san francisco police say two people attempted to rob a law enforcement officer and that officer fought back. we'll have an update. a new crash in san francisco westbound on the sky way has the bridge backing up already. we'll tell you more coming up. much stronger fog bank this morning already moved locally inland. it's cold for some and that means forecasted highs inland are coming down. also now that a judge has struck down proposition 8, what is preventing gay marriages from resuming? we'll break it down and tell you what's next. the morning news continues. good morning to you. welcome to thursday august 5th. i'm dave clark. >> and pam cook has the day off. let's get a quick look at

weather and traffic. hi, steve. >> thank you very much. good morning everyone. we have a big fog bank out there again and it's lifted a little bit. it has no problem clearing the coastal hills. the overnight lows are cold for early august. no doubt about it. 50s, 60s coast and bay side. mountain view only 68. upper 70s in areas that should be in the upper 80s or low 90s. not today. low to mid-80s inland. cooler day. here's sal. good morning in san francisco westbound skyway traffic is effected by a motorcycle crash just after 4th. it looks like at this point the injuries are minor however the vehicles are blocking lanes and traffic in san francisco is being effected by this if you are coming into the city you can expect delays for the time being. the fire department is there along with police. also this morning if you are driving the east bay highway 4 traffic is getting busier on the way to concord. and this is a look at 880, so far so good. it's 6:02. back to the desk nch one person

in the hospital following an overnight shooting involving an offduty federal investigator. we've within talking with police this morning and have an update. >> reporter: good morning. this incident happened in san francisco. however the officer involved in this shooting was not with san francisco police. we've learned that the officer involved is a special agent with the irs's criminal investigation unit. a short timing a we spoke with a spokesperson from the irs who explained there are about basically 100 of these special agent investigators here in northern california and they typically investigate financial crimes. things like schemes and fraud. however san francisco police say the agent involved in last night's shooting was offduty. the agent. we don't know at this point if the agent was a male or female but they were walking through the city's bay view district near kirkwood shortly after midnight. according to police that's when two people attempt today rob

the agent. the agent fought back and shot at the suspects as they try today flee. >> the officer fired their weapon and one of the suspects shot and the other one fled. >> reporter: now the injured suspect was transported to san francisco general hospital. police say he's recovering from a gunshot wound to the torso. the other suspect capture and had arrested after the shooting. police tell us there could be as many as three separate investigations into this officer-involved shooting. it's customary for the department to conduct an investigation as well as criminal investigation even if the officer is not their own. this all happened in san francisco which is why that police department will be conducting the investigation. also again since the agent involved is a federal agent with the irs, it is likely the irs will also conduct an investigation into what happened. live in san francisco, ktvu, channel 2 news.

>> all right. well, on both sides of the same sex marriage issue, supporters vow to keep fighting following yesterday's federal court ruling that overturned proposition 8. hundreds of same sex marriage supporters marched to san francisco city hall celebrating the court ruling. meantime critics were disappointed with the ruling. >> it's great that this happens in san francisco that proposition is overturned by a federal judge in san francisco. it really means a lot because san francisco has always been there fighting for gay and lesbian individuals. >> this case really is an assault on the people of california and their fundamental right to define marriage and protect marriage through the democratic process. >> now the same sex marriage victory celebration continued last night at this street party in san francisco's castro district. >> the judge's ruling doesn't mean that same sex couples can start getting married in california. at least not right now. some couples showed up at san

francisco city hall immediately after the ruling to try to get a marriage license but judge vaughan walker issued a temporary stay on resuming same sex marriage ceremonies. >> not a total disappointment that we can't get a license right now but the fact that the judge recognized as equal rights that's more than enough for us. >> the judge did order both sides in the case to submit written arguments by tomorrow to determine whether the stay should remain in place during the appeals process. your time 6:06. all along both sides of the same sex marriage case have said judge walker's decision will only be the first round in a very long legal process. the next step for the case will be the ninth circuit court of appeals in san francisco. that court has jurisdiction over nine western states. the outcome there could take the case all the way to the u.s. supreme court. now as always our complete coverage continues at our channel 2 website at ktvu.com.

