we have overcast conditions across the board again. everybody says low clouds and there's also a little breezy condition and some drizzle coast and bay. once the fog burns off and for some it may take a while. we'll see 70s and low 80s. that's it for some. very windy conditions towards the delta and foggy and cool over by the coast. here's sal. steve, right now traffic is going to be effected by a problem southbound 101 at pepper road. several vehicles got into a crash just at the grade there. a couple of garbage trucks, a couple other vehicles here on southbound 101. so watch for very slow traffic all of a sudden coming up on the pepper road exit. we'll follow this and have more traffic coming up in a bit. police searching for a gunman after an overnight shooting. good morning, paul. >> reporter: good morning, pam. i spoke with police a little more than half an hour ago and they say they are working with

very limited information. here is what we do know. around 9:50 last night police got a call of a shooting at the intersection of leafwood drive and sunset parkway here. once on scene officers found an 18-year-old male had been shot in the upper body. the victim was transported to an area hospital where he is listed in critical condition and is expected to survive. police have no leads or a description of a shooter. only that the person left the vehicle in a white vehicle. police plan to talk with the shooting victim later this morning in hopes to get more information. officers say with the shooting happening in a residential area they're hoping to hear that someone heard or saw something before the shooting. if you have any information about this shooting you are asked to call novato police. live, ktvu channel 2 news. time now 6:03. this morning police are out searching for the person who assaulted a woman inside her apartment near walnut creek.

this was the third assault of a park regency apartments in the past six weeks. the latest terrifying incident happened early yesterday morning. investigators say an intruder woke up a 25-year-old woman who was sound asleep in her apartment, then held his hand over her mouth. >> the victim was threatened and told not to scream. she was able to get away, fight back, the suspect fled and then she called the sheriff's office. >> investigators look at this police sketch -- investigators think the same man may be to blame for two similar attacks at that very same apartment complex. he's described only as an african-american man about 6'2" with some facial hair. overnight san francisco police released the only person arrested for this weekend's fatal shooting of a german tourist. 50-year-old was killed while taking an evening stroll with her husband near union square on sunday night. the suspect in that shooting

walked out of jail last night just hours after prosecutors made a surprising announcement the d.a.'s office says at this point it doesn't have enough evidence to charge the 18-year- old with her murder. time now 6:04. governor schwarzenegger is among the many officials who will be in the san francisco this morning for the big ground breaking ceremony for the nation's first high speed rail station. ktvu has reaction to this project. good morning. >> reporter: good morning, dave. this is where the high speed rail station is going to be. we're very close to the heart of the financial district in san francisco near first and mission streets. even though it's dark out here you can still see the sign out front is very well lit and reads transbay transit center. that's what's going to go up here. that's what they're starting construction work on today. now last week officials provided this animation to show you what the center is going to look like when it's complete. it won't be done any time soon. it's expected to take seven years to build. but when it's done you'll be

able to connect and transfer between eleven different transit systems. it's going to be a hub for everything from ac transit to bart and cal trans to the state's high speed bullet train. >> it's about time we're supposed to be a world class city but if you look at our transportation it's kind of archaic. >> reporter: this will help move things forward. >> i think it's a great idea. i think at the point in time making travel accessible to everybody and making it easy for everybody probably what we need to do and putting the infrastructure in california isn't that what we need. >> reporter: but not all are excited about the rail. about 46% of people in the state have expressed concerns about the timing and the cost of the high speed rail project. it's supposed to cost about $45

billion to build a bullet train rail line that would go from sacramento to the bay area and down southern california. so far the rail authority only has about three quarters of the money it needs to complete this project. last week it asked the federal government for about a billion dollars to contribute to this project. construction on the rail line is supposed to start in 2012. but the ground breaking for this particular station does start today. u.s. transportation secretary, governor schwarzenegger, senator barbara boxer and house speaker will all be on hand for the ground breaking ceremony. that's expected to start at 10:00 this morning. live in san francisco, ktvu channel 2 news. all right. let's go over to sal who we understand there's a crash in the north bay. >> that's right. clearing an accident at southbound 101 at pepper road. sounds like it's less serious than was once considered. look for slow traffic.

