[ inaudible ] >> -- dave clark. >> good morning. i am pam cook. let's start with the weather, hopefully it is getting warmer, stephen. >> for some pamela, yes, good morning. happy friday, pam, dave. we do have some fog out there. more exa sis on fog than the low clouds. not all locations say cloudy compared to most mornings. so mid-80s, upper 80s, 90s far enough away from the coast, the beaches 60s and 70s, your weekend forecast in five minutes, now sal with an update on the traffic. >> right now most of the traffic is doing well. the bay bridge toll plaza looks nice. but we have that big traffic problem on westbound 580 in livermore past portola, you can see that the traffic map is already red here with the road censors. ktvu's allie rasmus is live on the scene of the accident and

gathered new information. let's go to you. >> reporter: , good morning, yeah, it is a big mess for commuters and cal trans crews. this is what is tying up traffic. you been talking about it all morning, sal and you can see the 18-wheeler flipped over and the wheel just kind of dangling in the air there. it looks like a big crane tow truck has pulled up and they are trying to right it. it happened this morning it flipped over carrying bark and ma another and i can tell you just from being out here you can smell the cargo the truck was carrying. there is a lot of debris in the middle of the road. you can see the bags of bark this was carrying.

chp sad the driver told them he was driving 55 miles per hour in the right hand lane shortly after 4:00 this morning when his right front tire blew out. when that happened it caused him to lose control of the vehicle. it flipped over and now it is still blocking the two left hand lanes of interstate 580 just west of portola avenue. if we take a look around we can show you the traffic jam backed up at least a couple of miles from this point. again, just west of portola avenue. if we look on the other side of the median you can see traffic on the eastbound side is moving along nicely. however, we go even further and show you the frontage roads looks like the westbound is backed up as well because all the people who now know about this accident are trying to avoid it and find another way to get to where they need to go. again, the good news, the driver was not hurt. no other cars were involved. chp says they are waiting for

cal trans cleanup crews to arrive. the good news but this debris is it is not hazardous and just smells bad. the estimated time for these lanes to re-open is three hours from now so definitely tied up for commuters out here on west interstate 580. sal, back to you. >> thank you. we are learning details about a shooting investigation. tara moriarty has the latest. >> reporter: just beyond this crime scene tape this is a home where we talked to a man just leaving for work. we spoke to him very briefly. he said that he heard gunshots last night or actually early this morning. we are trying to get more information from him but before we could he was whisked away by a police officer. we did speak to another

neighbor. she said there was an officer- involved shooting shortly after an attempted breakin. the woman says around 1:00 she noticed more than a dozen squad cars lining the street. she says officers rushed toward a house on the back side of nearby railroad tracks and that is where someone was trying to break in. half an hour later police showed up wanting to make sure everyone was all right. no word on who was shot or if but we are told it was not a police officer. they will be here throughout much of the morning. there are new investigators that have arrived on scene. there is a fence and trees. we have benoiting a lot of investigators maded back toward that direction so we can pretty much assume that is where the house is located. we will of course bring you more information as soon as it becomes available to us here this morning. >> 6:05.

we just talked to fremont police a short time ag and they say they were involved in a 10 situation overnight. they helped the police officers from san francisco in serving a search warrant on a home. for a time police told everyone to stay inside their homes. at this point it is not clear if police made an arrest or if this is connected to a high profile case. jade hernandez is out there on the scene. she will have a live updated coming up at 6:30. the stage is set for the next round in the battle over same sex marriage in california. a judge has ruled that gay and lesbian couples can marry at 5:00 p.m. next wednesday unless an appeals court steps in to stop them. legal experts are already making their prediction on what happens next in this long and complicated court battle. >> i think the safe money is on the 9th circuit continuing the stay. it will facilitate a full

hearing without any kind of sense of emergency. >> those opposed to gay marriage have already filed their appeal saying the ruling undermines the will of california voters and have harsh words for the judge who made that ruling. >> he wants to muck things up because he is a liberal judicial activist, he is not what he swore he would be, a defender and supporterth written constitution. >> there are three judges on the appeals court. a reagan pointe and two clinton pointes. it has not yet indicated when it might weigh in. >> san francisco is gearing up for what could be a rush of margies if the appeals court lifts the stay next wednesday. many same sex couples told us they will go back to city hall to once again try to get married. dozens of additional city workers were on stand by yesterday. they say they will be back next week. >> we had some 63 volunteers

