desk. one man is in jail right now in connection with a deadly home invasion robbery. we're in bay point now with details of a wild chase and a long standoff that led to his capture. good morning. good morning, dave. investigators are no longer at the scene of the 1900th block here in bay point. but the investigation into a home invasion and subsequent homicide continues. as you mentioned it all started yesterday afternoon with a high speed chase on highway 4. police say 30-year-old was behind the wheel of a yellow ford suv that you see speeding down the highway. according to police he was armed and suicidal and repeatedly threatened to turn the gun on himself. >> various times went into high speed. >> reporter: deputies followed him back to a home in bay point where they say he locked himself up in a home and that led to a standoff that lasted a

couple hours. during that time neighbors in the area were told to stay in their homes and one man said police used his home as a staging area while they tried to talk to him. >> say what can we do for you? what can we do to talk you out of this? you know we're here for you and we're here to make things better for you. we don't want this to end in a bad way. >> reporter: investigators say at some point during the standoff he shot himself in the leg. he was apprehended and taken to the hospital. and he's expected to be booked into the county jail on a charge of murder. and that murder charge is because deputies discovered a man inside the home where the standoff took place who'd been shot and killed. now investigators believe he had burglarized that home before he then led police on that high speed chase on highway 4. later on this morning we're hoping to get more information from the coroner's office about the victim of this homicide. at this point it's unclear whether they knew each other or just a random home invasion.

live in bay point, ktvu, channel 2 news. oakland police say two teenagers are hurt after a horrifying shootout between two rival gangs. it happened during a party at 23rd and enyo avenue late last night. investigators say as many as 60 shots were fired during the gun battle. the two victims are 15 and 17 years old. they were rushed to highland hospital. there's no official word on their condition. but one young victim is believed to be fighting for his life. police are asking witnesses to step forward as they search for the gunmen. police in san francisco are investigatorring the death of a man who fell off a roof overnight. that happened at about 3:00 this morning on bush street. now the victim who has yet to be identified was reportedly in his 20s. one witness tells police it was an accident. it's believed the man may have stepped backwards before falling off the roof to the ground. police are still trying to figure out how and why it happened. time now 6:04.

county clerks all over california are gearing up for what could be a same sex marriage rush. by noon today the san francisco judge presiding over proposition 8 will decide if the weddings can resume. ktvu is in san francisco right now getting reaction. good morning, jade. >> reporter: good morning. we are live at city hall this morning because depending on a judge's decision in a few short hours there could be a rush of same sex couples trying to get down to city hall to obtain a marriage license so that they can get married. we are live in san francisco this morning. last wednesday u.s. district court judge vaughan walker lifted proposition 8, the ban on same sex marriage. couples swarmed city hall hoping to obtain a marriage license, but the judge immediately placed a stay on his own decision halting any marriages asking both sides in this case for their opinion on why marriages should or should not resume. california voters passed the ban in november2008.

the stay if lifted today could allow same sex couples to get married as this case makes its way through the ninth circuit court of appeals. currently same sex marriage is legal in five states. governor arnold schwarzenegger and attorney general jerry brown urged the judge to lift the stay saying the state has already issued marriage licenses to 18,000 same sex couples without any resulting harm. both men previously supported the voters' decision. we spoke to a couple people yesterday in the castro. they seemed cautiously optimistic about what might happen in the next couple hours. >> will we be having marriages down here at city hall? >> i think so. if not today i think eventually. sooner or later we're going to win. >> when it goes to supreme court and it's passed, then it will become official. >> i'm sure it will go to the supreme court. and i'm sure the supreme court will rule back in the state favor and rule and side with

the judge whopper. okay. we are closely monitoring that ruling this morning. we'll continue to follow it here this morning. stay with us. we'll bring developments as they happen and also throughout the day. you can check our website at ktvu.com for updates. now bart has even more surplus money in the bank. bart's board of directors meets today and may decide what to do with millions of extra dollars. after originally expecting a budget deficit bart received $4.5 million from the state and ended the fiscal year with about $4 million leftover. bart may use that money to reduce fares at least temporarily or make various transit improvements. now bart is also about to accept another $2 million today

