about two dozen people. but the folks here were dedicated and that included mehserle's father. >> i'm out here today to support my son and support all of law enforcement. because it's a very slippery slope when they start to send people to work with guns and not only civilly convict them but criminally. >> reporter: in his first interview, todd mehserle tearfully said his son is quote, doing okay behind bars since his conviction in los angeles for involuntary manslaughter and use of a gun in the killing of oscar grant. former police officer mehserle said he accidentally pulled his gun instead of his taser. >> he's in the wrong place. we love him dearly and grew up to be anybody he wanted to be and chose public service and this is his thanks for making a

mistake. >> reporter: todd mehserle thanked people out here. >> it touches my heart when i see things like this go on, when they jail innocent officers. we should thank them for the job they do. >> reporter: unlike last month's rally, there was no organized opposition today, but there was opposition. >> he was underground doing nothing defenseless, you can't do nothing. you don't need a gun there. he's a big strong guy. >> and you understand that he meant to pull his taser? >> reporter: organizers told me that they planned to have more of these rallies throughout the bay area before mehserle is sentenced which is three months from now. reporting live in san jose, rita williams, ktvu channel two news. we are learning tonight that an east bay man charged with hit and run and drunk driving in a string of

accidents in danville reportedly had a prior dui conviction as a teenager. police say 23-year-old canan sheerhold hit a light pole and pedestrians yesterday. none of the pedestrians were seriously hurt. a sacramento couple is charged with child abuse after their 13-year-old son was found on the street asking for help with chains on his ankles, wrist and neck. police say the boy escaped friday when his father and stepmother went gambling. the boy was chained to the table with only breaks to sleep and go to the bathroom. the couple was charged with imprisonment and cruelty to a

child. the boy is now with his mother. -- ktvu's david stevenson live in san san francisco with our report. >> reporter: supporters hope it would encourage would be criminals to think twice before striking. >> people want to feel safe when they are going on public transit. >> reporter: san francisco's council took a look at a plan to fine criminals for loitering while carrying a concealed weapon, in or around the bus zone or vehicle. >> we want to send a message that crime on munni is something that we just don't tolerate. >> reporter: their proposal comes on the wake of three

operators will receive a raise this year of almost 6%. with the raise the average describe would be paid $29.60. a top munni official says the increase will cost munni an extra $3 million. san jose officials say the latest proposal by the fire department union is quote too little too late. the union is looking for a way to save the jobs of 49 firefighters laid off over the weekend because of the city's budget shortfall. the new offer includes a two tier recovering structure. the proposals would save less than $6 million and that the city needs more savings than that. >> reporter: the california supreme court today upheld the state law that bans affirmative

action and public employment, education and government contracting. in the 6-1 ruling, the court rejected argumenting that proposition 209 passed through voters in 1989 violated federal equality protection. today's rulings comes as a challenge that gave presence to women and minority owned contractors. the order tphapbs expired in 2008. san jose may be facing another obstacle in its campaign to bring the a's to san jose. at&t says it has no plans to sell the lot where the new stadium is planned to go up. >> reporter: if you look over here, you can see either an at&t facility or the first baseline of a future a's stadium. depending on if a sale can be

made. at&t service trucks have been rolling out of this facility for decades. right where the city is buying up properties to build a baseball stadium as a possible home for the a's. >> it'll be a straightforward, real estate transaction. once major league baseball gives us the go ahead. >> reporter: but at&t says not so fast. despite some media reports, at&t has no plans to sell. he says the land is not for sale because it houses a working facility for more than 100 employees and there have been no negotiations with san jose. downtown councilman sam ricardo disagrees. >> i've been contacted by representatives of at&t about this site. so there's certainly no question the conversation has been happening for over a year now. it's hardly the case that what you see behind me is some undispensable tower of communication. >> reporter: the key may not be the stadium site property but

wall street started this month with a bang as investors reacted to encouraging economic reports from around the world. all major indexes jumped about 2.5%. the nasdaq up more than 40 points. if cell phone companies get tear way, consumer may soon have another way to buy things. paying with a cell phone has become popular in japan and the united kingdom. but will it catch on here? tom vacar has the report. >> reporter: could these be replaced by this, answer yes, emphatically yes. with minor modifications, scanning a smart phone is no more difficult than reading a credit card's magnetic strip. that could put all of your credit cards on something you

right. some jamba juice stores are under new ownership. the company sold 14 smoothy stores in the state to raise money. they are located in santa cruz, chico and redding. giant cranes are now headed to the east coast tonight. the low profile cranes are headed to boston. >> we're able to give these cranes to another port where they can put them to good use. we don't have to waste the steel, we don't have to work on recycling steel. >> port officials say the new state of the art claims have replaced the old ones. the low profile cranes were necessary when planes were

the top funds. >> this is an historic occasion. it means that california's curriculum is going to be even more rigorous and it's going to be aligned. >> reporter: the state superintendent of public education says it'll take three to four years to fully implement the standards. california joins 33 other states and washington, d.c. in approving the public schools. critical repairs are needed tonight on the international space station. what's wrong and how nasa hopes to fix it.

astronauts will take the first of two emergency space walks thursday to repair the cooling system on the international space station. engineers teams have been working nonstop now since saturday night since one of two cooling loops shut down. a second space walk will be needed to finish the job likely on sunday. the six crew members are safe, but some of the equipment on board has been shut down to prevent overheating. mark is here now with sports, this is my favorite time of year. all about football. >> i thought it was hockey. >> well, hockey too, but football as well. >> you're right, cal, sanford and san jose state all the
