"mornings on 2" begins right now. welcome to "mornings on 2." i'm dave clark. >> i'm claudine wong. tori campbell is off tonight. it's monday, august 2nd. in the news, a protest is happening in oakland at this ho ho -- at this hour. this one started two hours ago and already we've seen tense moments. ktvu's kraig deb bow debro is out there now with the latest. >> reporter: another tense moment a few seconds. behind me, workers are walking the picket lines. they are actually from two facilities. the workers are members of the united healthcare workers west and they work here at piedmont gardens and at grandlake.

a van had trouble entering the property. this is shortly after 5:00 a.m. this morning. the picketers are walking in front of the driveway. security had to clear the pathway so the workers could enter. the workers include cooks, and other workers. the picket is about benefits. >> we have a great plan but they want to change it, like if we go to the doctor and we have to stay in the hospital, it's $3,000. do you know how many paychecks i would have to say for $3,000? that's insane. >> we've made a number of offers. they've all been rejected. they are primarily economic issues. one of them is the pension plan, which is in critical status, which is legal terminology. we think another 401(k) is a better option for our employees. >> reporter: union workers have been accusing both facilities

of firing workers for taking more than five days' sick leave a year. the facility says they get 12 sick days a year but admit half of them are for kindercare. both facilities have hired replacement workers, people the union call scabs. one of the thing they are doing in addition to picketing, walking on the driveway, which we touched on before as a problem. police were out here a while ago. i asked her who called them. she said one of the neighbors. it was one of the neighbors who wanted to know what was going on out here because it was 5:00 a.m. back to you. >> thank you. a judge could decide whether to issue an injunction in another labor dispute. this one involving ac transit drivers. you can bet passengers will be

watching this next step very closely. ktvu's jade hernandez has been following the situation and joins us live from oakland. i imagine that riders just want to know what to expect when they are waiting for the buses. >> reporter: claudine, i can tell you they expect delays even today. a newly-appointed judge said a decision could come as early as today. we spoke to one bus driver this morning, and that driver told us they are just worried about their future under a newly- imposed contract made by ac transit. but it's just the opposite with ac transit. the agency says without forcing a contract which saves nearly $16 million for the ex, they will be forced to lay off workers and reduce weekend service. of course, that affects bus drivers and riders. this contract dispute's been going on for months now. today an alameda county superior court judge could rule on whether to lift that newly- imposed contract on ac transit on the more than 1100 drivers. the two sides will still are to

sit down with an arbitrate at the end of the month to work out the contract. the contract ended the 30th. ac transit says if the judge decides to lift the ruling, they will lose. 20% of drivers have been calling in every day sick since this became effective. the union denies a sickout. the union says if the judge decides in favor of ac, they will appeal. reporting live in oakland, jade hernandez, ktvu channel 2 news. >> all right, jade. thank you.

7:05. a suspected drunk driver's in a bay area jail this morning. he's the brother of a major league ball player. police say 23-year-old kanan kanansherholtz was involved in five hit-and-run accidents in danville. all of this came to an end on montare drive and mccomer road. he reportedly hit a light pole, suv, a pedestrian. he didn't stop at any of the places he crashed. >> there was a parade going up, maybe a motorcycle or two. they were honking their horns and such for him to pull over. >> now, the 51-year-old bicyclist was sent to the hospital with cuts and bruises.

