sea breeze, fairfield west- southwest 23, gusting to 29. yesterday at this time it was about 17 miles per hour so here we go again. sea breeze kicking in, 80s for some, 60s by the coast, oakland you could pencil in 68 and be within a degree within the past 6 days -- [ inaudible ] >> -- sal -- >> -- another truck, northbound 101 just north of cesar chavez et hooks like paul the lanes are blocked on the way to downtown san francisco. this is a serious problem. northbound 101. all the lanes are blocked. unfortunately it is so foggy our camera cannot see our area so i had to use a map, so if you are trying to get into san francisco right now don't get 101. at 6:01 back to the desk. >> this morning dozens of san jose firefighters who were laid

off over the weekend are trying to get their jobs back. allie rasmus is at a station right now that was shut down over the weekend. she has the very latest on this. good morning,. >> reporter: good morning. it is something that people who live in san jose are certainly aware of, layoffs and steep budget cuts at the city's fire difficult. in fact when we pulled up here we found this sign posted in one of the fire stations here. a private business owner put it out in front of the -- in front of his business, says danger your fire company is closing. that fire company is one of the ones that was housed here at fire station 30 across the street. a total of 49 firefighters lost their jobs this weekend. they began turning in their gear on friday and because of the layoffs he city of san jose is losing four fire instructions and a ladder truck. the city is dealing with a $118 million budget shortfall. yesterday the firefighters

local 230 union unveiled a new proposal in an attempt to try and rehire some of the 49 firefighters recently laid off. as part of that proposal the union announced it is willing to give up pay raises for the 2010-2011 year and willing to give up 10% of benefits to new hires. firefighters say the public will be at risk. while the city's chief negotiator says the proposal doesn't go far enough. here what is both sides had to say about it. >> with less firefighters the citizens you know can suffer but also there is not enough firefighters to back us up in these big incidents that it co- -could be injuries, could be death s. >> when you consider how much we need to avoid the layoffs we need almost $10 million so there is a $6 million gap between what they are offering and what the proposal actually takes.

>> reporter: now the layoffs and changes come at a time of new leadership for the fire department. a new chief, william mcdonald, begins his first day of work this morning. >> 6:03. a suspected drunk driver is in jail this morning and he is the brother of a major league ball player. police say 23-year-old kanaan surholtz the younger brother of nate surholtz was involved in five hit-and-run accidents yesterday morning along danville boulevard and railroad avenue in danville. it ended on monitorra drive. police say he hit a bicyclist, a pedestrian, a truck, a light pole and an suv. witnesses describe that frightening scene. >> i was extremely afraid that he might hit a child or an adult or just go up on a curb because he was just wreckless. he was just going.

>> the bicycly it was hospitalized with cuts and bruises. he is being held on $350,000 bail. he is facing nine various counts of dui, hit-and-run and driving without a license. >> 6:04. this morning healthcare workers from two nursing homes in oakland walked off the job. certified nursing assistants and other healthcare workers scheduled to -- their strike to begin at 5:00 this morning. [ inaudible ] >> -- grand lake gardens assisted living centers. the workers say they are protesting -- [ inaudible ] >> -- since february. the strike is expected to last five days. a judge is set to decide today whether to issue an injunction in an ongoing contract dispute and it could mean big relief for ac transit riders. jade hernandez joins us live from oakland with the latest on this story. hi, jade. >> reporter: good morning, claudine. riders have experienced delays for days now. we told you that a judge had

been expected to make a decision in this case on friday but on friday a new judge was appointed because the other judge had to go on vacation, so this case has been dragged out a little longer. the new judge said a decision could come as early as today but it could be made later. now, if a judge decides in the union's favor bus drivers would go back to their regular work schedule. for those of you not familiar with why ac transit bus riders have been upset lately, well this is a contract dispute between ac transit and its union. the union's contract ended june 30th and after three months of negotiating talks ended as soon as the union forced arbitration, ac transit decided to impose a contract the da after arbitration was made which changed schedules for some of the 1100 drivers within this system. arbitration is expected to begin later this month but the union has since taken its case to the alameda county superior court in order to get a judge to grant an injunction to lift the newly imposed contract and

subsequent work schedule. ac transit says they will appeal if the judges decides to lift 30 new contract. the agency will be forced to layoff workers and reduce weekend service. right now the union denies union activity in the form of sickouts but riders have dealt with delays over the past three weeks because up to 20% of drivers have been call in in sick since the new contract became effective. bus drivers on the street on the other hand just hope riders know drivers only want what is fair. >> we don't want the buss to stop rolling. we don't want to in convenience the passengers at all and you know we just want everything to be fair because what ac trains -- [ inaudible ] >> -- talk to the union, everybody needs to talk together. >> reporter: ac transit management said its new contract pays the agency $15.7 million, and that -- [ inaudible ] >> -- funding gap for the two year period ending in june 2011.