to upgrade its 24th street station. the metropolitan transportation commission approved the grant using federal dollars last month. the station in san francisco's mission district has been plagued by criminal activities in the past. and the money will pay for beautifying the area and restoration at that station. time now 6:07. a controversial plan to build a my no let on top of a mosque in santa clara is moving ahead. last night the planning commission unanimously denied an appeal. it was filed by a neighbor who opposes the plan. the 64-foot tower is set to be build atop the muslim community center on scott boulevard. some say it's not architecturally compatible with the area. supporters of the mosque say that is no different from a church steeple. city officials in san francisco are taking action to put the big treasure island development project on the fast track. this morning they'll hold a public hearing on the ambitious plan to build thousands of homes on the island in the middle of the san francisco bay.

the project will also include offices, stores and hotels along with 300 acres of parks and open space. city officials hope to begin construction some time next year. 6:08 is the time. let's check in with sal. update us on a situation in san jose. >> yeah. it started off as a crash on 101 northbound at 13th. and then there was another accident in the back up. people didn't realize traffic was slowing down. and then they got into a noninjury crash. you can see traffic is stacked up here on 101 heading north. i would completely avoid 101 at this time especially since you have such a good option in 280. avoid 101 for now. i can see it's not doing very well at all. the bay bridge westbound that traffic looks pretty good getting into san francisco. and this morning's drive on oakland i think i mistakenly said the raiders are playing here. they're actually playing away. i was joking around with someone in the newsroom and i thought they were playing here.

but we were just joking around. so that's my bad. they're playing in dallas today. all right, steve. >> glad we cleared that up. >> yeah, you probably scared a few people. thank you, sal. talking about and looking at how cool it's been the last time san jose had a 90-degree temperature was june 27th. june 27th. did not have one in july. and haven't even been close here in august. so about six weeks for you folks in san jose which you're saying it's been a cool summer, it has. it wasn't even that warm in june. but the last 90-degree temperature was back on june 27th. san francisco 52. 56 at 9:00 a.m. 59 and 60. a lot of fog and drizzle and cold out there. low clouds, sunny and breezy. 60s in san francisco. way below average. oakland only 62 yesterday. should be 73. santa rosa 76. should be 82. therm only 70 yesterday. mountain view five below and san jose 76. average this time of year on

the high side is 84. so, again, even with a little bit of a warm up we'll still be below average. one key that we might warm up today mt. tamalpais. eight degrees warmer than it was yesterday. a sign there's more fog and sooner burn off. away from the coast i don't think it's going to matter. a lot of 54s here. castro valley, pleasanton all at 54 degrees. 38 in tahoe. little chill there. sacramento's only 78 yesterday. they were looking about 84 today. 50s and 60s up and down the coast and another very cold pattern extends from crescent city all the way to low. there's a second one coming down seattle and portland way and that keeps the overcast, drizzle going. breezy. not as windy as yesterday. warmer away from the coast. 50s, 60s by the beaches. 60s and 70s by the bay. bumped up from yesterday. inland areas upper 70s to low

welcome back. some bad economic news for you this morning. applications for unemployment insurance unexpectedly went up to their highest level in almost six months. the labor department just said first time claims edged up by 2,000 last week to 484,000. ktvu in the washington d.c. bureau with more on how the economy is impacting president obama's approval rating. good morning, allison. >> reporter: good morning to you, dave. you said it. the bad economic news keeps piling up this week. this morning's unexpected jump in jobless claims comes on top of wednesday's big wall street slide and the report that home foreclosures surged in july. the worries about the economy and fears of a double dip recession are taking a toll on president obama's poll numbers. 48% of americans now say they disapprove of the job he's doing according to a wall street journal. president obama is on the defensive. >> we knew from the beginning

that reversing the damage done by the worst financial crisis and the deepest recession in generations would take some time. more time than anyone would like. >> reporter: the poll also shows that two-thirds of americans now fear the economy's going to get even worse before it gets better. reporting live from washington d.c., ktvu channel 2 news. time now 6:15. a judge plans to meet today with that chicago jury that's hearing the corruption trial of former illinois governor rob blagojevich. that's after the jury said it's deadlocked only some of the 24 counts against him after eleven days of deliberation. he's accused of trying to sell a u.s. appointment to the senate seat that was vacated when president obama took office. the judge said he needs clarification on the jury's deliberations before he can decide how to move forward. california's budget crisis will not slow down plans to build a new death row.