that appears to be the worst of the injuries. here's a photo of the suspect. he's being held on $350,000 bail and is facing nine various counts of dui, hit and run and driving without a license. contra costa county sheriff deputies are investigating a drive-by shooting in richmond that sent three people to the hospital. it happened at 5:00 last night at market d richmond. the victims, one boy and gun girl, were just there when they were shot at. 7:07. in san jose, firefighters and the union there are trying to come up with a way to get 49 laid off firefighters back on the job. the union offered a ne proposal yesterday to the city, trying to save the job of dozens of firefighters who were laid off friday. however, the city says this new proposal still doesn't have

enough cost savings. >> when you consider how much we would need to be able to have avoided the layoffs, we need almost $10 million. so there's a $6 million gap between what they're offering and what the proposal actually saves. >> with less firefighters, the citizens, you know, can suffer, but also there's not enough firefighters to back up up in these big incidents that could be injuries, deaths. >> with the layoffs of the firefighters, the city of san jose is closing two fire stations. in addition to the firefighters 142 other city employees lost this their jobs. muni drivers are getting a 6% raise. the average muni worker is now going to earn more than $29 an hour. the increase is going to cost the city around $8 million and to make up for the difference,

>> reporter: i'm right across the street from fire station 30. this is one of the two sessions that will be affected by the layoffs and budget cuts happening at the san jose fire department. those layoffs and budget cuts are something that people who live in -- who live and work in this this area are definitely aware. the person who works at this auto repair shop put up a sign saying "your fire company is

closing." the firefighters began turning in their gear on friday after losing their jobs. because. layoffs, the city of san jose is losing four engine trucks and a ladder truck. that will have an impact on at least two stations. one of them fire station 350. the city of san jose is dealing dealing with $11 million budget shortfall. yesterday, the firefighters local 230 union unveiled a new plan in the attempt to try to rehire the 49 firefighters laid off. as part of that proposal, the union said they will give up pay raises for the 2010/2011 year. firefighters say even with these new concessions, the public will be at risk while the city's chief negotiator says the union's latest proposal doest go far enough. here's what both sides had to say about it. >> with less firefighters, the citizens can suffer but also there is not enough firefighters to back up up in

from patrols for training. however, supporters of the k-9 program say one dog can do the work of three or four human service -- office -- officers when it comes to searching for a suspect. >> ned has already got seven arrests under his belt, which is -- he's only been working the street for a month and a half. >> there is no word on the fate of the s.w.a.t. team at this point. but the city is hoping to bring back the k-9 unites in november. the three other dogs are gonna stay with their handlers or be turned over to the police department during suspension. an oakland man is in the hospital with life-threatening injuries after san francisco police say he was shot several times. they say that man who was bearing -- who was wearing a bulletproof vest was standing outside glide memorial church around 3:00 yesterday morning. he was shot 16 times, including once in the face. now, witnesses told ktvu that the shooter told the victim

serious charges. bejust spoke with the ac transit spokesman and he's checking for us how many drivers called in sick today. on thursday of last week, there were about 147 drivers on friday, 150. that's about 15% of the operators employed by ac transit. i spoke with the bus driver this morning. she tells me that drivers are worried about their future under the newly-imposed contract made by ac transit. but it's just the opposite with ac transit. the agency says without forcing a contract, which saves nearly $16 million, the agency would be forced to lay off georgeers -- worker and reduce weekend service. of course, obviously impacting both workers and riders.

ac transit says if the judge decides to lift the contract, the agency would lose nearly $60 million in labor costs. riders have dealt with delays over the past three weeks because up to 20% of drivers have been calling in sick each day since the new contract became oathtive -- effective. the union denies a sickout. ac transit says if the judge decides in favor of the union, they will appeal. we don't want the buses to

a controversial this morning about the way bp used the dispersants. sandra, good morning. >> reporter: well, good morning, dave. certainly a war of words, a back-and-forth, rather, between congressional democrats as bp officials. but right now it's a very critical time for bp. the oil company is going to try to plug up the gusher for good. the first of two procedures to plug up the well once and for all could get underway as early as tonight. it's called the static kill, where mud would be pumped into the top part of the bill. >> we should not be writing any obituary until this is completely sealed. >> reporter: this would pump concrete into the bottom of the ruptured well. the final steps may not happen until the end of the month. still, officials say the work to clean the gulf is not over. >> we're gonna be here for a very, very long time. i know people are worried about that. now that the well stopped