oregon border. that's pumped in the fog and very cool air aloft. that helps to get low cloudiness to give up drizzle too. breezy and cool. 54 in san francisco. go for a high of 6o. has not been 70 degrees in downtown san francisco since july 4th. that's a long time. low clouds and fog, inland areas should i say breezy, blustery or windy? once the fog burns off it's going to be one of those three because it will only be in the upper 70s. already pretty good breeze for many even with the overcast conditions around the bay. 50s around the coast. 50s and 60s. 13 degrees cooler than yesterday. so the cold air associated with the low usually it wipes out the fog but today it's just enhanced. all 53. crockett 54. san carlos 55. our observer in crockett said it was howling last night with the went.

bureau with more on this story. good morning, allison. >> reporter: good morning to you, dave. we are also getting a closer look this morning at the location of the crash this morning that killed former alaska senator ted stevens and four others. investigators will be on the scene near dillingham, alaska, today to figure out what happened monday night. a new photo shows the crash site. you can see the float plane on the hillside. rescuers found the plane largely in tact. four people survived including former nasa administrator and his son. >> there was no post crash fire. and none of the occupants of the aircraft were ejected from the aircraft. they were all contained following the accident. >> reporter: here on capitol hill this morning the flags have been lowered in honor of former senator ted stevens. he was the longest serving republican senator in history. and he is being remembered as an icon dedicated to bringing federal money and projects to

the northwest. reporting live from washington d.c., allison burns, ktvu channel 2 news. crews drilling the relief well in the gulf of mexico have about 30 to 50 feet left to go, but they are now suspending work due to an approaching storm. the federal government's national incident commander says work could be delayed now for two or three days. the relief well will be used to pump cement into the blown out well with the hope of sealing that off for good. crews will pop in a temporary plug on the relief well to safeguard what they have drilled so far. governor schwartz schwarzenegger still hopes this friday's scheduled furlough will go on as planned. yesterday his lawyers filed an appeal that temporarily bars the governor from imposing the unpaid days off. so now some 156,000 state workers are waiting for final word on whether or not they should report to work on friday. and some angry state workers are busy planning a protest against governor

schwarzenegger at the box office. the expendables debuts this friday. the governor has a cameo appearance. organizers are organizing picket lines outside movie theaters. protests also being organized in sacramento and san diego. and the nation's largest organization of attorneys is voicing its support for same sex marriage at its convention in san francisco the american bar association backed a resolution calling on every state legislature to provide gays and lesbians the right to marry. the resolution sponsored by the new york bar association passed overwhelmingly. only one speaker opposed it. time now 6:16. there may soon be laws of the owners of pit bulldogs in santa clara county. board of supervisors voted to move ahead with the plan to have them spayed or neutered. this follows the death of a 2- year-old concord boy killed last month by his family's three pit bulls.

officials say spaying or neutering can reduce aggression in those dogs. san francisco may soon ban toys in fast food meals that don't meet strict nutritional guidelines. those restrictions if they're passed would apply to all restaurants. but they would specifically target fast food restaurants that typically give out toys in kids meals. under the plan toys can only be given out if a meal it comes in has less than 600-calories. a similar law just took effect in santa clara county. details about the return of fare enforcement program. while the crack down on fare cheaters started yesterday on trains, the bus fare enforcement will start tomorrow. after three months of retraining, fare inspection teams will ask passengers to prove they paid for their fare or they could be fined $75. muni says it will also put more emphasis on educational programs to discourage cheating on muni and a crack down on

look at that. it's cold out there. it's cold. how cold is it? never mind. west 21 at fairfield southwest 10 at vacaville south at sacramento. it is overcast and cool. so what's going on is there's a very strong low moving right down from washington and oregon. and that is really enhanced the fog bank and picked up the wind. hardly any sun by the coast after everything's said and done. it stays very cool over there. 50s, 60s on the high side. coast and bay 60s, 70s few low 80s inland. concord right now is clear. that's the only reporting station that says clear. but buchanan field has gusts to about 30 miles an hour. that can be a wind tunnel out there. it can also be very hot, but it's not. it's going to be a cool day. 50s for everybody. and until that low decides to pack its backs and move out friday it's going to stay cool. overcast, drizzle, even if the sun comes out not very warm. 50s and 60s by the beaches.