information about nato troops killing civilians and covert operations against the taliban. now wiki leaks founder says he has 15,000 more documents he is betting them now and they will soon be on the site. a spokesman says that would be the height of irresponsibility but he is defiant and says he has a duty to release the information. reporting live from washington, d.c., alison burns, ktvu channel 2 news. >> president obama is set to sign a bill today providing 600 million dollars in emergency aid to help secure the u.s.-mix conborder. it pays for 1000 new border patrol agents and provides 14 million dollars in new communications equipment. the measure has attracted strong support from both republicans and democrats. it is funded in part by imposing higher fees on companies that bring foreign workers into the u.s. we may know soon whether bp's ruptured oil well is sufficiently sealed. results are expected later

today on whether last month's so-called tactic kill is holding. if it is officials say there may be no feed to plug it from below. the government estimates it has spewed 206 million gallons into the gulf. >> 6:16. the governor's office will file an appeal today so he can furlough state employees. a san francisco appeals court upheld an alameda county judge's order yesterday blocking those furloughs. the governor had ordered three unpaid furlough days each month for thousands of state employees starting today until the state budget is passed. depending upon how quickly the courts act they could face furloughs the last two fridays of this month. some angry state employees are calling for a boycott of the movie which opens today.

the governor has a commie 0 appearance in the movie. the state employees are outraged the governor would take time to appear in a hollywood movie in the middle of a budget crisis. the protests will be held at movie theaters across the state including several here in the bay area. >> the chamber of commerce has voted against legalizing marijuana saying it would hurt business. its analysis indicates the measure would laid to more workplace accidents and also warns the state could lose federal contracts because businesses would have a difficult time prohibiting marijuana use on the job. >> an employer can no longer have the ability to have a drug free workplace, based on prop 19, because we are creating a new protected class of individuals in california. >> but prop 19 supporters say the measure would allow employers to continue to enforce their current work plus

welcome back to the morning news. we want to take you live to new york. there is the opening bell. as usual it looks like probably a lower opening. we have a chinese company visiting the new york stock exchange this morning. disappointing economic news coming in. retail sales, only car sales and gas brought those numbers up. most of the retailers sales were down. consumer prices also up in july and a lot of that has to do with gas. if you drive a car you have noticed. we will look at the numbers

coming in on the lower part of your screen. >> we will smile and say good morning to you. i am dave clark. >> i am pam cook. 6:30. >> a big rig accident is causing major problems for the morning commute and the back up will last hours. allie rasmus is out on the scene right now. where are you and how bad is it? >> reporter: it looks bad out here, dave. in fact just we are on the westbound 580 west of portola avenue and right now the highway is completely closed and that is because some of the cleanup has started to take place, about five minutes ago cal trans cleanup crews, a truck pulled up with their sweeper and some of their cleanup equipment. that vehicle that you see moving is the giant tow truck that had the crane on top. that truck was able to put the 18-wheeler that had flipped over right side up so this 18 wheeler is no longer upside

down. it is right side up. you can see there is people on top loading some of the debris that that cargo truck was carrying back on to the bed of the truck. but while all of this cleanup takes place this highway is completely shut down, westbound 580 previously just the far left lanes had been shut down but now as we said as the cleanup starts to take place all the lanes are shut down. so traffic here is at a complete stand still. we are just west of important storm a avenue on 580. this accident happened at 4:00 this morning. a truck carrying 20 tons of bark and ma another flipped over and as i mentioned earlier arlier you can smell it.

the driver was able to walk away. he says he has ten years driving rigs like this and said he was in the right hand lane going five miles per hour when his front tire blew out. that caused him to lose control of the big rig. it flipped over. luckily he did not hit any other cars. [ inaudible ] >> reporter: he talked to us in spanish and told us the most important thing to him was that nonetheless was hurt, that no one was hurt, period. he says the damage, that stuff he said doesn't matter. again this is a big mess for commuters. just about while we were doing this -- while we were doing this live shot in the last 15 seconds or so they have re- opened one lane. the estimated time for cal

trans to sweep up and cleanup is at least another two and a half hours. we will bring you more updates as they come in. >> we will stay on top of that. also just moments ago police released new information about the shooting in antioch. tara moriarty has been on the scene. >> reporter: dozens of investigators have swarmed the area. we are now told there was indeed a breakin and while the burglar was actually inside the house that is when officers shot and killed him at 1:15 this morning when a neighbor called 911 reported the breakin. authorities say the burglar was inside when they stormed in with their canine unit and that is when the homicide happened. >> there was an exchange of gunfire between the suspect and the officers. the suspect was hit.

