get very crowded very soon. mornings on 2 begins now. good morning to you. welcome to mornings on 2. i'm dave clark. >> it's thursday, august 12. county clerks across the state is getting ready for what could be a marriage rush. >> reporter: we are live at city hall where one couple is waiting here to get married already. i was told they will come back depending on a judge's decision later this morning. we are live in san fransisco. you can see here teresa roe and her partner krista corbin.

they went ahead with a little ceremony even though they couldn't legally be married that day. walker lifted the ban on same- sex marriage. but he immediately placed a stay on his own decision halting any marriages asking both sides in this case for their opinion on why marriages should or should not resume. his decision is expected before noon today. california voters passed the ban in 2008 but an appeal on whether the ban was constitutional brought the case before judge walker. that stay if lifted today could allow same-sex marriage couples to get married. the decision could change things in things nor couples. >> this is very excited for me because we can come out and really plan the big ceremony.

in berkeley. you can see the location on the map. we will bring you more details as they become available. time now 7:03. police are investigating the death of a man who fell off a roof of a four-story apartment building. this happened near fillmore. one witness told police it was an accident. reportedly the man may have stepped backwards before falling to the ground. that police investigation continues. police are also investigating a home invasion in pay point. a man's body was removed from a home overnight. ktvu's ali rasmus is joining us with more. >> reporter: investigators are no longer here now but there was a large police presence out here yesterday evening as they looked into a home invasion that happened on this street.

that investigation continues this morning. it all started yesterday afternoon with a high-speed chase near bay point. police say 30-year-old prubencio rubio was armed and threatening to turn the gun on himself. they followed rubio to a home where he finally stopped driving. >> he stayed in the vehicle holed up. at various times he had a gun pointed to his head. during the pursuit he had a gun pointed to his head at various times as well. >> reporter: and that led to a standoff that lasted about an hour or so. neighbors in the area were told to stay in their homes. some of them are now questioning the safety of this area. >> is it safe? i don't know. it doesn't seem too safe with

people getting shot like this. i wouldn't recommend the neighborhood after something like this, no. >> reporter: investigators say at some point during the standoff, rubio shot himself in the leg. he was taken to the hospital. he's expected to be booked into the county jail on a charge of murder. because police discovered a man inside this home that was shot and killed. investigators believe he burglarized the home before he led police on the chase. we are hoping to talk to someone from the coroners office to find out about the victim of the homicide. and whether the victim knew rubio or whether this was a random crime. ktvu channel 2 news. 7:06. san fransisco's renewed fare

enforcement program. police will look for fare cheaters on buses. patrols on trains started on tuesday. those caught without a transfer could face a fine of $75. the enforcement program returned from a 90-daybreak which muni used to train their officers. you might see more cars in california's car pool lane soon. that's because a bill would allow people in alternative fuel vehicles like hybrids to use the car pool lanes during rush hour. a program that already allows it expires at the end of this year. the new bill if the governor signs it would extend the program for six months and provide new energy efficient vehicle owners to drive there through 2015. >> the only people that should get a break are the people who are car pooling. >> i get the reasoning behind

it because the environment. but for me, no because i don't have one of those. >> they hope the new law will help the viability and help jump sales in the sluggish industry. you'll pay a one-time fee of $20-$30 for the stickers. transportation officials plan to have fixed entry and exit points designated merging areas, and toll lanes will have car pool hours in effect most or all of the day. so non-car poolers cannot use those in non-commute hours. it will be several years before these changes are put into effect. time now 7:08. all morning, sal's been warning us about san jose and 101. >> we're seeing some improvement. but i think people don't know why.

the governor has talk about reform adds part of any plan. california's budget crisis will not slow down plans to build a new death row. and the state will borrow nearly $65 million from the state's general fund to help cover the cost. state finance experts sabor rowing now will save money in the long run by. on top of a mosque is moving ahead despite opposition from at least one neighbor. >> we don't think that the tower even is architecturally compatible with the building. >> last night the planning commission unanimously denied

