>> the news starts right now. this is ktvu channel 2news at five. >> i'm ken wayne. >> just days after 49 san jose firefighters were laid offa new development that could get some of them their jobs back. the san jose firefighter's union came to the table with a new concession proposal but is it to late? paul chambers. >> reporter: good evening. we are live in front of fire station 30 that closed its doors at 8:00 this morning. shortly after the last of the firefighters had their final good-byes. >> it's a little rough, it's a little hard to take in. >> it rips my heart out. i can't tell you the pain that i feel personally of these young men and women. it's not fair. >> reporter: standing together possibly for the last time, nearly all 49 firefighters say

they hope to get their jobs back as the union offers another proposal. >> the ng up once again and making another proposal that we believe should knock down all the barriers. >> there is are positive things in terms of the amount of pay reductions and benefit reductions that firefighters willing to offer. it appears to be the same as the priorities. >> reporter: the firefighters say they would save the city millions into the future. the union is giving up pay races in to the 2011. also they are removing the no lay off provision from the contract and are willing to give up 10% of benefits for new hires. >> when you where what we would need to avoid the layoffs we need almost 10 million. there is a 6 million-dollar gap between what they are offering and what the proposal saves. >> we were guaranteed during the academy that we were needed and that we would have opportunity to serve the city of san jose. >> reporter: they were able to do that but for less than a

year. some like johnson was days from a year mark, others six months, either way it was decades short of the 30 years they planned to serve and protect. >> i have been able to live that dream. these young people, their dream has been shattered. >> my car is empty. we drive around with our gear in our car moving station to station. >> reporter: with the final round of lay offs the city will loose two fire stations and one ladder truck. everything remove from those vehicles and now stored here. >> with fewer firefighters the citizens, can suffer but also there is not enough firefighters to back us up. it could be injuries, deaths. report most of them say it was a pleasure sec the city and hope they will once again return here. >> this is the department i wanted to work for and i was lucky to get hired i will never give up hope to come back here. >> reporter: with the dispute still looming between the union and the city it appearance the

next step is the process called binding arbitration. that lets an outside mediator make the decision. the council will died if that will go before the voters in november. >> fire crews in southern california hope to have a stubborn fire there contained by tomorrow. the crown fire near palmdale in los angeles county is now almost 90% contained. the blaze has burned almost 14,000 acres and destroyed four homes and five out buildings. it's thought it may have been sparked from people using a tire iron to fix a tire feel. a major fire to the north in kern county is also nearing containment. fire crews say cooler weather and higher humidity helped them get the fires under control. bay area firefighters say despite the cooler than normal temperatures we have this there still a lot of fire season left. john is live in napa with

details. >> reporter: ken here in the bay area it's been less than beening but firefighters know that fire weather is on the way. cal fire is keeping its crews sharp for the big game that could come at any time. today we watched as this crew trained for battle against a pretended wildfire. >> right now is kind of the heart of fire season. >> it is. people can get into a falls sense of security because we have had the mild temperatures but we are not. >> reporter: unlike in other years this year's mild weather has let crews have a lot more dress rehearsals before having to face major incidents. >> higher relative humidities that affect the dry fuels, the dead fuels. and the lower temperatures as well. we just don't get the conditions where the fire start is as likely. >> reporter: the red flag conditions had the firefighters practicing hard, dragging hose hundred of feet up a rocky

hillside and putting out flames. >> training is important. we have seasonal firefighters and they aren't with us all year. >> reporter: of firefighter safety is important. the crew was ordered to evacuate because the fire changed directions. >> they have a look out established that calls out the fire is moving at you and now they move. >> reporter: while the bay area has been unhurt southern california is dealing major fires, stark reminders of the importance of defensible space. we found gary working in his yard. he feels he has enough defensible space for the ever present danger. >> because the fact we are on in particular hill and there is a lot of open space, a lot of grasses, some dead trees, so forth. they could be a fire hazard. >> reporter: officials say the cool summer has had no effect on fire conditions in the last three months of fire season.