moments on a picket line outside an assisted living facility. a big search for a stolen truck. the ac transit labor dispute heads back to court today. it could have a big impact for thousands of commuters. the second hour of "mornings on 2" starts now. good morning. welcome back to "mornings on 2." i'm claudine wong. tori campbell is off today. >> and good morning. i'm dave clark. it's monday, august 2nd the. we continue to follow developments happening in oakland. a week-long strike at two assisted living facilities is happening right now and this strike has already produced at

least one pretty tense confrontation. kraig debro is out there right now, so kraig what happened? >> reporter: i mentioned there were two facilities, one at piedmont. the other one at grand lakes gardens also in oakland. about an hour an five minutes ago, one of the vans coming in delivering the workers, the replacement workers, the union members call them cavs is coming in and bringing the workers in. the point is, they are blocking the driveway here to try to make their voiced and point heard. the owner of the facility has hired a security company. they are making sure people of the business can enter and leave securely.

the healthcare workers include maintenance are on strike. but the job action is also about benefits. if we go to the doctor and we have to stay in the hospital overnight, the deductible is $3,000. do you know how many paychecks i would have to say for $,000 for an overnight stay in that's insane. >> we've been trying to settle with them. we've made a number of offers. they've all been rejected. one of them is the pension plan which is in critical status, which a legal terminology. -- which is a legal terminology. union workers have been accusing both facilities of firing workers for taking more than five six days a year. they admit half of those days are for kinder care, taking time off for caring for a

relative. the strike is scheduled for five days, both facilities have hired replacement workers. again, the union is calling those workers cavs. the company calls them replacement workers. this strike -- occasionally these workers will walk around the block. this facility is large enough to cover a whole city block. we have been out here since 5:00 a.m. police were out here. they said they were called out here because one of the neighbors called complaining about the know. kraig debro, ktvu channel 2 news. 8:02. san jose city lead, say a new preparal by the firefighters union offers too little too late. ktvu's alley so -- allie rasmus joins us live. >> reporter: good morning, claudine. we're right across the street from fire station 30. this is one of two stations impacted by layoffs and budget cuts at the san jose fire

department. a total of 49 firefighters with the department lost their jobs over the weekend. it's something that people who live and work in this area are definitely aware of. you pan over take a look. the owner of this auto repair shop right across the street from the fire station has a sign in front of his business warning neighbors about the fire department cuts. he's not the only one around here who feels strongly with those -- about those layoffs. >> i don't think they should lay off the firefighters. i think they should fix the budget, you know, try a different way. >> the city of san jose is dealing with $118 million budget shortfall. the city's fire department is losing four engine trucks and a ladder truck and along with 49 firefighters as part of those budget cuts. yesterday, the fire department announced a new plan to hire

back the 49 firefighters. the union is willing to give up pay raises, they agreed to give up 10% of benefits to new highers. but the chief's negotiators says even with the latest concessions, it's not enough to hire everyone back. >> when you consider how much we would need to be able to have avoided the layoffs. we need almost $10 million. there is a $6 million gap between what they are offering and what the proposal actually saves. >> reporter: now, the layoffs come at a time of new leadership changes for the city of san jose's fire department. the new chief -- fire chief, chief william mcdonald, start his first day of week this morning. allie rasmus, ktvu channel 2 news. >> thank you, allie. in san francisco, muni drivers are getting a 6% raise.

