beginning our coverage. he is live in san francisco tonight. >> reporter: same-sex couples say they are gearing up for a wave of weddings next wednesday night. the excitement at city hall quickly turned to disappoint on word that three dozen same-sex couples would not be married today. >> the good news is the stay is lifted, the bad news is they said it'll be lifted next wednesday. >> reporter: the state's proposition eight same-sex marriage ban is unconstitutional said judge walker but put a stay on enforcing that ruling. today he indicated, marriages should be allowed to proceed starting next wednesday. >> something you have to deal with every time it happens, but that doesn't mean you give up. >> i think it's going to give couples an opportunity to plan. >> reporter: the delay gives prop eight supporters to appeal

to the ninth circuit court. >> he will facilitate a full hearing of the case without any kind of -- >> >> what i'm worried about is that it'll be delayed until the cases come to a final resolution if the stay is appealed to a main circuit. that there might not be any window of time for us to get legally married. >> reporter: city officials say they are now preparing to marry hundred of same-sex couples. >> we had some 63 volunteers ready to go in extended hours today to accommodate all those who wished to come down and get married. >> reporter: spoátars were also very outspoken today about the judge's ruling -- spoátars were also very outspoken today. >> reporter: finding gay marriage opponents in san francisco is often difficult so we came here to pleasanthill where the opposition is not as hard to come by. the first place we stopped was

christ the king catholic church. catholicism has always thought that only a man and a woman are allowed to marry. >> i don't see religious recognition of same-sex marriage. i don't see that coming. i do see honoring and respecting the civil marriage of couples. >> reporter: a similar struggle exists at hope center which is evangelical. >> the view is that two people of the same-sex having sexual relations goes against the heart of dog. >> reporter: yes, pastor west says he's seen a big change in the debate just from a few years ago. >> it was easier to take a stand. >> reporter: in downtown in pleasant hill where we met as

many people who object the proposition than support it. >> it's wonderful if a couple, same-sex couple wants to commit. >> reporter: she added that she fully supporting civil unions, she just doesn't want to see a change in the definition of marriage. i'm john sasaki, ktvu news. one north bay couple says it is willing to wait until the courts give them the right to wed. they found out they could not get married today. >> we waited this long, so we'll just wait another week. you know, at least there's some hope that something will

happen. >> the couple has been together for 43 years. two same-sex couples are named in the proposition eight lawsuit, one of them a gay couple from burbank offered encouragement for couples who had hoped to get married today. >> don't be disappointed. it's a small little hick up for today, but hang in there it's going to happen. it's absolutely going to happen. the truth is on our side. history is on our side, now the law is on our side. >> reporter: jeff zarilo and pocazoni have been together for 11 years. you can read judge walker's ruling in its entirety at ktvu.com. a san francisco appellate court today denies governor arnold schwarzenegger request to enact furlough days. preventing the governor from implementing the furloughs. thousands of state workers will

not be furloughed. the governor has vowed to appeal the decision to the state supreme court. the late budget is having a negative impact on business throughout california, including caltrans. they say the budget stalemate may force them to slow or halt more than $3 billion in projects unless a budget is passed by the end of the month. caltrans says this will impact both workers and drivers. >> every motorist in california can potentially affect as well as construction workers, the vendors that work for the construction, vendors that kind of has a snowball effect. >> reporter: several projects in the bay area may be halted if a budget isn't passed. they include widening highway 4, repaving interstate 80 and roadway improvements in san rafael. after temporarily putting

the breaks on catching fare cheats, the crack down is back again. sal castaneda has the story. >> reporter: officials say they lose about $19 million a year because of fare evaders. and that's why fare inspectors are back with ticket books in hand. fare inspectors walked through the train, it wasn't long till they found fare evaders. they've been doing enhanced enforcement looking for proof of payment. inspectors checked transfers, passes and cards. those without proof are subject to a $75 ticket. >> check of payment please. >> when you are going through every aspect of your operation and your business from top to bottom, and have had to make some painful decisions that we want too make sure that we're getting some people to pay

their fairs. reporter: who is it who's doing it you think? >> kid, kids that just don't have any money, try to beat the system. >> reporter: enforcement was temporarily stopped and inspectors were retrained because of concerns for minority groups said they felt targeted and intimidated. >> someone told us in spanish she thinks undocumented people are intimidated by large amount of uniformed officers. >> i didn't have pocket money that day, i just didn't have the change. >> nummi officials say they cite about 100 people a day. they look for those numbers to go up by 20 to 30% because of the program.