we've posted judge walker's entire ruling for you as well as a link to all of the video evidence that was presented at the trial. authorities in pleasant hill right now are searching for three men this morning who robbed a house while impersonating police officers. police say two of the men got in through a sliding door of a living room of a home about 11:30:30 last night. they identified themselves as police. they were wearing jackets and vest with the word police on them. investigators say these men were armed and told the victims to get down on the floor while they ransacked the house. they have reportedly escaped with some electronics. they were last seen getting into a champagne or brown colored suv possibly a chevy outside of that complex. more than two dozen alameda county residents are without water this morning because of a water main break. right now bachman road is also closed down because of damages

to that road. you're taking a look now at live pictures. you can see the crews trying to fix the problem. this was reported just before midnight. east bay mud tells us they are as you can see working to fix that problem but as of now there is no estimate on when those repairs are actually going to be done. all right. time now 6:07. we've got some problems. a big crash in san francisco. sal, i know you're checking on it now. >> that's right. a motorcycle crash on the sky way which is the section just off the bay bridge westbound. couple motorcycles got into an accident westbound at fourth street. it looks like they may be moving the accident disoon. however the traffic damage is already done. they are moving the vehicles now down to city streets below. but if you're coming in on the bay bridge there will be more slow traffic because of this crash. let's move along and take a look at westbound bay bridge toll plaza. still not a big delay. and hopefully now that the accident is being moved off the freeway there won't be one at

least related to this crash i just told you about. let's move along and take a look at northbound 280. that traffic looks very nice coming up through highway 17 and into the valley. at 6:08 let's go to steve. >> sal, california academy of sciences. >> really? >> 48 degrees. >> that's pretty cold. >> that is cold. low clouds, fog. concord says low clouds. liver more says san jose, everybody low clouds. they've lifted a little bit. foggy, little overcast, little mist, drizzle. sunny once it burns off may be a very, very slow process. very obstinate fog bank by the coast. cooler breezy to windy gusts to 30 at travis. cooler pattern setting up and will continue well into tomorrow and maybe the next seven to ten days. next week looks cool too. maybe even a little cooler. i know. what the heck's going on? just the pattern we're in, folks as another low pressure system will drop down from the pacific northwest.

the fog has no problem forming in this pattern. any heat in the valley enhances it. low 50s for many water temperatures. san francisco officially at 51. a high of 58. a good ten degrees below average for this time of year. 64 oakland, that's way below. santa rosa 70. mountain view it's ten below. a friend of mine up there says it's cold here. yeah, it is. 73 san jose, should be 84. most of the records were 1998 or 1997, 1983 for oakland. 85 on this date. cooler ten degrees this morning than they were yesterday. the fog made it up around 2500 feet. mill valley sitting at 51 degrees. not much warmer. crockett overcast, 53. stanford park 54. 79 palm springs and 50s and 60s up and down the coast.

52 sacramento. that's cool. that's a cool low for this time of year. that all spells cooler weather with a sea breeze through the delta. system dropping down from the pacific northwest right underneath foggy and sunny. that's going to settle in over us. cold and foggy. then after the fog finally starts to burn off sunny but cooler inland and a little windy at times. fairfield only 80. morgan hill 80. napa 71. santa cruz 67. a chilly pattern. will continue this way into saturday. slightly warmer from the coast as we head into the weekend early this week. your time is now 6:11. ac transit riders may have an easier time getting around starting sunday when ac transit switches back to old work rules and schedules. ever since a new contract and new work schedules were imposed on drivers, many drivers have called in sick and commuters have suffered through

frustrating delays on several of the bus routes. on monday a judge ordered ac transit to restore the old contract as arbitration begins on this continuing labor dispute. all rightment coming up next on the ktvu morning news, one bay area town is pulling the plug on a pg&e plan. we'll explain. the senate takes a big vote today to save teaching jobs. i'll show you how many local jobs are on the line coming up as the morning news continues.