these are the same drivers who the city has tried repeatedly to get contract concessions from. all over public unions with the city have made those concessions but the drivers 'union has twice refused. the average driver will earn about $29 million. this had cost the city about $8 million. to make up for the service, they've cut service. there is a ballot measure to change that on this november's ballot. 8:05. if your morning -- if your morning commute takes you near the civic center, you should probably go another way. a produce truck spilled this. this is the load that fell out along larkin street near market. right now, the police are still searching for the truck and driver who was last seen going east on mcalister street. he's described as being in his 40s and wearing a plaid jacket. so far, no injuries have been reported. a suspected drunk driver is

in jail this morning. that driver is the brother of a major league ball player. nanansherholtz was involved in five hit-and-runs yesterday. it all ended on montare drive and mccome ber road. police say he hit a bicycle, a pedestrian, a truck, a light pole and an suv. witnesses describe that frightening scene. >> i was strainly afraid he might hit a child or an adult. he was just reckless. now, the 51-year-old bicyclist was sent to the hospital with cuts and bruises. that appears to be the worst of the injuries. here is a photo of kanan. he's being held on $350,000

bail. he faces -- dash he faces hit and lun and driving without a license. a crash that sent three people hot tonight happened last night at market and third. the victims, 14-year-old girl, and two bays ages 14 and 16 were standing on the corner when someone drove up and started shooting. police say all three were taken to the hospital with non-life- threatening injuries. there's into word on suspects or motives. san francisco police are searching this morning for two or three more suspects in connection with a brutal attack in the park. a 40-year-old man suffered life- threatening injuries when he was beaten, stabbed and robbed on saturday. detectives have arrested three men, ages 17, 18 and 20. at first they thought they were about -- there were about 1 people involved in the attack but now they believe many of them were spectators. let's go right back to sal. he's watching the whole commute. i know you're looking at the

to speak to a disabled veterans convention in atlanta. he's gonna talk about the troopdown underway and the progress. alison burns is live with the very latest. >> reporter: that's right. president obama will be marking the end of combat missions in iraq. here he is arriving in atlanta just about a half an hour ago. he will be speaking at a veterans convention in atlanta and say that his plan is to get all combat troops out of iraq this month and say that that plan is on schedule. >> will he says the remaining 50,000 troops will be out by next year. he will also address growing frustration over the mission in afghanistan. he wants to begin pulling troops out next summer. >> it's a mixed picture. the most important thing that's happening, as far as i'm concerned, is that the afghan army is well respected, is now

saying he's being threatened. manning is charged with leaking an air strike publishished in april. the pentagon says he's the prime suspect in last week's disclosure of thousands of feel reports from the war in afghanistan to that website. 8:15. in a speech today iran's president said he's ready to meet face to face with president obama in a public debate over disputes between the two countries. president mahmoud ahmadinejad says he plans to visit new york for the next u.n. general assembly. that's in september. the iranian president said while there, he's ready to meet with president obama and quote put the world's issues opt table. but president mahmoud ahmadinejad is not mention the three uc berkeley graduates who have been imprisoned in iraq for a year now. relatives protested outside of the u.n. demanding their decision -- release. protesters were in san francisco, washington, d.c. and

several other cities. yesterday, an iranian government spokesman said the three are -- should be answerable before the law. we're getting word this morning that a uc berkeley student was killed in a plane crash in pentagon. we found this photo of her on a facebook page create bide her friends. she was a sophomore and soccer player. she joined the women's sporting team this year. she was traveling on the plane when it crashedout side of islamabad. all 152 people on board were killed. investigators with the national transportation safety board will arrive today at the site where a large cargo plane yesterday in alaska's denaldi

national park. investigators say the plane belonged to a freight company based in alaska. all three people on board were killed when the plane disintegrated upon impact. in arizona, three convicted murderers escaped over the weekend. three of the inmates are still on the run and should be considered dangerous. the three escaped saturday morning from the prison by cutting a fence. police say they then hijacked an 18-wheeler and fled. the two inmates on the run are believed to still be in arizona. 8:1. well, chelsey clinton is a married woman now. we have the pictures of

cal fire says it hopes it hopes to have the wildfire smoldering in palmdale fully contained tonight. the fire has already burned 22 square miles which is roughly 14,000 acres. it's also destroyed four homes and five outbuildings. investigators believe that fire

