70s and then upper 80s to low 90s away from the coast. steve right now traffic on 80 westbound looks pretty good coming around the berkeley curve with no major problems. this morning's compute on 237 westbound looks pretty good. no major problems. hearing of an accident in sonoma county that sounds pretty serious. we'll tell you about that and the rest of the commute in just a few minutes. now back to the desk. this morning police have only a vague description of a man who sexually assaulted a young woman in the munson park. we are there live. good morning, craig. >> reporter: good morning. we came to police headquarters to see if they developed any leads overnight. i know yesterday they canvassed the neighborhood and combed over every inch of that park. as you said it happened in munson park. the park is so small we passed it up a couple of times this morning looking for it in the dark. it looks like the kind of space

people use as a shortcut as well as a park. police say the 24-year-old victim was walking through the park on her way home from work sunday night around 10:30. adjacent parkway is lit but the park is not and a large variety of trees block ambient light. the woman told police the man came up from behind her and threatened her with a knife before he pushed her down to the ground and sexually assaulted her. the suspect fled the scene. the victim continued home where she called police. the park is not at all lit and it's closed after sun down especially since the attack happened the neighbors are changing their approach. >> i would never come past 7:00 or 8:00 at night now by myself with them. because it's a quiet park too. and i have -- and i just want to have a quiet afternoon i come here because there's not many people around. it does make me feel a little more guarded. >> my wife and many of the other ladies we have talk today are just not going out after dark until the police do what they have to do. >> reporter: and that is find

the person. >> that is find the furlough fellow and chop him. investigators have salvation armied the park a number of times looking for clues. they have canvassed the neighborhood to see if they have developed anything overnight. any new developments will be reported in the next half hour. time now 6:02. oakland police investigating an overnight shooting that happened at a housing complex. shots were fired into a home about 11:00 last night. none of the three people inside were hurt. shortly after that police stopped a car that reportedly had fled the scene. two men and a woman were arrested for outstanding warrants and they're being questioned about that shooting. the investigation continues. also a major road is still closed this morning because of a water main break overnight. it happened about 8:30. the street was actually

buckling as water came up beneath the asphalt there. both lanes are closed between western avenue and east washington street until those repairs are finished. we'll watch it all and keep you posted with updates. the san francisco board of supervisors is expected to vote today on a new plan to fight crime on muni. ktvu has a look at a new find now being considered. good morning. >> reporter: good morning. here's what that plan would do. if someone is caught loitering or hanging on the other hand a platform or bus stop like this while carrying a concealed weapon, that person could face a $1,000 fine. that same fine applied to anyone caught aggressively pursuing or harassing a passenger. right now the fines for these violations are $500 each. but if the board of supervisors approves this new plan, the fines would double. now the supervisors who support the measure say it is needed in order to keep troublemakers off of muni. so far this year there have been several understand dents

where passengers faced violent and aggressive behavior. three attacks happened along the third street line earlier this year. and just last week a mawas stabbed near a muni train platform. some riders say they support the idea of higher fines for offenders. >> i feel fine as it is. i think it's a good thing to increase the fine. >> it's a start. could be more. i don't know. >> reporter: now san francisco police say despite the public perception about crime on mu initiation, according to their numbers reports of crime on their system have actually decreased 45% in the last six months. >> statistically the crimes are very low, but if the perception's there, it doesn't matter what the numbers say you are the now the board of supervisors is scheduled to vote on this proposal when they have their meeting at 2:00 this afternoon. if the proposal masses, the new fines would go into effect next month. reporting live in san francisco, ktvu channel 2 news. no new negotiations are