the governor's office announced construction is still scheduled to begin at san quentin this november. and the state will borrow almost $65 million from the state's general fund to help pay for it. state finance experts say borrowing now will save money in the long run by reducing intest payments. but critics say it's foolish to take money from the general fund when california's facing a huge budget deficit. thirteen candidates now in the running for mayor of oakland in the november election. councilwoman juan just one of the local politicians to file her paperwork before yesterday's 5:00 deadline. former state senator also signed up. now they join a field that also includes councilwoman rebecca kaplan, real estate agent lie fell young junior and educator learn dell. current mayor is not seeking a second term. you might see more cars in california's car pool lane

soon. that's because a bill that has passed both the assembly and state senate would allow vehicles to use the car pool lanes during rush hour. a program that already allows that expires at the end of this year. the new bill if the governor signs it would extend the program for six months plus allow owners to buy energy efficient vehicles to drive in the car pool lanes through 2015. >> you really want to incentivize people to purpose which is these type of cars to clean up our environment. >> the only people that should get a break are the people that are actually car pooling. i think those are the only people that should get a break. >> it's hoped the new law will not only help the environment but will also jump start car sales. owners of the new alternative fuel vehicle would pay a one time fee of $25 to $30 for the stickers. time now 6:18. let's get you to where you need to go. sal's watching highway 101 in san jose. >> yeah. it's been a problem about 45 minutes ago we had an accident. the first one northbound 101 at 13th street then we had another

crash. and what happened was people didn't realize traffic was slowing down and then a four car pile up in the back up. so just be ware if you're driving down 101 now the traffic is backed up all the way back to 280. you can see people are slowing down here just kind of a sea of bright brake lights here on 101 northbound. two accidents in that back up and everything clears up by the time you reach 880. so i would use 2 80. in fact go to 280 now. little more sensitive on our camera here getting up to 217. highway 4 westbound driving to the willow pass grade that traffic is moving along very well. 6:19. here's steve. >> thank you. and good morning. we have a lot of low clouds as you saw. also low clouds at the bay point. that tells you another cool day although fog will burn off slightly sooner for some. gray and foggy and cold. sol of you love this. some of you can't stand it.

signs that maybe late in the weekend and early next week inland areas will warm up. no real screaming message that says high pressure's coming in for any extended period of time. first eleven days of august have been chilly and yesterday was probably the coldest day. fog, drizzle and sunny. san francisco 52 right now. high of 60. ten degrees below average. 60 on the coast, 60s. upper 70s and low to mid-80s inland. one siam is mt. tamalpais is running eight degreest warmer than yesterday. warmer air aloft meaning it will burn off slightly sooner. there's just so much fog out there. a secondary part of that system that cooled us down up in the pacific northwest is reinforcing the fog. so overcast drizzle gives way to sunshine. breezy. probably not as windy as yesterday but still breezy, blustery and slightly warmer away from the coast. some upper 70s and low to mid-8 0z. for many in the 60s and 70s. these are a far cry from even being close to where we should be on the high side this time

of year. not much change through saturday and then it will be warmer inland on sunday and monday. pam and dave. thank you, steve. this morning general motors announced a second consecutive profitable quarter. the largest u.s. automaker reports a profit of $1.3 billion. gm also a big step close tore going public again. two sources say gm has secured a $5 billion line of credit and will file an initial public offering tomorrow. the stock could go on sale before thanksgiving. right now the government does own 61% of gm as part of the bail out agreement. there's another sign the economic crisis continues for thousands of families. the number of u.s. homes lost to foreclosure surged last month to nearly 93,000. that's up 9% from june and the eighth month in a row that the pace has increased. banks have stepped up foreclosure proceedings this year as a way to clear out the large backlog of bad loans. time now 6:21. a recent scaring incident on a