6:00 hour. they are gone now but traffic is not quite recovered. now to steve. >> thank you. another big fog bank has moved locally inland. temperatures cool again. low to mid-50s. the fog is more down on the deck and there's some slightly warmer air aloft which should translate to a sooner burnoff and warmer temperatures away from the coach. so cut in half and vacaville where it says calm, they had a southwest at 10. there's plenty of fog out there, drizzle, then sunny. warmer inland. but the fog on the coast will keep temperatures in the 50s and 60s. 52 in san fransisco to 60 in san jose. looks like maybe we'll get a few holes in the fog here and burn it off sooner than yesterday. it persisted to noon.

everything's controlled by a strong low pressure in the pacific northwest. until that ejects out, our weather can only have subtle changes. one of those will be today with some little warmer afternoon highs away from the coast. 50s, 60s and 70s close to the bay. not much change friday and saturday. slightly cooler saturday but then a rebound on sunday and monday. it's 7:25. in hours, a judge will announce whether same-sex marriages will resume in california. we'll have reaction from couples gathered outside the courthouse in san fransisco coming up. live in oakland where a house party turned violent. two teenagers in the hospital. we'll tell you the latest in the investigation.

it is 7:29. many couples are anxiously awaited a san fransisco judge's decision. later this morning the judge presiding over the prop 8 trial will decide if same-sex marriages can resume. jade hernandez is in the city now with some reaction. good morning. >> reporter: good morning. we're live at city hall where last week despite a federal judge's decision to lift the ban on same-sex marriages, no marriage licenses were issued.

but today could be different. the reason: when u.s. judge vonn walker lifted the ban, he put a stay on his own decision. instead he asked both sides in this case for their opinion on why marriages should or should not resume during the appeals process. his decision is expected before noon today. governor arnold schwarzenegger and jerry brown have already shifted their positions and earn ever urged the judge to lift the stay immediately. both had supported the americans who voted for the ban. before the ban was put in place, 18,000 licenses were already issued. one couple who missed their chance before came down stead. >> we keep fighting and marching and push forward. we continue to love each other

updates. two teenagers are in the hospital after a shootout in oakland. this happened at 23rd and ino avenue. >> reporter: good morning. just to paint a picture of how violent things got here, police say more than 60 shots were fired and pieces of car like this one were found littered all over the street as people jumped into their cars slamming into each other as they tried to escape. a 15-year-old and a 17-year-old were wounded in the melee. police say there was a house party involving teenagers last night at 11:30. that's on the 2200 block of ino avenue. another group of kids arrived uninvited and was told to leave and that's when the mayhem began. gunfire erupted, people were scrambling to get out. five different handguns were used in the battle 37

the two victims were dropped off at highland hospital and police do want to talk to the person who dropped them off. one victim was shot in the arm, the other in the center of his back and leg. at last check that victim was in critical but stable condition. if you have any information regarding this incident, you're asked to contact the oakland police department. we just spoke to a neighbor who didn't want to appear on camera, he thought it was fireworks because there was so many shots fired last night. he says that this area is notoriously crime ridden but he hadn't noticed any problems at the house in question in the past few months or even years. ktvu channel 2 news. >> thank you. it is 7:33. this morning there's new information about the killing that led to a high-speed chase across contra costa county. overnight, the coroner removed the victim's body from a home in bay point. investigators say the man was killed during a home invasion

and burglary attempt. they've not yet released the victim's name but investigators have identified the suspected killer as 30-year-old prubencio rubio he was spotted racing up and down the highway after the killing. kelly rasmus will have a live update during the next half hour. the promoter of the teenage dance that ended with the killing of a young person has apologized. some of the teenagers may be to blame. a stray bullet killed her. blamed the killing on a few bad apples who attended the dance. time now 7:34. the police undercover teams have made arrests. the undercover teams were created after several assaults