truck and he is crazy, knocked over a pole and went up the street. >> reporter: once the driver stopped the truck neighbors surrounded, got the driver held and held him for police. >> deputies arrested a suspect in the killing of a man whose body was found in a high school parking lot. the 44-year-old is charged with murder. the victim's body was found at the high school friday afternoon in a car. he was identitied as a 34-year- old juan carlos garcia. he was killed somewhere else. an appear will be done tomorrow. the suspect is being held on one million dollars bail. oakland police investigating a couple shootings last night that happened with in minutes of each other. it's not clear if they are related. one involved a taxi driver and a passenger. police found the abandoned taxi just before ten at a gas station at 35th avenue and international boulevard. it had blood inside and a broken window. officers say someone drove the taxi driver to the hospital

where he is being treated for a gun shot wound. the second shooting involved two people shot in the 1100 block of 65th avenue. >> we had two men, that wereself transported from the 1100 block of 65th avenue to the hospital. they appear to be stable. >> there is no word on suspects or motives for either shooting. >> police in santa rosa have arrested a parolee think say tried to steal property from santa rosa high school. a burglar alarm alerted officers of the break-in just before 1:30 this morning. when they arrived they say they found the 29-year-old michael barton leaving the gym. he was arrested on charges of burglary and on a warrant for being a parolee. also two men arrested early this morning on charges of attempted murder. investigators say a 32-year-old approached officers just before 2:00 this morning saying he had been stabbed several times in a

. a 13-year-old boy is with his birth mother after police say he was found handcuffed with a chain around his neck outside his home last night. the boy told police his father chained him to the kitchen

table so his parents could go gambling but that he was able to unfasten the lock and escape. the father and his stepmother have been arrested and face false imprisonment and child cruelty charges. >> police investigating a deadly shooting that happened early this morning. officers responded to a call just after 1:00 a.m. and found a man shot inside a garage at a home. emergency crews gave first aid but the man didn't respond and was declared dead a short time later. it's not clear if he lived at the home. police haven't released any information about a suspect or a motive in the shooting. san francisco police are still searching for more suspects in connection with an attack yesterday morning in delores park. a man was attacked by as many as 12 people while walking through the park. he was stabbed several time its, beaten and robbed. police say the victim was targeted for his backpack and

didn't appear to know the suspects. he is in san francisco general hospital with life threatening injuries. the only details police have released are the ages of the suspects saying they were 17, 18 and 20. >> with california facing inepidemic of whooping cough parents are urged to get their kids vacant natured. >> reporter: it was once a common childhood illness and cause of death. that changed after people started using the vaccine. today people are finding themselves strapped for health care coverage. one program is trying to make sure no problem is left without insurance. this is the first time was gotten his teeth checked. >> open. >> reporter: he is within of 300 receiving a dental check and other check ups because of

neighbors in help. >> all done. >> reporter: free vaccines couldn't be at a better time. theresa's daughter starts school soon and as of two weeks ago the number of cases of whooping cough claimed to 1500. so far this year 7 infants have died in what looks like the worst epidemic in 50 years. >> it's nice to have this going on for them. for me single parent can't afford medical coverage. you can pay more than 5,000 for the emergency room. >> reporter: she was nearly wiped out bah of a trip to the er. >> it's scary because are you worrying about money. >> reporter: she made sure her nephew signed up for coverage. when i used to be at school i couldn't see nothing. >> reporter: victor's grades had started to slip because of his poor vision. here he was able to get glasses. >> the idea that little things become big things.

>> reporter: the city, county, united way and kaiser teamed up five-years ago to launch program. since then they have set up more than 10,000 children to health insurance and have provided free screenings, dental exams and back to school physicals for thousands. without it doctors say kids like victor could become drop outs, frustrated by not being able to see or read. >> when are you older and don't have insurance you can't get employment and we are putting this energy there to the kids now to make the future better. >> reporter: now to fight the epidemic california public health officials have expanded vaccine recommendations to include children under the age of seven, adults over 64 and women, before, during and after being pregnant. july, august and september tend to be the peak months for the cough and to give you an idea of how bad it is, last year there were 300 cases reported.

israel last night. the second attack with in 36 hours. no one was hurt. us receipt responded to the first attack with an air strike on a government building early saturday morning. no one is claiming responsibility for the attacks but the israeli prime minister warned gaza's rulers that israel holds them responsible and that they will defend itself. in pakistan the death toll from monsoon flooding has reached 1100 as the area braces for more heavy rain tomorrow. officials say at least 30,000 people remain stranded by the flooding. damage to roads and bridges is making it hard for relief agency to the bring supplies. related storms and flooding in afghanistan have killed dozens of people where united states and afghanistan military people are carrying out rescue operations. in china the government launched a new gps satellite into orbit today. the satellite is the 4th of 35 that will eventually cycle the

globe providing china with its only gps and communication system. it'll be able to provide ground navigation in china and asia by 2012. >> hundreds of protesters took to the streets today deuncing the united states and afghanistan government. >> we condemn american forces [inaudible] of afghanistan in different provinces. >> they marched to the presidential palace demanding an end to the occupation. the report said that 2400 civilians were killed last year. the deadliest year since the un started tracking the war deaths. >> they came under the game. freedom and human rights which is a false thing that they say. they are doing something against that. >> reporter: today's peaceful demonstration followed riots on friday when civilians attacked