san jose drivers it is not a good deal for you right now along northbound 101. we've had two separate crashes here on 101 at 13th street and another crash in the back up. so i would suggest using 280 instead in case you're just waking up and turning on your tv. 101 near old open road a big crash. avoid 101 for now. 6:25. back to the desk. all right. wild horse round up is underway despite protests and lawsuits from animal lovers and environmentalists. almost 130 wild horses were captured yesterday. they were herded into corrals. several will be adopted while other will be sent to pastures in the midwest. a federal law bans their slaughter. this round up is set to go on for six weeks until the 2,000 horses are captured.

vector control officials say the first mosquito and birds to test positive for the west nile vie race in contra costa county this year have been found in oakly. a group of mosquitoes collected near empire avenue. the bird was found near west cypress road and o'hara avenue. it's apparently unusual to have this detection of a virus this late in the year. the colder temperatures may have prefned the transmission of the virus. in sacramento an agreement has just been announced to make baseball safer for young high school players all over california. the group that oversees high school baseball has agreed to new safety standards requiring metal bats to be tested. and provide protective head gear for the players. they'll be required to use the any bats in january if they're available by then. a team of bay area doctors

and nurses heads to haiti today to offer high-tech help to earthquake victims still struggling in the wake of january's devastating earthquake. they're bringing with them a robot that's called a sophisticated version of skype. the system relies on the internet and several cameras to allow doctors here to assist with surgeries in haiti. >> we can tell rate sort of like john madden does in monday night football and we can coach the surgeons on what they should be doing. >> the robot's manufacturer in partnership with sutter help health is donating the device. also an x-ray machine, ventilator and other tools worth a total of $200,000. the judge has had a week to think it over and this morning he'll announce whether same sex marriages will resume in california. we'll have a live report from the san francisco courthouse.

welcome back to the morning news. there's the opening bell on time. they're celebrating on the nasdaq. however it does not look like a very good day. as a matter of fact, we're going to head straight down as you can see on your screen after the weekly jobless numbers coming in they were disappointing the number of people filing for first time claims up last week more than analysts expected. analysts actually expected a drop in that.

the suspect's capture. >> reporter: well, pam, investigators are no longer at the scene here on the 1900 block of cool very us avenue in bay point but yesterday evening there was a pretty heavy police presence as investigators looked into a home invasion and subsequent homicide that happened on this street. that investigation continues this morning. it started yesterday afternoon with a high speed chase on highway 4. police say 30-year- old was behind the wheel of that yellow ford suv you see speeding down the highway. according to police he was armed and suicidal and he led police back and forth between bay point and concord at least three times. he apparently threatened to turn the gun on himself during that pursuit. they followed him back to a home in bay point where he finally stopped driving. >> he stayed in the vehicle hold up at various times he had a gun pointed to his head. and i should mention that during the pursuit he had a gun

pointed to his head at various times as well. >> reporter: that led to a standoff in front of the home that lasted about an hour or so. during that time neighbors in the area were told to stay in their homes for their own safety. one man said lice used his home as a staging area while they tried to talk to him. >> they were saying what can we do for you? what can we do to talk you out of this? we're here for you. and we're here to make things better for you. we don't want this to end in a bad way. >> reporter: investigators say at some point during the standoff he shot himself in the leg. he was apprehended and taken into the hospital. he is expected to be booked into the county jail on the charge of murder. that murder charge is because deputies discovered a man dead in the home where thstandoff had taken place. later this morning we are expecting to get more information from the coroner's office about the victim of this homicide. and we have checked in with

breakins around river bank avenue in the past four months. robert cassidy's house was burglarized just last week. he says the thieves stole a lot more than just material items. they also stole a small family dog named lulu. the dog suffers from a liver condition and needs medicine weekly. if she doesn't get it she could die. alameda county sheriff officials are asking anyone with information to please contact them. a fed ex driver was robbed of several packages at gunpoint at the business park. this happened yesterday morning in pleasanton. the driver told police he was making a delivery when four men with their faces covered approached them. one of them had a shotgun. those men stole ten boxes. some of them contained computers. the robbers escaped in a gold buick. the jet blue flight attendant who became an overnight celebrity is now being described as a villain. steven slater's instant rise to