and street robberies were reported this summer. the mission station averaged a robbery a day since june. alameda county, warning residents about a series of burglaries there. there've been at least nine break ins around river break avenue in four months. robert cassidy's house was burglarized last week. they stole more than material items, they also stole a small family dog named lula. >> those purse dogs are trendy. they can be perceived as expensive. >> cassidy says his dog needs medicine every week and if she doesn't get it, she could possibly die. alameda county officials are asking anyone who has information about these to contact them. a judge sticking with ruling that management and

union members use an outside party to settle their contract dispute. despite a request for the judge to reconsider his earlier ruling. also the judge ruled there is nothing to prove that union leaders directed bus drivers to call in sick in recent weeks. bart has come up with another expected wind fall. they received an unexpected $4.5 million from the state. now instead of the expected deficit, it ended with a $4 million surplus. bart may use the extra money to reduce fares temporarily or make various improvements. bart is also about to accept another $2 million today to upgrade its 24th street station. the metropolitan transportation commission approved last month. the money will pay for restoration at the station. time now 7:36.

although there are signs it will be warmer today. but temperatures yesterday -- seriously how cool can we get in august? yesterday was one of those that's how cool we can get. low on the temperatures and i don't see much changing here except inland areas will warm up today. the stronger piece of that has moved off to the east. so by default, we'll get a warm up. should be closer to 70 degrees in san fransisco and that's not happening. we did have temperatures so cool yesterday. santa rosa was only 70. walnut creek 72. i would think that's a record low temperature. that was a record cool-high temperature for the day. we'll go 66 on the high today. but speaking of san jose, it's

been a long time since they've had some warm weather. the last time they had an 85- degree high was july 15. the last time san jose had an official high of 90 degrees was june 27. the last time they had a high of 95 was last september 26th, 2009. almost a year ago. that's hard to believe. it's ban cool summer. and temperatures in san jose can get very warm but they have not been there this summer. right now they are the warmest so to speak. 53 sacramento right now. only upper 70s there yesterday. that system to the north maybe might get out of here by the weekend. until then, it's just gradual warming. upper 70s, low to mid-80s. 50s and 60s by the beeches.

taking live looks on wall street. their slide is going for a third day today. there was a slight gain in the number of unemployment benefits for the first time and a drop had been expected. that was bad news.

gm posting its largest profits since 2004. right now the dow is down 40 at 10,338. nasdaq down 20. also new this morning mortgage rates sank to the lowest level in decades this week. part of the move to buy up government debt to lift the economic recovery. freddie mac says he average rate this week was 4.44% down from 4.4% last week. that is the lowest since freddie mac began tracking rates in 1971. $472 million is on its way to california to help out-of- work homeowners. the financing agency says the money will be used to help unemployed homeowners pay their mortgages as they look for work. that's on top of $64 million already in the program. qualified homeowners usually receive $1500 a month for six

months. the new funding comes from the treasury department which has allocated $2 billion nationally for unemployed homeowners. in atlanta, there was a possible indicator of just how desperate people are in this economy. this is where thousands of people lined up for a chance to get public housing assistance. they had gathered for a piece of paper, actually. an application for federally subsidized housing. it was only to get on a waiting list as no housing is currently available. 13,000 were handed out with officials saying next time they'll do the applications online. time now 7:45. a bill that will crack down on sex offenders is expected the pass later today. it's called chelsea's law. this bill goes before the state senate appropriations committee for a vote today. it's the fifth of seven hurdles it has to clear before it gets to the governor.