scheduled between ac transit and its drivers on this. ac transit's board of directors ended a closed door meeting last night with no indication of the appealing to the court ruling. disrupted service to thousands of passengers. transit officials say they impose the new work rules after negotiations broke down. >> obviously i'm disappointed. i'm awful very disappointed and sad that we've ended up in this situation where we're in court. >> this has been a dictatorship from day one. and as a union, we have a right to negotiate wages, working hours and benefits for our members. >> management says the union has been unwilling to make concessions and say without them the situation is only going to get worse. ac transit which is facing a $56 million deficit has already cut service by almost 8% and raised fares with more cuts

planned for later this month. the agency has until august 10th to carry out the judge's order. time now 6:06. new body scanners for tighter security are going into place today at oakland international airport. the first body scanners will be in terminal one. it will be paid for with federal stimulus money. passengers don't have to go through these but if you don't you'll have to go a standard metal detector and then submit to a pat down. tonight a number of bay area cities are taking part in the annual anti-crime event known as national night out. participating cities are going to host parades and block parties with music and food. and it's all meant to help bring residents together with local law enforcement to take a stand against violence and crime. last year 1500 communities nationwide took part in the event. >> we wish them well too. time now 6:07. let's go to sal. we have a big problem in sonoma county. what happened? >> that's right. it's a crash on a road that's pretty popular in sonoma county. it's west of highway 101 at

laguna road. it's a fatal accident there near the intersection of those two roads and also one person who was in the van that went down the embankment have took off. police are looking for that person. they're scouring the area. just west of highway 101 in the santa rosa area near the basically sonoma county watch for that. let's go to live pictures westbound bay bridge light delay. not a big problem so far getting up to the toll plaza. and this morning if you're driving in the east bay so far so good even on 580, 880, that traffic looks nice. 6:08. let's go to steve. thank you very much. going to be a little warmer today away from the coast. we have a lot of fog to start off with. fog, a little mist, little drizzle out there. other than that it will be fine. foggy conditions though. a lot more being reported today and a lot of lows in the low 50s again. santa rosa's in there. i'll show you something here in

just a second. we also have city struggling to get out of the 60s. should be around 68 this time of year. not again. 61 yesterday. we'll go 62. not much change there. but there will be some warmer temperatures inland. santa rosa downtown not at the airport 76 yesterday. we'll go 78. there's the 62 in the city. walnut creek 84. bump you up to 86. yesterday's cool 65 and san jose 77 from 79. the biggest jump away from the coast. here's a couple reasons why. two degrees warmer than yesterday. i know it's not a big deal but it is note worthy. but we also have half the sea breeze out at travis as we did yesterday. those two combine mean slightly warmer and more fog in the morning. sonoma 52 redwood city, a lot of 57s on the peninsula. 35 in tahoe. 85 las vegas. las vegas just had their warmest july ever.

average temperature high 96.2. 51 in eureka. system is developing in the pacific northwest will be here tomorrow for a significant cooling trend. a lot of tropical clouds or monsoon moisture erupting into southern nevada, arizona and southern california. fog, drizzle, sun, cool and a little warmer especially away from the coast today. upper 80s to near 90 degrees. by the coast and around the bay though may not even notice it. more fog and cooler weather really kicks in tomorrow. that will take us into the rest of the week. all right. time now is 6:10. having a glass of wine or beer may soon cost you more in one bay area city. coming up, why it's on the table and whose siding. that's when we come back.

good morning. time now 6:12. the engineers of bp will conduct one last test before they start sealing up the broken oil well. now the engineers will test the well with an oil-like liquid to make sure it can handle the sealing up process which is being called a static kill. now if it can hold up, they'll spend today through thursday pumping heavy mud down that well then sealing from the top end with concrete. the same thing will be done from beneath the well weeks later. right now the only thing keeping oil from spilling into the gulf all weekend is temporary cap that's been holding on for more than two