such a problem in san francisco westbound 80 between fifth street and ninth street. an accident blocking the left lane involving a pair of motorcycles. chp and fire department are there. traffic is backing up onto the bridge. we'll keep an update on that for you, keep an eye on it for you and let you know how this develops. at 6:14 let's go back to the desk. thank you. bp may be getting closer to permanently plugging up that broken oil well in the gulf of mexico. they were able to force enough mud down the well to push the oil back to its source. today they plan to start pumping cement in there to try to seal it up for good. the crews are still working on a relief well that will cut off the leak well below the sea level if everything goes according to plan that work should be finished by the middle of august. a bill to provide billions of dollars to save the jobs of thousands of teachers and other public employees is making its

way through congress. it's a big win for california. we're live now in the washington d.c. newsroom with details on all this. good morning, allison. >> reporter: good morning. california senator barbara boxer says 13, 500 california teaching jobs are on the line with today's senate vote. she is leading the push to get a $26 billion state budget bailout through congress. she says it will save teaching jobs and other public service jobs across the country. >> the police, the firefighters, those jobs will be saved nationwide today with this passage of this bill we save 250,000 jobs. think about what that means. >> reporter: republicans are calling it another budget buster and a payoff to teacher's unions. the house is on its summer break but being called back next week to okay it. house speaker sent out this tweet for house members to

return. now there is one big tough pill to swallow here for democrats, in order to pay for this state budget bailout, they are cutting a recent increase in food stamps. reporting live from washington d.c., ktvu channel 2 news. time now 6:16. supreme court justice nominee elena kagan will likely be confirmed by the senate later today. a report shows more than 51 senators say they will back her. that includes nearly all democrats and a handful of republicans. the confirmation would make her the fourth woman ever to become the supreme court justice and it would mark the first time three women serve at the same time. she will succeed if confirmed retired justice john paul stephens. governor schwarzenegger is ordering officials to warn the public whenever a sex offender out on parole slips away from supervision. that follows incidents in bakersfield and san diego where

parolees actually took off their gps ankle bracelets and allegedly attacked teenage girls. a correction official says the department plans to post information about the missing parolees on a public website. the department also says up to 60 parolees flee in a typical month. it doesn't say how many of those are convicted sex offenders. well, it's now official. oakland mayor will not seek a second term in office. he reportedly told city officials his reasons are personal. since taking office back in january 2007, the mayor has been credited with obtaining at least $80 million in federal stimulus money for the city of oakland. but lately his critics say he's been missing in action. right now there are eight candidates in the race to replace the mayor including city councilwoman . the firefighters union deciding whether or not to have its members vote on a proposed

9% pay cut in order to rehire 49 firefighters who were laid off last weekend. that's after city officials rejected the latest union proposal. the union had proposed cuts to overtime and pension reform as a cost savings measure. but the city says those measures do not go far enough and what's needed is an agreement by firefighters to get a 9% pay cut. the town of fair fax is banning those controversial pg&e smart meters. in a unanimous decision yesterday, the town council proved banning the installation of remote controlled utility meters within the town's borders. this comes despite the last minute promise to stop installing the meters in fair fafntle concerns about safety, accuracy and data collectibility of the meters. let's go right to sal. we have problems at the bay bridge right? >> that's right. the bay bridge coming into san francisco westbound two motorcycles got into an accident about half an hour

ago. right near the ninth street exit. the traffic is slow coming in via the bay bridge. there's still not a big back up at the toll plaza but if they switch those lights on and the accident stayed out there for a while it will be delaying traffic at the toll plaza. so far it's okay. this morning's commute has been all right on 80 westbound coming in from richmond driving in to berkeley same old slow downs here and there but no may score problems. and on lafayette drive westbound 24 looks okay getting up to the tunnel. 6:20. here's steve. all right. thank you. lots of low clouds and fog in the traffic shots. we have a bigger fog bank this morning and that spells cooler conditions for inland areas. downtown oakland 54, foggy and cold. the fog burn off two days ago, it was a nice day, warmed up to 70. yesterday back into the 60s and today will be the mid-60s. it's going to be a cool day and colder for many along the coast. just too much fog.