now a judge could rule as i mentioned earlier as early as today on whether drivers have to adhere to that newly imposed contract. reporting live in oakland this morning jade hernandez ktvu channel 2 news. >> all right, jade, thank you. time now 6:07. let's go right too sal. a major mess in san francisco. what happened? >> that's right, northbound 101 a couple of trucks tied it up. first reported as an injury accident, now just an accident with minor injuries northbound 101 just past the cesar chavez exit. take 280 downtown instead of 101. the bay bridge toll plaza, that is not effecting westbound traffic. that traffic looks busy at the toll plaza. this morning's commute in oakland northbound and southbound 880, that traffic is at the speed limit. 6:08 here is steve. >> all right, sal, thank you. and here we go again. traffic-- i always look at travis because you know that delta breeze cordelia to travis -- if travis is showing gusts to 30 miles an hour out of the

west-southwest it just can't get that warm. it just can't. yesterday at this time sunday morning it was 17 miles per hour, now it is 30. so i mean there you go again. so gusty west-southwest west wind through the delta region mainly core dead a, fairfield, but even vacaville has a west wind so the pattern, which we had in -- let's see, what, april, may, jiewfn, july, is carrying right over into august and there is real -- if anything we are going to cool down later this week. no sign of any significant warm up. a very strange pattern but we are locked in. low clouds and fog just kind of continue to hug the coast. water temperatures low 50s, mid- 50s, upper 50s. they seem to be steady. 55 at 9:00, 60, then 63, low clouds, folk and breezy, temperatures i didn't change a thing. dropped the city one. there is too much of a sea

this morning president obama is headed to atlanta to speak to a veterans convention, he plans to them them about the progress being made to meet his deadline of drawing down all combat troops from iraq by the end of the month. alison burns is live now in our washington, d.c. newsroom with more on this. good morning. >> reporter: woal, good morning to you, claudine. and this is a landmark day for the obama administration. he will formally mark the end of combat operations in iraq. president obama will speak to a veteran convention in atlanta and say that his plan to get all combat troops out of iraq this month is on schedule. and the remaining 50,000 troops will be out by next year. hi will also address growing frustration over the mission in afghanistan.

he wants to begin pulling troops out next summer but even supporters of that idea say it is unclear if he will reach that goal. >> it is a mixed picture but the most important thing that is happening as far as i am concerned is that the afghan army is well respected, is now going to be taking the lead. and these are very important words for the american public to understand. >> reporter: so while there is so much uncertainty over afghanistan president obama will today try to focus on the success of the troop draw downs in iraq, a message we expect that he will be repeating several times over the next several months. reporting live from washington, d.c., alison burns, ktvu channel 2 news. >> 6:15. in the gulf of mexico bp engineers hope to begin the process of a permanent fix on that oil well as early as tonight. it involves pumping mud into the top of the oil well followed by the bottom kill

procedure. meantime, both bp and federal officials deny claims that excessive amounts of chemical dispursants were used on the oil spill. >> i think we all worked hard to not use anymore than we had to but i would say it was a very effective tool in helping fight the spill and these are all trade-offs and one of the things we didn't want to see happen is the oil reach the shoreline and dispursants were effective in that. >> credited ticks have raised questions about the long-term effects of the dispurr ant. iran is now responding to weekend protests marking the one year anniversary for detaining three uc berkeley graduates in they rain. relatives and friends of the detainees demonstrated in new york outside of the iran reign elbase and held in other places as well.