started on thursday because someone was doing car repairs. 8:22. this coming friday, oakland mayor ron dellums will announce whether or not he will run for a second term. so far mayor dellums has not ruled out running for reelection but he hasn't confirmed he will run either. six other candidates have already announced their plans to run for oakland. california's fair practical commission says something has to be done about politicians sending out messages about new media. they say political postings on twitter or facebook or in text messages should be held as traditional advertising like on tv and newspapers. they say it's time to rewrite the rules to meet the new challenges of the new technology. an endangered species of

mouse could cause more delays to development. here is the problem. they are creating sec station and they need to remove it so the sediment can be released into the ponds. otherwise the sediments will have to go into the bay and that will increase costs and more permits. environmentalleists say part of the plan will be to trap those mice. let's go back to sal. did they find the stolen produce truck? >> yes. we have new video of this arrest -- pardon me? nobody has been arrested. i will just tell you what's going on here. we do have video. we just haven't turned it around yet. this is the video of the fruit

oakland with the very latest on this. good morning, jade. >> reporter: good morning, claudine. about a half hour ago i spoke to ac trans's spokesperson by phone. he said about 150 people called in sick, that's about 50% of the operators in all who didn't show up to work this morning. i spoke to a driver who said she was extremely worried about her future under this newly- imposed contract made by ac transit but it's just the opposite with ac transit. they couldn't save nearly $16 million for the agency and then the agency would be forced to lay off workers and reduce weekend service. this contract dispute has been going fon or months now. today an alameda county superior court judge could rule on whether to lift that imposed contract by ac transit. the two sides would still have to sit down with an arbitrator at the end of the month to

hammer out a contract. the union's contract ended june 30th. ac transit's spokesman said that if a judge decides to lift the new contract, the agency will lose $16 million. riders have dealt with delays. 15% to 20% of the drivers have been calling in sick every day. the union denies a sickout. ac transit says if the judge decides in favor of the union, they will appeal. we spoke to an ac transit bus driver who has worked here for ten year and says she's come to work every day for ten years. >> we don't want the buses to stop rolling. we don't want to inconvenience the passengers at all. we just want everything to be fair. what ac transit is doing to the district is not fair. everybody needs to talk together and come to some type of compromise. you know what i mean? >> reporter: i'm sure riders

are wondering if there are gonna be any delays and how much longer will there be any delays. that's true. right now an alameda county superior court judge could rule today on whether to lift a newly-imposed contract and right now, we -- we checked in with ac transit spokesman. he told us he doesn't know if the judge will make that ruling and then let both parties know or if there will actually be a hearing later this morning. we'll continue to follow the story for you. reporting live jade hernandez, ktvu channel 2 news. >> thank you, jade. 8:33. well, a protest is happening right now in oakland. this one started just a couple of hours ago and already we see -- we've seen intense moments. kraig debro is out there now and has the latest. >> reporter: good morning, dave. a loud report you could say. since we last saw you at 8:00 there's been a lot more musical instruments brought to the picket line. this is 41st street just off

piedmont avenue. there are dozens of workers who work here at grand lake gardens. those are two facilities owned by the same company. they are striking here over a delay in the contract. i wanted to show you something very quickly. they've been having vans come in here and the vans are parking down the way over there. that van had nobody in it. i'm kind of curious why they even did that except maybe practice. that's only one example of the tension on the line today. the replayment worker, union members have called them scabs have been trickling in for most of the morning. the company hired a detroit company to provide security and provided the replacement workers. the workers are striking here,

they are cooks, peop who clean, people who do the laundry, just about everybody in this facility and the other one are out on strike. it's only a five-day strike. worker want to make their point. the two sides have been trying to negotiate a contract. the workers are complaining about certain benefits but they are also complaining about the sick leave. >> i was dog sick. i came here in with the pinkeye and i came in here and i worked. they said if you are able to work, you work. i finally went down to human resources. for them knowing it was contagious, i got to go home. >> there's 12 sick days a year. >> reporter: not five? >> not five like they are saying. >> reporter: 12 paid -- >> 12 paid sick days a year. >> reporter: you come out here live, they are now walking

