on the ktvu channel news. good afternoon. it was one year ago that hasanni campbell disappeared in the east bay. there have been several leads, false hopes and even two arrests but still, no answers about what happened to the little boy. however, police have some suspicions. we're having technical problems. we'll get back to that story. we're learning more about a tourist who was shot and

killed. she was from germany. tara moriarty has more. >> reporter: good afternoon. 18-year-old phillip stewart was arrested and will face murder charges. this is thanks 234 parts to eye -- in parts to eyewitness accounts and a taxi driver. this is a look here from the building where a teen dance party had just let out sunday night. you can see the people returning back inside once gunfire erupted around 9:00. and then two minutes later, young man in a white hat is carried out the door by friends. it appears that he was wounded whether shot or grazed by a bullet, we're not sure. police say three people were caught under a hail of bullets. metchthi schroeer was killed.

we caught up with the individual who cat up with vehicle -- who caught up with the vehicle and got the license plate. he did not want to be identified. >> he was racing away. people were jumping in his car. it was very suspicious looking. >> reporter: the woman's husband was visibly distraught as he left the hotel to catch a flight back to germany. the couple came here to san francisco to celebrate their 25th wedding anniversary. tourists say they were shaken by the insentient and -- by the incident and merchants are angry tighter security was not in place. police are blaming promoters of the events. they say things got out of

oakland police's acting detective gus galindo has been working on case for about a year now. >> the case is still classified as a missing person's case. but based on the investigation i feel that hasanni campbell met foul play at the hands of louis ross and remains our primary suspect. >> reporter: ross was hasanni campbell's foster post -- foster father. the lieutenant would not say what information are leading him this way. jennifer campbell was hasanni campbell's foster mother. officials met with her. the lieutenant said louis ross is the suspect because i was the last person seen with hasanni campbell that we know about. ross said he left hasanni campbell in a parking area next to a rock ridge shoe store. today, the detective says he believes hasanni never made it

"the associated press "says the family was notified that ted stevens was one of the five killed. nasa official sean o'keefe was also on the plane but it's not known if he's dead. the crash occurred in poor weather near anchorage. at least three people were being airlifted to anchorage for medical help. this is video of the same plane

that went down. they were headed to a fishing trip. ted stevens began his career in the days before alaska state hood and ended his 0-year career two years ago following a corruption scandal. he also survived another plane crash in 17 -- 1978 that killed his first wife. we're looking live at the floor of the house where lawmakers have just begun to vote on the hispanic that cleared the senate -- on the measure that cleared the senate last week. it looks like the yeas are leading 66-47. $16billion of the bill would help states cover expenses. this would also eliminate the need for laying off.

>> the money will only go towards saving the jobs of teachers and other professionals. it should not be a bipartisan issue. i heard the republican leader in the house saying the other day that this is a special interest bill. some republican lawmakers accused democrats of trying to win the support of teachers unions and they say this would simply add to the deficit. the bill's sponsor says that's not true and the measure is paid for by closing corporate loopholes and reducing the food stamp program. fire chased residents out of a bay area apartment building this morning and another fire os and the east bay waterfront. flames could be seen for miles. people on coast are still hoping to see a break in the clouds. also -- >> reporter: i'm paul chambers and if you are caught behind the wheel on the phone you will

crews say the fire was difficult to fight because it was in a subbasement in a building behind two other structures. one neighbor told ktvu she was not aware of what was going on until fire crews showed up at her door. >> there was quite a commotion. the firemen rang the doorbell. i opened the door. they came in and that's when i sorted realized the magnitude of how much fire was right outside. >> there's no word on what sparked the fire or how much damage it caused. alameda fire officials are investigating the cause of a pier fire this morning the it started around 4:30 near buena vista avenue. police say the fire was challenging because most of the flames were coming underneath the vacant care. they called for immediate need for the san francisco fire boat. >> this pier was in disrepair, so it was difficult for them to

access this fire. so they used the boat to access it from the water side. >> no injuries were reported. it may be illegal but the chp says many people are simply ignoring california's ban of talking on the cell phone or texting while driving. that's why the chp is tracking down -- cracking down today and plan to pull over any driver disobeying the law. paul chambers has more. >> reporter: today, the california highway patrol said they will have a zero-tolerance for those not abiding by the hands-free cell phone law. that's why officers are making an extra effort to identify and ticket people who are holding their cell phones while driving. >> the reason behind this campaign, we want to remind motorists about the dangers of destructive driving. it a pierce -- it i a -- it appears some people are ignoring that law. >> reporter: that law went into effect in 2008.