it was named for chelsea king, the girl murdered by a repeat sex offender. federal authorities are taking steps to extradite is catholic priest from the bay area to ireland. patrick mccabe friends say they were shocked for learning he was accused of sexually abused boys in ireland. irish authorities say he committed indecent assault on six boys ranging from age 11 to 14. a south bay woman is suing the sports organization usa swimming claiming the group knew but did nothing about complaints about the swimming coach accused of molesting her years ago. janice thompson accused her

former coach of sexual abusing her. thompson is now 28 years old. >> usa swimming does everything to protect its image and ignore the swimmers that become victims. >> they are involved in similar charges with another boy. while an israeli general are admitting mistakes were made during a bloody controversy bound for gaza. when israeli troops staged a raid on those ships. in an investigation to whether the raid and israel's hamas conformed to law, the general testified that israel's mistake was not knowing enough about

the resistance and having an adequate man power to secure that ship quickly without the violence. a team of bay area doctors and nurses head to haiti today to offer help to victims still struggling in the wake of the earthquake. they're bringing with them a telepresence robot. a sophisticated version of skype. it relies on the internet and cameras to allow doctors to assist with surgeries in haiti. >> we can telestrait just like john madden does in football and can coach the surgeons on what they should be doing. >> the robot's manufacturer and partnership is donating the device. the medical team will also deliver a ventilator and other tools worth a total of $200,000. baseball diamonds will become a lot safer for baseball players across california.

a project to widen highway 4 in antioch. time now 7:54. we've got a problem. sal, what just happened in fairfield? >> there's a fire in fairfield martinez area. we're trying to narrow down where it was. but the fire and the smoke has delayed the capital corridor trains coming to and from sacramento in the bay area in between those two points. the trains are delayed. they either had to stop or slow way down as they traveled through the fire area. now if you take a capital corridor train, it'll effect your commute. this is highway 4 westbound. traffic is moving along okay. the morning commute is going to be a little bit slow on highway 24. a bit foggy. near 680 here. finally for this report, the bay bridge toll plaza in light. here's steve.

>> a little change here. we had some sun out there at bay point and talked to a colleague of mine. a little bit of sun trying to break out attacker deal cordelia too. west-southwest 14. that is cut in half. that should translate into a sooner burnoff. slightly warmer weather inland. but still below average. big reason is that strong low in the pacific northwest which has moved off into idaho and montana. the second part is coming down the coast in seattle and portland's area. that keeps the fog going. really cool temperatures aloft and still have low clouds and fog but that's what we have and local drizzle. then sunny and breezy. 50s-60s around the beaches. another key besides the wind

being cut in half is a warmer air loft. low to mid-60s on the current temps. really cool out there yesterday. they'll be in the mid-80s today. still far below average. until that low and low pressure in the north moves out, we can't really do too much in the thought of warmer weather. 50s-60s by the coast. upper 70s and low to mid-80s inland. but areas like vacaville will at least get back in the 80s. not much change saturday. but then warmer sunday and monday. it is 7:57. the judge has had over a week to think it over. this morning he will announce if same-sex marriages will resume in california. also a killing in the east bay led to a high speed chase across contra costa county. we found out new information about the homicide victims.

area. we're following the story now and will let you know more coming up. county clerks all over the state of california are gearing up for what could be a same-sex marriage rush. this morning a judge will announce whether he'll lift a stay on same-sex marriages and allow the weddings to resume. his ruling could come an hour from now. jade hernandez has the latest. >> reporter: we're live at city hall where despite the judge's decision to lift the ban on same-sex marriages, no marriage licenses were issued. but that could am change today. the reason when vonn walker lifted voter approved prop 8, he immediately put a stay on his own decision. instead he asked beth sides for opinions on why marriages should resume or not resume. his decision is expected before

noon today. governor arnold schwarzenegger and jerry brown have shifted their thoughts and asked for him to lift the ban immediately. before the ban was put into place, 18,000 marriage licenses were already issued. one couple who missed their window came down to city hall this morning hoping the judge lifts the stay today and allows them to get married. >> we keep fighting, we keep marching, we keep pushing forward. we continue to love each other. but we continue to want the rights that come with marriage and the privilege and the responsibility that come with marriage. we won't give up. the next time it comes around, we'll be standing where we're standing today. >> reporter: a spokesman for the defense alliance fund who argued for the ban of gay marriage said if the stay is lifted, they will appeal the ruling. a decision is expected sometime

