tourist. tonight we have obtained surveillance video from the night of the shooting. tonight we hear from the cab driver who's actions help lead to the arrest of a prime suspect. ktvu's david stevenson is live in san francisco tonight with our report. >> reporter: frank, nearly 48 hours after that shoot out near union square, police are still evaluating information and we're hearing from witnesses who may aid the police in their investigation. this luxor taxi driver did not want his face or voice used as he described today what he saw and did that police say helped them catch a suspect outside of union square. >> i have a sixth sense about bad people. >> reporter: police say who groups exchanged gunfire. on the 400 block of mason street, the shots wounded six people and killed a german tourist celebrating her birthday and anniversary with her husband.

the taxi driver said he saw a driver pick up one man and speed away. >> he ran through a red light and pulls over at the next light, half block right at the top of union square and picks up these three other guys. i'm following them and watching them, they are trying to drive evasively to get out of there. >> he phoned in the car's license plate and description with police and stayed on the line with police dispatch in time to watch officers swoop in on the driver. >> they pulled them over at the palimar hotel. a couple of guys got out. >> we have the taxi driver that assisted, but there were many other people who have cooperated, a lot of people are talking to us, we're reviewing video. >> reporter: ktvu today obtained this surveillance video taken at the lobby of the hotel's foyer where the party was held. >> this is a case that is being

resolved, we have identified one suspect at this point and we'll continue to work through it. >> reporter: the slain on sunday is san francisco's 30th murder of the year. the man arrested in that shooting could have his first court appearance as soon as thursday. david stevenson, ktvu channel 2 news. police and the west contra costa district are investigating vandalism. a district official says its happened over the weekend. >> i was very alarmed by it and saddened, sickened by this dispickable behavior. it's unacceptable to have hate crimes any where and especially in our schools. it's a complete violation but we also take responsibility and want to make sure we do a better job of securing our site. the school is currently

undergoing a major reconstruction project, district officials say the school is going to discuss the incident. the american bar association is throwing its weight behind the right of same- sex couples to marry. at its annual meeting, the aba overwhelming passed a resolution calling on all states to extend the right of gay couples to tie the knot. the vote comes after judge walker ruled that same-sex in california is unconstitutional. this morning, governor president obama signed a bill to send millions of the dollars in funds. the house of representatives passed the state aid bill by a vote of 247 to 161.

former u.s. senator ted stevens who represented alaska for more than four decades has tide in died in a plane crash at the age of 86. samantha hayes has been gathering reaction from washington and joins us now with details. >> reporter: shock in washington tonight where so many lawmakers who have worked with or against senator stevens finding out tonight about his death. former republican senator ted stevens died in a small plane crash in a remote area of alaska. at least four others were also killed in the crash outside of

dillingham. the group was reportedly on a fishing trip. sean o' keiffe who had held several positions was among those on board the aircraft. he and his son survived. bad weather was reported in the area at the time of the crash but officials are not sure if that's what caused the crash. the national transportation safety board has assembled a team to investigate. >> they'll be looking at the wreckage of the aircraft and they can figure out very precisely how it came down, how it hit, what angle, how fast more or less, etc. stevens was appointed to the senate in 1968, won election in 1970 and was reelected by wide margins until

a statement about senator stevens, she said quote, i will best remember ted for playing a pivotal roll in helping to pass the ten in ten fuel economy act. a growing storm in the gulf of mexico has forced bp to halt work in a relief well intended to permenantly seal off the broken well. cement will seal off the oil reservoir beneath the ocean floor prevending the possibility of another leak. crews put a temporary cap on the relief well today in case they're forced to abandon the job site. >> we want to get that bottom cement pumped and then move on. >> reporter: the national weather service says a storm moving toward the louisiana coast could turn into a hurricane within the next two days. the federal government has lifted the fishing ban on 5,000 square miles of the gulf of

mexico off the florida panhandle. the economy of northwest florida has been hit hard by the fishing ban and the loss of tourism to local beaches. the national oceanic and atmosphering association says no oil has been seen since july 3rd. state agriculture officials have quarantines all fruit and vegetables in an 89 square mile area in los angeles county. that quarantine affects pasadena and san marino. it went into effect on thursday after fruit flies were found in traps there. a pesticides has been put on light poles and in trees to try to lure and kill male fruit flies. farmers have been asked to keep their fruits on their property so fruit flies will not be