and then in 2009, texting while driving also became illegal. still, people are not getting the clues. the chp says the cell phones are the number one cause of distracted driving accidents in the state. there have been more than 1200 crashes statewide since the law went into effect two years ago. of those accidents, 68 people were killed. and 850 were injured. >> you cannot bring a human life back. so with the distracted driving, if you're not paying attention there is a possibility you could hit a bicyclist or motorist. >> reporter: last year the chp issued more than 135,000 citations nationwide, with 550 of them in the bay area for same crackdown. using a device without a hands- free device, the fee goes up

after the first ticket. in oakland, i'm paul chambers, ktvu channel 2 news. governor schwarzenegger plans to appeal after an alameda county judge blocked him from imposing new furloughs on state employees. the judge issued a temporary restraining order yesterday saying there were serious questions about the legality of the furloughs. over 400,000 employees were ordered to take three days off a month. another hearing is scheduled for next month. police officers in oakland have agreed to major contract concessions to avoid more playoffs. members of the police union have overwhelmingly approved the deal that requires them to pay more money in their pension deal and work longer before they retire. this is far from a done deal. these concessions are dependent on passing the parcel tax measure on the november ballot. >> it bring the 80 officers back that were laid off.

it bring -- it keeps the 122 that were threatened to be laid off. it keeps them here for three years. >> reporter: the parcel tax is $360 per household. if that measure fails, the deal to avoid police layoffs falls apart. bp halted work on a relief well intended to seal off the blownoff well. the national weather service says a storm heading to the louisiana coast has a 60% chance of turning into a tropical depression the next few days. the relief well is within 100 feet of the blownout well that spilled millions of gallons of oil in the gulf. the blownout well was capped but it is hoping the bottom is fixed as well. let's check in with our meteorologist, steve paulson.

>> it's really not that warm. some sunshine is making it inland. it's not very warm. temperatures are in the 70s for a few. there are a lot of 50s and 60s. it is retreating. i think by now we know that a little bit of haze over weekend. 64 degrees. oakland has remained way below average on temperatures. we had the fog around 3,000 feet yesterday. it came down a little bit today. it was around 1500 feet. 2,000 feet. it's another cool pattern and cool day. so there has to be something positive with it cool pattern. the fire pattern has been exceptionally low. very strong low up to portland. it looks like it's heading to the nevada/california border. it's just sitting there. it will burn off but not until

thursday. 60s, 70s and then some low to mid-80s inland. but then again, temperatures are a good, 5, 10 degrees pea low normal. we have a -- below normal. want some heat? palm springs. a rather cool pattern persist the up and down the coast. 76 in eureka. it's cool on the coast and not that bad inland. you can get a good look at the low right up there spinning. as that -- as that settles in, high pressure will build in. and it looks like by the weekend we'll get a warmer. even on the coast. today, breezy, warm, mild. the fog is burning off over the bay. breezy there. the morning clouds just stick and stay. cool for some, mild for others.

jobs. we'll have much more on this coming up on our website as well in our later newscast at 5:00, 6:00 and 10:00. today, the world health organization said the h1n1 flu epidemic is over. it killed 1,000 people worldwide since last april. but the number of cases has dropped dramatically since the beginning of this year. health officials warning that the virus could still cause problems and says high-risk groups, including pregnant women should still be vaccinated against the virus. west contra costa unified school district are investigating vandalism at deanza high school. someone painted graffiti and some racist comments are mixed in with the graffiti. ktvu was told the district was not notified about the vandalism until this morning. police say they are also investigating. wall street has been anxiously waiting to hear what the federal reserve announced last year.

the main reason those numbers are coming back a bit, you saw the dow just now, the federal announced in the last hour, it will maintain current interest rates and try some new policies to spur the economy. the reserve will use money it earned from the t.a.r.p. bond investments in mortgage securities to buy back some government debt. the fed hopes the move will reduce long-term mortgage rates and interest on corporate debt. the fed admitted that it expects economic growth to be "more modest" than it predicted just seven weeks ago at its last meeting. police in ohio have released video a fight at a mcdonald's over chickening in going nets -- chickening in mug nuggets. police say a woman got upset when she was sold -- told they didn't sell chickening in
