good afternoon. it's the day after the battle over same-sex marriage and both sides say the fight is far from over. proponents of proposition 8, california's ban on gay marriage, have formally appealed the federal judge's ruling today, striking down the voter approved law. this morning's appeal to the ninth circuit court of appeals is only the next step this a case that's expected to go all the way to the united states supreme court. ktvu's jade hernandez has details. jade. >> reporter: good afternoon. we don't know how long it's going to take for a federal judge to make a decision on whether or not same-sex couples can come down to city hall and pick up a marriage license. but ktvu did watch supporters cheer and celebrate at the federal building after yesterday's decision. this is what we know has already taken place -- both sides have been asked to submit in writing why a temporary stay

on same-sex marriages should remain or be lifted during the appeal process which could take months. yelled the chief district court judge vaughn walker overturned the marriage been on same-sex marriages and with that stay pending, the alliance defense fund, the attorneys representing the sponsors of prop, told us they have filed their appeal and submitted their paperwork to the judge before tomorrow's deadline. and they will remain the judge the attorney general and the governor arnold schwarzenegger stand by the will of the people. >> that radical more than 7 million californians to protect marriage as they've always known it. what is radical for a judge to force the rest of the people of california to accept an idea of marriage that is being put forth by a handful of activists. >> they stated -- i'm sorry to hear that. did you get any? >> we're trying. >> they arrived to get couples

married here yesterday at city hall before a stay against the ruling was announced. but san francisco's city attorney told us no one knows at this point when a decision could come down on whether same- sex marriages will resume. >> so we'll be prepared to argue in our breaux life why a stay is not required pending appeal and we feel confident on that and we think it's important that we expedite this as quickly as possible, make sure everybody's constitution at rights are protected. >> some legal experts say judge walker would not lift the temporary stay on his decision because any same-sex marriage is granted after the ban was lifted could be complicated by rulings and appeals later on. and prop 8 supporters could still ask the appeals court for suspension of marriages during their own appeal. the same-sex marriage is currently legal in five u.s. states, including massachusetts and vermont. reporting live from san francisco, jade hernandez, ktvu channel 2 news.

the ruling in the proposition 8 case is of course getting national attention. two of the plaintiffs in the case appeared on cnn this morning, explaining why they pursued the litigation. no what we're trying to do is reiterate what our government has already told us, that this right is a fundamental right for every single american. and during that fair debate, we were described as less american, as we needed to be prohibited from having the same rights as other people simply because we were gay. >> the other plaintiffs in this case were a lesbian couple, sandy steer and chris perry and the city of san francisco. as always, our complete coverage continues at ktvu.com, we posted judge vaughn walker's ruling in its entirety, as well as the link to all the video evidence. that was presented at the trial. police looking for two men they believe might have been involved in the fatal stabbing

of a 20-year-old man late last night. the killing happened around 11 lone 30 near the tennis courts on the campus of mills high school. investigators say there's a public bike path and a skateboard park in that area and it's a gathering place for young people. police say witnesses describe the killers as two men of pacific island descent in their late teens or early 20s, both about 6-foot 1 or 2. one weighs approximately 130 pounds, the other about 180 pounds. police in pleasant hill are searching for three men in a home-invasion robbery. the men were disguised as police officers. police say two of the men broke in through a sliding door of a living room at a home on parkway around11:30 last night. they reportedly identified themselves as police and were wearing jackets and vests with the word police on them. investigators say they were armed and forced the victims to get down on the floor while the house was ransacked. they reportedly stole some

electronics and escaped in a champagne or brown colored suv, possibly a chevy, with a license plate similar to 4tez960. several east bay law enforcement agencies are currently involved in a coordinated effort right now to cut down on gang violence. they're making special deliveries to gang member parolees' homes. ali rasmus joins us live with the details on what they are delivering. >> reporter: good afternoon, mark. there are several different law enforcement agencies working on this today from oakland police to fremont union city police, sheriff's, but it's really the department of corrections that's heading up this plea today, going after parolees who have known gang ties. that's why they came to this home, for example. near 80th and hillside in oakland. they say it's the first major sweep of gang parolees in

alameda county since the start of the year. >> we act as a deterrent for those that may be on parole, supervision, so they won't engage in this kind of activity. and also, it oftentimes leads to discoveries of other crimes being committed. so the benefits are two-fold. >> that's what happened when officers came to this home in oakland to check up on one of their parolees. the department of corrections says another person in the home tried to drive off in a van when police pulled up. police say they found some drug paraphrenalia in the van and so now both the parolees and his 14 have been detained. also as part of the sweep today the department of corrections talked about a new tool they have to help them keep tabs on their gang parolees. a new state law went into effect in january. that allowed the department of corrections to buy a thousand gps ankle race lets specifically to keep tabs on people with gang ties. this sweep is expected to continue throughout the afternoon. later today the department of

corrections is expecting to give us an update on the number of parolees they arrested today. reporting live, ali rasmus, ktvu channel 2 news. in san francisco right now there are several investigations underway into the attempted early morning robbery of an i.r.s. agent who shot and injured one of the suspects. it happened just after midnight this morning at kirkwood and lasalle avenues in the bayview district. police say two suspects tried to rob the agent who was on duty at the time. as a criminal investigator for the i.r.s. the agency would not say whether the officer was a man or woman but says the officer was armed and responded to the attempted robbery with gunfire. >> which don't know how many suspects it was, but the -- agent fired at one of the suspects, hitting one of suspects. that suspect is in custody at the hospital. non-life-threatening injuries. >> the injured suspect was hit