the woman at the center of this recorded tirate at a mcdonalds was arrested today. the woman's lawyer says that his client was drunk at the time and doesn't remember her mcnugget rage. she was sentenced today to 60 days in jail and ordered to pay mcdonald's for that damaged window. the jet blue flight attendant who made an emergency exit to get off a plane that landed on jfk last night

appeared at a new york court today. steven slater was arrested for reckless endangerment and trespassing. the 38-year-old got into a fight with an agitated passenger then used an emergency inflatable slide to get off the airplane. his attorney says that his client is under stress because his mother has lung cancer. >> civility is missing, people just don't have courtesy to one another, he's been on the airline industry since he's 19, and people just aren't polite. >> witnesses say the incident was triggered by a passenger who refused to listen and swore at slater when he told her that she could not open an overhead bin. witnesses say that somehow slater was hit by the over head bin and lost his cool, grabbed

my parents don't know what i need to be able to go to college. it is a situation that is upsetting many students in east san jose. they don't want to pass to graduate but not to go to a four year college. >> we're going to get to that story in just a moment. first though we have some breaking news involving that 50- year-old german tourist who was shot and killed sunday night just about a block from union square. ktvu's david stevenson is following the developments. >> reporter: i've just spoken to the district attorney, and they are saying they will not charge the one man who is is arrested in the killing. as you recall five people have been detained in the after math of that shooting which left two people wounded and the german tourist who is visiting san francisco and wife, she was shot to death in front of her husband. we are now told that the 18-

year-old san francisco man who had been arrested in that shooting death will now not be charged. >> there's no charges at this time. there is evidence continues to be collected including ballistic evidence, tests and evidence. the case remains under active investigation and we will work closely with the san francisco police department to gather that information. >> reporter: there was in fact, the one person who had been arrested in that homicide case. this is the 30th homicide in san francisco so far. and police want to reassure that the city is safe and that this incident on sunday is something that does not usually happen in that particular area. but again, it would appear to be a bit of a set back for thatinvestigation that the one man, the one man who is being

held in this case for the killing of that german tourist we are told is now not going to be charged. the investigation certainly continues. police say they have a lot of video tape and a witness reports to review. we'll bring you more details as this developments, for now reporting live from san francisco, david stevenson in san francisco ktvu. >> thank you david for those new details. a community town hall meeting is under way at this hour in san jose. run by students with a message for the school district and the community. that message, raise standards so that we can go to college. robert handa is live now in east san jose with details for us. >> reporter: heather, we're here at overtell high school, it's a school we've profiled before because the east side union high school has made significant progress in many academic arealess. but in a town hall meeting, they say that progress is not enough, not if they want their

students to go on to college. school is not in session yet but summer vacation is over for many students here in the district along with this casual student get together, the summer youth leadership academy has been hosting other summer event. they are upset that less than 40% of east side graduates meet the requirement for a four year college. they want the standards used by the csu and usc system to be the requirements for the school system. >> my parents don't know what i need to be to be able to go to college. and i recently found out my sophomore year that i'm not on the way to go to college. which it was a really big thing to me. >> in my school there's only a few counselors and there are students in the thousands and like, we have less than i believe five counselors this year.

you can't expect five counselors to inform every student in our school. >> i found out and i'm like, people don't know this. why don't people tell us these things. so i'm glad i know. i took some of my classes, i got 10 credits already. >> why is this happening in this community more than in other places? >> i think it's important in our district, we need a lot of resources out of our schools are under funded, especially with the budget cuts. >> reporter: the students plan to take today's feed back to the east bay school board meeting on september 15th to demand that standards are raised. the aclu is looking into whether some california schools might require kids to pay for expenses including athletic gear and medical examinations for sports teams. in california, schools are not legally allowed to require students to pay for uniforms,

transportation or other costs. the brentwood high school district in contra costa county reportedly charges students for some activities but is considering changing it's policies. demonstrators targeted big banks today. branches in los angeles and some here in the bay area in san francisco, richmond and san jose were the focus of protesters who are pushing change. ktvu's maureen naylor has more now on what the protesters want, maureen. >> heather, the group targeted banks today about the building promoting would affect how all california companies pay property taxes. supporters say it would mean millions for the state but it has major challenges and critics. >> about 45 people demonstrated outside a chase bank branch in downtown san jose this afternoon. >> people are hurting but the banks aren't hurting. the banks need to take more responsibility only what's been happening right now.