weeks now. today the full u.s. senate will start debating the nomination of elena kagan to the supreme court. her confirmation vote is expected by the end of the week. we're live now in the washington d.c. news room with the very latest. good morning, allison. >> reporter: good morning. that's right. as debate gets underway in the senate, both of california's senators have indicated that will support elena kagan. senator boxer says she is the proven ability to reach across party likes. senator fine stein calls her a breath of fresh air. president obama nominated her in may and since then adorned her criticism from republicans saying she's inexperienced and shows disregard for laws she didn't agree with. two dozen senators have said they'll vote against her but she is expected to be confirmed becoming the third woman and

youngest member on the court. reporting live from washington d.c., allison burns, ktvu, channel 2 news. president obama says he's sticking to his promise to end the u.s. combat mission in iraq at the end of this month. >> our commitment in iraq is changing from a military effort led by our troops to a civilian effort led by our diplomats. >> the president made the announcement to a group of disabled veterans in georgia yesterday. when president obama took office there were 144,000 american troops in iraq, but august 31st it will be down to 50,000. their jobs to train iraqis not to fight. we have developing news on the east coast this morning. an employee at a connecticut beer distribution warehouse has opened fire this morning at least three people were shot. an executive at the warehouse said the suspect had been called in to resign. it's not clear if anyone was killed. this happened in manchester

which is about ten miles east of hartford. timeday it could be decided whether to put a medical marijuana tax measure on the ballot. if approved by voters the measure would improve a 10% tax giving the city the highest cannabis tax in all of california. critics were saying this would be an unfair burden on patients. also today the san francisco board of supervisors will consider expanding the city's ban on plastic bags to all types of stores. three years ago san francisco became the first city in the nation to ban the use of plastic bags at large supermarkets and chain drugstores. now it may expand the ban to all stores. the proposed new law would take effect in march of next year. san francisco police are stepping up patrols trying to stop people from stealing from businesses and then reselling

the merchandise. retailers say they are targeted by shoplifters who grab items from cosmetics to alcohol, then take the stolen goods to an area around seventh and market street where they are sold on the black market. your time now 6:16. the result of a new long-term study shows a low carb diet may be better than one low fat. both diets worked about the same when it came to losing weight over two years. both also improved the amount of good cholesterol. those in the low carb diet category ended up with almost twice as much of that good cholesterol as those on the low fat diet. all right. time now is 6:17. let's go to sal taking a look at the east bay for us this morning. hi, sal. >> good morning. right now traffic is okay on 880 in the east bay here in oakland. northbound and southbound 880 traffic moving along well it is getting more crowded there

though. no major problems. also looking at the bay bridge toll plaza westbound coming in to san francisco, that traffic is moving along pretty well. and if you are driving in sonoma county near laguna which runs kind of like this in that area, there's an accident involving fatality, a van rolled down the cliff. one person is dead. the coroner's on the scene. they're looking for someone who fled the scene by the way. not only a fatal accident but also a police search in that area west of santa rosa. 6:18. back to steve. all right. thank you. a lot of fog this morning. some fog mist. the fog is getting squashed our smashed. high pressure's giving us a little bit of a slight warm up here today. not much but a little bit inland. slightly warmer air in higher elevations in the sea breeze is cut in half compared to yesterday. you can still see plenty of fog out there. fog, mist then sunny and just a little bit warmer. probably more inland than anywhere else.

the city's 52. santa rosa 51. mill valley 51. there are some cool readings. end up 62 which is only one degree warmer than yesterday. inland upper 80s to low 90s. shouldn't take long for that to burn off. 53 to 59. san francisco though 52. liver march concord 54. but there's san jose at 53 degrees. rain down into the four corners. system digging in from the pacific northwest will start a cooling trend tomorrow. today a little warmer. cool for some and slightly warmer for others. upper 80s to mid-80s to low 90s in lake county. 60s along the coast. 70s elsewhere. about two to three degrees warmer compared to yesterday. the cooling trend starts tomorrow and that takes us into thursday and friday. well, in the last half hour the commerce department reported personal income held steady in june. the first time it's failed to move up in nine months. and that may have prompted a

