his hands in his pocket. i'm going to slow it down here. speaking to one of the victims, there and present at the homicide scene, she described the suspect that had a gun as a male suspect, wearing a hooded

shirt. >> without this video, i don't think we would have anything, besides what the victim pro sided -- provided. the video is tremendous. i solved two other cases using this video. it's like a family member that sees you walking away, they will recognize you by the way you walk, carry yourself. i'm quite certain somebody will recognize these individuals. >> reporter: we have information about these descriptions that police have been able to give us. they say the man in the video where a black hooded sweatshirt and dark jeans, they believe he's anywhere from 18 to 25 years old. 5'7" to 5'10" weighing 160 to 175 pounds. they believe he's the gunman. they want people to pay close attention to the woman's jacket

because they believe her jacket is very distinctive and that will be something that somebody will recognize. we should mention, we did bring one of the victims who survived this into the police department yesterday, had her lock at this video. this video was taken from a camera just up the street from where this robbery happened. she confirmed these are the same two people who committed the deadly robbery. live in oakland, claudine wong, ktvu channel 2 news. >> thank you, claudine. san francisco police are facing new questions after a video appeared on youtube. it shows rough treatment by police. kraig debro just spoke with the former police of chief and joins us with more. good afternoon, kraig. >> reporter: good afternoon, tori. the officer involved works at the tara vell station right behind me. this is the second tape in two months that involved the san francisco police officer caught on amateur videotape. just last month, you might recall an amateur video camera

recorded and ported on youtube, the auctions of officers following a pride parade. now, those officers are under investigation african-american mature videotape surfaced following a confrontation involving them. in this latest videotape recorded on sunday and posted on youtube overnight, two officers strug struggle with the suspect, police say she's a suspect. the former chief of san francisco says the officers are responsible for the suspect's safety. >> once you get a prisoner handcuffed, the responsibility for the security of that prisoner is greatly increased, you know, because they are physically in your custody. >> reporter: after several minutes of struggling between the officers and the suspect, the officers try to get the woman into the back of the vehicle. she's halfway in but struggles out and that's what she's guided to or thrown -- that's

when she's guided to or thrown to the ground. >> in general circumstances in use of force, you have to see what the circumstances were at the time. the size of the officer, versus the size of the subject, was the officer gonna be injured? >> reporter: the officer is on leave. the chief size once the prisoners are cuffed, they have to get them in the car as soon as possible. >> grab them by the head or grab them by the hair and aggressively guide them in the car when they are resisting like that. >> reporter: there's still some unknowns here. we asked police if they could give us the name of the woman, the name of the suspect in this case. they would not release it or tell us if the woman had been charged in this case. we also caught up with mayor newsom atedding another event here in san francisco. he says he's seen the tape and will speak with the chief of police about what he saw on

that tape later on in the afternoon. kraig debro, ktvu channel 2 news. >> thank you, kraig. the oakland city council approved a $2 million settlement for people who said their homes were searched by officers who obtained search warrants by providing false information to judges. more than 100 people, some of them drug suspects, joined the class action lawsuits in states where search warrants were improperly issued for several years, ending in 2008. four police officers were fired because of the case. seven others kept their jobs, saying they had been improperly trained. oakland city council has adopted a controversial plan to license four large marijuana cultivation if thes. the plan which was given preliminary approval late last night would allow the facilities to grow, package and process cannabis -- process cannabis. they would pay an annual

$21,000 permit -- 210,000 permit fee. supporters say this could drive down costs and affect the quality of medical marijuana. >> if i was a patient it would give me some reassurance that i'm getting the best medicine out there. >> i would just hope we don't circumvent the small growers that made this occur in the first place. >> the ordinance must be approved on a second council vote. if it passes, oakland will be the first city in the nation to license cultivation marijuana. mortgage default notices in california are at their lowest levels in three years. according to report, there were just over 70,000 default notices filed in the state from april through june. that's down 44% -- nearly 44% from the same period last year. the 14 injuries drop in default notices filed from january

through march. president obama is declaring victory today in the passage of the most sweeping overhaul of financial regulations since the great depression. the president signed the financial reform measure into law this morning with a lot of fanfare and thanks for the lawmakers to supported the effort. he said many of the new rules are common sense reforms that will help people in their daily lives. they also give the government new power over companies that threaten the national economy. >> besigned the consumer protections, i've out lined, reform will rein in the abuse and access that nearly brought down our financial system. it will finally bring transparency to the kind of complex transact actions that -- transactions that helped trigger this.