stardom came after he cursed out a rider on the intercom and then grabbed a beer and zoomed off the jet on an emergency chute at jfk airport. several passengers tell the wall street journal that he deserved to be arrested. they say he had been drinking during the entire 90 minute flight and swearing at other passengers who weren't doing anything wrong. san francisco muni cracking down on fare cheaters on buses today. the new enforcement started tuesday on city trains. the program returns from a 90 daybreak which they used to retrain officers. any passenger caught without a transfer could face a fine of $75. all right. your time is now 6:38. sal still says we've got problems in san jose right? >> that's right. northbound 101 we've had a problem now for an hour. we've had a crash on the shoulder and then another crash in the back up and 101 continues to be backed up. it's very slow. it has been this way for about an hour now and it just keeps

getting worse. this is going to have a big delay on 101 coming out of 280. let's go to 237 which is still pretty good. so the rest of the drive getting into sunny vail and a lot of people need to be in sunny vale and mountain view for the jobs in the valley. 237 looks okay. and 280 and 285. 101 is not the one so to speak. westbound bay bridge toll plaza small delay at the pay gates there. 6:38 here's steve. >> all right. thank you. well, the fog is the one. it's been the big one so far a long time. it's keeping us way below average and i have temperatures to show you in san jose. temperatures that haven't been seen in a while let me rephrase that. stronger part of the low that gave us the really cool readings yesterday. you had low clouds hanging into areas until noon yesterday that usually don't see that past 8:00 or 9:00 in the morning. there's also another part of that coming down around the seattle portland area that just kind of keeps it reinforced

that being the fog. so fog, drizzle and sunny, breezy. not as windy yesterday but farther away from the coast upper 70s and low to mid-80s. 76 today in santa rosa. it's a tough call f. you don't get the fog to burn off by noon i'm done. 78 in walnut creek after yesterday's 72. i would think that was a record low maximum temperature for the date. oakland 62 was a record low maximum temperature. we'll go 66. and 72 yesterday in san jose, 76 today. now san jose along with everybody else has had a really cool summer. i'll try to walk you through this. the last time san jose had an 85-degree high was july 15th. the last time they had a 90- degree high was june 27th of this year. the last time they had a high of 95 was september 26, 2009. that's a long time. that's a long time to not see these kind of temperatures in

san jose during august, july, june. you don't even get into 95- degree range and you know that can happen fast in a normal summer. it's been a very cool summer for many and you can see y these temperatures which we haven't seen some in five or six weeks being very cool. 50s and 60s. san jose state is 60 right now. sacramento 53. their high yesterday in sacramento was 78 degrees. the low pressure in the pacific northwest until that ejects out not much changes. sunny, breezy, slightly warmer away from the coast. over by the coast 50s, 60s and around the bay 60s and 70s. looks like high pressure wants to build in away from the coast sunday and monday. thank you, steve. 6:41 is the time. you can see wall street down. an update coming. also today another bay area school district considers big budget cuts. find out why the cut backs won't effect the classroom. i'm live in oakland where

oakland overnight. we're on the scene with a look at where police are in their investigation. good morning, tara. >> reporter: good morning. that's right. police are actually looking to speak to the person who dropped two gunshot victimoff at highlands hospital last night. both wounded during a house party that turned sour. it happened in the 2200 block of enyo avenue at east 23rd street in oakland at 11:30. just to paint a picture how violent the scene got, police say more than 60 shots were fired. investigators believe five different handguns were used. two people were shot, a 15-year- old and a 17-year-old, one was shot in the arm, the other wounded in the leg and center of the back. that person is listed in critical but stable condition. now the scene was very chaotic here. apparently the teens were drinking alcohol at this party when another rival group showed up uninvited. when they were asked to leave that's when things got ugly.