around the block. they are headed west. the plan is go to north on piedmont avenue and go all the way around the block. this is a huge facility, actually covers a city block just off piedmont avenue. according to the company, you heard her say they have 12 paid six days -- sick days. but six days are for kindred care. so they get six days off and then the six days are for kindred care. police were out here. they were called by a neighbor. apparently the neighbors did not know this was gonna be going on in the morning. the police are gone. we're live in oakland, kraig debro, ktvu channel 2 news. >> thank you, kraig. 8:36. a 33-year-old oakland man is in the hospital with life- threatening injuries after san francisco police say he was shot several time. they say the man who was

wearing a bulletproof vest was standing outside glide memorial church around 3:00 yesterday morning. he was shot according to police, 16 times including once in the face. now, witnesses told ktvu that the shooter told the victim, i told you i was coming before he opened fire. oakland police are investigating two shootings saturday night. the first involves a taxicab driver shot time before 10:00 p.m. police say someone drove that taxicab drive to the hospital. in the second incident which place say happened minutes later, two men were shot on the 1100 block of 65th avenue. they also took this selves to the hospital and there's no word yet on suspects or motives for either shooting. 8:37. two sacramento parents accuser of shackling their 134-year-old son to a chair are out on --

accused of shackling their 13- year-old son to a share are out on bail. the boy said he was being punished for something he did wednesday. he was allowed to go to the bathroom and sleep in his own bed. >> it's not the most extreme case of child abuse that we've seen. but it's definitely not the normal, you know, case of abuse. >> now, police arrested the young man's father, and hit stepmother shortly after the teenager escaped. they are now facing charges of false imprisonment and child cruelty. >> that 13-year-old is in the custody of his mother the. about 40 people are facing charges in napa county following a raid on an alleged cockfighting operation in american canyon. acting on an anonymous tip, deputies, local police and the chp broke up this cock-fighting operation in a caged arena on american canyon road. officials say they found some

stats. new york central park, second hottest july ever. richmond, virginia about only the -- not only the hottest july over. san diego had their fifth coldest july and the coldest they've had sin -- since 1916. i'm sure l.a. will come in with record low temperatures. we just had our fourth below average month of temperatures. we're going into the fifth looking much like the four. we start off with fog and low clouds. the delta breeze is showing itself again. only 17 miles an hour. they are down to 23. gusts to about 25. when you get the delta breeze, that mean low clouds and fog on the way. another low coming in. this was november -- if this was november, de, january, we would have more rain. 63 should be 68.

live picture from atlanta -- the president is addressing a convention of disabled veterans he's thanking the verts for their service -- veterans for their service and also updating them about the drawdown of the troops in iraq and also upgrading the strategy in the afghan war. a 23-year-old man is facing several charges this morning in connection with five hit-and- run accidents in danville. there's his photo. he's kanan sherholtz, the younger brother of nate. police say he hit a bicyclist, a pedestrian, two vehicles, and a light pole before being arrested on suspicion of drunk driving. well, in the gulf of mexico, bp engineers are hoping to begin the process of a permanent fix on that broken oil well as early as tonight. the static kill, that's what they call it, involves pumping mud into the top part of that broken well. after that will come the bottom kill procedure. that's pumping mud and concrete from the bottom of the well.

in the meantime, bp as well as federal officials deny charges they used excessive amounts of chemical dispersants on the oil. >> i think we all worked hard to not use any more than we had to but i would say, it was a very effective tool in helping fight the spill. these are all tradeoffs. one of the things we didn't want to see happen is you all reached the shoreline and dispersants were affected in that. >> critics have raised questions about the long-term effects of the dispersants on sea life. oakland-based clorox, a pioneer in household products, has earned a coveted seal to verify its products are truly green. >> reporter: clorox calls their products green. when it come to food, natural, organic products often break