even inland a lot of 70s or very low 80s. and looks like this pattern through friday. and then warmer inland as we get to the weekend. dave and pam. thank you, steve. 6:19 is the time right now. mexican in airlines chief executive says the airline needs at least $100 million to keep flying. the airline has suspended most flights at all three bay area airports filed for bankruptcy last week. it's stopped selling any tickets. the airline and two biggest unions are trying to raise money from investors to keep the line afloat. trying to exchange personal ownership for the airlines. today former workers from the muni plant invited to a special jobs fair. it takes place at the alameda county fairgrounds. the gates open at 9:30 and runs until 4:00 this afternoon. our time now 6:20. still ahead it's a california ballot initiative, but most of the campaign money is coming

bridges, sounds pretty tired here. westbound bay bridge looking pretty good coming into san francisco. no problems on the san mateo or golden gate bridge. for the first time in a long time i can have a clear view of the traffic looks good. 6:24. back to the desk. thank you, sal. san francisco mayor is taking steps to require commercial buildings to be more ecofriendly. he introduced legislation yesterday to require owners of nonresidential buildings to monitor how much energy their building uses and disclose that information every year. it would also require owners to conduct an energy efficiency audit every five years. proposition 23 on the november ballot would suspend california's landmark bill

designed to cut greenhouse gas emissions. and critics say two key supporters of it are toxic polluters from out of state. the oil refineries are owned by texas companies and they are the two biggest donors to proposition 23, almost $5 million so far. prop 23 would suspend the global warming bill until the economy recovers. but those in favor argue that new clean energy jobs will be -- will more than offset any jobs lost due to increased regular lakes. >> if you think private corporations out of texas in the oil business actually want to spend tens of millions to help the california economy? is that in their interest in that's nonsense. this is purely about their bottom line. >> it could become a big issue in this year's elections. they call the bill a job killer while the democrats in those races both support it.

by the way, in just about three weeks ktvu is producing and hosting a debate between senate candidates. so submit a possible question for the candidates just go to our website at ktvu.com and look for the right now section. time is now 6:25. hundreds of thousands of teachers got some good news when president obama signed a bill that could help them keep their jobs. after the house of representatives cut its recess short to go back to washington to pass a jobs bill yesterday, the bill quickly went to the white house for the president's signature. a portion of the $26 billion package will go towards rehiring laid off teachers. for san francisco public schools, the new legislation will mean an additional $14 million to $15 million. >> i think it would be premature for all of us to start spending that money. i think we kind of have to do a wait and see and see what the state's going to do. we don't know when they're going to pass a budget. >> now the oakland school

district laid off about 40 teachers this year. but officials there say they may not want to rehire teachers who might have to be laid off again in a year or two when the federal money runs out. tonight santa clara officials will discuss an architectural plan for a mosque that at least one neighbor is fighting. the muslim community association wants to i rent a 64-foot high tower at the mosque on scott boulevard. that's similar to a which church steeple with a cross. one city board has already approved it. but thomas scott who works nearby is appeal tag approval. he claims that it would create an eyesore and send an unusual architectural precedent. a bay area man stumbles into a market after a bay area shooting. we're going to hear from the owner who help him who is no stranger to gun violence. i'm live near walnut creek where security has been ramped up in the wake of a string of attacks on young women.