after a long and tense negotiation, san francisco a mayor and supervisors agreed to a $6.5 billion budget late last night. the spending fund restores spending for some programs. the budget received preliminary approval but the supervisors must still take a final vote next week. a traffic accident in the east bay this morning. police had to shoot one of the drivers with a stun gun. are there more problems on a bay area bus system between labor and management? the weather is starring to feel a more like november than july. marriage toe myohas the -- mark tamayo has the forecast ahead. hundreds of people including a well-known national

chp officers used a taser to subdue a motorist who ran

across the freeway lanes on the 880. one vehicle overturned into the ditch. the man shot with the taser tried to run from the accident scene across the freeway through traffic. witnesses say the man had been driving erratically before the crash. there's breaking news out of the east bay. an officer-involved shooting near livermore has left one person dead. it happened about an hour ago in the 47,000 block of mines road. these are live pictures from newschopper2 heading to the scene right now. santa clara county sheriff officials say their deputies were involved m a joint, drug- related operation with the alameda county sheriff's department this morning. at some point during this operation, shots were fired and one suspect was killed. no officers were hurt. we'll bring you any update -- we'll bring you an update if any more information is available. people describe him as a man fulfilled by his music and

ministry. before his death, bishop walter hawkins led his followers through some tough times. a lot of the help was in the form of songs which came from the soul. as jade hernandez reports, hundreds are attending bishop hawkins' funeral service at this hour. >> reporter: hundreds of people filed through the doors at the paramonth theater. >> he was a dynamic singer. ♪ >> reporter: hawkins died more than a week ago after a two- year battle with pancreatic cancer. he devoted his life to gospel music and is best known for the love of the choir.

his love for the music -- music extended to others. >> the music has been transformative throughout the area. i was in south africa when nelson mandela died. this is a force of good for the world. >> reporter: today's funeral gave mourners the chance to remember hawkins's music. >> i was born in the '70s. his music came out in the early '70s. so i grew up listening to his music. all of the choirs. it was just wonderful. >> when i pulled up, i -- i was playing his music and been playing it a lot lately.

>> hallelujah! >> reporter: people are celebrating life today the way he did. you can watch a live video stream for the services of bip ship walter hawkins. go to ktvu.com and click on the walter hawkins page. ac transit and the bus driver union disagree whether drivers are holding a sickout for the third union in a row. a union spokesperson sent ktvu a memo said saying there is no sickout but ac transit says like monday and yesterday, about 250 operators called in sick today and there are delays throughout the system as a result. this morning one rider in alameda says the derays are -- delays are hurting them. >> the only way off the island is by car or bus. that's the only way, or you are walking, so it's very important. >> the agency said drivers started to call in sick after the agency imposed a cost-

cutter-cutter measure. union officials have gone to court seeking a temporary restraining order on the contract but the judge's ruling is not expected until july 30th at the earliest. tomorrow, b.a.r.t. will, once again, take up the controversial issue of extending b.a.r.t. service to the oakland airport. in february, the federal government turned down a request to partially pay for the $480 million project. now the b.a.r.t. board is looking at more funding plan which relies on money from a mix of state and federal sources. opponents say the project is financially risky and maintain the buses used to link b.a.r.t. to the airport work just fine. b.a.r.t. is expected to role on temporary fare roll backs at the meeting. they are considering reducing fares about 3% for four months.

a san francisco "chronicle" survey say four out of five hours are opposed to this. chinese officials are struggling to contain a massive oil spill in the yellow sea. it bass caused by a pipeline explosion last friday off the shores of tallo yun -- $ian. officials say the oil has stopped looking but it's spread across 160 miles and is posing a severe threat to sea life and water qual tie. let's water -- water quality. let's check in with mark tamayo for our forecast. no major heat in the forecast for today. in fact, the warmest locations barely make it up in the 80s.

you can see the fog pattern out the. the clouds right around oakland, right around san francisco, while still reporting patchy fog, we still have gusty winds to talk about. that's right around the delta, west southwesterly breeze. around 23 miles an hour. that same area we could have gusts approaching 30 during the afternoon hours. a live lookout side in -- look outside in san jose, the sun beginning to break through. temperatures as a result are coming up. san jose right now, we have a current temperature in the upper 60s. warmest locations, only 54 degrees. not much of a change since this morning and san rafael right new in the upper 50s. here is a look at the overall weather story. skies eventually becoming partly sunny. breezy for this afternoon like weigh talked about, a little bit of warming for thursday and friday. here's the eventual temperature range from the upper 50s all the way to the lower 80s but today will be one of the

gradually pushing back to the shoreline. this weather is good news for fire danger, keeping it relatively low. >> nasa important. thank you, mark. there's breaking news out of oakland right now. b.a.r.t. has shut down service at the lake merritt station because of police activity. officers are looking for a suspect who ran onto the tracks from a nearby traffic stop. they believe he's armed. a second suspect was caught. again, service is shut down at the lake merritt b.a.r.t. station while officers search for an armed suspect. san francisco is celebrating a second milestone in the conversion of doyle drive to the preside yo parkway. construction is already underway on the first of four tunnel. this morning state and federal officials are discussing this project and the mayor says this is a long time coming. >> this picking up on the report of 1955, where folks

thirty people were hust last night, one critically when a united airlines jet on its way to los angeles hit severe turbulence over kansas. the flight took off from d.c. and stopped in denver. passengers said drinks were flying and people hit the ceiling. >> i saw people sit -- people in front of me hit the ceiling. luckily, i had my seat belt on. >> more than 20 people were taken to the hospital. tourists who come to gawk at san francisco's famed sea lions at pier 39 can get more information about them. a trainer is being made available every day to answer