gunfire erupted and people scrambled to get out of the area in their cars. pieces of bumpers, glass and lights stone all over the street in the wake of the mayhem. we are live in oakland. ktvu channel 2 news. our time is now 6:46. a bill that would crack down on sex offenders is getting closer to passage. chelsea's law would require many offenders to go to prison for life without parole. this bill goes before the senate appropriations committee for a key vote today. this is the fifth of seven hurdles it has to clear befo getting to the governor's desk. the bill is named for chelsea king, the 17-year-old san diego girl murdered by a repeat sex offender. today another bay area school district will consider drastic measures to combat a big budget deficit. but this time the cuts will come from the very top. members of the south san francisco school board will consider freezing their own pay. time now 6:47. let's check our commute again. sal, what are you seeing out

there now? >> we're looking at the bay bridge now, dave and pam, looking at all the approaches to san francisco as we get closer to the heart of the commute. and right now things are actually looking okay if you are driving into the city. there are no major problems there. as a matter of fact, on 880 northbound that traffic also continues to look pretty good here northbound 880 passing the coliseum. southbound traffic looks okay. and in san jose northbound 101 still remains kind of a parking lot. we had two earlier crashes. even though lanes are open 101's not the best call. use 280 instead. here's steve. more fog and low clouds to go around even out to the air force base fog around 300 feet. but the sea breeze cut in half compared to yesterday. there's also a little warmer air aloft which means we should see that fog burn off sooner and inland areas will come up a bit temperature-wise. you can't get much cooler for this time of year than yesterday's highs which were in

the low 70s for many. a strong system continues to plunge right down into oregon. there it goes into idaho. there's still enough there to keep us below average on the temps. san frcisco 52. we'll go for a high 60 today. yesterday's high by the way was 59 degrees. low clouds, fog and drizzle. temperatures across the board as you already know by now are way below average. for oakland 66 yesterday only 62 downtown oakland a record low maximum temperature for the date. 73 is average. santa rosa forecasted high 76. 82 is average. mountain view only 72. and san jose 76 should be 84 this ti of year. haven't seen that in a while. mt. tamalpais along with many other higher elevations are running warmer today. 62 right now which is 7 degrees warmer than sterday. mill valley tub ron 53. san carlos and also prez anton 54. still a delta breeze but nothing compared to yesterday. still out of the west-

southwest. and until low pressure ejects out completely to the north of us our pattern doesn't change much. just daily changes and some of those warmer temps today away from the coast. so overcast and drizzl some upper 70s, low to mid-80s inland. but 50s, 60s and 70s coast and bay side. friday, saturday look to be similar than sooner burn off on the fog and warmer weather through the interior sunday and monday. thank you, steve. the latest report from the labor department has mixed news. 484,000 people filed for first time unemployment insurance last week. that is up 2,000 from the previous week. now economists predicted that that number of new claims for the week would actually drop. the number of continuing claims did drop down about 118,000 from the week before. all right. let's check in on wall street. dow jones off about 60 points as we look live. part of the reason is the new jobless claims. also a drop overnight in asia.

some concerns in china in particular. and this morning cisco systems stock bay area company down almost 10% which as steve and i were talking about it's kind of sad because they missed revenue numbers. that's why the stock's down but they still reported almost $11 billion in sales for the fourth quarter. so not like cisco systems is struggling but dis appointment on wall street taking tech stocks down. soccer's world cup helped boost second quarter sales. a $1 biion profit. now continuing growth for the rest of the year. time now 6:51. coming up a bay area university is named a top school by forbes magazine. we'll bring you all the details. new queen of roses in the nation and it's in the bay area. good morning westbound 92.

a permit renewal. county officials will vote on granting that permit early next month. crews in san francisco putting a finishing touches on a scaled down outside lands music and arts festival set for this weekend in golden gate park. the two day festival benefits the city's recreation and parks department. it kicks off saturday. it's a day shorter this year than in past years. organizers say it will still offer a lot of great music and food. this year's line up includ the kings of leon, phoenix and further. today's san jose's municipal rose garden gets the award of best rose garden. known for rigorous testing of new varieties of roses. all selections put the run down garden on probation in 2005 then noted transformation by lifting the probation status in