in the torso and was transferred to sf neral. the other suspect was captured close to the scene. police are conducting an administrative and criminal investigation into the incident. the i.r.s. is also conducting its own internal investigation. in washington, d.c., are set to vote this afternoon in the confirmation hearing for the supreme court justice nomine she's widely expected to be confirmed by the end of the hearing today. she has the support of almost the entire democratic caucus and enough republican support to avoid a filibuster if confirmed she will be the third woman on the high court. she will also be the first justice without prior judicial experience. since late chief justice william win equivalent. today the u.s. attorney general announced charges against more than a dozen people for suspected ties to somalian terrorists. eric holder spoke from washington, d.c. about the indictments. 19 people from three states,

a collision involving two school buses and a big rig left two people dead this morning southwest of the st. louis, ssouri. as many as 50 high school students were sent to the hospital on interstate 44. investigators say it appears the big rig slowed for construction and one of the buses hit from behind. the second bus then hit the first bus. the school buses were carrying band students from the town of st. james, 100 miles southwest of st. louis. to an outing at six flags amusement park. authorities have not said if the two dead were students. president obama is boasting today in chicago about the success of his auto industry bailout. house should come in time for many school districts to revisit decisions to lay off teachers before the new school year. allison burns reports from our washington, d.c. bureau. >> reporter: california senator barbara boxer says 13,000 california teaching jobs are on the line with this vote. a senator boxer is leading the push to get a $26 billion state budget bailout through congress. she says it will save teaching jobs and other public service jobs in california and across the country. >> the police, the firefighters, those jobs will be saved. nationwide today, with this passage of this bill we save 250,000 jobs. think about what that means. >> california is getting more than any other state, republicans say it's another budget buster and states should stop look to be washington for help. >> they're getting more from us than from their sales taxes, income taxes, from their

property taxes. the states are simply being -- becoming completely dependent upon us. >> now the house is on its summer break. but house speaker nancy pelosi is calling house members back here to washington next week for a vote to okay it. reporting from washington, d.c., allison burns, ktvu channel 2 news. there's mixed news from the labor department today. the number of people filing for first-time jobless benefits jumped from 19,000 to 479,000. that's the highest level since april. and a sign that companies continue toly off workers. but continuing claims slipped by 34,000, putting the number at 4.54 million. desperate times, sometimes call for desperate measures. as the saying goes. and at least one san francisco man we know about is taking it to heart. we found 59-year-old kendon alderson on the streets of san francisco. he is looking for a job in a most unusual way, by becoming a

walking resume. complete with a high-tech display. it's a technique he says got him a job 19 years ago. >> someone is going to see that i'm looking for a job and someone who will go to a link like this to get a job that's something they want to work with. >> donaldson is the communication expert from marin county. the back of his billboard perhaps sums it up best it. says, when the going gets tough the tough get creative. bp is making progress on its latest attempt to plug that broken oil well in the gulf of mexico. crews began pumping semen into the well headed to. that's after they pumped enough mud down the well to push the oil back to its underground source. crews are still drilling a relief well that will connect much closer to the oil reservoir. cement will also be down that well to hopefully plug the well for good. they hope to finish by mid- august. it seems like a most chilly

summer to me and it doesn't change today. mark is here with the latest from our weather center. >> yes, our weather story has been pretty much constant for the past few weeks, we're going to stick with it today with clouds in the morning pulling back to near the coastline. parts of the bay area today will not warm out of the 50s. here you can pick out lingering clouds for san francisco, extending out towards the bay around emeryville and oakland but as you widen out the view and show you that, we have cloud bank breaking off before the san mateo bridge and clear skies on the south bay for san jose. a live look outside in san jose, little haze but overall we're expecting this, nice conditions in the 60s, 68 degrees. look at some of the current numbers, san francisco right now only 56 degrees. and not going to make it into the 60s for today. santa rosa 62. concord 67 degrees. livermore at 66. so this is the scene towards the bay this morning. clearing skies to near the coast, temperatures actually

there some breaking news related to same-sex marriage in mexico. announced moments ago that the mexican supreme court is upheld the constitutionality of the law allowing gay marriage in mexico city. the justices voted there 8-220 uphold the law it. had been been challenged by federal prosecutors. they argued it violates the constitutional principle of protection of family. more than two dozen residents in the east baytown of san lorenzo did not have water for part of the morning. the water-main break happened just before midnight. back lynn road was closed because of road damage. east bay mud crews are on the

scene, working to fix the problem. water service was restored around a.m. this morning. the street repairs continue at this hour. federal prosecutors are reportedly intensifying their criminal investigation of cycling superstar lance armstrong. according to the new york times, the feds have questioned several cyclists and former teammates who reportedly back up claims that armstrong participated and encouraged doping to gain an unfair advantage. armstrong denies any wrongdoing. in denver, colorado he told reporters he had nothing to say about the federal investigation. tonight at 5, a new look at former police chief johanns messily and you've seen officer and a defendant but tonight we see him through other eyes. we see his family life and the kind of person he is. that's tonight at 5:00. meantime, our next newscast