their economy is actually slowing a bit. not a lot of confidence right now. we have some earnings coming in that could help a little bit. but you can say right off the bat the dow jones down 100 points. we'll keep watching. we're going to go ahead and say good morning to you. i'm dave clark. i'm pam cook. time now 6:30. walnut police searching for a man who attacked three women in three separate attacks. tara is getting reaction from neighbors out there. good morning to her. >> reporter: we have just learned there are three security guards on patrol and for two it's their very first day. we spoke to them just moments ago. they seem to be unaware of the recent attacks and haven't been shown a sketch of the suspects. there's a look at one of the security guards standing near the white car. security has definitely been

beefed up here at the park regency apartment complex off oak road. this is in the wake of three attacks or attempted attacks over the past two weeks and contra costa sheriff deputies have released a sketch of the man they say is responsible. authorities say a 25-year-old woman was awakened yesterday morning at 8:30 by an intruder with his hand over her mouth. she sprayed him with pepper spray, but authorities say the victim was locked. they are not sure how he got in. some residents say they're changing their locks. others say they may take more drastic measures. >> i think i'm going to look for other places to live now. this is the third attack. they haven't posted anything. management hasn't told us about anything. >> reporter: do you feel they've been negligent? >> yeah. i live alone. i haven't heard anything. >> reporter: investigators say this man has attacked in broad

daylight. on july 6th they say he entered an unlocked apartment and raped a 23-year-old woman who had been sleeping. then on june 30th the same man is believed to have knocked on a door at 1:15 in the morning asking for a glass of water. when the woman went to get him one he lunged at her, she screamed alerting her boyfriend. the suspect then ran off. now the attacker is described as an african-american man with a slender build, 20 to 30 years old. six feet tall and 200 pounds. because he got through a locked door some residents are wondering how or if he may have in fact gotten a master key. investigators will be looking into that. meantime we have been speaking with residents who say this is the achilles heel of the apartment complex. you can see the car getting through the security gate. you have to have a pass code to get through there and clickers all around the apartment complex to get through the gate. but there is a gap between this big column here and the 7 eleven. anybody can walk just right through there on to the property and that is how some

people believe this attacker may have entered the grounds. we're live here near walnut creek. ktvu channel 2 news. this morning the man hunt continues for the gunman responsible for an overnight shooting in the east bay. that happened at about 10:00 near -- last night near 10th street and west avenue in pittsburgh. the injured man stumbled into a nearby market and collapsed on the floor. the market owner who helped the victim is no stranger to violence. he's now in a wheelchair after being shot seven times during a robbery attempt a few months ago. >> i was kind of happy to get shot because i don't want the guy pointing the gun at anybody besides myself as the owner. so when i got shot as long as nobody got shot i was happy. >> the man gunned down in last night's shooting was rushed to the hospital. at this point we do not have word on his condition. time now 6:34. now in the novato police there are searching for a gunman in

san francisco police are asking for the public's help in tracking down a suspect in a deadly stabbing. the body of the 36-year-old found inside his apartment on august 2nd by a co-worker. police now say they believe the suspect is a latino male and that he may have cut himself on the hand during the attack. investigators believe the attack happened the night of the july 30th. days before the body was discovered. they also say there are no signs of forced entry. an unlicensed san francisco civil engineer is due in court friday to face more than 200 felony fraud charges. prosecutors say the 56-year-old created bogus documents for dozens of construction projects over the past 20 years. he is a former city worker known for his ability to push permits through building inspectors. and also the target of an arson investigation involving a san francisco home owned by his former wife that caught fire last year.

he denied the fire and was never charged. time now 6:36. police want your help this morning tracking down whoever is starting fires of the elementary school in fremont. it's happening in the 3300 block of war wick road. police say there have been four fires set since late june. all of them at night when nobody should be on campus. two fires burned trash bins, two others damaged a play structure. fremont police are saying anyone with information should call them. a federal investigation into toyota's problem with some of its cars suddenly accelerating is over. defective accelerator pedals and floor mats appear to have caused the problems. the transportation department as well as nasa started looking for the cause of the sudden acceleration since toyota was forced to recall nearly nine million vehicles. researchers say they couldn't find any evidence that the electronic systems were linked to the problem. also starting tonight you