♪[ music ] >> making a little bit of progress in san francisco along north bound 101 as you approach the downtown area, an accident just past cesar chavez, they have the vehicles up to a tow truck. i would use 680. back to the desk. >> 40 people are facing charges in fap a county following a raid on a cock fighting operation un-american canyon. now officials say they acted on a tip. a team of deputies and other agencies broke up the fight. police say they found two dead birds and 50 live birds there at the scene. most of the people who were arrested were called spectators but others were jailed on more serious charges.

a 33-year-old oakland man is in the hospital with live threatening injuries after police say he was shot several times. now police say this victim, who was wearing a bulletproof vest, was standing outside glide memorial church on ellis street in the tenderloin about 3:00 yesterday morning when he was shot 16 times including one tomb in the face. the shooter told the victim, i told you i was coming before he opened fire. police think the shooting could be either gang related or it was a drug deal gone bad. and san francisco police are out there searching this morning for more suspects in connection with a brutal attack in delores park. a 40-year-old man suffered life- threatening injuries when he was beaten, stabbed and robbed on saturday. detectives have arrested three people so far but say they are looking for two or three more. at first they thought 12 people were involved in the attack but now they think many of them

were spectators. >> time now 6:26. a new program in alameda county is trying to help foster children succeed in life. some 60,000 children are in foster care throughout california and studies show former foster children are at greater risk of going to jail or becoming homeless. alameda county is hiring former foster children in a program to serve as peer counselors. >> oftentimes they feel very alone when walking in and we are there to be a shoulder, partner and advocate for them to let them know they are not alone. >> it is more than just a group of co-workers and friends that i work with. to me the people that are in that office that i work we are like family.

running so we will just say good morning to you, thank you for joining us here on the ktvu morning news, monday, august the 2nd. i am dave clark. >> i am claudine wong, pam cook has the day off. >> time is 6:30. we have several develops one in oakland where police have been called in to calm the tension at an early morning protest. let's go to kraig debro out there right now. what is happening, kraig? >> reporter: good morning, dave. the picket lines are at the piedmont gar debs just on 41st street just off piedmont avenue. now there are a number of people out there, dozens over union workers not only from here but at the other facility owned by this company american baptist homes of the wet, that one is over at grand lake, no picketers there. they are all over here. this is the larger of the two facilities down the street there are police here dave but they just on stand by it is not clear who called the police. i talked to the management here at the home piedmont gardens and they said they did not. now workers at grand lake

gardens are also on strike for up to five days. there has already been some tension on the picket lines a van had trouble entering this property shortly after 5:00 a.m. the picketers are walking in front of the driveway and security had to clear a path for it to enter. healthcare workers are striking over benefits and sick leave. one allegation made by union workers west are restrictions on the number of sick days. now workers claim they could get 5 -- they could get only five sicks day and -- [ inaudible ] >> -- quarantine -- >> we had a situation one person came in sick, they worked. two or three days later people up in the health center started getting sick. they had to come out -- the state had to come out and quarantine the second and third floor for three weeks. >> the residents experience as happens often, there was a virus, for the resident

protection we did -- >> okay. >> -- take care of them and the state was aware of it. >> reporter: -- direct result of a sick worker. there are also other issues on the table including pension benefits. [ inaudible ] >> reporter: -- impasse since then and that is what led to this five day strike. reporting live in oakland, kraig debro, ktvu channel 2 news. >> contra costa county sheriff's deputies are investigating a drive by shooting in rich monday that sent three teenagers to the hospital. it happened just before 5:00 last night at market avenue and third street. the victims 114-year-old girl and two boys ages 14 and 16, were standarding on the corner when someone drove up and started shooting. all three were taken to the hospital with non-life- threatening injuries, the motive and any suspect information is still not known. police are trying to determine if two shootings which happend a few minutes apart saturday night are

related. police found the taxi just before 10:00 at a gas station. officers say someone drove the taxi driver to the hospital with a single gunshot wound. in the second incident two men were shot in the 1100 block of 65th avenue. there is no word yet on suspects or motives for either shooting. >> two special units with the vallejo police department have been suspended until december first. we are told it is not because of any bad behavior. it is the city eye difficult financial situation. city officials reportedly say the canine unit costs about $100,000 a year to operate which includes time off for training. but supporters of the program say one dog can do the work of three or four humans when it comes to searching for a suspect. >> ned has already got seven arrests under his belt, which is an -- and he has only been working the street for a month