a 5 billion dollars line of credit. they'll file an additional public offering tomorrow. the stock could go on sale before thanksgiving. right nothing the government owns 61% of general motors as part of the bailout agreement. police are investigating a violent robbery in berkeley. a man was stabbed on curtis street just after 6:30 this morning. they have not released the condition of the victim or a possible motive. oakland police say two teenagers are hurt after a horrifying shootout between two rival gangs. it happened during a party at 23rd and ino avenue last night. as many as 60 shots were fired during the gun battle. the two victims are 15 and 17 years old. they were rushed to highland hospital. there's no official word on their condition but one young victim is expected to be fighting for his life. police are asking witnesses to step forward as they search for the gunmen. we are learning more about

the man killed during a violent robbery in bay point. ali rasmus joins us with new information. >> reporter: good morning. this all started around 3:yesterday afternoon. that's when contra cost fa sheriff deputies received a call from bay point. that person was calling to report a burglary. now, a short time later, a california highway patrol deputy spotted the suspect of that burglary -- spotted the vehicle of that burglary suspect. he was driving a yellow ford suv. the suspect was identified as 30-year-old prubencio rubio. according to police, rubio was threatening to turn his gun on himself. they followed him back to the home in bay point where he finally stopped driving. that led to a standoff that lasted about an hour or so. meanwhile, inside the home,

investigators discovered that one of the people who had lived in that home had been killed. neighbors this morning couldn't tell us the name of the people who lived there or the name of the victim of that homicide. but they say the home had been vacant for a while until two people moved in just four months ago. >> a couple guys moved in and they had people visiting all the time. but nay seemed to be working on it and getting it -- like i said, they were fixing the front yard and things like that. didn't seem to be any -- there's been no trouble from them. >> this is a quiet neighborhood. i don't know. >> reporter: during that tense standoff with rubio, the suspect neighbors in the area were told to stay in their homes. at some point during the standoff, rubio shot himself in the leg. he was taken to the hospital. he is expected to be booked into the county jail on a count of murder.

they have not named the man found dead in the home. and we have not heard back from the sheriff's office to find out whether the suspect and victim knew each other or whether this was a random crime. ktvu channel 2 news. >> thank you. our time is now 8:06. in other news, san fransisco police are investigating the overnight death of a man who fell off a roof of a four-story apartment building. this happened about 3:00 a.m. on bush street near fillmore. the man was reportedly in his 20s. a witness told police it was an accident. reportedly the man may have stepped backwards off the ledge before falling to the ground. a police investigation continues. you might see more cars in california's car pool lane soon. that's because a bill that has passed the assembly and state senate would allow people an alternative fuel vehicles to use the car pool lanes during rush hour. a program that already allows

it runs out at the end of this year. the new bill if the governor signs it would extend the program for six months plus allow the owners who buy new energy-efficient vehicles to drive in the car pool lanes through 2015. >> the only people who should get a break are the people who are actually car pooling. i think those are the only people that should get a break. >> i get the reasoning behind it because of the environment. but i mean were for me because i don't have one of those. >> let's hope this new law not only helps the environment but will jump start sales in a sluggish auto industry. they will pay a one time fee of $25-$30 to get car pool stickers. other changes to car pool lanes could be changing. transportation officials plan to have fixed entry and exit points, designated merging areas, and toll lanes will have car pool hours in effect most

back economic news this morning. new applications for insurance went up to their highest level in almost six months. firsttime claims edged up by 2000 last week. allison burns is in our washington, d.c. newsroom with a look at how the down economy is effecting president obama's approval rating. it can't be helping. >> reporter: that's right. good morning to you. and that economic news seems to keep piling on this week. today's unexpected jump in job less claims comes on top of wednesday's big slide on wall street and the report that home foreclosure surged in july. the worries about the economy and fears of a double dip recession are taking a toll on president obama's poll numbers. 48% of americans now say they disapprove of the job he's doing. according to a wall street journal poll. president obama is on the defensive. >> we knew from the beginning that we versing the damage done