he was pronounced deceased. none of the officers were injured however the canine was shot. >> reporter: the officer whose canine was shot was taken to a vet clinic and is expected to survive. no word yet on the suspect's identity. we know he is from east contra costa county. his body is still in the house. we have seen officers arrive all morning long. we have not seen the corner yet. the crime lab is here to process evidence. they are actually located in a white truck behind a group of trees over there. members of the police department and the d.a.'s office are here. you can see there is crime tape up at the railroad tracks. it is not clear if trains will be halted in this area. we will check on that and let you know later in the show. live in antioch, tara moriarty, ktvu channel 2 news. >> this morning we know the identity of a man killed in his

own bay point home. hector sanchez was shot to death wednesday inside his home. investigators say it was part of a dispute between sanchez and the suspect, a 30-year-old man who remains behind bars at the county jail, taken into custody after a wild chase and standoff. san francisco police are asking for help this morning to identify three men they say kidnapped and sexually assaulted a woman. investigators say at 3:30 a.m. on saturday they pick her um at vanness and california and took her to a spot where they sexually assaulted her. police say the women described them as latino and said they took her to -- they told her they were from san jose. she also says they were in a black vogs wagon goff and 1 was named oscar and the other johnny. >> police are searching for a

man considered to be armed and dangerous. he robbed a video store with an usi style assault weapon. witnesses say he was dressed similar to construction workers outside. he was a husky african american man in his late 20s or early 30s wearing a construction vest, hard hat and jeans. that investigation continues. sheriff's deputies in santa barbara county say they busted one of the largest marijuana growing operations they have ever seen. authorities say a tip lead them to nine greenhouses on five acres of private property between highway 101 and the pacific ocean. take a look at this video. they found up to 20,000 plants worth an estimated $80 million. they also seized several

hundred pounds of processed marijuana. investigators say these grow houses had a sophisticated heating and ventilation system. in the city of oakland they are suspending several city services today because of budget cutbacks. the animal shelter will be closed, so will the libraries, there won't be street sweeping, however parking meters are enforced, all public works mere swreafnses will be responded to. parks will be open but the reese rooms will be closed, police, fire and emergency services are not effected. >> we are fouling breaking news in michigan this morning. authorities say six firefighters have been injured during a building collapse. a live look right now, this is detroit, michigan, gene, where there was a fire. they were putting it out when the walls gave way. there is no immediate word yet on their condition but again

good morning to you. welcome back. here is a quick look at some of the top stories we are following for you right now at 6:44. an early morning freeway accident is causing a major back up on westbound 580. this happened at 4:30 this morning past portola avenue in livermore. a big rig flipped over, dumped 20 tons of landscaping bark on to the freeway. for the moment all but one of the westbound lanes are closed. that cleanup may take another two and a half hours. a federal judge in san francisco has ruled gay and lesbian couples can begin marrying again at 5:00 p.m. next wednesday. that is unless the federal appeals court steps in to stop them. this will not be a furlough friday for california state employees. an appeals court has upheld a

lower court ruling that the governor cannot impose mandatory unpaid days off on 150,000 state employees. the governor now plans to appeal. >> we do have breaking news out of morgan hill area. police tell us they have discovered a body in a remote area. officers were called to the scene after 2:00 this morning. they say they were having difficulty because of the thick fog and heavy brush. they plan to expand their investigation when the fog clears later this morning. we have a crew on the way to that morgan hill area. we will have more information as soon as it becomes available. an investigation is underway following a raid in fremont. jade hernandez has more information. >> reporter: good morning. we spoke to many neighbors who wondered why we were out here

but one man told us he was asked to stay inside while police searched across the street. we watched as police collected evidence and brought them outside. this is in fremont. officers monitored the perimeter and police were involved at the scene. we know a search warrant was served. we don't know what it was for or what they were looking for. we are still waiting to hear how san francisco units are tieed into this investigation. we are told their involvement in this investigation is done. we checked with police but still waiting to hear back on word of what happened here last night when the search warrant was served in an apartment complex. jade hernandez, ktvu channel 2 news. >> 6:47. big traffic news, sal knows