and a half -- >> -- other ways to pay for the canine units and hopefully bring them back in november. in the meantime three other dogs we are told will stay with their handlers or be turned over to the police department during that suspension. >> a small earthquake rattled central california's salinas valley last night. the 3.6 shaker struck around 9:00. it was centered around 17 miles east of king city in south monterrey county. so far there have been no reports of any damage or injuries. cal fire says crews now have the upper hand on that wildfire smoldering in palmdale north of loss alaska rest. they expect to have it contained tonight. it has burned aches and destroyed homes and out buildings. they believe it started by someone doing car repairs. the cooler than normal temperatures around the bay area are making for a quiet fire season here but

firefighters warn that could all change pretty quickly and so cal fire is keeping its crews sharp by training them for battle against imaginary fires lick this one. >> we are not letting up. >> they say it does not have a cumulative effect and only takes a brief period of hot windy conditions to spark a wildfire. >> 6:36. a rooming is expected today in a major labor dispute involving ac transit. jade hernandez is in oakland with the latest. >> reporter: good morning a newly appointed judge in this case said a decision could come as early as today or it could come later and that is bad news for riders who have experienced delays over the past three weeks since a large number of

bus drivers have called in sick. but we spoke to a bus driver this morning who told us that the union is not behind a sick out. >> i have actually been upset, too, but i have actually you know come to work every day and just -- and just you know adapt to what we have been given and hopefully the judge will make a decision in our favor, make a ruling in our favor because we don't want the buses to stop rolling. we don't want to inconvenience the passengers at all. >> reporter: this is a dispute between them and the union. after three months of negotiating they decided to impose a contract. during that period ac transit imposed this new crack on employees which changed schedules, work schedules for some of the 1100 bus drivers within the system. the union has since taken its case to the alameda county superior court in order to get a judge to grant an injunction to lift that newly imposed

[ inaudible ] >> -- cool, the northeast and much of the carolinas, virginias hot. san jose 54, delta region, this is where you look for that sea breeze and boy habit been almost every morning showing itself. all right gusts now at fairfield to 30 miles an hour. sustained 23. gusts to 30. yesterday at this time 17. so the sea breeze has picked up, that means a cooler pattern. there is a system moving into the pacific northwest -- [ inaudible ] >> -- system it doesn't take much to get that fog going.

neighborhood that the fire company nearby here is closing. he is talking about one of the fire companies that was housed in fire station 30, that is right across the street from here. now another man who lives on this street told us this morning he appreciates the work firefighters do and to give us an example he told us about a fire that happened across the street from his home about a month ago. >> it -- [speaking foreign language] >> reporter: -- fire quickly and he -- [overlapping speakers] [ inaudible ] >> reporter: -- layoffs the city is losing four engine trucks and a ladder truck. the cuts are part of the city's plans to deal with 118 million dollar budget shortfall. yesterday the firefighters union unveiled a new proposal to try and hire back the 49 firefighters laid off this weekend in that proposal the union announced it is willing to give up pay races and

removing a no layoff provision and is willing to give up 10% of benefits to new hires. >> the san jose firefighters is stepping up once gene and making yet another proposal that we believe should knock down all the barriers. >> although there are some positive things in it, in terms of the amount over paid reductions and benefit reductions the firefighters are willing to offer, it appears to be the same as their prior offers. >> reporter: now the city of san jose's chief negotiator says even with the latest concessions there is still a 6 million dollar gap between what the union is offering and what the city needs. the fire department is also undergoing a change in leader shich. a new fire chief starts this morning. >> 6:47. this morning police are warning you drivers in daily city about a planned dui checkpoint tonight. it is being conducted by police

walked out of the jail this morning but she is not free just yet. lindsey lohan was released at 1:35 this morning after serving less than two weeks of her three month jail extension. a judge ordered her to report to a rehab facility within a day of getting out. a judge sentenced her to jail for violating her probation on a drunk driving conviction. the american version of the royal wedding happened over the weekend. there is chelsea clinton, marrying her lon time fi an say. she wore a gown by vera wang. there you see her with her mom and dad. vera wang was there, too. the newly weds exchanged their vows saturday evening at this estate in the small community of rhinebeck, new york. bay area drivers, claudine. >> -- 680 are sitting -- [ inaudible ] >> -- plea san ton and milpitas, drivers who sign up between now and october 20th