by the worse financial crisis and the deepest recession in generations would take some time. more time than anyone would like. >> now, the poll also shows that 2/3 of americans now fear the economy is still going to get much worse before it gets better. reporting live from washington, d.c., allison burns, ktvu channel 2 news. >> thank you. time now is 8:16. this is day 43 and california still has no state budget. lawmakers in sacramento are still at odds about how to solve this crisis. the democratic plan to reduce the deficit would hit some middle income residents with tax hikes but it would benefit shoppers, retailers, and car dealers by slashing the state's sale tax in half. tax experts told a senate committee that this is a good idea. however the governor has demanded tax reform with budget and pension reform as part of any plan.

california's budget crisis will not slow down plans to build a new death row. the governor's office announced construction is scheduled to start at san quentin this november. the state will barrow almost $65 million to help pay for it. experts say borrowing now will save money in the long run by reducing the interest payments. but critics say it's foolish to take from the general fund when california is facing a huge deficit. a controversial plan to build on top of a mosque in santa clara is moving forward despite opposition of at least one neighbor. >> we don't think that the tower is architecturally compatible with the existing building much less with the buildings in the surrounding area. >> last night the commission denied an appeal filed by tom scott. the 64-foot tower to be built

atop the muslim community center on scott boulevard. supporters say it would have an important role in the community. >> it has additional importance because it will reflect the religious diversity of this area and the value we all place on religious freedom and tolerance. >> more appeals could still be filed to try to stop the plans for it, but it is not certain if there will be more appeals. city officials in san fransisco are taking action to put the big treasure island project on the fast. in the milk of the san fransisco bay. the project will also include offices, stores and hotels with parks and open space. hope to start construction next year. san fransisco's convention and visitors bureau is offering

today another bay area school district will consider drastic measures to combat a budget deficit. but this time the cuts will come from the top. members of the south san fransisco school board will consider freezing their own pay. they also to constrict the expenses. and the pgne ceo this afternoon. they want to stop smart meters from being installed. the latest government to demand that meter installation be halted. evidence shows health impacts from various radiation. last week fairfax passed a similar ordinance. several companies that make the bounce houses are being sued by the state attorney general.

welcome back. time now is 8:29. we have developing news from belmont. a woman has been held against her will for more than six hours. police say the woman was dropped off at her home just a couple of hours ago by the man who allegedly held her against her will. police are questioning the

woman now to get more details. reportedly she claims she met the man at a bar in san fransisco last night and left with him willingly to an unknown location. that's where she said she was held against her will. meantime, two teenagers are recovering from gun shot wounds following a wild shootout during an overnight party. tara is live with the conditions of those victims. good morning. >> reporter: good morning, dave. we spoke to our sources within the police department this morning and they tell us that one of the teenagers who was shot in front of this house last night has stabilized but is still in critical condition. now, that person was taken to highland hospital last night. shot in the back as they were trying to escape under a hail of bullets. police say more than 60 shots were fired after a house party involving teens turned sour at about 11:30 last night. party goers were drinking alcohol at the time on the 2200

block of ino avenue at east 23rd street. then another group of teens came uninvited and were asked to leave. that's when the melee started. investigators say five different handguns were used in the clash. the two victims that were shot were dropped off by someone at a nearby hospital and police want to speak to that person. one victim in the arm, the other in the leg and back as we mentioned. if you have any information regarding this incident, you are urged to contact the oakland police department. ktvu channel 2 news. >> thank you. it is 8:31. many people are anxiously awaiting a san fransisco judge's decision on whether same-sex couples can get married. we could learn his decision as early as 9:00. jade hernandez is in the city now with some reaction. >> reporter: good morning. that's just 30 minutes away. right behind me in front of