can expect delays along highway 1 in mill valley. cal trans is starting a series of overnight pavement repairs at several locations between too many ill price and knew road. the work will take place between 8:00 in the evening until 6:00 in the morning mondays through thursdays. during that time traffic will be one way on highway 1. they should finish that job in about three weeks. all right. 6:38 is the time. let's check in with sal. you're looking at millipede how does it look there? >> we have a camera focused right on and there it is. mill pit as. beautiful. traffic is looking good right now. has not become very slow here. and usually when it does it gives us an indicater of when the commute all over the place is getting busier. let's go ahead and look at northbound and southbound 880. that traffic is moving along

very nicely heading up to the downtown oakland area with nothing major to report right here in this area. we've been watching it for a while. things are doing pretty well. and the commute on 80 looks pretty good all the way down to the bay bridge toll plaza. word of a brand new accident on 80 eastbound before columbus parkway in the noncommute direction in sola in, o county. 6:38. thank you, sal. good morning. another cool morning out there. cold. because there's so much cool air coming in fog even if it burns off and we get the sunshine it's not going to be very warm. unseasonably strong low continues to send us into a below average category. because of the cooler summer we have had some benefits. that would be low fire danger. haven't had anything at all. don't get any heat. don't get any northeast wind or north wind. low fire danger and air quality and visibility has been sparkling. so there are some positives. highs today santa rosa only 72 yesterday, didn't change a

thing. cooled san francisco off 1. 76 today. oakland stuck at 66 or 67 seems like forever. and san jose from 78 will go 75 today. bethel island 51. no heat in the valley. cool air aloft. one would think in weather that this would wipe out the fog bank but it's still there. even if it burns off it's not going to be very warm and the wind picked up as well for many. a south wind in tahoe. cool here. look at the big low up there. it keeps us cool. that's going to continue to play into our weather. so it stays cool, morning drizzle as well. windy at times. sunny but even if it's sunny it's not very warm. there will be warmer weather on the weekend. but probably not much by the coast. inland areas maybe even out to the sacramento valley for the first time in a while could see 90 degrees. overcast, drizzle, 50s, 60s, 7 0z or very low 8 0z.

74-year-old roger lopez suffers from dementia. this photo taken about seven years ago. police say he left his mission district home on july 26th and he hasn't been seen since. he only speaks spanish. he uses a walker. if you have any information please call the san francisco police department. well, police say the foster father of a fremont boy who disappeared one year ago is still a primary suspect. candles were lit last night for the boy during a prayer vigil. the lead investigator believes he met with foul play at the hands of ross. ross and his former fiance, the boy's aunt, were brief jailed on suspicion of murder but released for lack of evidence. he told police he vanished from a car parked in the rock ridge area. time now 6:45. let's get you to where you need to go. sal is watching traffic and the peninsula right? >> that's right. we are checking highway 101 and interstate 280 on the peninsula

right there spinning, seattle, port land into eastern oregon and the tail end dragging across northern california. mostly higher clouds up near the sierra. tahoe is warmer than many here. have to go back a ways to find most records here. not so much oakland and mountain view 1998 the records don't go as far back as san francisco and santa rosa and san jose. 1955 and 1937 san jose also when it was 100 degrees on this date. today santa rosa 72. way below average san jose 75 should be 84. i believe the last time i think if my memory serves me correctly and i hope so the last time san jose has a high of 95 or higher was september of last year. that's a long stretch. long stretch. 50s for everybody. 54, 57 and 55 in tahoe. a south wind and cloud cover. so that's why they're a little warmer. 50s and 60s up and down the coast. local drizzle. some of that drizzle tipped the

rain bucket. santa cruz, monterey, that low will continue to keep us on the cool side. overcast, drizzle, no sun but rather blustery at times. very cool to mild 50s, 60s 70s very low 80s unless you're far away from any fog bank. warmer inland on saturday and sunday. all right. thank you. time now 6:47. high power politicians will be in san francisco this morning. they'll be there for the ground breaking ceremony for the first high speed rail station. we just spoke with officials at the transbay terminal. she's back now with an update. good morning. >> reporter: good morning, dave. this is where that new high speed rail station is going to be. we're at first and mission near downtown san francisco. you can see work and people and crews setting up chairs and tables preparing for a ground breaking ceremony that's going to happen just a few hours from now. this is where the new transbay