another system enhancing that is dropping down from the pacific northwest. 51 in san francisco. california academy of science asks 48. if you're in the city saying it's cold, yeah, it is. the high today will be 58 degrees which is ten degrees below average. 50s coast, fog, mist and drizzle. 60s and 70s around the bay. upper 70s low to mid-80s inland. oakland, berkeley, concord 54. san jose 57. everybody says cloudy. low clouds, fog. here's the system starting to come downright underneath where it says foggy and sunny. little low coming in and looks like a stronger one might move in next week to keep the pattern coming. cold and foggy, cooler, breezy to windy at times. fairfield west-southwest already gusting to 30. there is your sea breeze. there's your sea breeze. fairfield at 80. oakly 84. not much warmer for anybody else even up it's not that warm. santa rosa 70. redwood city 71.

50s and 60s on the coast. even santa cruz has been cool 67. cooler for inland areas friday and saturday and then keep it right there as we go into the weekend early next week. well, there's bad news from the labor department this morning. first time applications fits hi highest level since april. that is a sign the job market remains weak. some companies are still cutting workers. initial claims went up 19,000. analysts have actually expected a small drop and this is the second increase in three weeks. as you might imagine the markets are responding. harley davidson considering moving its manufacturing plant out of milwaukee. it's built them there for 107 years. they will move operations if they can't cut millions of dollars in production costs. they say they're going to make a decision in the next two months. no matter what they decide harley's corporate headquarters are going to remain in milwaukee.

good morning. suddenly i'm in a great mood. westbound bay bridge traffic looks good. no problems san mateo, golden gate bridge all looking great. 6:25. let's go back to the desk. sentencing is scheduled today for a man convicted of stabbing a 15-year-old girl and a 60-year-old man at a san francisco bakery. last month 29-year-old scott thomas withdrew hisin sanity plea in the case which cleared the way for him to receive a life sentence for the 2007 stabbing. thomas was convicted of attempted murder for the attacks at the twin peaks bakery. he'd been released from san consistenten just a day before. a nonprofit says teenagers are

seeking more counseling in the wake of five suicides connected to gunn high school. between may of 2005 and january of this year five teens lost their lives. they counsel students at four area high schools and four middle schools says about 500 more students have sought on campus counseling than is usual this time of year saying it appears their campaign to reach out to teens who may need help does appear to be paying off. san francisco supervisors have taken the first step towards enacting what will be the first for the country. a city wide fee on alcoholic drinks to help pay for the cost of alcohol-related services. supporters say the fee would generate $17 million a year to treat those with alcohol abuse problems. but critics say it would hurt bars and restaurants. >> the greatest city in the world but so unfriendly to small businesses with its tax structure and various onerous things.

live look at new york city. you know the stock futures were actually edging higher this morning. we were feeling good about things that's because analysts expected the claims for unemployment benefits to drop and then the report came in about an hour ago and it actually went the other direction and they rose unexpectedly which of course raised more worries about the economic recovery. and that had futures falling. so looking at the numbers right now looks like the dow is already down 30 points. it may be a tough morning for us on wall street. we'll keep an eye on wall street. we'll go ahead and say good morning to you. thank you for joining us thursday august 5th. i'm dave clark. >> and pam cook has the day off. time now 6:31. in the news for you right now one man shot overnight. another one is in custody following a shooting that involved an offduty federal agent. it happened just after midnight on marlin court in the city's bay view district. we're in san francisco now with

more from the police. good morning, alli. >> reporter: good morning dave. the person involved in this shooting is a special agent with the irs's criminal investigations unit. because of perp fell and security reasons an irs spokeswoman told us they could not identify whether the agent involved was a man or a woman. however we know that san francisco police say this particular agent was offduty last night. he or she was walking through the city's bayview district near kirkwood shortly after midnight. according to police that's when two people attempt today rob the agent and the agent fought back shooting the suspects and one fled. one shot in the torso and sent to the hospital. the other captured and arrested a few hours after the shooting. san francisco police tell us because this incident happened in their city they will be doing two separate investigations of this. an administrative investigation and a criminal investigation. they say that is common procedure any time there is an officer-involved shooting in the city even if the officer isn't one of their own.