stall in consumer spending which was also unchanged. the lack of growth for spending incomes shows the economy ending thequarter on a weak note which could further shake consumer confidence. mexican in considering filing for bankruptcy and now suspended several flights from all three bay area airports at least for the rest of this month. flights from sacramento and los angeles have also been suspended although most flights to mexico city will continue to operate. they're already trying to rework its labor contracts. the move comes just days after the faa downgraded mexico's aviation safety rating. that also could effect the number of tickets they and its live aeromexico sell. time now 6:20. san francisco may soon charge a new fee on beer, wine and other alcoholic drinks. officials say that fee would help recoup the $17 million a year that's spent on picking up and caring for alcohol abusers. the city wants to impose a tax

that would increase as the percentage of alcohol increases. supporters say it would cost about a nickel per drink. critics say it will be more than that and warning it could be enough to send people elsewhere when they dine out. >> the customer is going to choose to drink in oakland or sonoma or napa or wherever. why here? how special is san francisco at the end of the day when we're all scrimping and saving? >> is it onerous for a consumer to pay 5, 10, 15 cents a more per drink? will that stop anyone from drinking at all? no. it will not. >> because they're talking about a fee and not a tax, voters don't have to approve this. but if it does become law the hospitality industry says it will immediately challenge the fees. all right. 6:21. coming up on the channel 2 morning news the father of former bart police officer mesherle breaks his silence. also ahead we'll find out why some bay area school districts could lose out on

but that is not effecting traffic. a big white thing at the bottom left there. golden gate and bay bridge looking good. 6:24 back to the desk. some east bay school districts could be in trouble when it comes to getting grants. the state board of education is postponing giving $311 million to 31 districts across the state. hoping they will reform consistently low achieving school. that means school districts in oakland, mt. diablo, west contra costa could lose out because there's not enough money to go around. they will give money to those applied to all schools in districts. they could lose out on its bid for more than $15 million to improve four of its six schools on the low achieving list. city officials redoubling efforts to prevent students from skipping school. of the city's 56,000 students, at least 9,000 are considered

chronicically truant. that costs the school district millions of dollars in federal funding. school officials say they are going to continue efforts to contact parents of students who miss school and if necessary they say they are prepared to take legal action against parents and students. more than $10,000 in damage to john mere elementary school happened when copper pipes were stolen and wires were stolen from a cooling system. investigators say they found stolen copper at the home of a 36-year-old. when they went to his home to check on him that's where they found it. they were there for a probation check. time now 6:26. we're hearing for the first time from a father of former bart police officer. todd mesherle. he's about one of a dozen people in san jose yesterday attending a rally in support of his son. last month his son was convicted of involuntary manslaughter for the shooting

for you this morning. >> yeah. we'll go ahead and wave to them and say good morning to you. thank you for joining us here on the ktvu morning news tuesday august 3rd. i'm dave clark. >> and i'm claw dean wong. police in san raphael want your help this morning following a sexual assault in the normally quiet neighborhood. this happened in munson park. we're at the police station. craig, you have new information. >> reporter: good morning, dave, you're right. police want the public's help in this case. there's no word yet on developments overnight from police but i spoke a dispatcher. she tells me a spokesperson will be in in about 20 minutes now. there are homes on either side of this park. because of what happened the people who live in those homes are going to think twice about walking there after dark. this all happened on sunday night.