transit center will be. it's going to replace the old building, that concrete structure you were looking at put out of commission just last week. on the side of that building you can see an illustration of what the new station is supposed to look like. it won't be complete for another seven years. when it's done it will be a hub for 13 different transit systems. you'll be able to transfer from ac to bart to san tran and cal train to the high speed bullet train. >> it's really about getting people to and from where they need to go quickly. it's about building a lot of housing retail office space around transit facility that is makes it more convenient. we know when you make it more convenient for people to use utilization goes up. >> reporter: so that's the goal to allow everyone who comes to the station to be able to connect between did i want transit systems. the transit center will have housing and commercial stations near it. it will include 1,000 square feet of retail space and

shopping as well as a five acre rooftop garden. this is supposed to be the first high speed rail station in the country. the bullet train will come in through an underground tunnel. high speed rail is a $45 billion project and the bullet train's rail line would go from sacramento to the bay area to southern california. so far the rail authority only has about three quarters of the money it needs to complete the project. and last week it asked the federal government for about a billion dollars to contribute to funding to the project. construction on the rail line is supposed to start in two years. the ground breaking for this station that will include high speed rail and other transit systems starts today. governor schwarzenegger, u.s. secretary of transportation and house speaker, senator boxer will all be here for the ground breaking ceremony. it's supposed to start at 10:00 this morning. coming up in our next report how the city and region plans to pay for this new transit

center. ktvu channel 2 news. wells fargo must return $200 million to some of it shall ruled how it manipulated debit card purchases to maximize overdraft fees. the suit covers bank customers who use debit cards between november of 2004 and june of 2008. wells fargo generated $1.7 billion in overdraft fees during that time. all right. millions of dollars probably being lost this morning on wall street. dow jones down almost 200 points. it has crossed the 200 point level earlier today. the nasdaq and s&p 500 also down. s&p 500 down about 2%. nasdaq even more. feds comments at the economic recovery is slowing down. also the trade deficit up.

that's contributing. a couple bright spots i want to mention profits at macy's are up for the second quarter. they've increased their outlook going forward. and gm's results are up over last quarter. we have some good news coming in. i always like to look for the positive. >> right. time now 6:51. still ahead, they're reviewing security at an east bay juvenile detention center. we're going to tell you what's happened that posed a serious threat to neighbors. and some south bay students are asking for tougher homework this school year. we're going to explain why.

been arrested. wait until you hear how they managed to find him. those stories coming up on mornings on 2. now back to you on the morning news. time now 6:55. re-evaluating security at the detention facility following the escape and eventual recapture of three teenage inmates. that facility is right near fair mount drive. all three escapees are described as dangerous criminals. they escaped yesterday afternoon by scaling two razor fences. they made their way into a residential neighborhood less than a mile away. deputies captured two of the three quickly finding them all with the help of helicopters and canine units. two of them in custody for murder. the third in custody for assault with a deadly weapon. some san jose high school students plan to lobby their school board for tougher

classes. they want the csu and uc systems to be the graduation requirements for the district. the issue discussed yesterday. they're concerned that fewer than 40% of graduates meet the requirements for four year college. students plan to ask for tougher graduation standards at the next month's school board meeting. very interesting. sal is highway 4. it's getting busier. if you come up to bay point you can tell more volume here of traffic here but no major problem. also if you're on the commute the bay bridge toll plaza a little more back up there. the metering lights have been switched on. and 880 north and southbound, southbound on the left you can see traffic looks good. 6:57. lest go to steve. sun by bay point. a lot of low clouds and fog. mist, drizzle giving way to sunshine. breezy misty conditions today. 60s and 70s for many.