we have breaking news to report at this hour, three juvenile suspects that escaped from the alameda county juvenile facility in san leandro we are just getting word that they have been caught. we want to show you some live pictures from news chopper 2 which is currently flying over juvenile hall right now. let's back up a little bit, because the sheriff department is telling us that the escapees were wanted for violent felonies including murder. they launched a huge search for those three suspects once they learned they had escaped from that detention facility. the latest word we are getting now is that those three juvenile suspects have been caught. we will though have much more information coming up on ktvu channel 2 news at 6:00 including just how all of this happened. today santa cruz county

began using a new federal system that will allow their sheriff's department to check whether a jailed inmate is in the country illegally. secured programs automatically check those illegals who are arrested. >> we have been able by a secured communities along with other tours that we now have to deploy other moves from the country, more criminal aliens than ever before. six bay area counties have adopted the secure communities system, alame da, contra costa and senoma.

the measure includes $300 million for extra service agents and two drone airplanes. the measure would be funded by higher fees to personnel departments. the measure now goes to the senate for a final vote. the centers for disease control says better hygiene appears to be reducing the i incidents of a drug resistant staph infection in hospitals. cases of mrsa actually fell 16% between 2005 and 2008. to the current rate of one case per 4,000 hospital patients. the cdc says increased hand washing by both doctors and nurses as well as stricter sterilization procedures have reduced the spread of that bacteria. and we will have much more coming up including zero tolerance, find out just what the h highway patrol is looking for at bay area

in full military honors. his body remained undiscovered after a world war ii bomber craft that is until his family set out to find him. tom fowler has the story. >> reporter: a u.s. army honor guard carried the remains of john bonosio to the family plot, 66 years after his b24 bomber crashed in germany. >> so wonderful that he got honored and wasn't just you know left in another country anonymously with his crew. >> reporter: his burial flag presented to his brother also a b24 crew man. >> this is closure, john is back with his father, he's back at home in san francisco. >> reporter: john bonosio inlisted at 17, three years later with his crew mates flew from england to bomb germany.

with our meteorologist mark tamayo. just didn't seem very warm out there today. >> reporter: that's right heather, we had temperatures near the coast on the chilly side once again. the upper 50s, inland a few spots in the low 80s. we've been tracking microscopic changes in the last few weeks. the over all weather pattern will begin to change as we head into the weekend. right now on live storm tracker 2. we are taking a look at the heat here, sacramento 82 degrees, compare that to san francisco ennear the shoreline. the cooling coast side we know it, you can see the fog already showing up there, in fact, here's a closer inspection as we dive into this region and the coast, pacifica and point ray. already the clouds are covering a good portion of san francisco. look outside at san san francisco right now, you can see the fog deck already in. as far as temperatures from today, you can see the range really not a big change from

yesterday, 60 in pacifica, the 80s out toward livermore and antioch. weather story is this, pretty much the same one we showed you yesterday, more fog expected overnight and the same pattern for tomorrow. then, in the extendible, we'll gradually warm things back up. as far as temperatures for your wednesday, you can see the range from the upper 50s coast side. warmest locations inland in the upper 70s to low 80s once again for your midweek forecast. this has been the persistent weather pattern for the last few weeks, little change for tomorrow. still cool tomorrow, the winds still a factor, could be approaching 20 miles per hour. but look what happens that system will be on the move, moving out to the east by the weekend. minor warming of the coast, but the inland neighborhoods for saturday and friday on track to reach the upper 80s and by monday, few neighborhoods inland could be approaching the lower 90s. for tomorrow morning, definitely get ready to bundle up again, areas of fog will cover a good portion of the bay area and some drizzle into the

for drivers to talk on a cell phone without a hands free device for more than two years now. since january, it's also been a crime to text while driving. but the chp says plenty of people are not getting the clue, officers say distracted driving has led to more than 1,200 crashes statewide. killing 16 people and injuring another 850 people. >> you cannot bring a human life back. and so, with the distracted driving, you're not paying attention. there's a possibility that you can hit a pedestrian or bicyclists or motorcyclists. >> in a similar crack down last year, the city patrol issued 500 citations. the fine for using a hand held cell phone while driving is $20 and $50 for every infraction after that. but, that can increase up to $200 when you add in court fees and other penalties.