2012. >> joint chiefs air chan said the united states has a plan to attack iran if needed but also said it would be a bad idea. the remark was a rare admission by a white house official that plans have been drawn up for possible military action. for its part iran fired back after the comment saying if iran were attacked the response would be overwhelming. robert gates made the rounds on the talk shows to talk about the war in afghanistan. >> reporter: the defense secretary predicts only small numbers of troops will leave next july when the united states is supposed to start a draw down. he said the way to improve security is to degrade the taliban so they are willing to consider reconciliation with the afghanistan government. gates said july 2011 is not the etched of the presence but the beginning of the transition and if the taliban is waiting for us to leave next summer they

economy rebound. >> i don't know where the stock market is going but i will say this. if it continues higher this will do more to stimulate the economy than anything we have been talking about today or any anybody else has been talking about. >> reporter: the former fed chair cautioned that home prices need to say stable saying another wave of foreclosures could trigger a double dip recession. he also warned against extending the bush era tax cuts. >> chemicals used to break um oil in the gulf may be polluting the oil beyond what was necessary for authorized. that is the words that has people concerned. chris guiterrez. >> reporter: new documents reindicate the coast guard approved bp to use hundreds of thousands of gallons chemicals to try to break up the oil in the gulf. the move was okayed despite a

government order that the chemicals only be used sparingly on the water's surface. it's extensive use is raising concerns as to the long term damage. >> we know that the oil and the chemical are both toxic, put them together and it's more toxic. thing that are critical to the marine life, the gulf of mexico. >> reporter: some agree. >> something like a -- with a shell, a small shell, crab, it gets stuck and if they can survive and shed that shell the oil can be released. if they can't it's stuck and there is a problem. >> reporter: bp is moving closer to permanently sealing the well. >> we are making preparations to do the static kill. that could start as early as monday night. >> reporter: it's a two part strategy to kill the well for good. first from above. pumping mud and possibly

cement. then from below using a relief well. a congressional subcommittee is expected to hold a hearing on the use of chemicals on wednesday. bp claims it used a record nearly two million gallons of the chemical in the gulf but now that figure is in question. in louisiana. >> with so udamage done because of the oil spill summer tourists have taken major hit. many are finding themselves along the atlantic. they are lining the shores of myrtle beach south carolina. some businesses say they are having the best summer in years. even so they aren't celebrating what's happen in the gulf. >> if someone from the gulf comes we will do our best to show them what we can but we won't be doing cart wheels offer getting business from somewhere elseful. >> reporter: a trend of vacationers diverting from the gulf to the atlantic. >> the high speed rail authority is seeking more stimulus funds for the project.

the rail authority has until the end of this week to apply for between 700 million and a billion dollars to work on tracks as well as build a station. the project has two and a quarter billion dollars already in grants for the 43 billion- dollar project. state voters approved nine million but it must be used to match other funds. >> muni reminding riders that a construction project starts tomorrow. its part of the ongoing improvement project. they say when it's done rider also be able to access the subway quicker using the clipper smart card. construction will be taking place between monday and wednesday. crews started putting in new gates and vending machines at other metro stations early their year. >> coming up next on the news --. >> continue to look at the cost of dining out higher. >> why auberger fries may soon

we have the on sheer breeze and -- a breeze around 20 to 25 miles an hour. that will be for wednesday and then thursday and maybe a little bitl bit of a bump in the numbers later in the week by friday and saturday. here is the plan. first thing tomorrow morning, near the bay possibly drizzle again. then into the afternoon. partly to mostly sunny. still patchy coastal fog. by 3:00 that's the forecast model. the depiction and then the temperature range, not a big change from the readings from today. santa rosa, clear lake warm at 90 and fairfield at 85. okay land at 70, if you want the 80s you can find them around walnut creek, pleasanton and livermore. san jose upper 70's. gilroy around 85. san francisco 64 degrees with a fog a factor in the morning pulling back to near the shoreline and sykes partly cloudy toward downtown. here is the look ahead. the five-day forecast and

an audit of the litter found fast food wrappers action cups and napkins the second most identitied source of trash on city streets right behind cigarette buts. to fight that city hall put a 20-cent user fee on cigarettes raising more than 2 million. >> it's basically off set general fund expenditures. we are relying lesson the taxpayer and more on cigarette buyers to basically fund the clean up. >> reporter: fast food joints and mini martes may be next. a similar fee would off set the cost of cleaning up the trash. criticized issues say san francisco people are paying enough. >> it'll hurt the consumer and i think it'll continue to drive the cost of dining out in san francisco higher eventually people will say it's to much. >> reporter: a restaurant manager said it's not fair to raise her prices because customers are litter bugs. >> places try to take care of the problems themselves but if