city hall, a small crowd is gathering. i spoke to one couple who's waiting here this morning to get married. they came here last week, they came back today. i was told they'll come back again depending on the judge's decision today. >> nobody asked are you domestically partnered. nobody asks do you have a girlfriend. it's are you married? if you go into a public building, you have to fill out paper work, to a hospital, are you married? that's the word that's asked. that's the word that people recognize and means something. >> reporter: teresa roe and her partner came last wednesday, went ahead with a small ceremony despite the fact they couldn't legally get married. they came to san fransisco when vonn walker lifted proposition 8, the ban on same-sex marriage. but he immediately placed a stay on his own decision halting any marriages asking

for opinions from both sides on why marriages should or should not resume. his decision is expected before noon today. california voters passed the ban in november 2008 but an appeal brought the case before u.s. district court judge walker. the stay if lifted today could allow same-sex couples to get married as this makes it way through the court of appeals. a small group already gathered waiting for the decision. >> to all united states citizens and the fact gay couples can't get married is a violation of that. although some say a marriage between a man and a woman -- it's not, it's between two loving couples. >> reporter: a spokesperson for against the lift say they will appeal if it is lifted.

they said some of the teens in that dance may had been responsible for the killing. the promoter of that party blamed the killing on quote, a few bad apples that attended the dance. to implement its renewed fair enforcement program. inspectors today will start looking fare cheaters on buses. those were caught without a transfer could face a fine of $75. the enforcement program returns from a 60 daybreak. muni used that time to retrain officers following complaints from immigrant rights advocates. bart has come up with another unexpected win fall. first they received an unexpected 4 hadn't $5 million from the state. and then they ended the year

with a $4 million surplus. they may use that money to reduce fares temporarily or make improvements. bart is also about to accept another $2 million today to upgrade its 24th street station. the commissionpproved the grant last month using federal dollars. the money will pay for beautification and restoration at the station. time now 8:35. several bay area road projects could come to a halt if the state doesn't approve a budget soon. more than $2 billion has been allocated to the projects buzz spending the state funding. the road work ranges from repaving to building new interchanges. here the work that could be delayed includes a $16 million project to upgrade interstate 80 in solano county. another project to widen highway 4 in antioch.

soon as it happens. also this morning, there's new information about the killing that led to this high- speed chase across contra costa county. the coroner removed the victim's body in bay point. investigators say he was killed during a home invasion and burglary attempt. and general motors chief executive officer ed whittaker said he is stepping down september 1. whittaker was named the chairman of gm last year when gm emerged from bankruptcy. 8:45. mortgage rates have fallen to their lowest level in decades. freddie mac says the average rate for 30 year fixed loans this week was 4.44%. that's down from 4.49% last week. that is the lowest since freddie mac began tracking them in 1971. about to get help in the

form of $472 million from the treasury department. the state housing finance agency says the money will be used to help unemployed homeowners pay their mortgages while they look for work. qualified homeowners usually receive $1500 a month for six movants. the treasury -- thousands of people lined up for a chance to get public housing assistance. they had gathered to get an application for federally subsidized housing. the line was only to get on a waiting list, in fact. there's no housing currently available. 13,000 applications for handed out with officials saying next time they'll do the applications online. a bill that would crack down on sex offenders is expected to move closer to passage later today. it's called chelsea's law. it would require offenders to

go to prison for life without parole. it's the fifth of seven hard-- hurdles it has to get through before going to the governor's desk. federal authorities are taking steps to extradite a former catholic priest to ireland. neighbors of patrick mccabe were shocked when they were told he's wanted for sexually abusing boys in ireland. irish authorities say mccabe committed indecent assault on six boys between the age of 11 and 14. an israeli general is admitting mistakes were made during a bloody confrontation