sal castaneda, 39 news. bart now has an extra $4 million in the bank and it's board of directors is considering giving riders a break. it's looking at delaying the next regularly scheduled fare increase for six months. an increase is set right now to take place in 2012. but is considering rolling back fares, the agency is now projecting fare increase. the most recent attack was tuesday morning when a woman woke up to someone's hand over her mouth. fortunately she was able to get

away. a teenage boy and young man are recovering tonight after a shooting. one person opened fire as a party was ending. evidence markers at the scene counted more than three dozen bullet casings. so far no arrests have been made. police say they do not know what led to the shooting. the rescue team that saved a woman from the frigid waters of a walnut creek water wave was honored today. sam buyai along with contra costa driver dave jesmeck received an award for their work that day. hogan and her husband were

thrown into the water after their son suffered a seizure. store employees heard a large boom as they ran for cover. there were no reports of any injury, while the store remained open right after the crash, managers tell ktvu they may have to close for repairs. details on president obama's upcoming california visit. plus. >> reporter: right now the competition surrounding the maverick's surf contest isn't between surfers, it's between groups who want to run the event, what will be changed, what will get wiped out, coming up. we had plenty of fog today but it cleared out rapidly. that looks more typical for summer. we have the forecast, it does include the weekend forecast. and the fight for full

we have breaking news to report right now from oakland. we're just getting word of a fire, a house fire that is burning. the address where this fire is burning is 165 west mcarthur. that is not far from interstate 580 and also just a couple of blocks from moss wood park. we don't know a whole lot of information about the fire at this point other than it's a two story house. it's burning at 165 west mcarthur. that is a pretty busy street in oakland, so keep in mind that there could be delays on that street or may even be closed.

you may be forced to go around. if we do get more information on this, we will bring it to you. the maverick surf contest is one of the most famous surfing competitions in the world. now two groups are competing to take control of the event and the outcome could impact fans. ktvu's robert handa is live now to explain what's going on, robert. >> reporter: heather, the maverick surf competition is always unpredictable, but right now no one is sure what group is going to organize the next contest and what changes will be made. mavericks is considered by many the premier surfing contest in the world where the top invited surfers come in 24 hours notice once waves hit a peak between november and february. but many surfers and fans say mavericks is being overshadowed by mishaps.

such as this last year where spectators were injured by incoming waves. so people are looking to get rid of many some -- and rename the event. >> it's always been the messaging, watch it from your computer, stay home, go to at&t park, watch it from at&t park. but don't come out here. >> reporter: both groups have sponsors lined up to pay for the contest. but some local officials are concerned about the over all impact from a low key event. >> we have people all yearlong because they want to come to the place where mavericks is held and go out and see it.

>> the harbor district says it will begin reviewing the applications next month. robert handa, ktvu channel 2 news. job losses continue to climb, the u.s. labor department said today initial claims from unemployment benefits rose to 484,000. that is up from 482,000 from last july. it is the highest it's been since january. analysts has predicted a decline. hiring is weak and employers may make even more cuts this month. texdot led a fall off. the dow jones was down close to 59 points at the closing bell, the nasdaq lost 18 points. betmo employees protested over a labor dispute with the

cosco bay liquid chain. employees said betmo told them it was cutting all full time hours back to part time. employees are now working with the united food and beverage union. >> our demands are simple. immediate restoration of full time jobs. immediate restoration of health insurance, a $1 wage increase to make up for those lost wages. >> reporter: the company has had to cut some employees hours but did not eliminate health or retirement benefits for those workers. it says it still employs 500 full time members. meanwhile the california nurses association today rallied outside california pacific medical center st. luke's hospital in san

francisco. they say they are protesting the cuts in the skilled nursing facility. the nurses protested the opening of a hospital without skilled nurses. while a skilled nursing facility is not planned for the new hospital, they are not cutting skilled nursing. legalizing marijuana would create a legal mess for business. proposition 19 aims to legalize marijuana throughout the state. the california chamber of commerce just released a legal analysis which indicated that prop 19 would create a dangerous workplace. the organization points out that many employers have to comply with a drug free act. >> they will not be able to comply with that requirement if prop 19 passes. that can result in the loss of millions of the dollars in federal funding. >> reporter: prop 19 supporters

dispute the chambers findings, they say employers will have the right to prohibit or punish employees for using marijuana just like alcohol. president obama is visiting the bay area tuesday. now the ticket is a $200. the visit is to fund raise for the democratic party. we're right on the edge of -- outer sunset, or the outer richmond, outer sunset it's foggy. you go to the east of 19th

avenue and you are starting to see clearing up and toward ucsf. you see clearing up around twin peaks, this is where the fog trying to come in and it did. earlier we showed you no fog as we got into the chrissy field area. the fog is pinched down. isn't it. that's how you know it's going to get warm. can i walk into this shot. i'm going to do it. i wanted to point out when the fog pinches like that down below twin peaks or suturer tower. the fog is getting pronounced, it's been pushing the fog down inland and we've been cooling. that is a visual sign that things are changing. the fact that you see the bay bridge and the fact that the fog is pinched down. the weekend, warmer still as this high pressure does it best to set up as we roll into your
