the constitutionality of prop 8, we have live team coverage, we begin with details on today's much anticipated ruling. >> reporter: cheers erupted from the crowd on it sued the courthouse in san francisco as same-sex marriage supporters learned judge vaughn walker had learned proposition 8 is unconstitutional. >> this is fabulous. it's so clear that we have the same constitutional rights to live as a family and to live together in love and harmony. >> reporter: the judge ruled the u.s. constitution "protects the choice of marital partner regardless of gender" and invoked all bans on mixed race marriages on how things can change. the main backers of proposition 8 had harsh words for the judge this deals really is an assault on the people of california and their fund. >> amanda: right to define marriage and protect marriage through the democratic process.

long as two years before it comes before the u.s. supreme court. in san francisco, david stevenson, ktvu channel 2 news. >> same-sex couples and their friends and family showed up at tv city hall to try to get married today. >> promise to will have and to cherish you. >> but the exchange of vows were not legal. judge walker issued a stay keeping same-sex marriages from resuming at least from now. he asked both sides to return to court on friday to determine whether the stay should remain in place during an appeal. we'll have more on today's sudden rush to get married coming up at 10:30. the celebration over the decision is still under way right now in san francisco's castro district. that's where hundreds of people gathered after judge walker handed down his land america decision. ken wayne is there with a live report. ken? >> reporter: the castro knows how to throw a party and there was no bigger reason to celebrate than with today's

sex marriage. tonight they are expressing strong opinions about the judge's ruling on prop 8. this beautiful august night brought out many people to dine outside or simply take a stroll. many told us they were disappointed by today's court ruling. >> you know, i was raised a staunch catholic all my life, and i have certain old- fashioned beliefs and i was raised to be a man marries a woman and vice versa. i was not raised to be in same- sex marriages. >> i think it opens the door for a lot of fraud maybe. i don't know. you know. two people living together, they are same-sex, saying they are married so they can get benefits? i believe they should have a union but i don't believe it should be called a marriage. >> why not? >> because i just have a lot of christian belief and you know from the bible, the bible says that a marriage is between a husband and a wife. >> reporter: the church of

jesus christ of latter day saints and the catholic church supported proposition 8. today officials from both declined to speak with us on camera. but the mormon church issued a written statement saying in part "california voters have twice been given the opportunity to vote on the definition of marriage in their state and both times have determined that marriage should be recognized as only between a man and a woman. we agree." in oakland outside the mormon temple we caught up with members of the church as they left a wedding rehearsal. >> i have no problem with civil unions, just don't call it marriage. >> i don't think they should be legal. >> reporter: why? >> that's something that, you know, that it's between those people. >> reporter: a spokesman for catholics for the common good which helped to lead the campaign for prop 8 said the judge disregarded the will of the people. >> marriage between a man and a woman is a reality and when recognized by the state becomes

. even though they have seen a drop the overall crime, gilroy police say gang violence has exploded in their city and in an effort to combat the crisis police met with concerned residents tonight to talk about what can be done to curb gang activity. ktvu's maureen is in gilroy with details. >> reporter: gilroy police say as the temperature has gone up so has the gang violence. in the city of 50,000 people the overall crime rate is down but in recent years the violence with gangs has almost doubled. tonight police are asking neighbors to be on the lookout. neighbors can still recall the

sound of gunshots ringing out in this gilroy neighborhood. >> i heard something like fireworks go off. later on i found out someone has been shot and killed. >> reporter: at the busy 2010 of 6th and church street a gang member was shot and killed in broad daylight about a year and a half ago. >> it was a hard experience for all the kids, there are a lot of kids in this area, and it was kind of scary for them. >> reporter: police say since 2007 gang violence has nearly doubled from 44 incidents then to 85 incidents last year. there have been 32 incidents in the first half of this year making it on track to be the first time in four years that gang violence could drop. >> we're continuing to see gang on gang crime so red against blue, a lot of stabbings, a lot of assaults. >> joaquin county at a town hall meeting tonight police and community leaders addressed a few dozen community members in an effort to curb gang violence. neighbors expressed concern about gangs coming in from east san jose and salinas, a town

. san francisco supervisors discussed a first in the nation measure today that would levy a city-wide fee on alcohol sales. [ chanting ] >> supporters say the fee would jen 6 again rate $17 million a year to treat those with alcohol abuse problems but opponents say it would hurt bars and restaurants. the budget and finance committee held public hearings on the idea today. the plan would add about 4% to the cost of alcoholic beverages purchased in the city. the full board of supervisors is expected to consider the measure in september. san francisco is also considering expanding its ban on the sale of tobacco products. currently drug stores are prohibited from selling tobacco. now, supervisors are debating extending that want to grocery stores with on site pharmacies. opponents say the expansion would not have a big impact because there often are liquor

. we want the take you back now to san francisco's castro district where crowds have gathered at times tonight to celebrate tonight's ruling striking down california's ban on same-sex marriage. ktvu's ken wayne is there with a live update. ken? >> reporter: the street party has largely died down as you look behind me, you can see a man with a sign and the police barricades that were here about an hour ago have been removed so the street is open again. earlier there were a couple hundred people or more gathered in the street in front of the castro theater. many of them were waving rainbow flags, some were waving american flags to celebrate the overturning of proposition 8. some people here are comparing this to the civil rights struggle of the 1960s. people here are following this issue very closely and

be licensed to approve property lines, surveys, permits and inspectionings and they were not license todd do that. >> reporter: they falsified the signatures and stamps of two licensed engineers who were unaware it was happening. the most serious charges, conspiracy, filing false documents to a government agency, forgery, false impersonation and aggravated identity theft. it appears the people who paid for the work were victims too. >> as far as the evidence shows us at this point that the homeowners involved in these cases were in a sense participants in these acts of fraud. >> reporter: making matters worse, city building inspectors apparently approved without question 500 documents the men submitted, many with obvious mistakes. >> but we don't, at this point, have any patterns as it relates to the conduct of dbi but the investigation is ongoing. >> reporter: so many property owners now wonder was the work done right and are their