an irs spokeswoman said that agency will also conduct an investigation. >> we have internal affairs would handle something like this. par for the course. this is normal practice for our internal side of the house to come in and just take a look at what happened and review the situation. >> reporter: now that was special agent lee with an irs public information officer. the irs told us also that they told us a little more about these agents that are based here in northern california. there's about 100 of them here. the agent involved in the shooting was one of them and she says they typically investigate financial crimes, things like ponzi schemes and mortgage fraud. we'll have more on this case coming up later on this morning. live in san francisco channel 2 news. 6:33. opponents of gay marriage vow to keep fighting despite a

court ruling that overturned prop 8. hundreds of people marched to city hall yesterday to celebrate the decision. but the judge in the case is still considering a motion to suspend that order while the appeals process is going on. this case could eventually wind up in the supreme court. jade hernandez joins us live from san francisco with that part of our coverage. guilty or not guilty, jade. >> reporter: good morning. we watch within minutes of the release of that decision a push before the ruling was announced. >> they stayed it? i'm sorry to hear that. did you get any in? >> we tried. >> reporter: how are you feeling about the decision? >> elated. but recognizing it's a step in the road but nothing would make us happier that the quality we have achieved through the course to continue. >> reporter: you just heard from san francisco board supervisor. the same sex marriages could take place as soon as tomorrow

depending soon after chief u.s. direct judge vaughan walker overturned the ban on same sex marriage or prop 8 he granted supporters of proposition 8 a temporary stay against any same sex marriages from being performed. he gave both sides in the case until tomorrow to submit written responses as to why the temporary stay should remain or be lifted. supporters of the voter approved prop 8 argued any same sex marriages which would be performed after the ban was lifted could be complicated by rulings and appeals farther down the legal road. the 136 page opinion issued is headed to the ninth circuit court of appeals. proposition 8 supporters could still ask the court of appeals for suspension during their appeal. that appeal vote could take months. then it may be on to the u.s. supreme court where one justice in particular may hold the swing vote. >> erg everything is going to come down to justice anthony kennedy. if you look at the history of justice kennedy there's a good

appearing in contra costa county superior court this morning for arraignment, 23- year-old younger brother of giants outfielder is facing several charges in connection with a dangerous hit-and-run spree last sunday in danville. he faces four felony charges and one misdemeanor in connection with a series of drunk driving crashes. the younger brother was convicted of drunk driving when he was 17. now in last sunday's crashes he allegedly hit a bicyclist, a pedestrian, two vehicles and a light pole. even though they have seen a drop in overall crime, gill roy police are saying gang violence has exploded in their city. at a town hall meeting last night, police encouraged neighbors be on the look out for suspicious activity. gill roy police say since 2007 gang violence has nearly doubled from 44 incidents then to 85 incidentst last year. those numbers could drop this year, police say there's still

a lot of work to do in this time of shrinking police forces, gill roy has actually been able to add three police officers this year because of federal grants and from economic stimulus funding. that's something the police chief is hoping will help fight gang violence there in the future. plans for a new ferry terminal in antioch are going ahead again following an 18 month freeze on funding because of the state's financial problems. the san francisco bay water transportation authority is looking at three sites. the marina at the end of l street, downtown at the end of i street and the fullton shipyard. it would run between antioch and san francisco with a stop in martinez. more than two dozen alameda county residents have no water this morning because of a water main break. it's closed down because of damage to the road. we're talking this is a live picture of the area right now. you can see some of the east