a horrible sexual assault. this is munson park you're looking at now. sunday night about 10:30 a 24- year-old woman reported being assaulted here. the park closes at sunset and has no lighting. the variety of trees block street lights on either side of the park. the victim told police she was walking home from work at the time. >> the suspect came up behind her and had a knife and forced her to the ground and assaulted her there in the park. and then he fled. and she went to her home and then called us from her home. >> startling thing is we didn't hear anything. there's no noise whatsoever. we would have heard them if there had been. [ indiscernible ] but nothing. >> reporter: yeah, that gentleman and his wife said they were watching tv in a room which sits right next to a fence and on the other side of the fence is the park. they're very surprised they didn't hear anything sunday night. police say the assailant described by the victim is either being white or hispanic, stands about 6 feet tall and

weighs about 250 pounds. update for you on mornings on 2 and overnight developments on this case. reporting live, ktvu channel 2 news. time now 6:32. we're finding more this morning about a deadly shooting that happened sunday in pittsburgh. police are looking for this man you see in the photo. he's described as 29-year-old isaac who police say is a transient with a long criminal history. police suspect him of shooting and killing a 25-year-old victim at his home. investigators say the victim was a possible gang member who wouldn't assault someone else on orders from other gang members. now his name hasn't been released yet. it's pending notification of the victim's family. bay area music fans are mourning the death of a local musician who was killed after his tour van crashed in oregon. this accident happened happened yesterday morning. police say the driver of the

van fell asleep behind the wheel and then the van went off the road. 28-year-old was ejected and died. he was the lead singer of the bay area band early grave seen performing here. the driver and another passenger suffered nonlife threatening injuries. alameda county sheriff deputies arrested a 12-year-old boy suspected of driving a stolen car. police responded to reports of a suspicious vehicle blocking a driveway and spotted the car leaving the area. a vehicle check showed the car had been stolen. deputies attempted to stop the young driver and finally did at 166th avenue and l street. the boy was arrested on suspicion of stealing the car, evading police and possession of stolen property. time now 6:34. we're keeping a close eye on ac transit service this morning. this after that big court ruling about ac transit's labor dispute. ktvu's jade hernandez is in oakland with a look at how the buses are running this morning. i know you're getting reaction from commuters as well.

good morning, jade. >> reporter: good morning, dave. that's right. riders can expect their bus schedules to return to normal today. that's a largely in part due to a judge's decision yesterday. but ac transit warns those very same riders they may see some cuts at the end of the month. riders have already dealt with an 8% cut in service and have had to pay higher fares. but ac transit claims employees working without a contract the agency deficit will grow at a rate of $300,000 a month. the reason the alameda county superior court judge ruled yesterday in favor of the union's request to lift the contract imposed by ac transit on its union members. ac transit has until august 10th to carry out the judge's order. the agency imposed a contract on its employees when talks broke down between the two sides and a judge ruled the meater wife to go into arbitration to force both sides to come to an agreement. they would have to adhere to a

new work schedule including working on unfamiliar routes. caught in the middle passengers especially those with special needs. >> i think it's difficult for anyone, but definitely being blind and having to navigate area that is you're not familiar with to get somewhere is definitely harder. >> my whole overall time traveling took like three hours and 20 minutes by the time i made all my connections. >> reporter: what would it normally take? >> less than an hour. >> reporter: ac transit's board of directors met last night for an hour and a half but did not make a decision whether or not to appeal the superior court judge's decision yesterday. despite a judge's decision back in early july for arbitration, neither side has agreed to sit down to negotiate. coming up we'll hear from ac transit and the union and hear what's next for both sides. reporting live in oakland this morning, jade hernandez, ktvu channel 2 news. time now 6:36.

shareholder lawsuits. that's after stockholders claimed countrywide concealed mounting risk as it loosens requirement for buyers during the housing boom. it's the largest pay out by any company involved in the mortgage meltdown and would end several class action lawsuits. the s.e.c. continues to investigate countrywide for misleading investors. let's take a look at numbers this morning. the dow is down by about 32 points right now. certainly we have been watching these markets because we had a few things come in this morning that the traders are not liking. among them personal income and spending numbers which both are flat unchanged in june. we'll continue to follow these numbers for you all morning long. now one of the biggest reasons people come to the bay area apparently is going it get a facelift this morning. renovations are already underway at the convention center. the entire project is expected to cost $55 million and it's going to include updating to the bathrooms, escalators and signs as well as upgrading the