bay money repairmen out there on the scene right now trying to fix this water main problem. hopefully they will soon. but there's no estimate at this point as to when those water main repairs will be completed. time now is 6:38. let's head back out to sal. how are things looking on the shore? >> they are looking pretty good. and yesterday i got a tweet from someone who is an east shore commuter wanted a little more coverage. our aim is to please because this freeway sometimes we take it for granted it's always slow coming in from richmond getting into berkeley although the good thing is there aren't any major problems. sometimes we have to focus on those. but today not that bad. i'm happy to say there's not a lot going on when it comes to major accidents on the roads. moving along to the toll plaza. it's still light and they cleared the accident? san francisco which is good because it was beginning to back traffic up on to the upper deck of the bay bridge. they got it out of the way. they're talking about it now on

city streets. this morning's commute on 280 northbound in san jose right out of downtown looks good into the valley. 6:39. hello, steve. hello, sal. i have yet to receive any weather tweets today. usually i get something. but so far nothing. maybe it's too cold. upper 40s for a few and low 50s. big fog bank out there. sp weather if you want to send me weather information. for most a cloudy morning, cold, foggy, misty. cooler and breezy today and cooler all the way into the inland areas. a cooler pattern is developing and it's going to continue not only tomorrow but well into probably the weekend and maybe even early next week. i have to -- hold on a second, nelson, i need you to set that computer please. any way, the seven to ten day outlook continues cool and in fact a stronger low looks like it will drop in next week. well, if it comes in as advertised, maybe up ne the oregon border we could see our first rain of the season up to

workplace shooting rampage out a connecticut beer distributor. 8 people killed, the 34-year- old was a former driver for the company. police say he was called into the office for a disciplinary hearing with management on tuesday. but he brought with him two pistols and a shotgun and started shooting at his unsuspecting co-workers. >> breathing a lot? >> yeah. people running all over the place. i see him running out. he's shooting at somebody else. he's still shooting. he's shooting at a girl. >> frantic employees you can imagine ran for shelter and offices, they hid in closets during the rampage. police say thornton ended up killing eight people and wounding two others before killing himself. authorities are still investigating what led up to that attack. state lawmakers working on

in the fog just heard from lisa tweet cold and foggy in mount claire village. everybody reporting cloudy conditions. big fog bank. pattern looks like it's going to go into a pretty cool one for inland areas. it's in the 50s and santa cruz can't reach 70 degrees which is a little unusual. usually they get sun about noon or gets in around 70 or so that has not been the case this week. rather strong low dropping right out of the gulf of alaska and into the pacific northwest and set up shop and not move for about five to seven days. if anything might get stronger next week. for those who work outside man, it's been a nice summer. it's been cool even in inland areas. for many in the bay it's been cool. 58 will be the high in san francisco today. cold and foggy. they were 59 yesterday. it's even colder today. and 51 the current temp. 50s on the coast, 60s, 7 0z around the bay. upper 70s low to mid-80s

possible get away vehicle. also the new problems facing the city of alameda as it tries to decide what to do with that former navy base. and controversy's growing this morning over body scanners and what's done with some of the images after they're taken. the san francisco board of supervisors just gave the city's entertainment commission the power to close down nightclubs that pose a public safety threat. a string of recent violence including several shootings outside the clubs in different parts of the city. in the past the entertainment commission could only temporarily suspend the permits of problematic clubs. but now the commission has the power to revoke the operating permits of those troubles clubs. time now 6:55. there is a surging demand for food stamps in sonoma county. more than 25,000 residents receive food stamps in the month of june. that's a 77% increase from two years ago. still officials say there are many families that could use the help. they're conducting an outreach

program to let them know about what's available. they're also setting up a network of locations to apply for food stamps to help those who live in the outlying areas. the daughter of former new york city mayor rudy giuliani is under arrest for shoplifting. she's the youngest child of the former mayor. she was caught on camera taking cosmetics from a store. she was confronted by a salesclerk and a security guard who then called police. officers took her out of the store in handcuffs. the district attorney is going to decide whether or not to file charges. the los angeles county coroner says the husband of actress britney murphy died of the same illness that took her life a few months earlier. the 40-year-old died of pneumonia on the 23rd. and the report says that prescription medication in his body did not contribute to his death. his wife, britney murphy, starred in the movie clueless
